K-1 Fiance(e) Visa Process & ProceduresEmergency Expedite k1 visa request
You mentioned something about a proxy type wedding in the unfortunate case that you aren't able to expedite things quicker. I think this might be possible somehow... I can't remember too many of the details, but a few months ago I read a newspaper article about a couple who got married over the internet and webcams... they had never met in person but had been carrying on a relationship for years. Like I said, I can't remember the details so I am not that helpful, but I do remember reading that they had been able to legally get married in different countries. Maybe you could look into this?

Thank you for serving and good luck

K-1 Fiance(e) Visa Process & ProceduresGoodbye and good luck
I followed this thread since you first posted it and agree with the others that you deserve to find the right woman and am glad for you that this relationship is getting a 2nd chance. You sound as if you are being very smart about this which is great. People do make mistakes, and should be forgiven while at the same time, you need to protect yourself against being hurt. It sounds like you are doing your best to keep both of these ideas in mind. And hey, if we don't take chances we can never get ahead! Just take your time, make sure its right! Good Luck

Ask him to get two certified copies...ine for NVC and one for the interview...chances are you won't need it for the interview but it's always best to be safe as documents do come up missing at times. All original documents are normally returned after the interview.

We got an RFE during our I130 stage because I forgot to sign the G325! When I first seen online that we were etting the RFE I was so crushed. I cried and said to Ahmed I dont know what they want and he would say baby calm down let us wait. When I opened the snailmail letter I started to laugh and cry and said stupid stupid so stupid how could I forget to sign my name??? So of course I immediately signed the form and sent it right back that same day by express mail, and a week later we were back on track. We had smooth sailing thru the rest because everytime Ahmed would say dont forget to sign!!! Good luck overcoming your RFE and try to relax!!! Best wishes!!!

IR-1 / CR-1 Spouse Visa Process & Proceduresmy CR1 visa rejected under section 221 (g)

thanks so much for ur information consulate gave me 12 months time now to gave them more proof on this if i am not able to give them proof with in 1 year my pettion wil be cancelled once and forever , blessing to my wife coz of her i am punished when i told her to come to damn pakistan she didnt show up in 3 damn years in pakistan and consular officer asked me why she didnt come to pakistan in 3 years , i said she was working on my visa and i also told her she was here only for 14 days , i did some mistakes and i am being punished very badly for that , but if my wife was here , i wouldnt be punished for that

I'm guessing that this contributed to the consulate's decision to send your petition back to USCIS. I would highly recommend that your wife spend more time in Pakistan and you can use this evidence to help prove the validity of your relationship.

You need the "return transcript" (box A). I'm assuming your just requesting for a 1040, right?

If you need a verification of nonfiling for 2007, then I believe you'll have to fill out a separate 4506-T just for 2007 then.

All that matters if the relationship is real no matter what it's based on. Why is it ok for a rich old coot to marry a young woman who clearly only married him for his money but god forbid someone wants to marry person in a country they want to live. If they are good to each other who cares. Even if they don't last they have the right to have a failed marriage like the rest of the people in the country.

But they're receiving immigration benefits, it's not like it has no effect on anybody.

Yes, I absolutely think that different histories of courtship/marriage should be treated differently at an INQUIRY/CHECK level, because that in my opinion would be the only way to make the process more efficient and effective.

I would say it's definitely taken into consideration at the consulate level, depending on which consulate you're going through.

IR-1 / CR-1 Spouse Visa Process & ProceduresCasablanca Interview Today Please Help!
Usually they will issue a 221(g) document stating that the case has been forwarded to Washington for administrative processing. I'm not sure why your father would not have received this paper if indeed he is in administrative processing.

You can call the DOS at (202)663-1225 to see if they have forwarded the case for AP. I would wait at least a few days after the interview to give them a chance to forward it.

IR-1 / CR-1 Spouse Visa Process & ProceduresCasablanca Interview Today Please Help!
Did they keep his passport? Did they issue him a 221(g) document?

It sounds like they need to do the standard FBI name checks that they run on all visa applicants. Once that check is complete, they will call him and tell him they are ready to issue the visa. When he returns to pick up the visa, he should bring the documents they requested.

Name checks can take anywhere from a couple of days to several months, there's really no way to tell in advance.

Why did you wait until almost march of the year after you were married to file?
Had you filed in January after your marriage, you probably WOULD be together now.

hardly.

First of all it takes a good month or so to get the marriage certificate from the ministry of justice in Cairo, then get it translated and send it and then receive it in the US. That brings us to late January. Sure if she had everything together she could have maybe filed in Feb but who knows with Cairo. That government is so disorganized I'm shocked we're not still waiting for our marriage certificate almost a year later. Plus, even if she could file then that totally doesn't guarantee he'd be here. We have many people still waiting for the visa more than 9 months after the interview. I'm in Admin Processing going on 4 1/2 months after our interview and I got married Dec 28 and filed the last day of January. The OP came here for support because she is sad about missing her anniversary. I don't think it's productive to find fault with what she did as far as the process, especially if you have no idea what you're talking about.

We will spend our first anniversary, Eid and New Years apart. It will suck but I will just put one foot in front of the other and try my hardest to not focus on how Cairo's disorganization is ruining my life.

