You know that after I got my Petition Approval I didn't get anything from NVC that they told in the I-797 paper? Well, after that I called them and they told me to wait (just like that!).

Hi MC,
Simply do this. Go ahead with your naturalization process... You can download form N-400 on the web. You don't have to wait for them to mail it to you. When you become a citizen, just photocopy both the certificate of naturalization and the approval notice and send them to National Visa Center, 32 Rochester Ave, Portsmouth, NH 03801.

That's it. You're done with the upgrading. I went through the same process and I'm only waiting for the appointment date for my wife and two kids.

Hi everyone,

I am having a hard time finding detailed information on exactly what happens after our CR-1 case is transferred from the NVC to the consulate in Rio de Janeiro.

What is the first packet of info my husband will receive? Will he get his interview date in the mail?

I also would like to know the order of documents for the CR-1 interview. If anyone out there has done a CR-1 from Rio, how long did it take before your interview?

I'm sure these questions have been asked many times before, I just can't find the answers in the forum.

I'd really appreciate your help and any shortcuts you might know of.

Since yours is CR1, it'll follow a pattern like this. Embassy will send notice for the interview date and time to beneficiary. That mail will include documentations for the medicals, where to go do it, the amount involved and that's pretty much all you need. Rule of thumb: Do the medicals immediately you get the packet from the embassy. This will ensure that the results get there on the interview date. Good Luck!

as far as I know this is not possible. You can only go back after you have your AP. You have to apply for the advance parol after you get married in the US together withe the EAD and AOS documents.
You can see if someone else disagrees.

Hi friends,

I had called the NVC and checked on the automated voice service and it said that they had recieved our biographic forms.Does that mean the DS230 ??? cause then i think im close to a complete case.
O yes the affidavit of support is yet not recieved which my wife had completed about 2 weeks back with our attourney.

so as per VJ time lines how long do you think will it take for the case to get completed and have an interview once the AOS is recieved by NVC?

And as far as the inteview date is concerned we dont need to wait at all cause there are no applications at all altease none on VJ .

I am a bit concerned about filing the I-864 (possibly the EZ). My income, thru 2 jobs, is above the 125% I need to be my wife's sole sponsor, but upon deeper inspection may not seem sustainable. Last year I was volunteering for most of the year, did not make much and was claimed as a dependant on my parent's tax return. This year I have had a hard time finding regualr employment and have worked for a temp agency for most of the year, though most of it assigned to one company. I also have a PT job in retail.

My question is: how concerned should I be that NVC or the consulate (Nairobi) will dig into my finances and what can I do to bolster them. I do not want a cosponsor (don't like the idea of others having any pull in my life). I do have assets that can be liquidated and put in an account, but do I need that, and how much?

Also, what kind of letter should I get from a PT job and a temp agency? The ones I have seen here describe annual salary, that is kind of hard to determine with these jobs, should hourly be put in its place, or approximate earnings expected this year?

I think if you have the 125%, you don't have to worry. It does not matter if the job is permanent or temp. A job is a job. Neither NVC nor the Kenya embassy will dig into your finances. NVC only checks with IRS to make sure the figures you submit are correct. I'll advice you call the IRS for your tax transcripts for the most current year - FY 2005 - I presume and use the same copies when filling the afidavit of support. You should be all set. Good luck!

Just as I thought all was over, boom! Another setback. NVC sends me I-864W. Sadly, the simple form is more complicated than I had imagined. Now, whose name goes on the part 3. Is it the sponsor or the intending immigrant? The signature portion is clearly spelt out. I'll appreciate forumers help.

The web-site says that one of the two applications (I believe my daughters) has been touched. Do I need to contact CSC to insure that both my wifes application and daughters application is processed together or will my call cause some type of "inquiry" holdup?

The two applications will move in different directions BUT they'll meet at a point when you pay either the procesing or the IV fees. Don't worry. You'll be just fine.

hello guys just want to let you know that my wife and my son has done with their interview today and they are APPROVED :dance: :dance: :dance: atlast my battle has ended.my wife said they only asked her a few questions like

whos your petitioner?
when we got merried and how long?
how did i enter here in the US?
if im working?
when was the last time i've visit them?

those are the only questions that they have ask her by the filipino interviewer and the consul.they dont even ask for any documents my wife said the filipino interviewer only looked at the pictures coz the album cant fit into the window.and my wife also told me that all interviewer where very nice.after shes done with her interview with the consul she said the consul picked up a green card or sticker and stapled it into our folder but she didnt saw the word APPROVED because the folder is at the front of the consul and its to far from her sight she was about to ask the consul if they were approved but before that the consul greeted her the word "YOUR APPROVED GOOD LUCK TO YOUR TRIP TO AMERICA" my wife said thank you and she said the consul smiled back at them and waiving bye bye to my son.and then they paid the del bros for visa delivery and they steped out from the embassy.their appointment was 8:30 a.m. and they finished up at 10:30 a.m.im so happy now that my battle has ended i cant explain the feeling that my wife and my son will be here pretty soon im so excited.THANK YOU GOD and thank you to this forum ive learned a lot from reading to people's posts and it helped me and my wife a lot.and good luck for those who will have their interview in the future. I mailed the I184 bill at the end of last month. the check cleared 10/4 but I still haven't gotten the i184 packet. How long should I wait for it before I request another?


