On going relationship is for interview stage? If you meant that you send it as evidence of meeting prior to filing then you might need to withdraw the petition and get married in legal court then file for CR-1. Sorry you have to go through this. If you have not send in the pictures but have it in hand for interview then you can omit those pictures and pick other pictures to proof on going relationship

I included the pictures already ... I am going to take my chances because we may have an interview next month. If we fail then will have to go with CR1 ...

Hey guys .. I need some help.. Me and my fiancé did a ( traditional marriage ) in July 2013. But we did not register anything or get a marriage certificate. And I included the the traditional marriage pictures as ongoing relationship (evidence).... Now I am worried that they may deny us a k1 visa .. !!!!Saying that we are married aready !! !!..I've read some posts about traditional marriages and some don't look good!!!. But traditional marriage in Uganda is not legal according to marriage law in Uganda.... I mean we had no any other option rather than the k1 visa.. What should we do? Any one with the same or similar situation??

Hello all,

 

My financee and I have our interview scheduled!  Only 121 days from NOA1 to Interview... it's gone so FAST!

 

Her interview is scheduled for Guangzhou on December 19th, and we are preparing all of the documentation for it.

 

My question is: What is considered acceptable for financial documentation to show financial support?

 

I've prepared: W-2 from last year, current paystubs, employer statement, bank statement, property value records, and the affidavit of support.

 

I've read that some people provide full Tax Returns, but I feel like that is overkill... 

 

What do you all think?

1. You should, your timing doesn't have to be 100% accurate as long as there is no gaps.

You will need police certificates from any country you lived over 12 months since you turned 16 for your interview. sS yes you will need police certificate from Canada. You will also need your birth certificate, divorce decree, name change document etc but that list you will get from your embassy when its time.

 

So I have to say 16 months in Canada, isn't it?

Hi there!

I need some help with a couple of questions that are confusing me a lotcray5ol.gif . I hope you can help me.

This is my situation:

I met my fiance when I was on holidays in Canada for around six months, a friend introduced us cause I was planning a trip to NYC and he thought it was a good idea for us to be friends ( It really was hehehe) Anyway, during my time on holidays I heard about the Working Holiday Visa in Canada (WHV) so I decided to apply in order to keep visiting my boyfriend and having him visiting me, improve my french and get to travel a bit around the area. I got lucky and I get my WHV after 5 months in Canada, so I went to visit my boyfriend for a few days and went back to Canada to activate my visa at the border. Everything went fine and I had my visa activated during 11 months, I worked on retail for 6 months in Canada and after 11 months (one month before my visa expired) My boyfriend picked me up and took me with him to the States for 83 days of holidays :)

The total amount of time  I stayed in canada was 16 months and two weeks.

So, my questions are:

1. In the G-325A when they  ask for your residence in the last five years, what should I consider residence in Canada? The time since I got my WHV activated till I left? or the time since the moment I arrived for holidays plus the WHV time?

2.I am the foreign fiancee, am I going to need any kind of paper, certificate or record from Canada? I never had problems with the police or anything neither in Canada or Spain.

3. If I need some kind of record from the police in Canada, how do I get it? any idea?

 

And my last question, Do you think we should hire an attorney since we have this situation? or is not such a big deal?

"Place of Birth? always means country of birth. I read this from the USCIS website: http://www.uscis.gov...benefits-center

 

I understand that birth certificates from different countries have different format but I think that as long as the country is correct, it should be fine.

Thanx! It does help!!. I sent a mail to the embassy here and they said country and at least a city, although the closer the information is to the birth certificate info the better :)

 

 

lol that is extreme but I am no different from you. I have it bookmarked on both my laptop and my phone. I read it all the time when I am siting around waiting for someone or something.

hahahaha, well It sounds extreme but I have not much time and I spend a couple hours a day on the bus so I always feel that is the best way to take advantage of it ;)

My fiance and I recently got NOA2 approved and I was a nervous wreck over the paper work & submissions for I129F.

 

In particular I worried about getting a RFE, today I am pleased to say we did not recieve one.

 

There is a wealth of information available here on the " Guides" which is very helpful.

 

However I would admit it did fluster me a bit, my fiance kept me in check by esnuring we stick to what the I129F Instructions requested.

 

The process is a team effort,  keep calm together & ensure to review for errors.

