You will another another Police Certificate just because in DR is only valid for 30 days. That is why you need to have another. For the interview I would recommend to have another copy of the BC and MC. Just in case they misplaced. That way you are ahead of the game. Remember you have to go prepared. Bring all the copies of the packets you sent to USCIS as well to NVC and the original BC and MC and the passport photo that is no more thank 6 months old.

Thank you everyone for your help. I received the translated documents today from rev.com but I had to send them a message because there were a few errors on the birth certificate for my step-daughter dry.png Now I'm just waiting to hear back soon hopefully, I wanted to mail everything tomorrow. I used to volunteer in an office a few years ago doing this same exact thing: translating government documents from Spanish to English which would later be reviewed by a peer, then notarized. I wanted to do the translation myself but didn't know if they would accept it. Now I'm a little frustrated because the translator messed up on this and I have to wait longer mad.gif If they would have double checked, the mistakes would be SO OBVIOUS. Hello everyone,

 

I finally have all of the necessary documents to start the I-130 process, but now I am stumped as to the whole translation issue. I wanted to know where some of you had your translations done and about how much it cost? I got a quote from a couple of sites that are certified translators. One was $94 for notarized hard copies (marriage and birth certificate) and the other $159 for a certified hard copies. Both promise PDF copies within 24 hours. Is a hard copy necessary or will the PDF suffice? wacko.png

Everything seems covered and thorough.

Let me share how it was with me--my iphone kind of sometimes does not sync with my email contacts--my phone logs on Viber, and on my phone per se had either my husband's name on it or his phone numbers reflecting his caller ID. Call log info was inconsistent, but i printed it all
Just as it was with no explanation. I had no problems with it when I presented it at face value. No cover letters or explanations--the CO just asked for it without even skimming through it, I was surprised!

Bottomline, i think your letter explains the situation perfectly--you shouldn't worry. For as long as you have other evidence to back you up to prove a bona fide relationship--even without your cover letter, it'll do. But, sending this to the USCIS (AND in the future submitting the same to NVC aaand going to the visa interview with it would surely be of great help if a few questions/suspicions arise...at least your letter is readily available to help clarify things.) Good luck!




 

Thank you! I already mailed my packet and I just realized I didn't mention anywhere WHEN we met (2010). All the pictures I have (except for ONE from 2012 which my friend luckily found) are from my last trip there (June 2013) only because it was still on the memory card; my hard drive crashed and everything was GONE! cray5ol.gif I feel like I'm stressing over every little thing!

I am almost done putting everything together but I would really appreciate your opinions on whether or not this is confusing. I am including the phone logs in my petition but my husband changed his number twice this year, so there are calls to 3 different numbers total and I wanted to explain why.

 
Explanation of Phone Number Changes

All highlighted phone calls were calls made to my husband between March 2013-January 2014. In February 2013 I purchased a new phone and got a new number, so all call logs before this date are no longer available. I first spoke with my husband at his personal cell phone number: 829-901-XXXX and occasionally at his work cell phone: 829-712-XXXX. However, his personal cell phone stopped working and I began speaking to him regularly on his work cell phone number. In September 2013, my husband gave his 829-901-XXXX SIM card to a friend of ours, whom I also occasionally still call. I sent him the money to purchase a new phone in October 2013, where he acquired a new number: 809-356-XXXX. Unfortunately, my husband was in an accident in November 2013 and his new phone broke, so we are back to the 829-712-XXXX number.

  Hello...I am pretty certain that I need to file separate AOS's for both my wife and stepson.  My question is part 2/1 (Info on principal immigrant) and part 2/2 (family member 1).  Obviously, my wife is the "principal imigrant" in her 864 and the son is "family member 1".  Do I simply switch them in his 864??? (Making him the "principal immigrant", and my wife "Family member 1",  which would make sense....)...thanks....

The key words here are "Family Member" not "Immediate Relative" which is what your wife and step-son are considered. As an example, if you were sponsoring your sister and her spouse/child, then you would file one I-864 and list her spouse/child under family member 1, 2 etc.

From what I read, the form says, "Do not include any relative listed on a separate visa petition." (Part 3 question 2) So it is my understanding that if you filed separate I-130 petitions for your wife and step-son, they also each need their own I-864. They still need to be counted when adding up the size of your household, though.

These may be dumb questions, but I need a little help:

1.  Page 1 - mailing address and other information section - I can't tell if it's going along with Part 1 or Part 2.  Do they want the info on the sponsor (me - from the US) or the immigrant (my husband from Kenya).  I've seen examples that show both, so I don't know who's info they want.

2.  On my original visa packet that I sent in, I listed my husband and his son.  My husband of course is the principal immigrant.  In Part 3 it says "Part 2. Do not
include any relative listed on a separate visa petition."  Do i list his son as a family member or do I have to do another I-864 for his son?  (My husband will come first and then in a few months his son will come to the US).  I'm not sure if I list a family member on the same visa petition....eg - his son.

