Spoke to a CSR @the NVC. He asked me info about myself and the beneficiary. And I asked about the Case number, he provided.
Said was recived on Sep 9, 2011 and Left Sep 12, 2011.

Ok so I called today and NVC has my petition..... :dance: however they told me it takes 10-20 business days to load it in their system... :crying: . So I questioned the rep "does it mean it will take 10-20 days to for my petition to arrive in Haiti?" Then she asks well what type of petion is it? I tell her K1" So she says again "It takes 10-20 days to load it in our system....before we can discuss the case with you. "Is there anything else I can help you with?" I chuckled then asked when will it be forwarded to Haiti?" again she repeats the famous script " It takes 10-20 days...yadda yadda yadda. Is there anything else I van help you with?" I answered politely and said I will call back and find someone elses who can help...because she was not answereing my question...She told me to have a nice day... :unsure: :bonk:

I thought once the case gets to NVC it is then forwarded to the U.S. Embassy in Haiti within days...The good news is it is there...One step closer. I am going to review the timeline to see how long it takes for NVC to forward the case to the Embassy...Hang in there. You all will get the next peice of news you are waiting for soon... :yes:

Hello VJers,
So my petition was approved last Wednesday (8/31/2011), boy what a relief.
Its the Tuesday after, and I'm awaiting the part where my approved petition reaches the NVC.

I called the 603 number and they ran a check on my Receipt number and don't have it yet.

I'm thinking the long weekend means "give them a few more days to get it and register it in the system."

Is there anyone who got approved from Vermont Service Center last week and know if their Approved Petition has reached the NVC?

Just trying to be proactive in seeing that I don't have to wait too long at the embassy to receive the interview date.

Congratulations on your recent approval :dance: . My approval was on August 18. I called NVC on firday 9/2/11 I was instructed to call back again on 9/9/11 to see if our petition has been recieved. I hope your petition moves a lot faster than ours. So it will be 3 weeks since our approval.

During this time I have been getting all the info needed for packet 3 ready to send to my fiance in Haiti. So use your time wisely and read the posts, review your countries portal and stay informed. Lots of contradiction on here so take time to sort it all out...Good luck again.

These people will ALWAYS assume that the marriage is for immigration ( fraud)purposes. It is up to you to PROVE they are wrong. Sometimes all the papers in the world mean nothing.

When my wife went to Warsaw, alone, for her interview the woman said to her " do you know your fiancée is still living with his ex-wife in her home..we have proof". Wow. My wife looked her right in the face and said " you are wrong. He lives alone at this address. I do not believe you. You cannot show me proof because you do not have any". And she was very confident in her answer. That was enough for the woman. She got her visa.

One of the problems with these interviews is that the fiancée is intimidated.And nervous. It can be difficult. Most USC who accompany their fiancée ( usually they must wait outside) will not take no for an answer if there is a problem and maybe even argue a bit because it is THEIR government and they have the right to question the CO's.

Sorry you had to go through all this.

For what it's worth - Lars was denied entry in October/2008 and sent back to Copenhagen and it had NO impact on his interview. No delays, nothing. They asked him what happened and that was it.


Same for my fiance from France. He was denied entry under VWP in 2008, was sent back to France immediately. No interview delay or whatsoever. He just had to mention that in his DS-156 form and even explained the situation to the CO during his interview. He got his K-1 visa after all that.

Hi guys, my Fiancee and I just had a baby. Being a citizen, my children are entitle to citizenship through me. So, I have set up a date for my baby's birth to be reported and to get all the neccesary stuff and it is my Fiancee that his taking him. My question is, when I fill out an affidavit of support and all other documents that require the list of dependants for my fiancee, do I put my newborn's name in it? I will be appreciative for any comments. Thanks!

I am not sure that this is what you are doing, but for 4 or 5 days I was using the Automated response system at NVC and it kept saying they had no record of my file. Someone posted here that you need to speak to an operator in person for the K-1 petition to find out when it got to the NVC and when it would be forwarded to the Consulate/Embassy.

Maybe that is obvious to everyone but I thought I would just mention it. When I spoke to the operator they had already received it and were forwarding it that same day.

I talked to live person and she said the same thing. She told me it takes up to 15 business days. I asked her how come NVC received some people's packages within 1 week and mine is taking more than that? She told that it depends on the consulate..... I have no idea what consulate has to do with this because the package is still within USA. This sucks!

Not so. What about the onslaught of TPS that has been clogging up the system for most of 2010 and continuing? Where are the citizens in that?

As I have said before and firmly adhere to in the face of a lot of opposition, some even suggesting that I am a racist, K1 and K3 are special because they directly impact the right of American citizens to marry as they see fit. Those petitions should get TOP priority over ALL other petitions, but USCIS seems to think that we should be at the bottom of the pile instead.

