K-1 Fiance(e) Visa Process & ProceduresI've been refused... then now what!?

Last year I've applied for an Nonimmigrant Visa, but didn't grand it for some reason. Is it going to affect me getting my immigration visa? There is a question on DS-156 form, asking if I have ever been refused for a visa, should I put yes?

And also, below it on part 38...."Have you ever been refused admission to the U.S., or been the subject of a deportation hearing or sought to obtain or assist others to obtain a visa, entry into the U.S., or any other U.S. immigration benefit by fraud or willful misrepresentation or other unlawful means? Have you attended a U.S. public elementary school on student (F) status or a public secondary school after November 30, 1996 without reimbursing the school?", if I put "yes" then I may be required to personally appear before a consular officer.

What should I do? Anyone has the same experience?


You should put a yes on DS 156. However, please see above for part 38 - it's asking if you were refused admission because of fraud or willful misrepresentation. You were NOT refused because of that, were you?

It sounds like you've got everything covered. If you can get him your original birth certificate in time for his interview tomorrow, sure, send it. I know they tell you to bring all originals of copies that you've given them, in case they ask for it.

2. Description of meeting. I admit I haven't done much searching around this, but there's isn't much guidance on the checklist regarding this. My current description is "I, Joshua Kaufman, met my fiancée, Janine-Opal Fischer, on 5 January 2004 in London, England, UK at a night club. Miss Fischer was bartending and I approached her and asked her for her phone number. We met again a few days later and began dating soon afterward." Is this an acceptable description of meeting?

3. Documentary proof of meeting. I read the descriptions on the checklist, which includes airline boarding passes, train passes, itineraries, hotel receipts and passport stamps. Out of those, I only have train passes between Zürich and Munich, but I'm not sure how much they'll add to the case - especially if I give my current address as in the United States (see 1 above). The items in #2 (photos) and #3 (proof of ongoing relationship) are easier, but I'm sort of stuck on the documentary proof of meeting. Is this a problem and what can I do about it?


I still don't know if the description in #2 is acceptable, but I think I'm clearer about the documentary proof of meeting bit. What I'm planning to do is within the supplementary letter that describes how we met (#2), I'll also say something like "I have also included copies of receipts and other documents as evidence of our ongoing relationship including: photos, grocery receipts, Munich ATM receipts, Shared bank account, Munich Lease, etc."

Please let me know if you think this will be acceptable as proof of meeting and documentary evidence that we've met. Thanks!

What makes a copy "certified"? Is it simply the institution (where the originals are held) stamping and/or printing "certified" on it?


Basically, yes. It depends on what the document is. i.e. A divorce decree is certified by the court clerk (from the court where you were divorced) with a seal, stamp and signature.

Remember in the initial submission of the I-129F, they are looking for proof that you have met in person in the past two years (passport stamps, a few pictures, receipts). Letters do not prove that you have met in person. Proof of your ongoing relationship needs to be given at the interview.

I am interested in peoples opinion on whether a Immigration Attorney is needed, or if used would speed up the process. My Fiance is in Hunan China, and that consulate seems to have very long lead times for interviews. I have been reading the support material on this site and generally understand the process, though this is all new to me.

Is it worth the ~$2500 for a Lawyer to make sure things are correct ? Do they know any tricks to speed things up ?

Looking at the Embassy lead times for K1's Vs K3;s for the DR it is hard to give advice, the one thing that I have heard was that it is easier to bring children into the US with the I-129f. That is the path that I am taking.

As someone else new to the process I can tell you that there is a ton of information on this site, and lots of "regular people" that have worked and done the same thing that we are working to do, get a loved one to be able to marry and live with us in the US. I would suggest reading the Embassy and timeline information, then pick through forums for people in similar situations - of course there is something to be said for getting started. at best the process takes a while.

