K-1 Fiance(e) Visa Process & ProceduresPost NOA2

yes u have to pay the visa fee to BPI and you could schedule interview.. Visa fee is not $350 but $240...

I'm glad you brought up the pricing, I've seen some discrepancy with the price. Some things say $240 and others say $350. Basically, some docs from US say it's $240 but then the Philippines is telling me it's $350.

Thanks for your response!

I'm excited right now. Looking at more info, it seems we must pay the BPI fee and file DS-160 electronically first before we can schedule an interview. That's the lone form we haven't completed yet and it looks like it's crunch time.

K-1 Fiance(e) Visa Process & ProceduresPost NOA2
Hello all,

I received my NOA2 letter on Feb. 21st. I called NVC to try an obtain an MNL number/Release date from them but wasn't successful in obtaining that information until today. Honestly, I was surprised they had it. They had told me it could take well over a month for them to have that information for me, so to have it this quickly makes me very happy.

They gave me the MNL number and told me that it was sent to the Philippines Embassy on March 8th. Now that I have this info, I was wondering if you vets could provide some clarity on the next steps. Some of the guides I've seen say to basically wait 8 days or so from the date of when it was sent to the Embassy (In this case it'd be March 16th) and try to schedule an interview at UltraVisaDocs (Non Immigrant). If it allows me, my fiancee can pay the BPI fee ($350.00) and get her medical exam taken care of at St. Lukes in Manila.

Is this the correct setup?

K-1 Fiance(e) Visa Process & ProceduresPre-Interview Checklist

Paycheck stubs
Bank statements
W-2
1040
IRS Tax Transcript
Yahoo/Skype logs
Vonage phone call logs
All the DS forms filled out

Printed up wedding information for where we'll wed
Receipts for gifts
Letters from my family showing support for our marriage

I think that's everything in my binder other than my proofs of having met. Is there anything I'm missing?

K-1 Fiance(e) Visa Process & ProceduresClarification of evidence for I-129F and for interview
This is my first post on VJ so please bear with me!

I've been reading through the site for a while now including the K-1 guide and have done my homework, but I'm still a little confused on the evidence needed for the interview. I will be sending the initial I-129F application packet later this week and want to make sure I fully understand everything before we begin.

Here is my understanding:

For the initial I-129F packet, I need to prove that my fiancé and I have met within the past two years (I have passport stamps, itineraries, boarding passes, photos and bank statements).

But for when my fiancé has his interview, he needs to prove that we have an ongoing relationship, and the evidence is more personal (call logs, Skype messages, etc.). I guess I am confused as to the specific dates needed for the evidence of an ongoing relationship. Does it need to be dated after the initial application was sent to prove that we are still in a relationship or does it need to be more general proof that we have been in a relationship (for the past three years)? For example, I made a scrapbook for my fiancé in 2009, and he has sent me postcards and letters throughout our whole relationship. We also lived together in Chile for a year and I have a copy of the lease and bills we paid but this was from 2010-2011. Would these things work? Or should he provide newer evidence starting from the time we submit the initial application?

Any help or suggestions would be greatly appreciated.

K-1 Fiance(e) Visa Process & ProceduresRecord of Vaccinations
Susana and I had the same question. My fiancé's doctor died recently, and all of his records since he was a little kid don't exist. He called a government worker (not exactly sure who) who said that the laws regarding which vaccines are necessary haven't changed in many years, and so as long as he has the scars in his left arm (which he does), she would be happy to write an official letter stating that he has received his childhood shots.

We know that he won't need these vaccines for the K-1, but in order to make is AOS process easier, we want to make sure that he can get the USCIS doctor to fill out the necessary form when he goes for his K-1 medical appointment. Any advice on what he could bring besides the government letter that would make it more likely for the doctor to fill out the vaccine form? If the doctor won't do it, will he need to get any shots before he can enter the US or adjust his status?

K-1 Fiance(e) Visa Process & ProceduresInterview documents
I just received our NOA1 but am starting to gather some of the documents needed for my fiancé's interview, which I know won't be for at least 5 more months. I also know the interviews are country-specific but there isn't a lot of information for Chile, so I'd like to see what other people have done in the past.

