K-1 Fiance(e) Visa Case Filing and Progress ReportsRFE I got was simple and silly

I stand corrected. :bonk: It is question #2 which have 3 parts to it and at the bottom of it there are two check boxes Yes NO. I did not check off either box. That is what my RFE is on.

Oh, okay! I guess it make sense that they would want to have all their ducks in a row, but what a tiny thing to RFE you about!

K-1 Fiance(e) Visa Case Filing and Progress ReportsRFE I got was simple and silly

I mentioned on Monday that I saw on the USCIS website an RFE. I thought it would be for the blue background on me and my fiancee passport pictures. It wasn't that.

It was for page 3 of I-129 application part C. I didn't answer the questions about if I was involved in domestic violence and other types of crimes. There were 3 questions. I answered no to all 3 of them and sent it off today. I recieved the hard copy in the mail yesterday evening. One page was instruction and the other was the page to respond. Both pages were blue in color. I made copies for myself.

The version I used (i.e. the current version on the USCIS site) has 3 questions on page 3:
1. If you are currently serving in the Armed Forces...
[Answer: "Not in military service"]
2. Have you ever been convicted of...
[Answer: No]
3. If you have provided information about a conviction for a crime ... check all of the following that apply to you:
[Answer: blank, as none of the following applied to me]

There's no way to answer "no" to question #3--are you sure that's what you did?

Another good answer is that you would have the period of separation be before you are married than after: that was our reason for going K-1 rather than CR-1.

K-1 Fiance(e) Visa Case Filing and Progress Reportsfiance visa, why is it taking so long?
Hang in there!

(To avoid being redundant: all of the dates for my K-1 process are right down there at the bottom of this post. We're almost 8 months in and still a month away from the beneficiary's interview, with no RFEs or other snags apart from crazy interview delays at the embassy. Who knows how long after the interview before he's here. No one said this would be easy, but it will be worth it.)

K-1 Fiance(e) Visa Case Filing and Progress ReportsProof of relationship for K1 visa
* For my phone calls to him, I use Rebtel, and the phone records print out nicely from their website.
* For his phone calls to me: they show up on the statements from my cell phone provider (Verizon), but the entire number doesn't show, nor the location from which the call originated. So what I have done is take a photo of the screen of my phone showing the call information (date, time, number, duration) for each call. I'm including an example page of a Verizon statement with several calls, and arrows showing which example photo represents which call. Then, the rest of the calls are just shown as photos, printed in neat rows. I doubt that the embassy will even look at this, though!
* For his texts to me, I'm also using the photo technique, except that there isn't any gold standard, as nothing shows up on my Verizon statements except the # of international texts. So it will just be the photos.
* For my texts to him, I usually send them through Gmail, so those are easy to print.

We've used FB chat a few times, but there doesn't seem to be a tidy way to print the chat history, given that Facebook displays your entire message history to the beginning of time. Any tips?

K-1 Fiance(e) Visa Case Filing and Progress ReportsHoneymoon

We are planning to go somewhere in the U.S., preferably Hawaii but someone told
us that there might be problems going to Hawaii on the K-1 visa. Is this true?
We will get married in the east coast. Please let us know.
Thank you!

The issue I have seen others raise is that if you leave the U.S. mainland, even to go to another U.S. territory/state such as Hawaii or the U.S. Virgin Islands, you would run into major problems if your flight gets diverted for any reason or needs to land somewhere other than the U.S. destination airport. If a K-1 fiance/ee sets foot anywhere other than the U.S. before the green card/AP is received, he/she would have to return to the home country and start over with the IR-1 visa. Obviously this is an extremely unlikely scenario, but with the amount of stress, difficulty, and expense that most of us go through to get the beneficiaries to the U.S. in the first place, I personally wouldn't take any chances at all.

We'll be staying in the continental U.S. for our honeymoon. Probably somewhere pretty local, like a couple of hours away to somewhere in New England. After the stress and hubbub of the wedding, an epic voyage just doesn't sound like it would be my preferred activity for unwinding. Plus with all the expenses of the wedding and him not being able to work for some time thereafter, a big fancy trip will make a lot more sense a year or two down the road. Also, it will be January!

K-1 Fiance(e) Visa Case Filing and Progress ReportsAnyone used correction tape on forms?
We entered all of the information on our forms by typing it on a computer and then printing the completed version. When we were reviewing the information just prior to the interview and found several small errors, though, I just crossed out the incorrect information with a single horizontal line, wrote in the correct information neatly, and wrote my initials. The embassy accepted the forms without a problem. I wouldn't think that for an official form, the embassy would be happy about a correction method that obscures what was written there originally, so the above method seems as though it would be preferable to correction tape.