Call NVC (603-334-0700, option 1 for English and option 5 to speak with an operator live) and find out when they generated I-864 packet. You should receive the packet within 7-10 days after it is generated by NVC.

I read some were that the NVC updates there computer on ly on thrusday, is this true???
our I-130 was approved in July I send everything to them and still they have not send petition to Cuba, why is it taking so long??? this stress put me in the hospital last week for 3 days.

I know how it is to wait eagerly and get nothing. As far as I know, the NVC updates every Tuesday and Thurday but if you want on the spot answers, talk to an operator and forget about those machines. No more stress okay? I've been there and you got to take it easy on yourself before you get psychiatric issues. I got insomnia and rapid heart beat + stress just thinking about my wife and two children's case. 90 days after case completion, no interview date. When I call them they read gibberish to me.

My case has been xfered to NVC and they claim to have sent the AOS fee bill couple of weeks ago but I have not received anything from them yet.

I already know what my case number is and I got that by calling their automated response line.

The question I have is if the NVC actually sends a physical notification with the NVC case number when they receive the application from the USCIS. I have not gotten anything from NVC yet.

Who did you choose as your agent? If it's the US Citizen, every correspondence will go there. If not, it'll come to you. Also, the automated machine can tell you that it's been sent but in actuallity, it'd still be sitting down and gathering dust at the NVC. Mine was sent 12 days after the automated machine said it had been sent. The entire process is like a journey on foot in the wild. You go through a lot of rugged terrain before you get there. hey folks, any experiences with this....we submitted g325a bio data already with petition. we have the ds230 already to go. both these docs have you listing employment info. my wife just got a fantastic job offer, too good to pass up really. but the ds230 will be submitted before she would start this new job, so the g325a and the ds230 would not have this new job listed on them. will this make any difference? i'm inclined to think not, i'm thinking she could disclose it at the interview. or should we send this info to NVC somehow? hehehe, i can always find something to fret about in this process! :wacko:


If you have not submitted the DS 230 part I yet, then she should include her new job before sending it out to NVC. Is your wife the beneficiary? The DS 230 is for the beneficiary only.

Technically, she hasn't started the job yet. To be on the safer side, why not talk to someone at NVC?

Hi Folks,

I need some advice regarding immigration petition processing for my wife and daughter. Here is a brief case status:

I became a US Citizen on October 20, 2006. I had filed an immigration petition for my wife in July 2004 when I was a PR. After becoming citizen, I applied to upgrade the status of my wife’s case from spouse of PR to spouse of USC and it escalated the immigration process for my wife. However, what it did not do was to give my daughter a derivative visa status based on my wife’s immigration petition. Therefore, I had to file a separate immigration petition for my daughter who was born in July 2006. I have not received an approval for my daughter’s case from USCIS and am not sure how long it will take.

Now the challenge is that based on how my wife’s case is being processed, she may be able to get an immigrant visa by Mar-Apr 2007; however, my daughter’s case may still be pending. At that time it would be impossible for my wife to travel based on her immigrant visa as we can’t leave our daughter behind.

I have been thinking of applying for I-129F simultaneously with immigration petition and bring both of them to US based on K-3 visa but have no idea how well it will work.


UPDATE

I spoke with an Immigration Officer today by calling USCIS customer service number. The officer told me this:

1) I do not need to include my daughter in any correspondence with NVC.
2) When NVC forwards my wife's IR1 case to US Embassy in Pakistan, and the embassy sends documents for my wife to fill out, we should include my daughter's I-130 NOA1 and my daughter's birth certificate with other documents.
3) At the time of issuing visa to my wife, the US embassy will also issue visa to my daughter.
4) I do not need to file for I129F for my wife and daughter.

So far, I do not know any one who have been through this process and I will really appreciate if you guys can share your experiences with me.

I haven't posted here much, but read the info here diligently while filing for my wife's GC.

Got email notification from this morning from USCIS regarding I130 approval notice sent. Even more surprisingly, another email came this afternoon saying that I129F approval was sent.

As I recover from the shock, the $1M question is should I stick with the K3->AOS, or go through consular processing? How do these options compare in terms of time, expense, and hassle?

