IR-1 / CR-1 Spouse Visa Process & ProceduresCR-1 questions
Thank you all for your input. This is very difficult but it helps to see that other couples have sucessfully navigated through it and are finally together.
We have waited this long to find each other and it will all be worth it in the end but who knew waiting would be so hard!

IR-1 / CR-1 Spouse Visa Process & ProceduresCR-1 questions
We are getting married in Scotland UK in July. We plan to apply for CR1 and we will live in USA.

Most of the sample interview questions and requests for evidence seem to presume the couple is already living together.
We need the visa in order to be able to live together so none of this will apply to our situation. Will this be a problem?
We can definitely prove we have been a couple for over a year but we will be appling for CR1 as newlyeds so how do we prove bona fide marriage?
We need the visa so we can begin our life together.

How long should we reasonably expect to be kept apart while we are waiting? I understand there is a significant backlog at the Vermont service center.
I understand we should be able to visit each other but all it takes is some person at entry having a bad day and then he wouldnt be able to come in. I worry about being kept apart for unreasonable lengths of time. I see timelines taking as long as two years. Does that mean you are not allowed to see each other at all during the waiting period?
We have been trying to see each other roughly every 6-8 weeks since we met. If we can keep doing that it would still be hard but tolerable. if we had to be apart for 6 months or more it would be unbearable.

Is it permissable or even recommended for me to attend the interview even if I am not specifically requested to do so? I would like to fly to London and attend with my husband when the time comes.

Thank you for any assistance you folks who have survived this ordeal can provide.

IR-1 / CR-1 Spouse Visa Process & ProceduresConfused about I-797 Letter
QUOTE (junoonis @ Sep 22 2009, 04:06 PM) <{POST_SNAPBACK}>
Hello, I filed for my finance on august 5th and received NOA1 on august 12th. Now on the 19th of this month, I received a letter from uscis (I-797) stating that my i-130 is approved and case is forwarded to NVC. It all sound good and all but is this NOA2? If it is then I am confused because by the stats and timeline here and other sites, I heard it takes about 5 months between NOA1 and NOA2 and how come my case was forwarded it to NVC in less than 2 months? Can someone clear this up .. btw I am not complaining but sometimes things seems too good to be true, this is one of them...

Count your blessings. I would love to be in your shoes!

QUOTE (simps @ Nov 6 2009, 10:27 PM) <{POST_SNAPBACK}>
we went to the interview in mumbai india and they basically harrassed my wife until noon about her religion and then they said that they need proof that i am no longer christian and that i converted to islam. they said without it that they cannot issue a visa to my wife. we are having our imam from my city write a letter stating that he knows me to be a muslim. the way my wife described it to me is that they wanted some kind of document from the government that i changed my religion and noone i know seems to think there even is such a thing in america. has anyone heard of this kind of document existing in america? thank you all for your advice.

I am really confused. There is freedom of religion in the US. You can worship whatever way suits you and no one has the right to question you on it. It just does not make sense. Have you tried calling the consulate and speaking with someone?

IR-1 / CR-1 Spouse Visa Process & ProceduresIRS TAXES UGHHHH

You know that sounds like a question that a professional CPA could tell you. I'd give one a call and ask them.
I am leaning more towards the advice MsSheka is saying. Technically your wife wasn't in the usa last year, and you haven't applied for a tax id for her....

I've been wondering the same stuff. I mean we are married so I could file married separate because he did not live or work here or I can file head of household again. ugh. H & R block might be the answer.

IR-1 / CR-1 Spouse Visa Process & ProceduresI came to the US with K1 visa and didn't go back. What do I need to do now?
The best way to fix this is to start the ordeal now. You obviously know what is coming to you at this point based on the feedback from our fellow VJ members. Anticipate the worst (I'd say) and plan how to make your marriage work in anticipation of this nightmare. You can't hide forever unless you plan on staying idle in the U.S. for the rest of your life. That's not a very sustainable option either. This is a tough one to break because the rules are written all over the place.

May the force be with you...

That actually crossed my mind that he may have applied for a tourist visa and got denied OR tried to apply but never got around it because there's a lot of logistics involved to gather proof of "i-will-come-back". So you can use that as another reason. Some have better position in maintaining a long distance marriage by visiting regularly, but some don't. The P.I. is definitely a challenge but families survive at any rate. Good luck to you. I hope the CO understands your situation.

Playing devil's advocate here... devil.gif

Presuming I was a CO at any consulate in the world, and I was presented with a case where a married couple had not seen each other in 7 years. The separation was by choice, and not because the beneficiary was stranded on a deserted island or held prisoner in a gulag. As an imaginary CO, I would deny the visa flat out. I wouldn't even ask to see any proof of "bona fide relationship". There would be no way you could convince me that a marital relationship existed between two people who choose to live apart for 7 years. The purpose of a spousal visa is to reunite families. In my mind, as an imaginary CO, this isn't a family - it's a couple of friends who live on opposite sides of the planet.