K-1 Fiance(e) Visa Case Filing and Progress Reportshow often do u check your email and USCIS web to check ur status??
I am generally logged into my email most of the time during the day, and I keep an eye on my phone. USCIS maybe every few days. We're only at about 6 weeks so far so I'm not expecting anything for a while, but in a month or two I'm sure I'll have my phone permanently attached to my hand. My NOA1 came in the middle of the night (1:53am) so by then I'll probably have stopped sleeping, too.

Hi everyone! Back briefly after another long break. Congratulations to everyone with new green cards, and sorry to hear that things didn't wind up as you'd hoped, KTandTommy: all the best as you sort everything out.

I'm happy to report that Elena Noelle arrived with minimal fuss in early December, and could actually be the cutest  baby in the history of babies.

Woo hoo! I just got the email that Rob's card is in production! As of last week, he was still at the NBC, so either they transferred him to Chicago and he got approved there, or NBC processed the paperwork. Either way, I'm anxious for the card to arrive and for us to be free of USCIS for at least another year and 9 months.

Congratulations!!!

And.....we just got the same email last night! Wheee! It's funny how this seems so much less life-changing than the I-129F petition approval, even though it's a much bigger deal. Aaron is a permanent resident: YAY!

K-1 Fiance(e) Visa Case Filing and Progress ReportsAny February 2012 filers?

Hi everyone! Long time no see. Not much has been happening, immigration-wise, so I keep forgetting to check in! (And whoa, the site looks different!) A few weeks ago, I suddenly got a bunch of USCIS alerts on my phone and got all excited, only to find out that they were confirmation notices that we'd changed our address. Well, duh!

In non-immigration land, though, (almost) everything is great, except that we've been trying (to no avail) to get Aaron added to my primary checking account since he arrived. It's an online account through Capital One 360 (formerly ING Direct). We had no problem getting a joint account at BoA pretty much the day after he arrived, but CO360 just will not budge. Part of it is probably his lack of a credit history, which I haven't been as conscientious about addressing as I should have and he doesn't really understand the importance of. We applied for some sort of newcomers card for him a few days ago, and hopefully he'll get approved for that and we can start the ball rolling. The CO360 account is just too convenient for us in so many ways that it doesn't make sense to switch banks, so they had better come around at some point.

In other news, though....

...he got a job! He's in school, primarily, until he can boost his education level enough to be competitive for jobs in this area, but we wanted something stable and part-time with regular daytime hours, and my friend/ex-coworker mentioned an opening at her (my former) company. He applied, got an interview, and got the job: the first job he ever applied for in the U.S. I'm so amazed and proud. He's been there a week so far, and if all goes well it will take him through school and provide a giant boost to the family income. Which couldn't have come at a better time, because...

...we bought a condo! Somehow, we managed to keep the wedding affordable enough that we had enough left for a down payment once the dust settled. The new place is gorgeous, in a much more appealing neighborhood, twice the size of the apartment we were renting before (and with extra storage space, a shared porch/yard, and our own parking space, to boot), and the monthly cost to us is the SAME. Best of all, it has 3 bedrooms! One for us, one for guests, and an extra one. Which couldn't have come at a better time, because...

...we're having a baby! I'm due around Thanksgiving. wow.gif

What a year! And to think that last year at this time, I was sitting on the edge of my seat convinced that the NOA2 would never come and Aaron would never get over here and even if he did, how did I know that we'd get along well and be able to make a life work together. And somehow, pretty much everything fell into place <knock on wood>. Happy, happy, happy. biggrin.png

It was a week for us but that definitely seems to be on the shorter side. Do you have delivery confirmation? (Sorry if you already mentioned that upthread...)

Well on Friday night I received the email from USCIS telling me my card had been picked up by USPS. It arrived today.

Yay, that's exciting!

So has anyone got any plans or thoughts of visits back to their motherland?!

We've been thinking of going back for Christmas next year, but a number of unpredictable factors may affect that, so we'll see. We *are* taking our first married plane trip together in June, though: using some frequent flyer miles to go to CA for a few days. Fun AND bonafide-relationship fodder: win-win!

Hi everyone: long time, no see! Need to get a moment one of these days to catch up on all of the new posts!