For the documents needed for the interview (birth certificate, police certificate, evidence of ongoing relationship, I-134), does everything need to be an original? I'm especially asking about the relationship evidence and I-134 supporting documents. I am hesitant to send in letters, postcards, scrapbook pages, and other things with a lot of emotional value rather than copies of those things. Also, I will be using my father as a co-sponsor, and he does not want to send in his original W-2s and tax information. Is it absolutely necessary that these things be originals?

Thanks for any help you can give.

K-1 Fiance(e) Visa Process & ProceduresI-134 Question
I'm starting to prepare the documents for my fiancé's interview (not for several more months) and have a few questions about the I-134. My father will be my fiancé's co-sponsor, so I am trying to educate him on the process but don't want to give him incorrect information. He and my mother jointly file their taxes every year, but only my father will be the co-sponsor. He will include his W-2s for the past 3 years and his income alone meets the 125% requirement. Should he or my mother write a letter explaining why her name is on the taxes but only he is the co-sponsor? How will the embassy be able to separate their incomes? With my father's W-2s?

Am I correct that the only required supporting documents for someone whose income meets the requirement are: letter of employment, 3-6 months of paystubs, tax transcripts from past 3 years, and w-2s from past 3 years?

Also, I recently posted in this forum asking which of these documents needed to be originals and most people agreed that the tax information and w-2s should be originals. However, on the USCIS instructions for form I-134, it says that copies are fine. Should I trust the instructions?

Thanks for your help!

K-1 Fiance(e) Visa Process & ProceduresService request
Based on advice from other VJers, I just tried to get a service request for my I-129F and was turned down twice. The first woman I spoke to was not very friendly, but the second man was very nice and understanding on the phone. However, they both said that because VSC is currently processing cases from May 28, 2012, my case is "within normal processing times" and they cannot issue a service request. The second guy said that he even tried to give me one but wasn't allowed to. Neither would let me speak to a tier 2 officer.

I've seen other cases on here with NOA1 dates close to mine that have already gotten service requests, and it's been just over 5 months for my case.

Any advice or suggestions? What do you have to say to speak to a tier 2 officer? Am I being too pushy and should I just wait until they start processing cases closer to my NOA1 date?

Thanks for your help.

K-1 Fiance(e) Visa Process & ProceduresI-134 Question
I have a few questions for the I-134. My father has offered to be our co-sponsor and makes well above the poverty guidelines for our household size. My mother (who is married to my father) also works but will not be listed as a co-sponsor. They file their taxes jointly.

Here are my questions:

1. Should my father list my mother as partially dependent on the I-134? Again, they both work and they file their taxes jointly.

2. Will there be any problems because they file jointly but only my father is the co-sponsor?

3. Because my father's income is higher than the poverty guidelines for our household size, does he need to list his bank savings, mortgage, life insurance, etc. on page 2 or can he just list his income?

4. If he just lists his income, are the paystubs and W-2s/ tax forms the only supplement documents he will need?

Thanks for your help!

K-1 Fiance(e) Visa Process & ProceduresProof that we met in person

So I need to print out photos then.. bec I thought since it's digital I will just have to paste it in MS Word and type captions then print in an ordinary printer. But you're saying it's better to print it out in Kodak or legit photo print shops to get good quality prints and handwrite captions at the back. I also noted that you included photos with relatives and friends, I will do that.

You can print pictures either way-through MS Word or individually. I think printing them in MS Word looks neater because you can put several pictures on one page, and it will make your packet less bulky. It will also make it easier for the person sifting through all your paperwork. I put all of our pictures in chronological order and put captions of exactly who was in the picture, the date it was taken, and where we were in the pictures, then printed them on photo paper.

I agree with what others have said that it is important to include photos in a variety of settings with family members and friends. I would also recommend that you make it clear that the people in the pictures are family members (For example, in a picture with my fiance, me, and his parents, I wrote John Doe (fiance's father)). Anything you can do to make it less time-consuming for the person to figure out will help.

K-1 Fiance(e) Visa Process & ProceduresMedical Exam and Lost Records
My fiance is also from Chile and although he received his vaccinations as a child, Chile is not so great at keeping medical records, and he has no record that he ever got the vaccinations. He spoke to the doctor who will perform his medical, and she said that it is normal for Chileans not to have their vaccination record, and she will give him everything he needs (he has proof of the vaccines by the scar on his arm). His medical is in two days, and I can let you know what happens if you want.

