Yea, I know that it doesn't say you need to include it on this board, or on the actual instructions, but I have read elsewhere that it is a good idea. And seeing as how you do have the birth certificate and therefore its not a hard thing to do, I would say include it!
I have read the argument that giving them things they didn't ask for makes your petition take longer to get approved, but I don't know how accurate that is. I included lots of things that the instructions don't ask for but that I had read in one place or another were a good thing to include. My petition was approved very quickly and I know of others who did the same and got the same results. I know others have included only what they asked for and gotten good results, but I figure if the extra evidence/materials is easy enough to include, why leave anything to be questioned?

The NVC will send the info to the embassy in the fiance's country as well as a notice to the USC. The embassy will then send a packet with forms and instructions (country specific) to the fiance.

Even though its a non-immigrant visa, they obviously expect immigration eventually. When James went through the POE with his one-way ticket, the first thing they did was ask how long he was going to stay. He answered, 'permanently, I am getting married' and the officer just asked for the K-1 visa stuff and there were no other questions.

Don't be embarrassed! I did the same, just for a different part of the petition. I had sent everything in by the time I had found this site and I had a totally different idea of what the letter of intent should be. So both my fiance and I wrote long letters of intent that gave descriptions of our meeting, our visits, how much we meant to each other and the promise that we were legally able to and did intend to marry.

Not sure that I should bother at this point, but just wanted to clarify that I didn't mean you should be lazy and not bother to supply the necessary information and evidence with your petition and I bet those who had similar advice to mine would say the same.
All I was saying is that I tried to make my petition as straightforward as possible. They ask a simple question about if you have met, I answered it in the space they provided, assuming that unless you have a complicated story, that is the type of answer they wanted.
I think that there are many different ways to compile a successful and speedy petition, since many of us have had that experience even though we have differing opinions about the best way to do things. At the end of the day, those reading this board for advice have to take it all in and then decide for themselves the best way to do their own paperwork.

I wouldn't worry at all about how your traveling makes you look financially to them. Either you have proof that you meet poverty level minimums, or you will use a co-sponsor. As long as someone signs a paper saying your fiance will not become a public burden you are all set. Good luck!

What would happen if you came over on the K1 and then decided? You have 90 days to get married, use the first 70 to figure out where you stand, get a quick wedding if all goes well to stay within the timeframe or if its not so good, leave without getting married?

I don't know if that is 100% legal though, because the intent to marry is only partially there when you cross the border, is partially there enough?.....I don't want to give you any advice that isn't legal but I don't see why that would be so bad as long as you actually left the US within 90 days if you decided you didn't want to go through with it.... Hopefully someone with more knowledge can post about that.....

I would think that the most important part about the death cert/family register would be that the wife is in fact dead, making him legally able to marry. Sounds like you did the right thing with the note of explanation. :thumbs: I would maybe even bring a picture of the gravestone, or other type of documentation of the death to the interview in case they questions anything further, but I wouldn't go too crazy over this. I would hope that they would not be discriminatory against someone with a disability wanting to get married!

When are you planning the non-civil part of the marriage? (and just a heads up, be careful with that... even though it is not a legal wedding, if for some reason the immigration officers mistake it as one you will have trouble)

After sending in the I-129F there is a long process before she actually gets a visa so you could probably do all that in the middle. Have you looked into the process for K-1s in Mexico yet? Every country does things differently. Some people get the visa immediately on completion of a successful interview, others get it shipped to them. I think you need to find these things out (by reading the guides, consulate websites and asking questions) before you make any plans!

But once she actually has the visa, I don't think she can use a different one to get into the US. I could be wrong on this as we never even looked into it, but think that I have heard once you get the K1 you can use it and only it.

Do you mean once the K-1 Visa is approved or really the I-129F? Because the I-129F is just a petition and there is still a process to go for her to get the actual visa.... Please clarify!

When she gets her actual visa, why wouldn't she just use it and come over for good?



During the process of obtaining the visa she can visit the US as long as she can prove her intention to return home until the visa is approved.

I am in the same boat as you. I make well above the necessary amount now, but only started the job in September. I had my mom co-sponsor for both the I-134 and the I-864 with the understanding that she would never actually need to help us (I mean she knows she is legally responsible to and would certainly help us if we needed it)

Its possible that this was not necessary, but I figured I didn't want to take the chance. I would get a co-sponsor just to save later trouble for yourself.

Not that this helps you at all, but I would like to ask if this makes sense to anybody else.

