K-1 Fiance(e) Visa Process & ProceduresNVC
Hello all:

So I got my NOA2..saying that the petition has been approved and that the application is not sent to the NVC.
The NOA2 has a date on it of Dec 11.
I called the NVC the other day.. to find out but it said in the automated system that the case is not found.
( in entered the Receipt # )
I finally spoke to an operator and she said something like the case is under review.. What does that mean ? What do they actually check there. I thought it would be at the NVC for a few days and then it would get sent to the Consulate in Brazil.
Do I suppose to get a Case # from NVC ?
I was wondering where the Interview letter comes from.
Consulate or NVC ?
Sorry for all the questions, still trying to figure things out.

Merry Christmas to everyone smile.gif

QUOTE
Illinois does not have a Proof of Singleness. You can get a certified divorce decree, but only if he had been previously married and then divorced. If he was never married, then there is nothing official he can produce. If you are not married, everyone assumes then you are single. It is one or the other.

I guess he could get a statement from his mother!

LOL..sorry I was reading the thread and couldn't laugh about your last statement. I agree... there is no official document that proves you are single. It is probably something you need to come up with via simple letter and have it notarized.

I did file a police report..and I just found this site today..I was trying to do this all on my own and it was really stressing me out. Today is one of those emotional I miss my baby days LOL I appriciate all replies. One thing we are really nervous trying to do this the right way so much to do it sometimes overwhelms me infact when i read on the next step theres so much i start to panic and i keep saying no just do this part and worry about the next part later. Im about to go to work..my last question is my fiance , he is younger than me. We met online and for 2 years we have been talking..(calling) skype, ventrillo game chat =P anyways I am worried about the age difference..plus the face i saw a post this morning that said if its female bring male to us it gets denied. I know im worring a lot and i havent even put in the packet yet. But..u dont know what a relief it is to find this site..so far already Its relieved my fears and helped me know how to put everything together Im about to head to work but Im so glad to have found u all I feel a bit better

Oh dear... are you kidding me? If I was not working during the day, then I'd probably have my very own "Oscarville" moment. It is really tough to be separated like that and being in the dark for sometime and waiting is also painful. We are on the same boat. Met my fiance online too, he is 5 years younger than me but I'm also in my early 30's (uhm considerably decent as my mom used to say). But again DON'T WORRY too much about those things and focus on the paperwork, get them right and submit asap. When you panic, you will more than likely to make mistakes in your paperwork. Good luck to all of us. I'm waiting here, almost growing cobwebs already... think positive and deal with setbacks as they come.

Happy Wednesday.

Harry and I are just now getting started on our k-1 pettition. I am in the USA and he is in Mauritius. Im really nervous about all of it as we have some special circumstantces to our case. ( I think anyways) Im just waiting on his letter of intent... I would have had him do it here when he was visiting but...I thought for some reason it had to be postmarked.. sleep.gif anyways he is doing that and sending it tomorrow and then I will be able to send out the package. My question/worry at this moment is.. I dont have a lot of photos of us. I pulled some off my camera but the day I took Harry to the airport I was in a really bad car accident and my camera was stolen from my car by the towing company. I was more upset about the pictures than I was the accident. Anyways I guess im really nervous about all of this as I think how much I want Harry here and I miss him so badly. Any encouragement? Suggestions

Hi there,

Provide whatever photos have at this point. Tons of photos are not the only proof of ongoing relationship. If you have phone bills, plane tickets, letters, you may provide those too. I know photos help a lot. Maybe you should file a police report that indicates you had a car accident and your camera has been stolen or something in case they ask for more photos. I'm just throwing it out there but I wouldn't worry if I were you.

Hate to be the bearer of negativity but in theory yes age is just a number but it will always be questionable whether you're applying for a visa or you happen to fall in love with older man/woman or for whatever reason. The society will always scorn on that and tend to wonder what forces of nature that drive 2 people with wide age gap to want to be together. Wouldn't you blink an eye if you have an 18 year old daughter who happens to fall in love with your next door neighbor who is 50 years old? I would and even if the man is a decent man, good natured, I will still say "What the heck?".

Thanks for your help!!

My fiance has no middle name at all. So I had to leave it blank and I've been wondering if that will be questioned too "ahhh RFE...you did not put his middle name..kaboom, blast. papow". Imagine all those little things that make us go bananas.

