I did an internet search and was able to fax copies of documents to the translator who sent me back certified translations. The base rate seemed to be $25 for a non-lengthy document such as the permesso di soggiorno or birth certificate.

No, a K1 and K3 are only available to US Citizens to file not a permanent resident. She absolutely must become a citizen before she can file for her fiance. Pax is mistaken. You can check USCIS to see the same.

Being how nit picky they are I would reprint them on letter size, because I'm sure they would give you a RFE. Since you haven’t submitted the I-129F petition, this should be easy and quick to correct.



Thanks for the repsonse. "Quick" would be about 1 week becuase she says she can't get 8.5 * 11 paper. Plus about $200 to ship there and back via DHL.

There's really nothing one can see in a timeline that would indicate a petition that has a chance of being rejected.

However, Vermont usually processes more quickly than they are going with your case. Have you signed up for online case status updates using your case number on your NOA1?

The K-1 visa is only good for entry BEFORE you get married, so go ahead and move your belongings :)


You can move your belongings (used personal effects) duty free at the time of your entry into the US or after your entry. Your shipper will need a copy of your I-94, Your visa and a CBP Form 3299.

If you try to move your belongings before your entry on the K1, your goods are subject to duty.


So the only opportunity I'll have to move is when I actually activate that K1 Visa because once I activate it I can't come back to Canada....correct?

Correct. You can't return to Canada until you have either your green card, or advance parole, which can take 90 days to receive from the filing of your AOS.

I don't know if I quite understand your question. Your K1 visa will be valid for six months from the date of issue, so you can enter the U.S. *one time* within those six months. You should "move your stuff" at the same time that you move yourself to the U.S. Since you won't be getting married until after you enter the U.S., then clearly you do not have to be married before you move. In fact, if you somehow you were to get married before you moved you would invalidate your K1 visa, as you must be engaged but not married at the time of your entry into the U.S.

I would have imagined that you would have known right up front that you were required to submit evidence of being able to support your fiancee if the visa was to be issued. It appears that you didnt take timely action and let the approval expire. They are not obligated to renew it just because you failed to make timely submissions on required documents.

Your only recourse is to file again, but this time have the required documentation to submit when it is required in the process.

Actually Jenn it is relevent. The OP stated that the interview was in August.......this was when a request for co-sponsor was made. The submissions were not made until March.....that is 7 months and because of that the petition expired.


Well, I would think the expiration date as given on the 221g would override the previous one.

I suppose I could be wrong, it has been known to happen once or twice. ;)

I did read it, and I think its relevant. He claims to think that he was given a year to come up with the document, apparently the Consulate didnt think so. Does he know for sure, is it in writing???


Yes, the 221g states that you must respond to the request within a year, which they did. Usually what happens at that point is that they will issue the visa, assuming your missing document was sufficient. In this case, it seems the consulate did not deem the document to be sufficient and therefore sent the case back to USCIS. However, usually when a petition is returned to the U.S., it is done immediately after the interview. A 221g is issued to the beneficiary stating that the case is being sent back to USCIS. Since the return of the petition in the OP's case happened post-interview, they were never informed that the petition was returned.

The 4 months validity as stated on teh NOA2 has nothing to do with what happens post-interview.

There is a timeframe though to submit the requested documents .....I thought it was something like 45-90 days (anyone know the exact timeframe?) or the petition would still expire and still up to the conof as to whether it is revalidated.


She submitted the required documents in sufficient time. I have a feeling that the documents were received and the case was still denied at the consular level, for reasons that could be related to the affidavit of support. But she doesn't know the exact reason because the consulate never provided her with *another* 221g to notify that the petition was being returned to USCIS for review.
