If it was me, I would probably go forward with the immigration process until it became an issue. At the same time I would try to very quickly figure out how I could square things with the German and US govts (if they wanted back taxes, fees or whatever) I would cross my fingers and hope it didn't become an issue. If and when it does, I would run to the nearest immigration lawyer (actually I would be doing some research on good ones, maybe even getting a free consultation in the meantime)

This is by no means an expert opinion, just trying to think how I would do things if I were in your place!

You sound like you are on the right track. To answer the G-325A question- yes, he needs to fill out all four (or have them typed in on the computer all at once) with real signatures, not photocopies. Any forms you send need to be originals with your signature, not photocopies.

I didn't put any address on my letter of intent that went in with the I-129F petition, neither did my fiance. We both wrote 'To Whom it May Concern' on the top and then wrote letters about how much we meant to each other and that we intended to marry.
I sent that in before I found this site and read its guidelines, so I just did what I thought was best. I got approved in 14 days, so it must have been alright, I wouldn't worry about yours!

Could she maybe talk to him and see if she can't get copies of both the BC and papers declaring his custody, mayeb that would make him worry less? I realize talking to him may not be an option, but if it is, give it a try!

Our photos were a little older then 30 days AND I'm pretty sure we had that same problem with the wrong size. I just took the photos he could get, brought them to CVS and used their photo machine to enlarge and print new ones that were the correct size. No one at VSC seemed to notice! Then I think he had to bring more photos to his interview in Dublin and by then he had found a place that would do it right for him. Basically, what I'm saying is I wouldn't stress the photos. As long as they don't look worn or old, I would use 'em!

I wouldn't worry about the pictures as long as the forms are updated. I think that requirement is to ensure the person still looks the same. However, if the forms were old, they would probably be able to deduce that the pictures were too!

Not to bug you about stuff you didn't ask advice for - but you mentioned that you didn't think your job would be enough to be his sponsor and that you couldn't get a co-sponsor... What are your plans with that? Just asking because it is another thing you might want to take care of before filing....

I don't know that there is a policy against old forms of that nature for USCIS, but personally my opinion would be that it is a good idea to have him do those again. It may raise questions for the person who is reviewing your case and like you said, its better to wait and do things right.

They are not going to put extensive effort into searching down your old jobs... at least I highly doubt it and know they didn't do that for us.

I would make as complete a list as possible, but only put down significant jobs. I would leave off such things as babysitting, etc.

I have always had several odd jobs in addition to whatever else I am doing. I just put my main jobs on the form and ignored the rest. Also, for several of my jobs I worked there off and on as I was in college and spending a lot of time in Ireland. I didn't bother to make the off and on part clear on the form, just listed the overall period of employment.

My (the USC) form had a large gap between December 2004-September 2005 (I was student teaching and then looking for a full time job but did not indicate this anywhere) and my husband's had several gaps and we were approved very quickly.

In the end you ave to do what you feel is right, the above is just to give you an example of what 1 couple did successfully.

Also, at this point with it already sent in, I think there's not much you could do even if you discovered a problem, so sit back, try not to worry too much and start getting your fiance ready for the next steps. If a problem arises, you'll have to deal with it then, but hopefully you will be just fine

I agree with Boiler - I am from India and for an LPR to bring his wife from there is 7 years or so (someone told me recently); so best to file for citizenship and then either do the K1 or K3. (This would only take 4 to 6 months after you are a citizen as compared to 5 + years as a LPR.) Interestingly India now allows dual citizenship without too much hassle (fee is $250 at present.) Maybe Germany will have something similar by now. Good Luck



Thanks.. for the info. I did some research on this and acutally had gone to the german consulate but they denied me to keep my german citizenship. I was upset about it because I AM german. So anyway it would take like 10 months for the dual citizenship to go thru and another 6 for the US Citizenship to go thru and then maybe another few months for my bf's papers to go thru.
So I filled out the papers for the US citizenship and I guess I will have to loose the german one.
So I am a bit stuck because I want to be with my future husband... I guess we just have to get married when I go and see him in July. :yes:

I am new to this board and I don’t even know where to beginn:

I am originally from Germany but live in the USA since 1990. I am a permanent resident allien since 1991. I had planned on getting my dual citizen ship but I was denied from the german consulate.
Now comes the tricky part: My boyfriend is mexican, lives in Mexico ( I am currently in the US) and we plan on getting married. He applied for a Tourist Visa so he can come and visit me…in the meantime I am traveling to Mexico – again – to visit him.
We are planning our future together and we decided that we want to live in the US if possible. Does anyone know if he can apply for a greencard once we are married since I am only a permanent resident? I also considered applying for my US Citizenship again to make things easier or should we maybe wait to get married until I have my Citizenship??
I am confused and I don’t really know where to go and ask… cant go to the INS and ask..hehe… I just know that I love this guy and that I want to be with him … so if anyone is in the same situation then me I appreciate suggestions

I come here often and read posts and I find all the information very helpful.
I rarely post anything because I have not gotten to the stage where I have to apply for the K1 visa.
Right now I am in the process of doing my dual citizenship german/american. Not sure how long takes since I am waiting for my paperwork at the moment from germany.. I guess that could take a bit since the worldcup is on :lol:

So, I figured once that is all done I can go and apply for a K1 Visa for my other half.
Could someone give me a rundown of the papers I need to fill out. I am reading this discussion often and read peoples timetables but I am a bit confused... because of the different names and what they mean... :huh: ... for example.. NOA1, AOS, EAD, package 1 package 2 ... I am confused I guess.
I just want to figure things out now so that when my papers are thru that I am ready to send the papers for the K1 in..
Also I noticed that some countries seem slower in the visa process then others.
Are there any people on this board who's fiance is from mexico, just curious about some of the issues they been going thru and how long it takes.