Separation is ok as long as we know for sure that in a few months we will be reunited. But that's not our reality. My life at this point depends on the govt. Quite hard to take... Not too long ago, I simply rely on the govt (local at least) to pick up the trash on Tuesdays. Ehhh? Now the stake is higher and my future is in their hands. The beneficiary (Guy from N.Ireland) does not need a job.

The petitioner (girl from Indiana) will need a job with sufficient income, or assets, or a cosponsor. That comes later, but is good to know about/plan for.

I believe that the sponsor has to be a US citizen/LPR, so don't think his mother sponsoring him will work out, unless she gives him the assets in his name to self sponsor. (London has let others do this - assets only)

Yea but I'm just worried will they wonder why I haven't had a job since I left school...

Can my fiancee's mum not sponsor me? My fiancee is a student and this is the only option we have...

Ahh you're young. They will forgive you for your lack of workforce experience. Your USC lady love should prepare more to prove that she can support you when you live here. I hope she has enough to prove that she's able citizen..if not her parents can definitely co-sponsor. My fiance hasn't had a steady job in years (geez I should freak out too for him) but someone has to show the dough and it ain't gonna be the beneficiaries. No worries mate.

If you're truly worried they might ask you why you have been out of work since you left school, tell them the truth but with an honest intention that you are planning to be employed by any means. The job market in Northern Ireland hasn't been quite promising for the last few years, am I wrong? But who am I kidding? The job market hasn't been well everywhere.

Good luck mate.

all sorts of "proof" of a marriage being planned. Caterers, church everything.

Am I understanding correctly that none of you JP marriage folks submitted anything related to a marriage being planned? Did you say in

I am not yet a JP person but I have seen in some posts here that COs tend to ask what your plans are for the wedding, stuff like that. So I wasn't sure if wedding plans are subject to "AHA!" too. That's what triggered my paranoia and asked around here. luv.gif

If you know his/her arrival date then there is no reason why you can't start planning a nice wedding and have your family and friends there.

I think that's like a wish for everyone. I would love to have a fairy tale wedding with my baba but he's not into the whole let's-drink-and-be-merry thingie and I frankly don't want to spend the dough lavishly in an economy so uncertain. It will be a while for us to get to the romantic wedding part...sounds like everyone here would like to have a part deux at some point.

BTW - if you're the USC, how did you manage to fly to Cuba? Are we not banned or forbidden to go there?

Has it ever been an issue when K-1ers simply plan a civil wedding? In lieu of the economy and because we're somewhat not the drink all you can partying kind, my fiance and I wanted to have an intimate and quick ceremony, no church and no big reception, dance the night away type of thingie. That's the reason I'm kicking back and relaxing and not worrying about any wedding details. I mean how much can you really plan within 90 days? Now out of paranoia, I wonder if COs will find that questionable or what. Has anyone been questioned for this?

QUOTE (rwenstrom @ Aug 9 2009, 02:07 PM) <{POST_SNAPBACK}>
I know most of the peoople here are looking for information, but I'm assuming many of you have been through some family barriers in the midst of getting married.

I just really could use some support right now through everything that has been going on with the VISA process, wedding plans, work, etc. without the person that I love, I think we all know that is so stressful in itself. Then comes the family's opinions & friends that have never met your fiance, who just don't know how to handle the situation. I feel like sometime I fight for our relationship more than live it.

Right now my family is asking that we move the wedding back until June 2011, because they want us to experience more of life together & of course they want time to get to know him more. It's a legimate concern, but on Danny's part he has been doing everything he possible could do to try & form relationships with my family through webcams, emails, phone calls. His english isn't fluent but over & over he tries to talk with them & they finally decided to come down with me in March to meet him & his family face to face.

I understand that time will always tell & bring more security to the relationship or more confirmation, but Danny & I already have enought confirmation & security about getting married & for once I want to do something that is truly from my heart, but my family's opinions definitely do affect me. I want nothing more than for my parents & sister to enjoy & participate in my wedding planning with a pure heart & pure excitement & I wish for nothing other than on the day of my wedding that there would be no doubts in anyone's mind & my father would be completely confident to hand me over to the man of my dreams.

I just don't know how to make my family feel secure if they haven't met him yet...any thoughts?

Sounds like you have a very tight clan so what each and everyone does affect the other. I think this now becomes a question of breaking that custom and how you will manage to detach emotionally. You can't control their views and emotions about certain things but you can for yourself. Great idea that you will introduce them to him and his family but be prepared for what comes after next. What if they still say push the wedding out? You have to be mentally prepared to be challenged again and figure out the right balance. I don't want to say ignore your family but take a stand and do what you really want. Their family of course has your best interest at heart but so have you.