In my case my Fiance speaks mandarin. She was able to e-mail me her name and address in her native language and I could copy & paste into the PDF (a regular browser supports that if you set language encoding under the "view" menu). I sense the address in the native language is most important, if I sent correspondence with the address in english it has little chance of arriving.

You could also consider an on-line translator like alta vista bablefish http://babelfish.altavista.com/ .

For me, I did actually need to send a package overseas, for a signature on the G-325a, which requires an authentic signature (I believe). This can be used as an opportunity for the other person to review and complete forms as well.

Unfortunately, this is fairly common with the USCIS. They obviously have a bunch of (poorly) trained chimps going over the applications.

I recall one person on here a few months ago who got an RFE for something he had sent in the original I-129F application. He got another copy of the item and send it back to them again. They then denied his application because they said it was missing, even though he had sent it to them twice. He wrote a really nasty (but funny) letter (that he posted online here for us all to read) and sent it to them, knowing he had nothing to lose at that point. The letter pointed out their incompetence, and asked why he had received an RFE, then a denial for something he had provided twice. They sent him back an NOA2 in reply (no explanation given).


Now THAT definitely sounds like VJ urban legend... :lol:

we have met in the past two years, which was clearly stated in my original post. we have been together for three years and have seen each other at least once every three months.

yes, we are serious about each other, thank you for those unwelcoming comments that have suggested we're not. a three year long term relationship is just that... very serious.

for those of you who do love your significant other and wish nothing but to be with them, I would have expected much more compassion from you. I want nothing but to be with my girlfriend. I love her and it breaks my heart to hear her cry on the phone every night because we can not be together. I take marriage very seriously and do not want to rush into it if I don't feel that I am 100% ready, however the US Government gives us very few choices on how we can be together (as stated above by those who suggested other visas... and commented on their difficulties and delays).

I still hope to receive a few comments regarding the questions I posted as many have offered their opinions, but few have offered answers. Thanks in advance to those who are understanding about how difficult being away from your loved one can be.

We ALL here understand your dilemna and how difficult is to be apart from a loved one.

You also say that the U.S. government gives us very few choices. So you seem to know what your options are already. I don't know what solution you expect us to propose for you.

Yes, many of us probably got married before we would have had immigration not been an issue in order to be with our loved ones. That does not mean that we used the system. We all have to make difficult choices and take risks sometimes.

Although some people DO use a K1 visa as a 90 day "get to know you and see if we actually want to do this", IMO it is actually fraudulent.

In order to get the K1 visa, both parties must submit letters of intent to marry within 90 days of entry. If you submit these letters without actually being sure of your intent, then you are abusing the system.

"Using the system" as you suggest in your topic title contributes to the backlogs that all of us who are actually serious about our intentions must suffer through.

I'm aware of the other types of visas, however the K1 seems to be faster and would work more to our benefit which is why I was asking the question to a group of K1 visa applicants...

My questions were more along the lines of what are your thoughts on us claiming we are engaged to get the visa? do you suggest waiting out the 90 days to see if things are working, or would you suggest fake the marriage right away so she can begin applying for AOS and work here? would it work? has anyone here done that? heard stories?

He should not fill any of that section out unless he is in front of a notary public. A notary public affirms that you are in fact the person whose signature is on the paper.

The easiest place to find a notary public is at your bank. Notarization is usually a free service. He needs to make sure he brings proper identification with him (driver's license or passport) so that the notary public can verify his identity.

Since your fiancee is the one marrying you and supposedly supporting you, she´s the one that will be filing the affidavit. You can get a co-sponsor if she doesn´t meet the requirement but it´s advisable that this co-sponsor is someone close to your fiancee, since they´re co-sponsoring her, and not you.


I see that you're going through France, which is not a high fraud country. I would agree with Laura that in some circumstances, a co-sponsor that is a friend/family member of the petioner would be preferable to one of the beneficiary. Sometimes a consulate might see a co-sponsor being a friend of the beneficiary as a red flag for fraud.