We are sticking together and he is being very supportive. I can't wait to have the first part ready to send it and feel a little bit more relaxed, at least feel as something is done already :)

Thank you! I am doing so much research! I printed the FAQ, the tips, the instruccions and all the forms for the first step of the k-1 and I read them even on my way to work on the bus hahaha. I guess you all guys had the same feeling of wanting to finish the first step and get it sent so you could at least feel that something is done! :)

I totally understand how you feel. I was very scared to get an RFE too when we sent our petition. My best advice is keep it a team effort. Get your fiance to go through the directions and forms with you. Try not to second guess yourself too much. And if you do get an RFE, don't be too hard on yourself. It happens to the best of us. The guides here on VJ are extremely helpful, and so are the members. We are here if you have more questions. Good luck smile.png

 

I usually get worried about paperwork. My fiance is going through the forms with me but he feels the same way! hahaha we are such scary cats about doing something wrong! Although the more I read your comments the better I feel : ) thank you!

Hello everyone!

I'm pretty new here and me and my partner will be sending off our I-129F early next year. However I have a trip planned in the summer to visit my partner.

 

My question is how long does the process usually take? How long does it take to get approved? How long until the medical exam, and then the interview?

 

I want to make sure that I am in the U.K so I am able to send anything else that needs sending, and that I am here ready for my medical exam.

 

I really don't want to have to fly back from the U.S.A so what do you guys think?? If we send it in Februrary, will there be a chance anything would happen in the summer? Should I not visit my partner in the summer? Or should we send the I-129F after the summer?

 

 

 

Average - it will take 6 - 9 months. So you need to prepare yourself for that. You'll see some visas get approved in 3 months, but that is pretty rare. Tell yourself that it will take at least 6 months. 

 

You really don't know how long it will take - I sent mine in Nov, and the earliest I'll probably get approved (whole process) will probably be early summer. 

 

It will be quite unlikely that your visa will be approved by the summer if you apply in March. Unless you get super lucky! I'm just trying not to keep your expectations high. 

 

Do you have to visit him this summer? If you're going to apply in Feb/March, why don't you wait until everything is approved?

Were you ever convicted of the crime, or were you left off with a warning? Because you can be arrested but not convicted. And I believe that the forms will phrase it as "were you ever convicted of a felony?"

 

In any case, I would check 'no' since you weren't convicted. But I would also collect ALL information that you have had on this case and keep it in case it gets brought up during your interview. Also - is this something that would come up during your police clearance check?

There are people in the forum who haven't attached an extra sheet, so if where you met can fit into the three lines, then by all means.

We just compiled them neatly and used a big clip to clip them together. Some people here have used binders. Whatever you think will be easiest for the USCIS people to look through.

 

We screencapped any messages and conversations/our FB engagement announcement and then pasted it and printed it out on a sheet. 

 

We just shipped it in a big manila envelope.

My guess is if you had income for 2012, received a W-2, and filed taxes you should provide that with I-134 affidavit of support, along with the most recent pay stubs, banking info, and a letter from your employer.

 

If you did not file taxes for last year then perhaps just the pay stubs, banking info, and letter from employer is sufficient.

Hello,

 

I am currently preparing I-134 affidavit of support for my fiance's K-1 visa application.  According to the instructions for I-134, I must have:

 

1) statement from an officer of the bank or other financial institution with deposits, identifying the following details: date account opened, total amount deposited for the past year, and present balance.

 

2) statement from your employer on business stationary showing: date and nature of employment, salary paid, and whether the position is temporary or permanent.

 

3) if self employed: copy of last income tax returned filed or report of commercial rating concern.

 

4) list containing serial numbers and denominations of bonds and names of record owner(s).
 

Only #1 and #2 is applicable to my case. I printed out my 3 most recent pay stubs, as well as a letter from the human resource department stating my title, pay, and status (full time, part time, contractor, perm, etc) on company letterhead.  I also printed out my bank information as well.

 

However the instruction package (packet 3) states "the original form I-134 must be accompanied by records of the petitioner's income for the most recent tax year. The preferred record of income is the Completed Income Tax Return Transcript from the IRS (formerly IRS Form 1722). However W-2s and a certified copy of a completed federal return (Form 1040), including all pertinent schedules, might be acceptable in some cases".

 

My question: what is more accurate the instructions for I-134 or the instruction package from the US embassy (packet 3)?  Here is my story: I took a one year sabbatical in 2012 to travel and met my fiance in Viet Nam.  I had no income for 2012 (the most recent tax year), and therefore I did not file any tax returns nor do I have any W-2s for 2012.  I am currently employed, have good savings and a mortgage free condo.  I am in a good position to support my fiance but that is not for me to decide.

I'm new here to the site but I've used it a lot to navigate thus far with the I-129f petition so thank you already. 

 

I am looking for some advise on an unusual situation.

 

My fiancee and I are in same-sex relationship. We live together in Ukraine. Today we sent our I-129f petition and are beginning the long journey toward a k-1 visa. 