I'm not the most optimistic person in the world, but I think a real CO may be even more jaded than I am. blush.gif

I think it depends on how culturally savvy the CO is. In the P.I., it is normal for families to be separated longer than anyone can imagine. People tend to seek job opportunities outside of the country so often times families have to deal with separation. Flying back and forth just to see each other goes in the back burner... it's a small sacrifice they typically make just to save the money instead. It's a tough choice to make but I hope OP can still counter any possible issues. Staying where he is for the purpose of collecting decent retirement money from his company is not a bad reason. Saving money instead of blowing it on airfare is not a bad reason either.

IR-1 / CR-1 Spouse Visa Process & ProceduresMedical Appointment
I scheduled and attended my medical without problem before I got my interview date.

The London Embassy medical FAQs state:

Why I am being asked to schedule the medical examination when the Embassy has not yet scheduled the visa interview? The medical results will be valid for 12 months and it will help to speed up the final processing of your application if we have received them before your the visa interview, however, it is not compulsory.

Guys,

As you will see from my feedback and timeline my journey has been a jumble. Be very selective to pick a attorney (if you are going to have one). It's very handy to have an attorney, it helped us allot with documents writing etc BUT she was a completed B.!.T.C.H. I monitored everything she did. Even resisted when she said don't call NVC, I ignored this and good thing I did. To date, she hasn't even followed up if I have received my visa of not.

We paid a total of $1,750. I mean it was good I hired a attorney, but this women is rubbish!! I have sent a huge complaint letter to her boss.

It sounds like more of a $1,750 case for NOT hiring a attorney!

IR-1 / CR-1 Spouse Visa Process & ProceduresDocuments to NVC

King,

Are you getting RFE's from NVC? Your CR-1 has already been approved, right? I am just wondering why the NVC is also asking for documents submitted with the CR-1 package.

Hello, everyone,
Hope you're all having some fun so far with the heat and sun :D :D :D
I spoke with an operator last night because I keep getting RFE's that only says sumbit OF ---DS 230 I: I know I have to add some documents too. The lady told me to send the Originals of 3 documents. Marriage, birth and police certificates.
Hello!!!??? DO they expect me to write the case numbers on the originals of such important documents? What happened to certified copies? I asked her and she still said originals. Did you all send the originals of your documents to the NVC or were they certified copies?
Any ideas? Our consulate is Accra, Ghana.

Thanks to yo'all!

Actually, with the exception of the police report, notarized copies of all the other documents were submitted when I filed the IR petition. I've no clue why they keep asking for the same documents over and over again. No clue at all!

Certified Copies are what you get from the relevant bodies that issue your documents. Certified Copies are what is referred to as originals.

This is where the confusion begins. In most parts of West Africa, a certified copy of a document is a photocopy with the expression " This is a true copy of the original document ...." and signed with the seal of a notary public.

Why can't NVC say originals??? The entire world knows that original is original. No way around it.

Many people have suffered depression at different stages of their lives due to circumstances/situations. I had a a short bout of depression a few years back due to a situation and whilst I told the doctor conducting the medical, he didnt even mention it on my forms.

Here is a thread where a similar question is asked http://www.visajourney.com/forums/index.php?showtopic=8078&hl;

So you dont think it will affect anything then ?

I don't think they look for depression. Chest X-rays, physical, blood work to check for HIV AIDS and related blood borne diseases and shots/immunizatons against the 5 killer diseases. That's it!

IR-1 / CR-1 Spouse Visa Process & ProceduresWaiting for Interview in China

Hi, I am new here. Here is my situation. I initially filed the marriage visa and not the fiance visa so I belive it is the CR-1 visa. I have gone through all the paperwork in the US and it has been sent to Guangzhou in middle of April 2006. It actually took 1 year to complete the US side of the paperwork. The US embassy has told my wife to go and get her finger prints which she is doing late June 2006. I am a US citizen.

Does anyone have any experience that can tell me how will it will take before they notify her to get the medical/physical examination? I have read and heard from people that once they tell you to get a physcial/medical examination the interview is about 2 weeks after. Is that true?

Also, can anyone that has experience tell me what questions are asked at the interview? Do I have to be there with my wife? Do they want to see proof of communication, proof of income, proof of medical coverage, etc.... Or do they just ask relationship type questions? I just want to make sure I have all the bases covered. It has been 425 days since I first started this process and IT IS WAY TOO LONG.

Thank You!

For all I know, your wife will receive the appointment package from the Embassy. If the Embassy is scheduling the interview, you might not know unless you call or e-mail them. You could also call NVC and they might be able to tell you if they scheduled the interview before sending it to your country. I don't know about your country but it must not be that long. Good Luck!

IR-1 / CR-1 Spouse Visa Process & ProceduresSUGGESTIONS FOR INTERVIEW

(L) Okay here's the deal...the interview is one week away. We did the originals all to the NVC here
in USA all fees paid everything. We got packet said do medical, he did and finished. And it said
just take this first page with the bar code for the interview and his passport.

;) Any suggestions or other things you think he should take with him?

 He was also concerned about dressing appropriate, however it is like 95 degrees
in Cairo these days. So he was curious if they would be offended if he wore
jeans and short sleeve shirt, even if very expensive american jeans and very nice
skechers?

I just have one week if there is anything else I need to send to him, so let me know?