I get that pictures are apparently not good enough for immigration, yea, sure we could all be photoshoping it up... BUT why then are airline ticket stubs and other pieces of paper worth anything?? I sent in pictures and airline tickets, and some other receipts of things from visits, but doesn't all that paper stuff just prove I visited Ireland? In my case, most of the receipts weren't even from the county that James's address has always been as most of my visiting was done while he was at college and a secondary address. If you were to take the pictures out of my pile of evidence, I would not think that it proved anything other then that I was in the country he lives in. Sorry, just a little rant about immigration...

Have you ever gotten your passport stamped? (I know they don't always do this at the border...) Bought a bus or train ticket to visit?

What about any receipts for stuff you did together? Ever rented a car, gotten tickets to something together? I don't know if this would work but maybe get some affidavits from people saying they have seen you together?

I used a coversheet and regular white paper as dividers with each divider sheet containing a description of the section to follow. I did not use any tabs.
I wrote brief descriptions of the evidence items as needed.
I clipped the entire packet together with a single large acco fastener clip and put the whole packet into a manila envelope.
I put that envelope into the actual USPS cardboard shipping envelope.



I finally received everything I need to send off my application. I have read the tips for assembling the application but still have questions. Can I use a manila folder that has 6 sections with tabs with an ACCO faster on each tab, or or am I suppose to just have the papers all together fastened by ONE Acco fastner at the end? In which case can I just seperate the items by plain sheets of paper to divde with no tabs? Also, for the evidence section do I explain what each piece of evidence is, or is that not obvoius (ie, hotel receipt, car rental recepit, passport stamps)?

Sorry for such mundane questions.....just want to make sure I do this right. Thanks!





I set our packet up much the same way. If you wanted to use tabs, I got the sticky plastic ones and I think it made it very easy to organize, and for someone else to read, but make sure you put these on the bottom of the documents rather then the sides if you use them. I would think they are less worried about which kind of fastners and organization you use and more concerned that it is in fact organized. I think that as long as it is neat and easy to follow you will be ok!

Hey all, just thought I would make a little public service announcement for when people have gotten approved and are coming into the states. Not sure this is the right forum to post in, but figured more people would read this before going through the POEs.

When you are filling out your I-94's make sure you write very very clearly! When we went to get my husband's SSN he wasn't in the system and it was taking forever to verify his documents. We just found out this afternoon it is because they somehow mistook the N in his name for a W on his I-94 and that is what is in the system. (He doesn't have the neatest handwriting, so we realize its his fault, but we still think its pretty ridiculous, I mean the name was printed on the visa documents, actual K1 and his passport, but thats what they go by??) Means an extra trip to the airport, not a huge deal but probably avoidable, so be NEAT!

Anyways, I also wanted to comment on the original post. My husband hasn't been as involved in all of this as I have been and I am the USC. He doesn't know much about the process and I know that worried me when it was his time to deal with packet 3 and his interview, but he managed. He asked me questions on some things and needed help with the proper terms, but he did it just fine. When we recently filled out the AOS and EAD things, I was frustrated that he couldn't be more help but to his credit he sat with me and did his best to help despite his limited knowledge. The thing is I had already done all the research so it seemed silly and counterproductive to tell him to do it over once we sat down to start filling out forms and compiling.

I would like to preface this post by saying that I am no expert but this would be my advice....

As long as the forms are exactly the same I would think you could print it out and fill it out correctly. As long as you get everything back to them that they ask for I would think you are all set. If the form online is not identical, then you could always white-out what you did on the original and photocopy it for a fresh sheet.

I believe some people go online and print and fill out all the forms prior to recieving their packet 3, just to be ahead of the game. Maybe someone more knowledgable then I will respond and confirm or deny this, but my advice is to make sure you have all the forms they ask for filled out one way or another and don't worry if this messes up the way they sent you the papers. Don't know that this will be of any help but when we were waiting for my husband to get his interview from the consulate in Dublin, I was going to call and ask them for a speedy one as we wanted him here in time for my brother to be at the wedding before going to Iraq. He ended up getting an interview scheduled the day before I was going to call so I never found out what the reaction would have been, but I bet they would at least keep the circumstances in mind when scheduling. I suggest calling the consulate, can't hurt!

Our story had a happy ending with timing: Our wedding ended up being the weekend of my brother's last leave prior to deployment! :D

Also, if your unit is anything like my brother's (in the Marines) once you actually get called up you will have a few months still in the states, training and what not. Good Luck!!

You mentioned something about a proxy type wedding in the unfortunate case that you aren't able to expedite things quicker. I think this might be possible somehow... I can't remember too many of the details, but a few months ago I read a newspaper article about a couple who got married over the internet and webcams... they had never met in person but had been carrying on a relationship for years. Like I said, I can't remember the details so I am not that helpful, but I do remember reading that they had been able to legally get married in different countries. Maybe you could look into this?
