I applied for a K1 Visa I129F followed the instructions here (thank you!) Sent it on 9/11/2013 with Checked cashed on the 12th and an SRC number assigned 09/13 from the Texas.

 

Today i received my (5) 4x6 color photos returned stating that they cannot support my application/petition with photo pictures.  They are standard pictures in the format stated in the guide here.

 

Anyone else had this issue?

That is strange...

Have you gone to the advance search tool to see if there are others in the same predicament as you and the reason why they were returned. It's worth a try to check it out. yes.gif

 

Sounds like you did send them in correctly in a bag and specifics written on the back..not sure why they were returned. That's how I sent in mine as well.

Initially I wanted to book my flight through Lufthansa and called their customer service to ask if they have better one way prices for people with immigration intent. She said that they don't and I should book a roundtrip and don't use the trip back home. But she has to inform me that according to their policy they are allowed to claim an additional charge (up to a one way ticket's price which is about $3000) afterwards. They hardly ever do but it COULD happen.

 

so I decided to book a one way trip through Icelandair...

A lot of people travel before they eventually meet their significant other. Don't worry about that. The people at USCIS are not totally dumb ;)

The CO will probably ask your fiance during the interview how and when you two met. Just make sure your fiance says the truth at all times. If the CO is confused because you have a stamp from 2011 in your passport s/he can tell him that you went on vacation but you didn't know each other then. No big deal, really!!

MrsMayer is correct! You can enter the US on a K1 only once!

You can file for Advance Parole to be able to reenter the US (You have to file and receive the AP BEFORE you leave the country!). But usually it takes up to 90 days to get the AP. You can only expedite it if you had an emergency and having to attend a wedding isn't considered an emergency at all.

 

Your options:

- travel to the US on your visa AFTER your friend's wedding

- travel to the US as planned and don't go to your friend's wedding

- travel to the US, get married, leave the country to attend your friend's wedding and have your spouse file I-130 and wait another 8-12 months for the new visa before you will be able to return to the US (I don't think you wanna do that)

I went through the german embassy so it might be slightly different but honestly, your envelope doesn't seem right to me.

I got my papers in a brown envelope that was in another bigger envelope. The envelope that I wasn't allowed to open did state on it that only an Immgration Officer is allowed to open it. This envelope had an edge cut off and I could see some of the papers but I could not have gotten them out of there. Plus, it was very neatly cut off with scissors and not ripped. Yours looks ripped open by someone.

 

Check with your embassy (can you send them a picture of your envelope - in Germany we can send emails to the embassy). Don't go to the POE with this envelope without being 100% sure that this is the way it's supposed to be. You risk being denied access to the US!

From your reply, I'm feeling that we don't need to get a joint-sponsor.  The one concern is that he made very little money last year because he was caretaking his mother and she paid for everything.  He doesn't have any proof of this besides a letter from his mom.  Do you think this will throw up a red-flag?  Then the 3 years prior his income was under the poverty line.  So, we would be relying solely on his assets.

Since NZ is the only country you have resided in for the given timeframe, then you only need an NZ police clearance.  The Consulate will know what the relevant government authority issues.  Therefore, if all that is issued by the relevant authority is a letter from said authority, then that is all you require.

We just got noa2 a few days ago by email, so now I have been looking at the documents we need for interviews etc. I want to know if anyone here have gotten a NZ police certificate for their K1?  I saw that NZ only give you a letter from the ministry of justice, not a police certificate...is that what the consulate is asking for? also  I'm a Chinese citizen but NZ is the only country I have lived for 12 months or more since I turned 16, so do I need to get a Chinese police certificate as well?

As for birth certificate, I was born in China and I don't think I have a proper birth certificate, just a piece of paper from the hospital with my mother's name on it. What should I do for the Chinese birth certificate? Thank you

thanks :) and yes we got transferred to TSC about 2-3 months after NOA1. Did you get transferred too? It seems that TSC likes to procrastinate with sending approved cases to NVC, so it took us a while to get a case number. hope you guys don't have to wait too long, and don't worry, I'm sure they will send your case to Australia

 Alien applicant needs to provide Consulate General with evidence of visa status in New Zealand, also case number, name and date and place of birth and current N.Z. address and phone number. We can then request the case file from another Post or directly from the National Visa Center

So wait until you have your case number. Then the first three letter of the case number tell you where is the embassy? If it is not NZ, then you should send them an email straight away and tell them that you want to change it to NZ. I found this sample online

what? really? I hope that doesnt happen...I saw someone here who got his K1 in NZ even tho he was not a resident of NZ, so I think it should be ok as long as you show them that you are not here just for the us visa interview. and no I havent, my fiance is gonna call NVC sometime next week . Last time he called, they told him that it's gonna take up to 8 weeks for them to receive your files from uscis!!! it's gonna be a whole month since our case is approved this sunday, so hope they give us the case number already