 

Same-sex couples are new to this site as we have not had the same opportunity as others until recently in the ways of immigration for marriage purposes. The situation is this. We are two women who live together in Ukraine. We have the same chances as anyone for receiving the k-1 I suppose but I want to know if there is any way we could expedite the process or use our situation to our advantage. If you don't know, Ukraine is an extremely hostile place for same-sex couples and we are a minority here and are legally unable to marry or have any kind of civil union. We will be living in Massachusetts if she receives the visa where same-sex marriage is legal. 

 

I'm not sure what exactly we can do to make the wheels move faster but it seems to me this is an original situation in which it would be possible to expedite the visa process.

Hi everyone,

 

The situation is this. I understand that my fiancee could visit the States while our k-1 is processing but I wanted to get your advice on our chances. 

 

We are a same-sex couple living together in Ukraine. I work here but under the table teaching English so I have no official papers to give to prove my employment. My fiancee works by herself with her mother to make handmade things and they also don't have any official papers showing they have a business though they have participated and can show they take part in exhibitions where they sell their work. 

 

Last year she applied twice for a b-2 tourist visa so she could come to the States with me and finally meet my family over the holidays. At the time, she was a student in her final year, no kids, no property, no real ties except her mother and grandmother who rely on her for the business they have together. When we applied, my parents drafted a letter of support with bank statements saying they would support her financially and that she would be welcome in their home. She was denied anyways due to lack of ties which I can see now. 

 

We filed our I-129F petition yesterday and are starting that process toward marriage. She still has not met a single member of my large family and I have met all of hers since I live in Ukraine where her family is from. It's a pretty strange thing having a fiance who your family hasn't met even though you've been together for years. We want to try again to visit for the holidays but we are not confident of our chances. 

 

Will it be to our advantage or disadvantage that we are filing our I-129F petition? I thought perhaps they would see that we are going the legal route and would perhaps grant us leniency but we all know that's not the way of things usually. 

 

Any advice would be greatly appreciated. Thank you.

Sincerely thank you for taking time to respond. It seems I will have no trouble getting the employers letter for myself and I can possibly get my pay stubs from 2012/2011 from my former employer in Poland. If I manage to get these previous tax forms from my work abroad, do you think that will be enough along with my current employers letter? The thing is, in Ukraine, most English teachers are paid in cash with no official forms filled out. I've worked at the same organization for almost a year but no pay stubs to show, only the letter from them. 

 

Dave, thanks for the very wise advise. I had no idea to be honest. I'll check with my old accountant back in the states to see if he has any advice on the matter for my situation.

So we have our interview scheduled and are gathering all documents but I was unsure about one area and the call center was zero help. 

 

I have two signed I-134 affidavits of support from my two parents who have enough funds to sponsor my fiancee. I have very little savings having worked as an English teacher abroad for the past three years. I also don't have any current w2 forms as the last time I filed taxes in the States was 3 years ago. I am getting letters from my schools to show that I have and currently work and will get copies of my old w2s anyways. 

 

My question, what other documents to show financial support should I bring? I have from my two co-sponsors letters from employers, w2s, 1080 tax forms, bank statements.

 

Also, will it be a problem that I, the primary sponsor, does not have enough money since I have two co-sponsors?

There is a timeline to get a medical and a visa, yes.  If you communicate with the embassy and it takes longer, they will extend that time for you.  If you do nothing, the petition approval will expire.

 

A K-1 just goes to NVC for a little bit to get logged and to be assigned a consulate case number.  It's a technical aspect but nothing for you to worry about.  Some people call NVC to get the case number to initiate communication with the embassy.

 

Are you sure of that?  Im just waiting for packet 4 , you tell me that if i dont call them before the expiration date everything will be ended?

I am applying for K-1 visa for my fiancee. I filed on Aug 22, 2012 and finally received the NOA 2 from Vermont on March 5, 2013. Woohoo!! :dance: I called NVC 2 weeks ago and found out that everything has been mailed to the American institute in Taiwan on March 15, 2013. I haven't heard anything since (neither did she).

Now I'm assuming AIT will mail package 3 to my fiancee soon. In this package there will be instruction on filing out forms such as i-230, i-156, etc, and where to get the medical examination. We have started on all of the required forms, getting a police report, etc.

Several questions from this point:
1) Regarding scheduling interview, does package 3 come with a pre-set interview date, or will she need to first mail the required documents back to AIT then they will give us an interview date?
2) Can she get a medical exam first, even before receiving package 3? If so, where can she can the medical exam done?
3) Just curious to all Taiwan filers, how long did it take for you from receiving NOA2 to having visa in hand?

Thanks for all the information. I just wanted to follow up with what I found out. We talked to two lawyers and both said that we should list it and that it should not affect my Fiancee's case. Well she had her interview last week and they didn't ask anything about her sister. She just picked up her visa today! So from everything I have found I would say it should be listed because the worst thing that can happen is that they catch you in a lie!