I would not worry about your fiance not having his medical record or vaccination record, assuming he is in generally good health.

K-1 Fiance(e) Visa Process & ProceduresI don't understand this process
I hope someone can shed light to this. I don't understand how the service centers process the files that come in. I don't get how at the same service center you can have cases that have later NOA1 dates get their NOA2 sooner than the ones that had earlier NOA1 dates. Especially if all things were equal like no expedited service was chosen and no RFE's came up. Aren't they reviewed in the order they came in? Are they placed in a giant bin and then just arbitrarily grabbed? I can understand if a case is not complete or an RFE comes up but when all things are equal why inst there a direct correspondence to the NOA1 and NOA2 dates of every case?

Hello to all. I would like to know when you respond to an RFE how long should it take to get the response that they received it. I received an RFE on 7/6/12 and promptly send it back to the VSC express signature required on 7/13/12. The VSC received it and signed for it on 7/16/12 at 12:49pm. I am signed up for both email notification and text notification which worked when I received the RFE. They have had my response for a week with no notification. How long does it take? When should I start fussing? When I sent the 129F packet I got the NOA1 was very quick.

Hello to all. I see on the affidavit of support form it asks to list your property, its value and mortgage amount. I'm a co-owner of a 4 family house that is rented out. Due to the housing market..the place is currently upside down in value at about 70,000. Will this affect my affidavit of support form even if i meet the minimum income requirements? I also pay child support for two of my children who live with their mother. In section 8 of the support form do i have to list them there and if so are they wholly dependent or partially dependent. Thanks for your responses.

Every country works differently so you guys should think twice before posting something that can confuse people. Having said that, the London embassy will not schedule an interview until they have received the results of the medical. And they usually get them 4 days after the medical check.

K-1 Fiance(e) Visa Process & ProceduresEvidence Of Support
I'm going to bring her all the original documents (W2, bank statements, employer letter). The 1040 was the only one that wouldn't be original. I only ask this because I have seemingly terrible luck with the post office where I live. Things are constantly getting lost, not arriving, things I send out get lost, it's just a mess. The closest IRS office is quite far away from me and it's not really a customer service type office. I'm going to order the transcript, I'm just thinking in the worst case scenario where the interview arrived and I wasn't able to obtain the transcript, if in the opinion of you all/those who maybe have tried, if it's been acceptable. Fingers crossed the transcript arrives. Thank you to all those that replied!

Hi Dale_Trisha, thank you for your response

I'm aware that you can order transcripts from the IRS. If my fiance only had my e-file, would that be enough combined with my other forms of evidence be enough to convince the Manila office? Each year it's what I have when I e-file. So I have this packet of documents that show all my income. I can use it in the US for things fine, I'm just unsure about the Consular acceptance. Has anyone got by with their e-file documents (1040ez)?

K-1 Fiance(e) Visa Process & ProceduresEvidence Of Support
Hello all!

I just have a few quick questions in regards to proving evidence of support and I was hoping the knowledgeable people of this site would be able to help me :)

I'm in the US and my fiance is in the Philippines.

"You should be able to demonstrate that you will not become a public charge or be a burden on the U.S. taxpayers for financial support. A completed I-134 Affidavit of Support Form with original signature will be useful to the consular officer to evaluate your petitioner’s ability to be financially responsible for you. You should also submit your petitioner’s most recent U.S. Federal income tax return (Form 1040) and wage statements (Form W-2). Employment letters stating salaries and bank statements may be included to substantiate the I-134."

I have the I-134 form completed. I have W-2's. I can get an employment letter and a bank statement showcasing assets. I'm aware that if you made the required amount during the past year that you don't need to show assets but I'm going to bring a bank statement to be thorough. I also can furnish paystubs. The only thing I'm iffy on is the Income Tax Return (1040).

Each year I e-file my Federal tax return (1040ez). I do this via TurboTax. After I file, they give me a document to save for my records. After a few days I receive a confirmation that my Federal Tax Return has been accepted.

My question is: Is my e-file document that is provided to me by an e-filer, sufficient to show for the Federal Tax Return? I'm aware that you can order transcripts from the IRS but I simply want to know if by any chance, I don't have the transcript from the IRS and only have the documents that I have after e-filing each year - Is that acceptable?