As for USCIS giving non-citizens the priorities they deny giving to them, look at the last entry in your timeline. That e-mail is the smoking gun proof that our K-1 petitions are indeed getting pushed aside so that petitions NOT involving American citizens get worked on first. That is the wrong choice and needs to stop, ASAP.

If you want to call me rude for pointing out realistic options, then I guess I'm rude. So the OP got a response of '6 options' from someone already approved, and a response of '3 options' from someone not approved. They are realistic options, though, since there really isn't much the OP can do.

Unfortunately, all of our hands are tied when it comes to USCIS. Even talking to a congressman doesn't get USCIS to jump all over your petition, and that's just the way it is.



Well here's a realistic option for you..when someone asks a question or makes a statement how about if you have nothing constructive or helpful to say you don't say anything at all. Sarcasm and rude responses are not needed here.

I was wondering the same thing...NO LATER THAN 10-14 DAYS ...doesn't mean only in that time. Just that its likely you wont get the results for the interview the closer you are to the interview date. I think once you have the appointment letter for the interview you can go ahead with the medical. Just my 2 cents :)

Hi all.
I'm an Australian citizen residing in South Korea (for 3 years now). My girlfriend (American citizen, currently back in America) is the petitioner of the K1 visa and I'm the beneficiary. We originally sent the K1 in September, last year. Somehow the USCIS took 3 months to find it and, as a result, it was sent back to us because the filing fee had changed in those 3 months. We sent the K1 again, per their instructions (a green paper above the package), with the new fee in February. It has since been acknowledged as received and touched once on April 4th but it is still waiting to be approved.

My Korean working visa expires on the 25th of August and I'm extremely worried about this all being wrapped up by then. We thought that sending the K1 in September was ample time, but that previously mentioned hiccup has significantly slowed us down. Would my expiring visa for this country be reason for expediting the petition? If so, how would I go about applying for it? Can I do it as the beneficiary or does the petitioner have to do it?

My fiance and I would really like to start the application process in the same country and I had planned to visit him for a couple of months in September. I notice on the form there is a section to fill out if the alien fiance is in the US at the time of filing the petition. It seems to be okay, but I want to be absolutely sure before I go ahead and book my flights to Boston. Also, is there a chance I'll be delaying things at the UK end if I'm in the States for several weeks?

My fiance and I are planning to start the K1 paperwork when I head over to Boston at the start of next month. My return ticket is booked for November. Whilst I'm obviously a little concerned about potential questioning (I was there for an extended stay at the beginning of the year) I'm just planning to arm myself with evidence of my permanent address in the UK, plus a statement from contacts in the US as to the nature of my visit. I think it's best to just be as transparent as possible - in the long run it'll cause far less confusion and problems. Good luck!

Hi there,

I'm currently in Boston, MA and working through the K-1 forms with my fiance. On entry to the USA I had to go through secondary passport control (I'm here for a couple of months and was here earlier in the year for a long stay). When they stamped my passport I didn't get the usual white card stapled in, with my departure number etc. However, I was advised that if I had filled out the visa waiver online, it was no longer necessary. Does anyone know anything about this? I need to give my I-94 number on the I-129F form and don't have one!!

I hope someone can help. Or perhaps there is an organisation I should contact?

I say this all the time, but if he doesn't want to go back to Italy in December, and(most importantly) DID NOT PLAN ON IMMIGRATING HERE ON THIS VISIT AT HIS POE, then theoretically, you can marry now, and simply adjust status.

Granted, he will not immediately have a work permit, or the ability to leave the country, so if that is a stumbling block, this option isn't for you.

That's great that you can be together for the holidays! I last visited the US for an extended trip (2 months) in September, having already stayed for almost three months earlier in the year...let's just say they weren't too happy. I was pulled into secondary passport control, had my luggage searched, and was questioned pretty intensively. We actually just filed the paperwork on that trip, so that wasn't an issue then, but thankfully I took with me a lot of paperwork proving my ties to the UK. It was a nervewracking experience, and I was told that I was "abusing the system" by spending so much time there. Unfortunately, this means I probably can't visit again until this process is over. :( Enjoy your time together and hopefully you'll have the visa soon!

The annoying thing with this is that there aren't any hard and fast rules. However, even if you just make several shorter trips the guard may have cause to question you. Last year I spent a total of five months in the US, with 3.5 months back home in the UK in between. I was given a real grilling on my second trip, taken into secondary passport control, had my luggage searched and was told I was "abusing the system". That was before submitting my petition (which we did together during that stay - I'm an October filer), needless to say I won't be trying my luck with another visit before my K1 visa is issued.

It's frustrating for those of us who do want to do things by the book, but I would definitely err on the side of caution. You don't know what mood the guard will be in when you pass through immigration!

How do you know there's nothing wrong with it? Maybe it aggravates the case worker who has to sift through all of it to find what was actually requested - evidence of meeting in person within the past 2 years.