One way or the other, the interviewing consulate will be Hongkong.

I'd appreciate any insights regarding the options, and especially going through the process at US Consulate Hongkong. Thanks in advance!

I don't know the wait time in Hong Kong but you might want to check that first. If it's more than 6 months, then go on with the I129. My wife's case was completed in July 2006 for I130. She's in Ghana and I've not even received a word about appointment date. Meanwhile, those I know who did the I129 have their families here. So check that out. Good Luck!

:( I know I shouldn't complain and I know there are a number of people who have waited to be with their loved one longer then I have, but despite knowing all of this, I must say I am quite disgusted and depressed by this whole immigration process. I do believe the immigration process is a process to discourage people from marrying people from other countries and thereby stopping people from immigrating to the USA. Although I have read in other posts that the people at the NVC have been helpful, it makes me wonder who the heck were they talking too? I have gotten nothing but vague answers or downright lies. An example, that automatic voice response telling the lie that a fee bill has been mailed and three weeks later after talking to a customer service rep, I get a response that the fee bill was mailed yesterday and not three weeks ago. Or how about the amount of time it takes to process paperwork you overnighted but does not get processed 3 or 4 weeks later. My theory is...half the time this stuff sits on somebody's desk who doesn't give a rat's bottom that people are seperated from one another. Oh yeah and is it asking to much to include a fee bill with the paperwork that you need to fill out to keep the process moving? What is this pay a fee, we send you the paperwork and holding the barcode hostage until they receive the money? It's real simple, if the fee isn't paid, then don't process the paperwork. Oh but then again if the NVC should happen to do their job in a timely manner or equip applicants with the information they need to speed things along then some government workers would be out of a job.

Now I feel much better now that I have gotten that off of my chest!

I share your anguish. You have not even gotten to the frustrating part yet. I've been waiting for six months for my family's appointment date. I'm so frustrated I've decided not to call the NVC anymore. They can do what they want. I don't care anymore. So, you're not alone. Worse situation here.

In very simple English, they're going to check your background to ensure you're exactly who you say you're. If your name does not trigger any red flags, then you're cleared to get your visa.

Ok, now that my husband is finally here, in the US, can he start working BEFORE he has his actual social security card in hand? How long does it generally take to receive it? Before, After, or the same time as the green card arrives? Today, we went to the social security office to apply for his card, but they said it was already in the system, processing, (i guess it's because we checked the box that we wanted them to issue a social security number upon arrival) Ok, so this is great...but how long?! We need him to start working now....we need that second income....he's already got a job lined up.....he should have his interview this week.....

The SS card should take 2-3 weeks maximum. If not then there's something wrong somewhere at the SS office.

I have a question about medical exams.
I will be marrying my Fiancé in Japan on April 15th. We had originally planed on filing DCF but that is not possible now.
What we want to do is get her medical exam when we visit Tokyo for our honeymoon. Since she has to fly to Tokyo to get a medical exam we want to do it then so that she does not have to pay for another flight. Can we get her medical exam performed before we file the I-130? Would they accept it?
We will be using one of the medical facilities that were listed on the Tokyo Consulate website.
I have heard that the exams are good for one year.

It's simply a No! No! You'll need the appointment letter to go for the medicals. They need the case number on the forms.

i did not hear anything from the embassy this days the last email i got from them says ur case is with the officer for final review we will contact u once that has been compelted i got this answer for 3 monthes now and they must onley take 3 weeks i really do not know what to do me and wife are fighting i,m so nearvus we did all what we can called congressmen and consular officers here and no way today my wife called me and i was so nearvus or maybe i did not feel good i did not go to work for almost 4 days my boss was calling me and he told me theres lots of work for me at the lab i have to finish it ..... i told him i,m not in the mood to work or to do anything at all he told me this will not work ur working for the biggest comapny in the middle east and u must respect it and u must respect ur work contract i told him i do not care he told me i must be at work tommorrow 9am and i will not be able to leave not before i finish the work i told him no one can tell me what to do and i can leave when i wish he told me u seem not in agood mood we will talk later i told him bye then my wife called i told her i,m not in the mood for talking and i hang up the fone i know she will be crying now and she will not sleep i tried to call her she closed the fone any way i do not know really what to do i,m thinking so badely of divorce guys but i really love her and when i think like that it cut my heart it makes my heart burn and i really be in bad paitent please tell me what to do coz i really gave up about my visa.

A friend called me this morning to seek advise about the CRI,since I just succesfully completed my process not long ago. He narrated the story that his wife was denied a CRI visa at the embassy interview because of the following reasons: 1. no proof of relationship,because she was asked about the names of the her husbands two children which she couldn't recall their names and gender. 2. she paniced alot and the consular suspected a fishy thing. Otherwise, the photos,emails etc to establish the relationship was fine.
The denial letter they gave her at the interview said in part that,they were sending the case to the review board for the final verdit. What can he do now? Any advise?

