Painless medical, a really funny doctor with a good sense of humor, no objections to getting the vaccination supplement, no looking at evidence of ongoing relationship, no tough questions - it's gonna be a breeze for you two! Larig told me that after their interview but I was still worried, so take it both from me AND Larig - Paris is an easy embassy, you guys have nothing to worry about!


I will start to believe.... we went through his entire packet when I was there, and I know we're in excellent shape. But you know how it is. We'll be the only couple that they ask for the certificate that says there isn't a star named after him or some other nonsense! LOL

Hi all,

Well the time has finally come (well almost!!) for My baby and I to get the visa ball rolling. My divorce will be through in the next week or so and we want to get going as soon as I have the piece of paper in my hand.

So my question is: Should we use an immigration lawyer?

Will it speed the process up or can we get everything sorted just as quickly on our own?

The money is not the issue here, we both just want to get everything done as quickly as possible.

Any feedback or experience in this matter would be gratefully received

Unless you have some legal issues that can complicate things, "No" you do not need a lawyer. You can do this yourself. The lawyer does not make the process faster! Actually, they become a middle man in the process and they can actually slow things down.


I agree - I used a lawyer and believe they significantly slowed down my process. Also, I received an RFE for something VERY simple that should not have been overlooked by a lawyer that specializes in immigration (decree of absolute divorce).

K-1 Fiance(e) Visa Process & ProceduresDoes my job need to be PERMANENT in order to apply for the Affidavit?

Im planning to file the I-129 in a couple of days, and to go back to the US next month. Once I get there I will only have a summer job for 3 months before moving to Washington where we are planning to live. I think that the request for the Affidavit form will come during my summer job in Alaska, which will be temporary. Is there a problem with this? Do they specifically require for a permanent job? Or could I ask my employer to omit that information in his letter? Do I need to file another form if I move out?

The letter should state whether the job is temporary, permanent, full time, etc. The I-134 needs to prove that you can support your fiance/spouse when they arrive, and that they will not become a public charge due to your lack of ability to provide for them. So, if you have a substantial bank account, etc., you can use all that to prove that you can support your fiance. But I don't recommend having your employer omit anything.

I'm curious how they discover a mental problem and what constitutes it now though.

And like some people said, they don't care if you marry someone from your own country and they have a mental problem. Maybe the poor girl didn't even know she had what would be considered a mental problem by the Embassy doctor.

And at the same time they don't care if the USC has anything wrong with them either - just the foreigner. This whole process seems so one sided to me. I'm not bashing the program, I think it does make sense especially in a day when so many people just aren't honest with each other, but I just think it's one sided.


She wasn't denied the visa due to a mental problem. HE denied her due to the mental problem - he didn't want to marry her once he found out.

ManunSam, I lean towards agreeing with you. Although it is hard for us who so desperately want to be with our loved ones to feel that compassion for what others may be going through when it directly contradicts what we are trying to do, I DO try and do that.

Take for example the immigration raid on that company in New Bedford, MA. 361 illegal immigrants were arrested.

YES they're here illegally.
YES they're working illegally.
But they're also human beings. They have small children, some breastfeeding infants, who are now with fathers who don't know how to WEAN them. They were sent within a DAY to Texas and New Mexico. There were only 90 that remained in Massachusetts. There is a human tragedy regardless. These workers were fined $15 for every minute over 2 minutes they took for a bathroom break. It was a sweatshop.

I know this doesn't really have anything at all to do with the OPs issues, but I really do try to see the human compassion side of it. I KNOW he's mucking up the system and making it harder for many of us here. I DO realize this. And honestly, I agree with most here that it's really awful what he did and is doing (and I honestly find it hard to believe that he had a real relationship with this ex-fiancee of his since he didn't know about her mental illness). But I can't judge, I am not in that relationship, in his head, or in hers. I think someone who bounces from one man to the next for any reason should re-examine herself, but again, that's really not my place to judge. But, I'M human, too... and I have my own judgements... and sometimes I say them (when maybe I should keep them to myself)...

Since you do not work, I would put "NONE". This is not the stage where you are verifying your income.

I don't know what the poverty guidelines are, but my grandmother makes about 500k plus her assets (but she REFUSES to tell the government what she has). She lives with my grandfather who supports himself. I only say the number because I read a case in one of the guides where the person was denied because they were on disability (I'm on SSI).

Hi - good luck with this process. Sounds like you have a lot of questions that can really be answered by reading not only the guides, but also reading through a lot of the posts on here. Reading through peoples' experiences really helped me a lot, and getting one persons' answers, while very helpful, does not give you a true picture.

Best of luck! My fiance has his interview in Paris next week, and the process for us has been pretty easy. We started in October when we mailed in our I-129F, got one RFE, and it was approved at the end of December in Vermont.

With the I-129F, you are required to submit proof that you have met in person within the last two years (pictures, plane tickets, copies of passport with stamps, etc.). The USCIS office is checking to ensure you meet that requirement.

Proof of ongoing relationship is required at the interview, not with the I-129F.

Just to be clear by simplying things. The Visa itself is good for 6 months on a one time entry. Once you enter the US is when your 90 days starts 'ticking'.

Example 1:
If you want to say do a going away party in 5 months of getting the K-1 Visa in your hand you can.
Enter the US and that's when your 90 days start ticking. NOT when you are issued the K-1 Visa. Correct?

Sorry to hear about the RFE. Especially going through VSC, where you think things will zip along, an RFE will sure put us in our place! I got an RFE because I submitted Judgements of Divorce Nisi instead of the Absolute Divorce Decrees. Sent it along and got NOA2 within a month.