Don't fight it. The universe has its way of aligning where things should be.

I think it's a timing issue. By the time USCIS responded to their petition, the relationship has ended. She might have gotten their notification and wonder why it's still in the works. The petitioner should either withdraw that or just ignore it...it will be closed eventually due to lack of action.

Dani and I just got our NOA2 notice today, (the day before my birthday!) while I am visiting her here in FL. Our I-129f was approved in 146 days.

We'd like to keep this moving along as fast as possible of course, after this trip I likely won't be able to see her again until I get the Visa so it will be a long stretch. (I know not nearly as long as some of the members on here!) We're hoping to possibly be together before Christmas, is this realistic? Any tips/suggestions on what we should start getting prepared for what comes next would be appreciated.

Thanks!
Todd & Dani

I think it is possible by Christimas. Judging from the timelines here, it takes about another 2-3 months after NO2 to POE. Congratulations. You can reference the K-1 timelines posted in this site too, it has a checklist of things to be prepared for. You also need to wait for the instruction letter from USCIS and it tells you what is needed. Good for you mate. If you follow all the stuff closely, you and your fiance will be reunited by Xmas. We are still waiting here. :-(

Hi all
Hoping you can clear up for us some confusion about by when we have to get married. Our K-1 is valid until Oct. 30th.
Our religious ceremony is scheduled for Oct 4th.

Our families would be very upset if we got married before, but we've seen posts saying that you can't really wait that long because of the AOS paperwork.

As long as we send the AOS before oct. 30th, will we still be "in status" or is it that we have to have received the EAD before the 30th of October if we want to be in status.

thanks in advance,
sara & ludo

Hi, I don't think you're cutting it too close. You need to submit a marriage certificate after your wedding. If you'll have that in time to submit your AOS application, you should be fine.

can I file for him as visa fiancee? Remember this is the p erson whom I previously married and divorced but now he is LEGALLY divorced.

He needs to finalize his divorce first. Divorce decree for both parties will need to be submitted when a petition is filed.

K-1 visa will allow a fiance single entry to the US. Did you not say he's with you now? What is his status in the US?

Hey guys,

I am preparing for phase 2 of my visa journey and started snooping around for packet 3 stuff (even though we have not received anything yet). In one of the forms (D156K) one of the supporting documents that he must bring to his interview is evidence of engagement. Other than engagement ring receipts, what else can he provide? We didn't make a big fuss about having an engagement party and his grandmother gave me her engagement ring so what can I show as evidence? Would it trigger a red flag if we don't provide any paperwork to show we're engaged?

My fiance got his K1 today. This process has been painful enough, and we haven't seen each other since March 3rd. Originally the plan was that he would pack up and be here within a few days. I mean cmon, he has had the past 6 months to prepare for this move, and it's not even like he is leaving a good job, or a good apartment, or anything that would require a lot of effort. His reason for taking two weeks is shopping. Seriously?! I am devastated and pissed. After 6 months, he wants to shop? Material things mean more to him that being with me... ? (at least thats how i feel right now...) I can't do anything. I don't even want to talk to him. Not to mention that my family doesn't understand why he wants this time, and he wants me to "cover" for him. sad.gif He's an idiot!

Any advice? Comment?

Let him take his time really. It is not about you, it is about the whole idea of moving. He will leave India and maybe won't be there for a while so he is perhaps enjoying his moment there. Don't take it personally. He probably knows the barrier is gone and he will soon be reunited and be with you. Cheer up.

Can I just change the process from K-1 to K-3 (I believe it's a K-3) I am trying to do the whole application thing without a lawyer but early in the process I did call one immigration lawyer who said that what I'm describing here is indeed possible but she didn't say how... she wanted me to retain her services at a fee of $3500 CDN and I figured that was a waste of money....

you have all been EXTREMELY helpful in the past and I'm very thankful for this website!! It has made this whole process a heck of a lot easier! Please let me know!!!

It's kinda cutting too close. It got my NO2 after 5.5 months, then I have to add 2-3 months for the rest. It's all a gamble..you'll be lucky if you can get here before May but then every case is different. Don't risk it until at least you got your NO2, at least half of the battle is gone.

