A legal permanent resident can not file a fiance petition, only a USC can do so.

You can either wait until your fiance becomes a U.S. citizen and file for a K1 fiance visa, or you can get married, and try to do it that way. I think the process is pretty lengthy for a permanent resident to bring over a spouse.

Oh dear! I didn't realize that. I just thought they wanted how we met and where (I included that we met online as well but also included the weeks we spent together). I figured they read so many that they wanted just a short and simple answer ("Just the facts, Ma'am." as my dad always likes to quote from Dragnet).

Did everyone else add about how they decided to get married and love stuff? I did put about 12 pictures in the packet and put the best one on top (the one everyone looks at and says, "wow, you two are really in love").


I didn't inlcude anything lovey-dovey in mine. Just the facts, as you said, with photos, boarding passes, passport stamps, etc. to back it all up.

Slightly off topic but - in a normal situation (not where the consulate cancels an interview or other unusal extenuating circumstances) would someone from immigration really have a need to call the foreign fiance at home? I was just wondering about why they might need to do that.


Some consulates do not issue the visa on the day of the interview, but rather call the beneficiary when the visa is ready.

ok well is there an easy way to just go through with some kind of visa status change? Do i really gotta go through the full length K1 process? This will take forever.... it takes like 5 months for everything to process! also I will be moving in September and have a million other things to worry about. Is there an easier solution here? I mean she visited U.S.A. the first time with the intent to travel (not marry) so the marriage thing was spur of the moment, we just have not got married yet. She can't come back to USA to marry me? ugh this is annoying. Surely there must be a way so that we dont have to go through the full K1 process? to be honest in Indonesia its MUCH harder to get the travel visa than it is to get a marriage visa, so I dont know why it would be a big deal for her to come here and marry me...

Another idea is what if I went to Indonesia and married her there?


Had you gotten married on her first vist, then THAT would have been spur-of-the-moment. Unfortunately now that opportunity has come and gone for you. You now have intent to marry, so her crossing the border and marrying you and then trying to adjust her status would NOT be the legal thing to do. I know it seems like a catch-22 in a way, but that's just the way it is. Sure, she can come here and marry you. But she would have to return to Indonesia and you would need to file a K3 or a CR-1/IR-1. Same thing if you were to marry her in Indonesia.

We've all wished that there was some shortcut, but if you want to do things right, you will have to apply for the appropriate fiancee or spousal visa.

To enter the U.S. with an intention to marry and immigrate while on a tourist visa is immigration fraud.

If your fiancee were to enter the U.S. on a tourist visa for a visit, and you were to get married, the burden would be on you to prove that you did not have intentions to marry when she entered, but instead decided as a "spur-of-the-moment" thing.

In your situation, the best course of action would seem to be filing for a K1 visa.

I live in the US and I am on F-1 status.
We applied for K-1. What's happening after we receive NOA2?
Am I going to receive package 3 in the US. I am italian and for Italy I am an Italian residence abroad.
I no longer have an address in Italy.

Am I going to receive package 3 in the US?
Are the consulate flexible in scheduling the interview date? or do I have to jump on a plain when they decide?

That's a little confusing. Wouldn't it be much easier to get married, apply for a spousal visa and adjust your status from F1 to spouse assuming that is possible?

The I-129F form requires an address abroad - what information did you put there?

The interview will take place in Italy when they schedule it as well as your medical. But I don't know how you are going to receive the packet 3 if you didn't provide them with an address. Maybe someone else can clarify.

A visa wouldn't even be necessary. They could file the I-485 right after marrying.

I really want to resist adding this, cause I know it will get flamed, but I feel I have to.

Men and women have a problem with jealousy. It is equal. However, there are women out there who will take advantage of the court systems to lash out at a former lover. The laws and the court systems are set up to be sensitive to women. I'm not saying they should not be that way, I'm saying there are women who use this to seriously hurt a man, and its not fair. I'm suprised there are many people out there who will not acknowledge this.

Rape is serious, and like the case meauxna talks about, prosecuters are hesitant to disregard any case. To me, this is an issue men have to deal with that tends to get swept under the carpet.

Add sexual harassment to that too.... Or really any crime where it's just one person's word against another's...

To the OP, I agree with everyone who said that since this was not a conviction it should have no bearing on your case. I was as surprised as you were at the reactions you got here. I don't know your back story, but what reason should you have to doubt your fiance? Good luck to you.

I just thought I'd mention the Duke rape case here.....Is there anyone who thinks that that wasn't a false accusation??? I do believe it happens all the time.

It's ok, it takes a while to get used to things. Just look at the post you just made. On the left hand side you see details about yourself: type of visa, local office, consulate, etc..

ETA: I did a search for others going through Thailand and Tucson, and it looks like you're the only one so far! But there are plenty from Thailand and Tucson individually.

I think personally I would keep the wedding date (depending though on how much money would be lost in changing it - also think about wedding guests that may have already bought plane tickets?). But I think your decision really depends on how big of an affair you're planning.

When we were doing the K1, my husband's interview was more than three months after the I-129F approval. As dwar49 said, it all depends on the embassy. I would not make wedding plans yet if that's why you are asking.

I've never heard of a petitioner being able to use infopass before the beneficiary has actually arrived in the U.S. I was under the impression that infopass is solely for the immigrant, and in almost all cases, I believe the immigrant has to be present at the infopass appointment. No one can speak on his/her behalf.

Please someone correct me if I am mistaken.

It is hard to describe how things change once you are finally together. Oh for sure, it's better to be together. But when you are separated, you tend to think that as a couple you are invincible - while it's true that two are always stronger than one, the regular everyday grind is hard on a marriage. When you throw in the curves of immigration, like the single example of waiting for work permits - well it's almost as if it's a system designed to try these marriages to the very edge of commitment.

I can tell you this. You may find it hard to believe, but this separation you are experiencing now is part of the very glue that will hold you together later on. When you've been married a while, and he's left dirty socks on the floor, sugar on the counters, or done some other thing to just drive you mad - try to remember what it was like to live without his presence in your life. It helps put things in perspective. It'll still your tongue - at least enough so you don't wring his neck! And over time, it will be part of your story. Part of what you will tell your friends, your children, and your grandchildren.

I wouldn't be so sure that name checks are not what's holding up your petition. I think your only recourse at this point is to contact your congressman to at least get them to find out the status of your petition.

U cannot apply for a K1 Visa if you two haven't met in the last 2 years.


Not entirely accurate. From the I-129F, you may file if:

You and your fiancé(e) intend to marry within 90 days of your fiancé(e) entering the United States, and are both free to marry, and have met in person within two years before your filing of this petition unless:

The requirement to meet your fiancé(e) in person would violate strict and long-established customs of your or your fiancé(e)'s foreign culture or social practice; or

It is established that the requirement to personally meet your fiancé(e) would result in extreme hardship to you.


However, as far as I know, it is very difficult to prove one of the above reasons for not meeting to USCIS.


Does this apply to your situation? If so, then the 2-year rule can be disregarded. If not, you have to meet the petitioner in person and comply with the rule.



Even when people think that these exceptions apply to their situation, USCIS rarely agrees.