Although the instruction says he should take the barcode and passport, be sure that he goes to the embassy with all the supporting documents; copies of marriage certificate, birth certificate, police report, marriage photos, letters from you etc.
For the dressing, I don't think there is a dress code at the American Embassy. He can dress comfortably as the weather permits. Hope this helps. Good Luck!

IR-1 / CR-1 Spouse Visa Process & ProceduresMY wife's life threatened back in India

Hello guys, yesterday we received a phone call from India, my father answered and it was a lady who told him, "do you expect your son's wife to reach America alive" in our native language. Is it a common practice to joke like this back home?? Interesting...sounds like your wife may have crossed a road for someone in hopes to leave and never come back.

I hope everything turns out OK though...

IR-1 / CR-1 Spouse Visa Process & Procedureswhy so long

. The IV Fee Bill payment was received by the National Visa Center on August 2, at 12:00Pm, and when I call there is no update. Why does it take so long for them to process the payment? :(

It takes about 1-2 week for NVC to update the IV Fee Bill payment. First, St Louis Center receivs it and subsequently updates it into NVC system. Then NVC okays it and they generate the DS 230 packet. You are better off talking with an operator live rather than automated system, as the automated system does not update any recent developments right away.

Yea! They are very slow on that. Same thing happened to me. You've paid so go ahead, download and prepare the DS-230 and all necessary documents. When you hear DS-230 generated, send them in. You don't have to wait for them. Good Luck!

IR-1 / CR-1 Spouse Visa Process & ProceduresADDITIONAL DOCUMENTS NEEDED BEFORE VISA STAMP

My hubby and I had this problem in London, and eventually sent the information for a co-sponsor even though we pointed out many times our income more than met the guideline requirements. We sent the documents to a friend in the UK who sent it via the courier the embassy uses. We didn't want to have to go through the extra expense, but decided it was justified it if got us the visa! Sorry about the hassle. By the way, he didn't have to go back for another interview, they just stamped the visa and sent it about two and a half weeks later! He's just coming home to the US next week! Hope you get everything sorted.

Nikki

shoshweetygaff,

Who is the "them" who you talked with, who told you what the officer wants?

When your husband was still talking with the officer, or when you were talking with 'them', did he or you point out that your current income is quite adequate and has been for over a year now, that you have the documents to submit demonstrating that, and that the girl at the desk had declined those documents?

I've heard of many cases where the clerical person taking in the material has not accepted relevant documents, and where re-submitting the documents directly to the interviewing officer at the appropriate time saved the day.

Yodrak

Ok we had the interview. The crazy thing the girl at the desk went through our file and pulled out explanations and other documents related to the Affidavit of Support. She gave them to him and told him, we dont need these for the interview.

Then he goes to the interview and the man says, well based on 2005, your wife does not qualify as a sponsor (I have only been at my job since May 2005 so my income tax reflected only this 1/2 year amount) for my income). However, I had documents indicating my income and verifying my employment for 2006 and that if you total the two together I more than qualify as a sponsor. Plus I had included my assets, which include my clear title of my vehicle. These were all in the papers the girl pulled out and said, you dont need in the interview.

Thus, the officer then marked on the paper stating you need a co sponsor to receive visa.

Ok, so I talked with them, and they said this is what the officer wants, you have to do this. I said ok, so I got my mom to be co sponsor, but the question is should I send directly to the embassy?

They said send by TNT to the embassy in Cairo. But I dont have TNT here in Texas??? So should I send to my husband and then have him send by TNT? It seems like extra expense. I can't get anyone there to
tell me cos their offices are closed. I want to send this Saturday if possible to get it there a.s.a.p.

Also, I'm wondering if this will throw us in to another loop of A.P. ? And will he have to go back again to have another appointment after they receive this?

Help! If you can tell me any information, instead of responding just on here, can you please send to my email address at fina_sev@yahoo.com I would greatly appreciate it.

Thanks for all your help everyone...we are so close~!

:D

You raised a lot of issues but in short, get the co-sponsor as fast as you can and mail it to your husband who in turn should mail it to the Embassy by the TNT courier service. That's exactly what the Embassy is looking for. Do not panic. You're almost done. Good Luck!

IR-1 / CR-1 Spouse Visa Process & ProceduresUPGRADING THE LPR PETITION. . .

Thank you very much diaddie mermaid, i'm so blessed I found this website too. . . and visa journey website had a lot of different case and you could find help and information too from all the members like you.

Thanks again, take care! If I need to ask more answers re: my questions I will post again here or I'll email you right away.

You know that after I got my Petition Approval I didn't get anything from NVC that they told in the I-797 paper? Well, after that I called them and they told me to wait (just like that!).

MC

Hi MC,
Simply do this. Go ahead with your naturalization process... You can download form N-400 on the web. You don't have to wait for them to mail it to you. When you become a citizen, just photocopy both the certificate of naturalization and the approval notice and send them to National Visa Center, 32 Rochester Ave, Portsmouth, NH 03801.

That's it. You're done with the upgrading. I went through the same process and I'm only waiting for the appointment date for my wife and two kids.
Good Luck on the citizenship process.