I am from Australia and my fiance filed the I-129 petition (NOA1 received 21st Feb) through Vermont and we are waiting on our NOA2. It feels like forever!!

Just a quick question - once I am in the US and we get married, would I be able to leave the country if we decided to go on a honeymoon? Or will I need to get my green card first before hand??

US customs does not check his passport at departure from the US. He is allowed to be in the US during the process. The problem would be if he tried to come into the US after you've filed, sometimes US customs officials deny entry because the foreign citizen does not show enough ties to his/her home country.

I'm a Vermont filer, and it took a month to get an RFE, then another month once it went back to get NOA2. So it's not always super quick. I've been jealous too of a lot of Vermont filers - some are getting NOA2 within a week of NOA1.

There is always a risk of being turned away when non-residents attempt to enter the U.S as a tourist. :(

It is good news to hear that it doesn't matter where you stand in the K1 process when visiting as a tourist. His country is part of the visa waiver program so perhaps that will help. Do you think it is worth it to pay an extra $800 bucks to enter a small airport like Cincinnati rather than somewhere like NYC or Chicago?? We are thinking it could potentially help...hoping that it could make things easier.

No, I don't think so. What could help, though, is going through the POE in Dublin, so if your fiance is turned away, he won't have traveled all the way to the States...

So... I've read other threads on visiting the U.S. while your K1 is being processed. I realize it is possible but if someone is having a bad day at the point of entry, your loved one could be denied entry.

BUT.... does it make a difference where you are in the K1 visa process? What if your NOA2 has been issued? The reason I am asking it that my fiance has A VERY IMPORTANT trip planned this summer. We don't know where we will be in the process but need to make this visit happen. There is a possibility we will have our NOA2 at this time but one never know!

Please help! Advice from people who've done this before would be GREAT!

No, it does not matter where in the process you are. Even if you've received NOA2, you risk being turned back.

I remember when Wes came back for his second visit to me. We had only been apart like 10 weeks. But we had to 'readjust' to each other, even with that brief separation. I've read in many many threads here of that same effect.

Relax girl. You've wanted this and waited for it a very long time. Big deep breaths now - ok? Don't think about the 'having' to get married bit. Don't think about your April time off. Don't put that pressure on yourself.

Wait for tomorrow. Readjust. Fall in love - in person - all over again. Be realistic with eyes wide open. Let the feelings happen. You will know the right answer. I have a feeling it will be crystal clear to you, and that you won't be disappointed.

Actually there are stories that a large age gap does result in closer scrutiny, and the consulate level, because they are looking for sings of fraud. That you had no problems w/ this issue, is your personal situation and no reason to belittle another person's comment by suggesting they don't know what they're talking about.

As I've repeatedly said since my fiance's interview, if you are a MAN who is older than your fiancee, they probably won't scrutinize as much because it's accepted that old men like young women. I'm 10 years older than my fiance, and he was asked at his interview if he knew he was marrying someone MUCH older than he is, and if he had a problem with it. If I were a man and 10 years older, I'm quite sure the question wouldn't have been asked.

For those of you who had been succesfull in the K-1 process, after the fiancee has arrived to the country, can the couple travel without restrictions? For example, getting married in civil union and then go to a honeymoon out of the country, can that happen?


The K1 is valid for ONE entry into the US. You need to file for AOS, and recommend you file for Advance Parole to be allowed to travel outside the US since that seems to be granted before GC. Plan for a honeymoon in the US.

We are trying to get an idea on how soon we will be together. My divorce will be final in 2 months, but the law here is I can't marry again for 6 months after.

Do we have to wait that whole 6 months before filing or can we file as long as I am legally divorced?

The plan was that we would file and she would come here 60 days before my 6 months was up that way we could get married within 30 days after.

Maybe thats not real great either if we have to worry about the time it takes to get approved for marriage licenses?

We just want to be together really bad, this wait sure sucks.


You must be legally free to marry when you file. If the law where you are states you cannot legally marry for 6 months after your divorce is final, then you must wait until then to file. Sorry for the bad news...

My fiance will be coming next month after what seemed like a very very long wait..We have been lucky, things have gone well without any problems so far.
I was trying to get a sense of whats the process after she enters US...specifically , how soon we can get a court marriage done?
Does she need a SSN# to get married in california/Vegas? If so, then the guide on VJ says to wait atleast 2 weeks before aplying for a SSN#, right? How long does it take to get a SSN#?

You must get married within 90 days of arrival. Just check your state's government website to find out what you have to do to get married (blood test, how long it takes to get a license, if you need SSN, etc.). Google searches are very helpful.

I've seen people here recommend waiting 2 weeks before applying for a SSN so that they can find you in the system. I think it's only a matter of weeks for a SS number once you apply.

Hi all..how is everybody? i just sent my paperwork for I-129F to my fiance, and after i sent it i just remembered that i readed one time that the fiance letter of intent needs to be notarised....is that true??? i dididnt notarised them..i made them just like in the exemple from this site and just print my name and signed them( to have original signature)... Do they need to be notarised also??? thanks..


I had the letters that we sent with the I-129F notarized.

However, for the interview, where they request updated letters of intent, I did not notarize.

Both were accepted. Can't worry about it now that it's sent. If they require a notarized letter, you'll get an RFE. Maybe you should have new letters (notarized) ready, so if you do receive the RFE, you can send it right away.

I wrote an email yesterday to the chief of USCIS, voicing my concern as well as the concern of many that USCIS needs to keep us better informed as to where we stand...i made it clear that we all know that the USCIS processing estimates are just an automatic update done by a computer and there is no substance to it!!! I said that they should have a daily update or at the very least a weekly update for all of us waiting!!


I completely understand your frustration, but would you rather them spend their time updating the system, or working on your cases?