3.  Part 9 - since I'm self preparing I just leave blank?

4.  Also - this has to be done hard copy right?  When I called the NVC, they said they are reviewing his assign agent form, but in the meantime I could complete this form and then when the fee was available I could pay it.  I was thinking it was online, but seems like it's a hard copy mail in type form.  And I'm guessing I should hold off on mailing it in until they give me the list of stuff they need in addition to it.

1. Part 2: Information on Principal Immigrant, so they want your husband's information, his address and if he has an "A number" already. Part 4: Information on the Sponsor, is where you enter your address.

 

2. "Do not include any relative listed on a separate visa petition." If you filed separate I-130 for your husband and his son, then do not list them here, they each need their own I-864. The reason you would not list them under Family Member is because they are your Immediate Relative, not your Family Member. As an example, this section would be filled if you were filing for your sister (she would be considered family member and not immediate relative) as the Principal Immigrant and her son; her son would then be listed under Family Member 1.

Are you talking about form I-864? If so the current one does not have a question #13 on part 5.

 

Second, the three most recent years would be 2012, 2011, and 2010 and your reported income would be $0.00 since you did not report taxes for those years. You will need to include 3 letters explaining why you did not file a tax return for each of those years. I would also request a transcript for each of those years showing that no tax return was filed.

 

If you indeed have more than enough in assets to meet the guidelines than you are fine, no need for a joint sponsor. But if for any reason you do not feel comfortable then I would get a joint sponsor. Keep in mind it can be anybody you know that is willing to help. It doesn't need to be family but first look into direct family and branch out from there as it makes gathering the paperwork a lot easier.

Since I only just filed my I-130, I probably won't need to fill out the I-864 until wayyy later in the year, so the three most recent would be 2013, 2012, and 2011 by then. Since I'm only meeting the guidelines because of assets, I didn't know if they would see it as a bad thing that I basically have had no income since 2010... I go to school full time, but was wondering if maybe getting a part time job would help later on.

Hello everyone,

 

Even though I only recently filed my I-130 petition, I have already filled out the AOS just to have it ready. However, I am a little worried because I only meet the poverty level requirement because of my assets. Will they see this as a bad thing because I have no substantial income coming in? Only the interest I receive on my assets, which isn't even enough to have to report on income taxes. Because of this, I haven't filed taxes since 2010, so for part 5 question 13 would I just leave it blank and submit the letters from the IRS for the 3 most recent tax years which state this? I have enough in assets to more than meet the guidelines for my husband and step-daughter, but wanted to know if they will see it as a major negative that I haven't filed since 2010.

 

I also wanted to know what kind of questions they would ask my step-daughter at the interview? She is 7 years old and my husband has full custody since her mother abandoned her as a baby... When I first met my husband and we became very good friends, his daughter began calling me "Tia" (Auntie) as a term of affection. It has stuck up until now and I honestly don't mind; I don't want to force her to call me mom or see me as her mom until or when she is ready. What I'm worried about is if at the interview they ask something like, "Do you want to go live with your dad and step-mother in the US?" and she will draw a blank because she only knows me as Tia. Would I get a chance to explain this to the consular officer or is she the only one allowed to answer the question? Maybe I'm worrying for nothing but I'm kind of nervous about this.

 

Any insight on this would be greatly appreciated.

I got mines back too...was in collage format on 8x11 sheet and they were returned back in May 2013 with same letter you received.
I got my approval in Dec 2013 without RFE for pictures so as long as you have other good evidence for bonifide relationship you should be ok.

 

That's a relief, thanks! I have this as secondary evidence as listed on my cover letter.

Copy of joint credit cards and credit card statements 
Money transfer receipts for spousal support
Copy of receipts for gifts purchased
Phone logs and explanation of phone number changes

I made a Microsoft publisher document with all my pictures...it allowed me to make notes beneath each photo. Then I printed them out on regular paper and submitted with my application.

 

I tried to print them on regular paper but the quality wasn't that good when they came out, maybe I should have sent those anyway, probably wouldn't have been sent back unsure.png

No, I just photocopied all pages of my passport and listed it on my husband's cover letter as: "Copies of passport pages to show trips taken to see benificiary" The photos of us together in Dominican Republic were supposed to help back that up but those were returned also.

I was looking through the returned documents from my step-daughters rejected petition and saw that they also returned the copies of my passport stamps. However, I only submitted these with my husband's petition to prove the trips I have taken to visit him. It's not listed on my cover letter for her petition and I also took a picture of everything I submitted before sending it in. Sure enough, these were not in my step-daughters petition before mailing. So how should I correct this? Will they even believe that they mixed these up or just assume that I mistakenly placed it in her file? Now I'm worried because that means there's no evidence in my husband's petition of the trips I have taken to see him and since they also returned the pictures of us together... Not a lot of evidence left unsure.png sad.png

With a spousal visa, as he is getting, his LPR status is triggered when he enters the US.  He will get a stamp in his passport that will allow him to work while the GC is being mailed to you.  He will need to get a SSN, which will leave some lag time, but it is virtually immediate.