I don't have my case number yet. we got noa2 on 25th July, and according to uscis website it's shipped to NVC on 14th August, so hopefully I'm getting the case number soon. and yes on the application we picked the consulate in NZ as place for interview...and I don't have a job? I only just finished study a month ago :o

 

I think the consulate will probably contact me for my NZ visa etc once NVC is ready to ship the case to NZ. cos on their website they said they will only ask the case  to be forwarded to NZ after making sure that I'm eligible to do  the interview here..there's really not much info on the websites, kinda frustrating :(

I just received noa2 today. I haven't had my case number yet. My visa in aus will expire 8-2014 so it will expire next yr. Xo you have nz driver license. I handed it in too just in case. I dont know is it enough evidence.

argh my bad, 2014 not 2013 :o . well uscis never asked us for RFE, we got our noa2 in july, should be getting my case number soon. NZ consulate says it will only request the case to be transferred to NZ after the third country national showed proof of ties to nz. I guess I'll have to wait for them to contact me.

and no I don't have my nz driving licence anymore, I lost it in Sweden a couple years ago and never got a new one...are they gonna ask for that? I think I'll just show them proof that I did highschool and university here, hope that's enough

I received RFE on 16/7 so I also sent my COE = certificate of enrolment from my uni, my visa (which will expire in 8/2014) and some document to prove that I went to Aus in 2007 to study high school and then uni. Is it good enough?

you received a RFE in july? was it after you got your case number? also if your current visa is expiring in august then have you done your interview yet? or do you have a new Australian visa? other than that, it sounds like you have enough evidence to prove that you are not in Australia to get a US visa :)

I am a Chinese citizen but I'm currently in NZ. I am now waiting for NVC to give me a case number amd forward the case to the consulate in Auckland. I was reading information about Third Country National applying for k1 on the NZ consulate website, and it says that

"

First, that person must show that they have permission from the New Zealand Immigration Service to remain in New Zealand for 6 months or longer i.e. NOT just on a tourist visa.  Depending on the immigrant visa category involved, it is possible that we would accept that person's immigrant visa application. In general, however, the person must have some ties to New Zealand; that is, some reason for being here beyond applying for the visa."

 

So in order for the consulate here in NZ to accept my application, I have to have a valid NZ visa for more than 6 months and have some tie to NZ.

I have been on a student visa in NZ for the past 7 years and I just changed to a 1 year work visa as I finished uni a month ago. so I meet the 1st requirement.

 

Now I'm nervous about the 2nd requirement. Since I have just finished uni and am also applying for K1, it's impossible for me to have a permanent job right now. So now I'm just looking for part time work while waiting, I wonder if that can cause a problem?? :( I have been in NZ long before I met my fiance and I'd stay here if I didnt meet him....the thing is, last year I tried to apply for a visitor visa in Auckland so I can visit my fiance, but was rejected.. the reason given was that I didn't have a strong tie to NZ...and that was when I was still studying.  Now I'm not in uni anymore and don't have a job, wouldn't that make them refuse to take my case? :(

I'm in a similar situation. I spent exactly 6 months in sweden a couple years ago, and the U.S consulate still suggested me to get it even tho in their packet 3 it says 12 months for any foreign country. 

In the email from the consulate, I was told that it's a good idea to apply for police certificate for any country that you have stayed for 6 months or more anymore, even tho the requirement for immigrant visa is 12 months, because there's a chance that the CO will ask for the police certificate at the interview.

So get it just in case. I wish I have applied for that swedish police certificate earlier, hope they don't ask me for it during the interview

you probably should wait until your medical check. I didn't bring any records too, and I only got 2 shots at the clinic even tho there's a long list on the vaccination form. the doctor will assess what vaccinations you need. I got everything done in the same day, I doubt they would make her wait for 2 months for the vaccine shots.

Oh I see... you are chinese citizen anyway?  That is so frustrating about the mistype.....I would contact the Consulate in Auckland and ask them what to do since it's just the English version mistake.

also it's ok now, I had the interview already on Tuesday and they just sent me the visa today. I didn't really need  the police certificate, was getting it just in case, the consulate didnt ask for anything during the interview :) good luck, hope you get everything sorted soon!

I just asked my dad to bring the household register to the local police station and notary office. But you are a NZ citizen? I don't know the process for non-Chinese. It only took a couple hours for me to obtain that, but mailing it all the way to NZ takes at least 4 days...good thing the consulate didn't need that in the end :)