It takes from the day the I-129f is put in the mail until the day that the USCIS service center sends the approved petition off to the NVC (from where it will be forwarded on to the appropriate consulate).

Where your alien fiance lives doesn't have much to do with it, which USCIS service center processes the petition has a lot to do with it. Check the processing dates for your service center to see what the backlog time currently is, add 30 days, and you'll have a rough idea of how long it will take for the typical petition to be approved. But recognize 2 things
- the backlog can change suddenly and dramatically, and
- your petition may not be the typical petition.

Not necessarily true, each consulate has a different backlog. Morocco is usually not too backlogged. Okay, this won't make a difference as far as the I-129F vs. I-130, but I did want to point it out so no one will compare one consulate to another.


I agree with Morocco4ever. I got the impression from the OP that she was asking about the entire K1 process, misnaming it as the 129F process. Otherwise, identifying that they would be using the Moroccan consulate would be irrelevant.

It's really not all that significant how long the "129F process" takes. It could take 30 days through VSC, and then you're held up for three months waiting for an interview in Morocco. Of course the service center will contribute to the length of the entire process, but the consulate is just as signigicant.

In Morocco, K1's are generally processed much faster and with a higher success rate.

We got the K1 visa through Morocco and it took about 5 months total from the day we sent in the 129F petition until the day that my fiance arrived in the US. Of course, every situation is unique.

We had the same problem. We had lived together for over a year before we submitted the K1 application and I was getting stressed about evidence. Reading VJ tends to give you the impression that you need hundreds of pages of emails and internet chatting to provide as evidence. We had never written even one email to each other!

We relied more on photos as evidence. Lots of photos of us together in our apartment, and with friends and family. We had no problems. In fact, they didn't even want to see the phone records from the most recent 6 months when we weren't living together. They were only interested in the pictures.

I think you'll be absolutely fine, but of course Thailand could look at things differently.

If it were me, I wouldn't risk it. You never know how closely they're going to scrutinize your documents and you don't want an RFE, that'll just slow everything down.

You could make it through no questions asked, but is it worth the $70?

The process is expensive, and we paid money for a bunch of things we never ended up needing, i.e. police certificates, translations, etc.

It all comes down to how much of a risk taker you are, I believe.

husband entered 9/04 rec'd temparory employment stamp. applied for SS. got married 10/04, found a job 11/04, EAD card arrived 12/04...been working ever since. no break in employment...job was secured on temporary stamp

It's not so basic for everyone. You were very klucky that you just happened to receive your EAD card before your temporary EAD expired. This is usually NOT the case.

My husband was issued a 221(g) at his interview declaring that the case was on hold for administrative processing and that he would be contacted when the processing was complete. His name WAS sent through the FBI security checks, as I confirmed with DOS. It took about 2 weeks to clear. As far as I am aware, this is how administrative processing goes. It's standard procedure for immigrants from certain countries. The clearance seems to take 1 week to 3 months, depending on the number of hits generated in the FBI database.

If DOS told you that the name was not sent through the FBI database, then this is not the standard administrative processing. Was a 221(g) issued at the interview?

Administrative Review seems to be something else all together, and I have no idea how long you could be waiting on that.

No, I don't think that small of an age difference will be a problem.

Hi working history in Morrocco should have absolutely no bearing on him being granted or denied a visa at the Embassy interview. The Embassy is only interested in the employment history of the USC.



What you've said is theoretically true. But I would be careful about making these sorts of broad statements when the OP asked about Morocco specifically. The consulate in Casablanca is an entirely different animal, and there are factors that enter into decisions there that may not be standard practice.

As for your question...I think it depends. We had no problems getting the K1, and my husband was not working in Morocco at the time since he just moved back from Europe to complete the visa application process.

However, if you are in the situation where you happen to be significantly older than your fiance, which in my opinion has been causing difficulties at the Casablanca consulate, then perhaps a job for your fiance wouldn't be a bad idea. It would at least show that he's not completely dependent on you for support, which might alleviate concern of visa fraud, which has been common in Casablanca these days.

I think the law that you're referring to requires that the USC petitioner undergo more extensive background checks to assure that he/she doesn't have a record of domestic abuse.

You're right that the new requirement goes into effect in March, but as far as I know that will mean that petitions recieved March 1 or later will probably be subject to more lenghty processing times due to the added checks. It should not change anything about the petition procedure on the petitioner's end. No resubmission should be necessary.