If you don't have any prior convictions or trouble with the law, you don't need any representation. You can do the paperwork yourself and they are not very hard plus you have VJers here who can always help 24/7. Save your money...you'll need it when you get here blush.gif

All over these affidavits it says income from the beneficiary is accepted if it will continue. If the OP will have an Australian job paid with Australian dollars from an Australian company but simply performs his job remotely, it seems to fit the bill to me. The whole idea behind restricting working in the US isn't that we want immigrants to be idle, we just want to give American residents and citizens the first shot at American jobs. The only thing I worry about this rationale is that "income" can mean earnings from a job, OR earnings from investments, which have different connotations.

A good place to check is with the US consulate in Sydney - "Can I keep my Australian job and work remotely from the US? If so, may I use that income to self-sponsor my K1 visa? "

I just got a reply from them on the subject.

Dear Sir:

It depends on the job you’re doing and where you are paid from. However, the fact of the matter is, you are not allowed to work in the U.S. until you have a permit.

Sincerely,
Immigrant Visa Unit
U.S. Consulate General, Sydney (RST).

Have to hand it to them for ambiguity.

rofl.gif This should be in some comedy. Hm... I was hoping that someone actually did this.

With such ambiguious answer, let's try to read it between the lines. Getting paid by an Australian company charged to your Australian social security. You're not working in the US for a company that requires you to have employment authorization. You are working remotely from the US. Hence it's ok?!?

For device drivers, software that runs on embedded systems, apps such as video editors, and other low-level software, you are correct: unmanaged languages are the way to go. However, for most everything else, managed languages are the way to go. Advancements in garbage collection algorithms, for instance, have put languages running on the java VM on par as far as efficiency is concerned with non-managed languages such as C++ in some cases. Improvements in VMs and the steady increase in processing power make managed languages much more appealing as well, not to mention the fact that they are much easier to work with. In my own industry I'm seeing C++ go the way of the dinosaur and Java is quickly taking the lead - rightfullly so. There are some things that managed langauges (especially Java) can do much better than unmanaged langauges. For instance, I do a lot of backend development of fault-tolerant distributed systems. A million times easier to do this sort of thing with a managed network architecture like Jini versus any unmanaged langauge I am aware of.

As you said, though, totally off-topic. Ok, I'll shutup now (maybe). innocent.gif

I'll answer the LIVING MONEY question: If you will be based in the North East, target a $4,000/month budget. This is to cover apartment rent, to drive a car, to purchase car insurance, utilities, to eat. Check the unemployment rate for the state you will residing. I have to agree that IT jobs are still all over the place but there still are unemployed web developers these days and you will be competing with them to get the job. What's your specialization?

(Hehe, I feel like I'm posting for a job app tongue.gif) I've had about 5 years experience over pretty much the whole range of web development. I've worked with a decent amount in terms of languages, ASP, ASP .NET, PHP, AJAX, JavaScript, HTML / CSS, MySQL, Access, SQL Server. I have a Bachelor's Degree in Computer Science and I've been programming for almost 15 years now (just not professionally)

I'm not sure if having had worked in a corporate/company setting carries a weight in the hiring process. As one of the advisers here implied, do not worry too much about injecting your fiancee's bank account to show support. There are ways to get around proof-of-enough-dough to support an unemployed web developer. luv.gif

K-1 Fiance(e) Visa Process & ProceduresJust a few questions
QUOTE (damianGray @ Aug 29 2009, 11:02 PM) <{POST_SNAPBACK}>
We're planning that she come to Aus over Christmas for probably a month or so to meet the family among other things so we'll definitely have a few visits under our belt by the time comes that we need to go for the K1. The main issue is money. She's at school at the moment and only has a part time job. There is no way she could support me while I'm over there, which is why I need to have enough in the bank for myself. If they are only going to look at her finances in regards to this process is there any way I could for instance transfer funds from my bank account to hers as a sort of wage to bump her over the minimum? I understand I'm not allowed to work until I get an EAD which could either be when I fly over to JFK or anytime in 3-4 months. So I would need to have probably at least 6 months worth of living money saved up for the both of us. (Me getting the money isn't really an issue as I'm in an excellent position to be saving at the moment)

Looking for a job when I get an EAD also won't be any sort of issue as I'm a web developer and can simply contract work online from anywhere. So the issue isn't getting money its just a matter of how much. But if she needs to be over a certain amount then is there any way I can get around that?

Having to wait for her to finish school and get a good job is not going to be very ideal for either of us.

