I can tell you that getting an expedite with the DOS through the embassy is a lot different and easier than getting an expedite through the Department of Homeland Security and USCIS. As I said, doesn't hurt to try...but I wouldn't hold my breath.

Get documentation from your fiance's doctors, if there is a social worker of some kind at the hospital, have him or her write a letter as well. Write a cover letter explaining the situation. Once you get the NOA1, send them this documentation with a copy of the NOA1.

Expedites should be no more than 5 pages, including your cover letter.

Hi all - am much appreciating all the information you've posted here. It's a great comfort to know that we're not the only ones going through this.

I filed I-129F this past Wednesday and received confirmation of delivery (tracking on usps.com) on Thursday and am already anxiously awaiting NOA 1. Just a couple questions:

-- How does one know when one has been "touched?" Is this a mail notification? Or something you can see online somewhere? In general, how can I track the progress the application is hopefully making?

-- The USCIS reported processing times are FRIGHTENING. Right now it says that they're processing applications filed in July, 2007. Is that for real? I didn't count on this taking *quite* that long and the data on visajouney doesn't seem to look quite that bad.

Anyway, I'm mostly just looking for reassurance. Congrats to all of you who have your visas in hand. We hope to join you soon!

Thanks again for all the helpful tips you share... would be lonely to go through this all alone... not to mention MUCH harder.

Anyway, we filed I-129F in early Feb. We have NOA1 and have been touched once. My fiance moved last week and we need to update his address in Germany. Anyone know where or how to do this? The only form I found (the one linked from the USCIS Case Status main page) only seems to have options for changing the petitioner's address or an address in the States. Any thoughts?

Just a quick question. We're still waiting on NOA2, but I'm starting to think about the Affidavit of support already. Here's my question: I'm a Ph.D. student and, as such, am not "employed fulll-time" per se. I do meet the poverty level guidelines with my stipend and teaching income, but am unsure about what the letter from my "employer" should look like. Perhaps a letter from the university saying I'm a student and one from financial aid saying what kind of stipend/teaching fellowship I'm on? Does anyone else have any experience with this?

I know I asked the same question myself early on - "This is important, and it's going to take a long time...so it it important that it is right. Can I do it without a trained professional ???" Reading other posts and my experience is that if you case does not have major complications, and you are willing to invest the time, doing it yourself can be better. Who is more motivated than you ? And you do not have to worry about your file sitting on someones desk with no action for a week !

For me, using all the resource VJ (sample form's, info in postings, etc) and double checking myself, seems to do the trick (so far, so good). There are periods of extended waiting, where you really are not going to be able to get good information on status and you have to be patient. That is one of the hard parts.

Hi Kay,

Has your fiancé returned some of the forms that were included in "packet 3" to the U.S. Embassy / Consulate in Tunis? My understanding is that at this stage of the process, your fiancé should be sending them back signed DS-230 Part 1 and DS-2001 where he states that he has in his possession and is prepared to present all the documents required for the interview. It's only after accomplishing this step (mailing them back those two forms), that your fiancé will get "packet 4" which should include the appointment letter for the interview, specific instructions for scheduling the medical exam, and payment requirement for visa processing.

The reason why I am asking is that I don't see in your signature or timeline when your fiance sent the forms back to the U.S. Embassy (typically labeled "packet 3 sent")...

If you've signed up for email notification, you will receive an email, followed by the NOA1 via snail mail.

Even if you do not check your email compulsively, your NOA1 will arrive just the same. :)

CSB is the code assigned to petitions bound for Casablanca. Once your case leaves the NVC, you can no longer track it online at the USCIS site. If you want to inquire about your case at Casablanca, you can email them at nivcasablanca@state.gov. However, they're not very good about responding to emails, at least in my experience.

We're all impatient here, we all want to be reuinited with our loved ones. That's just the way it goes...

As for the topic of the post, would even the consulate be dealing with this at this point? I mean, the actual lottery doesn't start accepting applications until October 4th. Even then, it's all automated on a website. I could imagine in the spring when the winners are chosen and the NVC and consulates have to deal with these new visas that it would be a problem. I can't imagine it really having an effect right now though.

Of course, I could be totally off-base on this, just my logic.


The way I understand it, applications for 2006 are accepted beginning October 2005. Winners are notified in the summer of 2006, and immigrant visa processing for these begins at the consulates in early October of 2006.

Wow this is so weird! I never thought they would ask for the foreign birth certificate. Good luck Alex, and sorry this happened, but luckily it's a pretty easy one I hope. Also, on the USCIS website under general tips on assembling packet they show you how to type up the translator's certification page and it's easy peasy.

My husband's translated birth certificate looks very similar to his original in terms of the layout. It's entirely in English. We submitted both together and it's easy to tell which lines match up.

There's a difference between extra relationship proof (perhaps advisable in this case) and trying to explain an age gap. ('Well, you see, her mommy and daddy loved each other very much 20 years before my parents did, and when mommies and daddies love each other very much.....')


I'm not sure exactly what the extra proof/explanation might involve, but I do know that there have been those who have included extra who have been successful. Of course, we can never know if they would have been successful had they not submitted the extra material. There is a certain burden to overcome in these cases that is not expected at other consulates. You basically must try to show that the beneficiary did not go online fishing for older women to use them for a green card.

What might be advisable is to run this by some of the ME/NA gals. I can't imagine explaining the age difference outright, again, because I can't think of an explanation that would help, but ask them: it might be worth it to include more than the usual amount of 'relationship proof' in the initial petition (if it's the case the ME/NA petitions are returned or decisions are made by the interview) to ensure the consulate sees it.

Care to cite specifics? Must have been for technical reasons because I can't returning a petition for reasons outside the scope and purview of the adjudicator.


You can browse the MENA forum and find many examples. Many 221g's doubting the validity of the relationship, and no, not for technicalities. I think we've all concluded that it is not correct procedure what they are doing, but they are doing it nonetheless. See jasal's post as well about China. This is a consulate specific issue, so if you're going through England, no one would ever suggest addressing red flags in the I-129F.

I think it IS a good idea to address this issue in the original petition. Consulates operate in different ways. For instance, an older USC woman with a younger male beneficiary is a common scenario in Morocco. Many of these cases are not approved at the interview, but rather, are sent back to the U.S. because the consulate questions the validity of the relationship. There have even been instances where it would appear that the consulate has made up its mind even prior to the interview, refusing to look at any evidence.

Granted, Morocco is unique. However, if I were in the situation, I would want any possible red flags to be addressed in my original petition for the reason stated above.

If you look at the petition application, the only burden of proof required is having met in the last two years. It is straight forward and I would suggest not complicated it further at this stage.

An attachment addressing certain red flags would not be for the benefit of the adjudicator of the I-129F, but rather for the consulate when they receive the file.


Exactly, that is why you bring that documentation with you to the interview rather than muddy the water upfront. If it is in fact a problem, would you not rather defend the information face to face with the ultimate decision maker rather than defend it via snail mail with a processing clerk? As you said, each consulate is different and the servcice center adjudicator does not know what "hot buttons" Morroco has vs Rio vs Sydney. By including in the original submission you are opening yourself up for problems that may not even be a concern of the CO. Come to the interview prepared to answer any potential red flags you have thought of, don't by previous action give them a "freebie" reason for potential denial.