My husband's case has been under AP since september of 2007.
I finally got through to a woman in DOS who talks, not redirects you to a place such as the embassy that gives no answers
As I prayed for some answers, I recieved them through her. I asked why there was such a long wait for AP, for one check...she told me that the cases that go to Washington don't actually go there only once, but several times, going back and forth from the embassy to Washington for checks, after one name/security check is cleared, there comes another one, until and until all are cleared. That is when they can issue the visa.

To all those who are waiting, it is good to understand what is happenning.

Let us pray, and keep our Iman strong, put faith at its best and seek answers through patience.

I wish for all of us from the 2006/07 generation to recieve the visas in hand.

I wish our husbands (and wives) who are waiting on the other side to know Allah is watching always and that there will come our news of visa issuances in the right time

Tammy

That seems like such a waste of time and money .. oh right, this is the US Gov't we're talking about. Nevermind.

I don't think that the security checks are a waste of time or money. My husband has been in ap since July 29. My gripe though is not with the security checks but in the loooooong delays once the checks are complete. His have been complete since September and since that time we have been in line for the "special" administrative work that is unique to going through Egypt. Once those are complete guess what.......the security checks will probably have to be done a second time!!! But again...I still am not angry at all over those because out of the thousands of innocent and true people if these checks catch just one bad guy then they're worth it. Of course I wish my husband didn't have to go through any of it but like standing in those long lines at the airport it's the price we pay for safety.

i got my interview, it went well,it just took less than 5 minutes, the consular was very nice gentleman. anyways i went when i was ready to admit it if i were asked about this court charges with documents. but as i said it was short , and he did not even ask more than four questions. but he gave me a white paper which is 221g , more Administrative process aka name checks...so now im worried they might know about it through their checks , and be a problem that i did not mention it ? so what do you think ?

Again I would say if it comes up in their investigation you can explain it and inshallah it will be no problem. The bigger issue though would be that court dates don't normally get set for a good year or so in the future so you might have to wait to come here until this is settled. Good luck.

We are getting married in Scotland UK in July. We plan to apply for CR1 and we will live in USA.

Most of the sample interview questions and requests for evidence seem to presume the couple is already living together.
We need the visa in order to be able to live together so none of this will apply to our situation. Will this be a problem?
We can definitely prove we have been a couple for over a year but we will be appling for CR1 as newlyeds so how do we prove bona fide marriage?
We need the visa so we can begin our life together.

How long should we reasonably expect to be kept apart while we are waiting? I understand there is a significant backlog at the Vermont service center.
I understand we should be able to visit each other but all it takes is some person at entry having a bad day and then he wouldnt be able to come in. I worry about being kept apart for unreasonable lengths of time. I see timelines taking as long as two years. Does that mean you are not allowed to see each other at all during the waiting period?
We have been trying to see each other roughly every 6-8 weeks since we met. If we can keep doing that it would still be hard but tolerable. if we had to be apart for 6 months or more it would be unbearable.

Is it permissable or even recommended for me to attend the interview even if I am not specifically requested to do so? I would like to fly to London and attend with my husband when the time comes.

Thank you for any assistance you folks who have survived this ordeal can provide.

Always read carefully and interpret literally. Literally, anything listed following the words, "in addition to the required...." is simply NOT required.
If I understand you correctly you are saying not to provide more than what is specifically requested. Wouldn't more proof than required be helpful?

I was only able to live with my husband for a few months after we got married and then I had to come back to the states so that I could get a job and start preparing our lives here. To show proof of a relationship we started a bank account together in El Salvador. Also, we had someone who had rented us a room for several months write an affidavit talking about all of the couple things he saw us do together. We also sent in about 12 photos that showed us doing various things together. With just these things our I-130 was approved.

It took almost 7 months for our I-130 to be approved. (We submitted it at the beginning of August 2008 and it was approved at the end of February.) This was hard because USCIS gave no updates. Just one day, out of the blue, I got an email saying that it was approved....

I sent proof our relationship with the DS-230 to the NVC as well. This isn't required, but I don't think it hurt. I sent 14 photos, copies of emails and cards, the bank account info and the affidavit I submitted with the I-130, and a document showing that he is on one of my credit card accounts.

It took two months for my approval with the NVC. This could have gone faster but we had trouble getting some of the documents. Also, it was hard for my husband to remember where he had worked for the past 10 years, as this is not something important in his country.

Now, his interview is on June 28th and his embassy requires two embassy visits.... and often mails the visa rather than giving it right there. So, I am assuming he will be here sometime late July.

So, almost a year from start to finish.... We have been apart since the end of September and have not been able to visit at all......

It is hard, but I think it has made our relationship stronger.... We have had to learn to work together to put the applications together while in different countries. We have had to find alternate ways of communicating.

It is hard, but I know it is worth it.

Good luck.

We talk either by phone, email or Im (sometimes all of three) several times a day. I dont know how people can tolerate being separated so long. We were together for a week in April and will see each other for a week again Friday and then be apart until the wedding in July. I know I could o there during the time we are waiting but I simply dont have that sort of time off available with my job. I was granted a visa for the wedding which would have allowed me to remain for six months but I have children,a job and a home here so I couldnt make use of it. I do believe all of us must have strong relationships. No one in thier right mind would put themselves through all of this and not be head over heels in love! It does make me feel better to know we are not alone in this. I just wish it wasnt such a long process. Good luck to you as well. Thank you for your input.