K-1 Fiance(e) Visa Process & ProceduresDo you think age difference would be a problem?
I think it depends on the age group too. There is a big difference between a 21 year old marrying a 32 year old AND a 31 year old marrying a 42 year old person. Same age gaps but different age group. The latter is perceivable as more in control of life and also more than likely would have a good conversation flow. I don't see a problem for the latter to form a sustainable relationship. The former is a bit sketchy, has a bit of a learning curve and adjustment period, a long one if I may say. I stay away from that during my "dating" years. The conversations are not the same and frankly I don't want to raise a little-big kid.

Please look into Medicaid option. COBRA is extremely expensive and you both could use that money for something else. Medicaid generally covers low income USC or even a lawfully admitted immigrants. Try this option to see if you guys are eligible. K-1 Fiance(e) Visa Process & Proceduresphone bill question
    QUOTE (sam singh @ Nov 25 2009, 05:53 PM) <{POST_SNAPBACK}>
hi everyone, just wanted to know , how can i show phone calls as an evidence when the no. i dial doesn't show up on my verizon bill because i use calling card to call her, i first have to dial the third party no . then my pin then her number. So on my bill i only see the third party no.
any suggestions, i only have cell phone
    thanks

I also used a calling card and I have been calling from my celphone. I didn't really sweat over this since it is fairly common now that people use calling cards to save $$ making international calls. I submitted my mobile billing statement and highlighted the 1-800 access numbers there as well as SMS. If they are in doubt, they can call that number to confirm that it's a calling card company. Explain how it works to them and you should be fine.

K-1 Fiance(e) Visa Process & ProceduresRFE BEFORE NOA1?? Sounds weird to me
    QUOTE (CaMic @ Dec 13 2009, 06:12 AM) <{POST_SNAPBACK}>
Maybe it wasn't even a proper RFE that we got if there is no case number on it?

This really sounds strange. NO1 to me is just to acknowledge that they received the petition. Any missing docs would be determined between N01 and N02 stage/s. Divorce decrees come in all shapes and forms based on the state. Whether it's a one pager or multiple pages, they simply want it certified with a seal of some sort. You certainly need to have a case number in order to turn in additional paperwork they asked OR if your fiance has a copy of that letter, make a copy of that and attach it to the divorce decree when he/she sends it back.

K-1 Fiance(e) Visa Process & ProceduresHoneymoon locations in the US
    QUOTE (Cally & Blue @ Nov 8 2009, 05:56 PM) <{POST_SNAPBACK}>
This might seem a daft question - but has anyone experienced any issues with flights post-marriage but pre-AOS? (I'm thinking for the honeymoon specifically). Will there be some scrutiny at security?
We were considering Florida for a honeymoon, but as we'll be living in NH it's one heck of a drive down wink.gif

If you are traveling within the US all you need is your passport but also take your marriage certificate just in case.

K-1 Fiance(e) Visa Process & ProceduresVaccinations and age requirements
    QUOTE (NikkiUK @ Sep 16 2009, 05:01 PM) <{POST_SNAPBACK}>
    Hi everyone!

Firstly, thanks to everyone for all your help so far. I am, like most of you as it seems, completely addicted to this site and its helping me so so much! So thank you all.

I am just a little confused about the vaccinations. For example, with the Hepatitis A and B, the requirements are for people under 18 I believe. I am guessing that this means that if you are over 18 you dont need it, but I suddenly wondered if it meant that under 18 is the usual time that you would recieve this in life, but if you didnt, then get it now. I wondered this because I saw that somebody who didnt have MMR as a baby had to get that done recently.

Also, from my understanding, varicella is chicken pox. I dont know if my doctors are aware that I had chicken pox as a toddler, but will I still need the vaccine? Surely im immune now?!

Oh and also, the flu jabs...surely they change every year anyway so is that necessary?

I have read as much as possible before posting to avoid asking 'silly' questions, but am still confused.

    Just for info...im a 20yr old female.

Thanks in advance, I appreciate any help

    Nikki

    Hi Nikki,

I'm a 33y/o male and went for my medical on Monday. I had two jabs as I wan't able to produce any vaccination records, they were the MMR and tetanus. That was all that I was required to have. As a 20y/o female you need those two and the HPV vaccine.

The London medical info is here: http://london.usemba...V018a_Oct08.pdf

    Hope that helps!

Ok, now it gets weirder...I called NVC and they said they did receive it, but it was "in and out so fast" that it didn't get entered into the system. Sounds legit, right? tongue.gif

Anyway, it was forwarded to Skopje already. Yay! Thanks for the replies.

Same happened with our case. We were in and out of NVC on the same day. Good luck with the rest of the journey!