They should file an appeal with the USCIS Benefits center ASAP. The case will be reviewed an re-opened. Seek a lawyer's advice though.

I'm trying to read the instructions about the I864 on travel.state.gov but I have some points that I can't figure out.

Situation:
Ok, my sponsor (the petitioner) does not meet 125%, she is still making something so she will sponsor me. Her parents definetly meet 125% and they accepted to be a cosponsor. One of the cosponsors is selfemployed while the second is employed. My wife sponsor is employed too.

Question 1
Which forms do they have to fill out
I864, I864EZ I864W... I don't understand.

Question 2
3 years of tax returns, are these documents available at IRS offices? If they can't find them at home who should they ask?

Question 3
How much is the IV fee for NVC (CR1 visa)? 380$ or 350$ the internet site of state.gov says the latter, in the forum people payed 380$.

Question 4
Where can I download the IV fee so to get it ready to send it as soon as NVC sends it out?

Hi, I understand your situation. Go to www.uscis.gov. That is a better website.

1. Your petitioner only need to use Form I-864 and also use only one co-sponsor. The Co-sponsor uses the same form I-864 as the original sponsor/petitioner.

2. The Tax returns copies are available at the IRS. If you don't have them, give IRS a call and they'll mail them to you free. Actually, you only need the current tax i.e. 2006. For 2005 and 2004, you need only the total income made for those years since it's optional. You may decide to submit the paperwork or not but you have to slot the numbers in the boxes.

3. The IV Visa Fee is $380.00 NOT $350. I paid for three people recently.

4. You can prepare that document from elsewhere on this site but please, don't rush it. Wait if you'll take my advice. The barcode might not work if you prepare it yourself and that will delay the process for you.

As far as I know you cannot apply for any other visa while this one is in place. Depends on which country your person is from. Better that you go and visit or meet up in another city.

As has been said.. "A properly prepared case is the key"... this is done from the onset. not at the interview. Did you have a Dinh Hon or Dam Hoi prior to the Wedding? Only 1 trip before the wedding? That will likely be a red flag that will require extensive documentation of a growing relationship between the 1st trip and the wedding trip...
Go through your relationship and try to identify any red flags that HCMC may identify... addres them in the initial filing .... The consulate will focus on what is in the initial file more than what she brings to the interview... so if the picture is clear when they get the file.. he interview will likely be more streamlined rather than a hurdle...
contrary to what folks from other consulates may think... submitting the bare minimum just to get through the initial petition is not a good idea when dealing with HCMC... several hours of research and interaction here at VJ can potentially save you months or years in your journey...


We had the dam ngo-where my mom and relatives came to my wifes house, we had the ruoc dau and proper mass ceremony also. We also took a trip to Phu Quoc by plane together. yes only one trip before the wedding. i believe my lack of visits to Vietnam is where the red flag will be..i also have pictures off all events

Hi would like some opinons before i apply for CR-1. i just got married this january. I met my wife during a trip to Vietnam in april 2008, at the time we were just friends. after my trip we communicated with each other basically everyday until the time of our wedding. in the time between our 1st meeting to our wedding, i did not go back to Vietnam to visit. i have all the chat logs, phone records, receipts of me sending gifts, pictures, plane stubs and visa stamps. Is this enough evidence for the I-130 to be approved?

Hi All,

A week after I sent out the reposnse to the RFE (requesting the certificate of marriage in the original language) associated with my I-130 petition for my wife in Taiwan, my wife just told me this morning that she accidentally typed the wrong day (23th, instead of 25th of the birth month) for her mother's birthday on the G-325a form.

Should I send out the corrected version of G-325a right away, or should I wait until the case has been approved by USCIS and forwarded to NVC? My primary concern is that if I correct the error right away, it might potetially delay the case tremendiously, especially if USCIS receives the correction after the case has been approved.

Hi All,

I have been seeing a lot of members in this forum whose case history shows the application had been "touched" on certain dates.

I have been checking the status of my I-130 prtition, online, for my wife daily for two months, I have never seen word, "touched" , showing up as the status.

Hi All,

I filed I-130 petition for my wife in early March, receieved NOA1 on March 16, received RFE on April 30, sent out repsonse on May 10. Then finally the petition has just been approved.

It seems that CSC are still processing I-30 petition.

221g for administrative processing through MENA countries is standard and shouldn't be any cause for concern (nearly everyone receives a 221g). As mentioned above, they need to complete the security clearance. Processing times, as might be expected, vary widely.