Hi everyone!

 

First I must say that this site has been amazing for keeping our spirits up and knowing we have a wonderful community people going through the same struggles and successes.

 

Simple question: Our I-130 has just been approved this week after an agonising wait since May 2013 (yay!) so now we go on to NVC processing.  He is currently abroad in the UK.  Because he is not Adjusting Status, will be be able to enter the country after interview, with green card, and automatically be allowed to work?  Or is there more paperwork to be filled out once he gets here?  If so, can we do it early?

Any help would be super, thank you!! xx

yes we are legally married in my country and we have the court documents and everything is legal and official, we submitted the I-130 first and got the NOA1 and then we applied for the I-129F (K3) so we can wait the I-130 while we are there together and we recieved the I-129F NOA1 too like 20 days ago, and we have photos and hotel invoices with both our names and sure passport entry stamps.
 

OOOOO K3. I kept thinking K1 haha. 

 

Expediting requests is usually if you can show that your spouse or fiance is experiencing tremendous hardships (i.e. the typhoons in the Philippines was a reason).

They're different. Are you married or not? 

 

If you're NOT legally married, then you can only submit the I-129F. If you ARE legally married, then you submit the I-130. 

 

Don't really understand why you submitted both...? 

 

Not a problem that you're younger, as long as you show a bonafide relationship.

 

Photos are secondary. To strengthen your evidence - proof of joint bills/accounts, stamps in your passports to show you were together in the same country at the same time, proof of joint households, etc.

So now you know what to do going forward. Since you don't want your wife going back and forth I suggest she goes to lagos a week ahead of interview has medical 4 days later picks up results than interview. I know some have picked up results the day before its up to you.

?? If the physician gives you your medical exam results, bring them to your interview in the envelope sealed

by the medical office.

?? Two passport photographs measuring 2 inches by 2 inches (5 cm by 5 cm) with a white background

?? A valid unexpired passport

?? Photocopies of all civil documents

?? A new police certificate from your current country of residence, if you obtained the police certificate

more than one year ago.

?? Any additional documents listed in the U.S. Embassy or Consulate specific interview guidelines

The following table lists the documents requested by the NVC and whether or not you submitted them to the

NVC. Please note that even though you may have provided the NVC with a copy of a document, you are

still required to bring the original document to the visa interview.

Refer to the Document Status Code Definitions on Page 3 to determine the meaning of the document status codes.

This is so torturous. Wish it will end. I had originally filed IR-1 but upgraded the petition once I became a citizen in April last year. Will update my timeline this evening.

Hi all,

 

Does anyone know if my fiancée in Nigeria will receive any packages (with instructions) before her interview date, or does this email I received from NVC serve as the only notice for us. When does she go for her medical? Are we going to receive instructions about this? The interview data is just a month away but she lives in Rivers State and I am very reluctant to have her travelling back and forth to Lagos unless if absolutely necessary; it?s very expensive to do so.

 

I received the email below from NVC on the 26th of December.

December 26, 2013

 

Dear XXXXXX,

 

The National Visa Center (NVC) completed the domestic pre-processing of the immigrant visa petition

LGS2013XXXXXX filed by XXXXXX on behalf of XXXXXX. The NVC will now forward the petition to the U.S. Embassy or Consulate in LAGOS, NIGERIA

for a visa interview. This letter serves as formal notification of the visa interview. SAVE this letter and present it

to the U.S. Embassy or Consulate guard/receptionist at the time of the interview. Etc, etc.

You have a point. Too bad that the auto-expedite of cases submitted from abroad no longer seems to apply.

Too bad things don't work the same way it works in europe where the priority is to keep families together and where there is such a thing called service levels...

Regarding the sponsor part, yes, we have that covered.

Absolutely - I'd just like the process to be a little more easy for someone just starting the process. It's truly a very stressful process.

USCIS doesn't have anything to do with either your POE or your experience with the embassy.  The Department of State runs the NVC and the embassies and consulates around the world.   The Department of homeland security is who is in charge ultimately of the USCIS (who are self funded) and the CBP.  Most people find the CBP to be annoying to deal with. 

 

 

Ok, I don't know who has jurisdiction for what; Deparment of State, USCIS, CBP, Dept. of Homeland Security, all have a sense of superiority and unnecessary authority.  These departments need to be more respectful to the people who enter the United States the legitimate way.

I do have a lease with my parents,my name is on it. And I have an active car insurance with my brother. I also bought health insurance plan starts September 2014- August 2015. I have an active drivers license. Letters from my family who will help me the first months until I find a job. Job emails I have applied to.