I hope that doesn't sound too garbled and is clear enough for others to understand me. Thank you to anyone who takes the time to read this :)

So it's been awhile and I still haven't received the package 3 yet. According to DoS, "the decision to mail package 3" has been made on 3/22/2013.

Maybe I'm being anxious, but would it be possible to send them the required forms before receiving the actual package 3. And just to get this right, I whould mail the DS-230 Part I, I-156, I-156k, and check list, with my case# included. What is check list anyway?

K-1 Fiance(e) Visa Process & Proceduresa hypothetical question which could make or break a love story. please read

i would like to somehow oppose to your opinion, that younger men marrying older women are not normal. looking the situation from outside, it would seem that way. though, living here, and knowing hundreds of the same situation, ( younger men marrying older women, ) is a different thing... the only difference is, both person do not need to go through immigration process because they are both pinoys. and prefers to live her in our country. my mom and dad are a living testimony of that "NOT NORMAL " scenario. my mom is 55. and my dad is 47. but it was never an issue.

in defense on my part, I am marrying a filipina who happens to be an american citizen by naturalization. not a foreigner by birth. I am a licensed nurse, having my masteral degree at a university. earning a descent income. and opportunities to every countries are open.. but still, i chose to be with the woman i love. isnt that justifiable? that the immigration benefit the consul is referring is actually irrelevant if he tries to consider the fact that I would have chosen to go to some other countries where there is no recession, where economy is not at its downfall. .. how about that?could that be a logical answer?

K-1 Fiance(e) Visa Process & ProceduresRFE after almost 5 months.....
Hi I seen your post and wanted to give you my story along with a little friendly advice.

Our case was complete on January 31, 2011. We filed the I130 on June 13th, 2010. At the 5 month mark we recieved an RFE.

I went crazy!!! I cried so much and Ahmed said calm down baby, let us wait and see what they want. I said but I gave them EVERYTHING, everything they asked for I gave. I did not send in an overwhelming amount of evidence, I simply sent in my passport pages (copies) I sent in my plane ticket stubs, and that was all the evidence I gave the USCIS. But if you look carefully they do not ask for an overwhelming amount of evidence.

So when the snail mail letter arrived I ripped open the envelope only to discover our RFE was only to ask me to sign the G325! Yes! That's right I looked over everything and made sure to send all they requested, but in my hurry I did not sign the form!!! :bonk:

So I of course immediately signed the form and ran to the post office to send back the form express mail, and within one week we got our NOA2, and since then we sailed smoothly thru the rest of the process. Of course Ahmed was always so sure to remind me to sign the forms!

In saying all this I hope you feel a little encouraged to see that maybe it is just something so simple and you will take care of it quickly and be back on track so fast! Please try to relax and just wait for the snail mail, this journey is not always smooth and easy, but in the end one can overcome it all by being as calm as possible, and ALWAYS REMEMBER TO SIGN THE FORMS!

Best wishes to you!!! (F)

Matt, Hi I am sure others have answered you by now... but from one moron to another.... I DID THE SAME THING!!! We waited 5 1/2 months got an RFE... Wow congratulations! MAN I was thinking in filing a I-129F it seem like it is much faster than I-130 but a lot of people told me not to bother as it takes the same time as the I-130.

I was wondering if anyone can answer a couple questions about I-129F while filing I-130 at the same time. I know all fees are waived because you already filed a I-130 but I was wondering how that works? Sounds like if the I-129F is done and completed the interview they can come to the US but in that case what happens to the I-130?

I dont think it would be worth filing a I-129F at this point since my case has completed at NVC on Feb 15th just waiting on an interview date. But who knows? Do you think it would be worth filing I-129F at this point?

Thanks

Ramy.. Just my 2 cents for what it is worth... I say no do not file an I-129F... just wait it out, your interview will come! It is the waiting and not knowing when the wait will end that is the hardest part. I wish you well and hopefully soon you will have your interview!

Hello I dont have much experience with K1 as I am a CR1 filer, but I do know you will need the I-134 form. You can look on here under GUIDES... then click the K1 Guides and it will explain all you need to know! Best wishes to you!

Keep faith my dear, at least you know it is done and all you 2 need to do now is send the embassy the drug test results and sit back and wait for the visa to arrive! Isn't that awesome news in itself??? Best wishes to you!