We made it through our wedding, although things still have not settled back to something resembling normality: really excited for that day to come. Getting documents together for AOS and trying my best to enjoy the last few days of my new mother-in-law staying with us (3 weeks!) in our 450 square feet that's barely enough space for 2. <breathe>

The wedding was so, so, so great, though. Worth every penny, hour of missed sleep, new gray hair, etc. etc. We don't have too many photos yet (grrr pro photographer promising to give us teasers in 3-5 days and it's now been 10!), but here's one I like [of ME. Bonus shot of the back of Aaron's head...].

That's lovely Joy - after all the waiting and challenges, the hard part will be over. At least for the rest of the process you will be together doing it :)

That bean thing is so funny! Happy for you!

Thanks, everyone! And he made it! It took almost 90 minutes after his flight landed for him to appear, so I was getting a little concerned. I only have one photo on my phone (took the rest with the actual camera, and haven't downloaded them yet), but...

Also, he was very highly amused by the beans. It's so, so nice to have him here! (Of course, I'm at work right now, and he's at home, which doesn't seem right at all, but oh, well.

Tomorrow's [edit: and by tomorrow I mean today] the big day! (Well, one of them!) I'm really having trouble winding down to get some sleep. So, I'm obsessively organizing our apartment. I've also made a "welcome home!" sign for the door. And, we had a running joke in Kenya that the trip was so expensive that once he arrived here, we'd be eating nothing but beans, so I set the table very nicely with silverware, nice glasses, napkins....and a nice can of beans on each plate. When we get back from the airport, I'll try to convince him that's dinner. :innocent:

I don't know if you can get the white I-94 on the plane, because I'd filled in a landing card I thought that was it (doh)... the immigration officer at the desk had loads of them and just said to fill one in. I did that at the side while he dealt with the next in line but I didn't have to get in line again. I just took it back when he was ready :D

I just took the same flight yesterday that Aaron will be on entering the U.S., and the flight attendants handed out the customs declaration forms for everyone, and the white I-94 ones to people entering on visas (they were also available to grab on your way out of the plane). I'll definitely tell him to double check what the card going in his passport says, though! That's a good tip.

Good to know: thanks! That's the white form they give visa holders to complete in the plane, right, and that then becomes a small card that is attached to your passport to give you permission to be in the U.S.? I'm not that clear on the step in between completing the form and having the card put in your passport: is that where the mistake happened? Trying to figure out what to tell him to watch for.

I'm kind of about to burst right now! I woke up at 2:30am (because of course that's a fine time to wake up if you're in a timezone 6-8 hours ahead of EST), and checked the DHL waybill status for his passport/visa while I was up: "awaiting collection by recipient"! He's going back to Nairobi (12 hours each way on the bus) Wednesday to retrieve it. We decided that's close enough to visa-in-hand to book the ticket, especially as the seat availability is quite low for the itineraries direct through Amsterdam with POE in Boston. We considered having him fly from Nairobi to save the trip back, but all of the fares are way more expensive, and his relatives in Uganda would be disappointed not getting to send him off. Plus he spends a lot of time in/around the Uganda airport for work, so we like the idea of his actually getting to finally go there to fly somewhere. There were 2 affordable days within the next 1.5 weeks, so we picked the one that doesn't involve his arriving at the airport in the middle of Thanksgiving dinner.

He'll be here next Tuesday!!!! OMG!!!
I'm having this almost uncontrollable impulse to run outside and start telling random strangers about it. Should find a way to channel this impulse into unpacking & organizing my apartment, eh? YAY!!!!

Thanks, everyone!

I just flew in this afternoon from a 3-day stopover to see some friends in Holland on the way back from Africa, and Aaron and I were speculating on the phone about when the embassy might get around to issuing the visa and sending it out, since I'd checked at the end of the business day on Friday and there was nothing listed then. But then when I got home and checked online, a record had been added and his passport/visa is now in transit. !!! Not sure why it was shipped out on a Sunday, but I'm not complaining. He's already saying his farewells to friends and wrapping things up at work, so we're on track for him to leave very soon. Surreal!

For those of you who've done the whole POE thing in the U.S. recently, what does he need to have with him when he lands, other than his passport, the visa, and his x-ray?

For those whose interviews are coming up, think calm thoughts - don't stress (easy to say now :P ) because the process at the embassy is actually very straight forward. Just another day of work. If you have all the right documents and talk honestly about a relationship you know is genuine, you have nothing to fear. The staff are really very pleasant.

*slams head into wall* UGH! We got the report from child services today and it's not what we expected. :crying: :crying: The boys were interviewed and explained how they want to live with us and are scared of their mum. The report states that they now have a good relationship with their mother and that I should move to the UK. I want to know what children they interviewed for this report cause it wasn't his! They go to court Monday and we still have 200+ pages of evidence as to why the boys need to live with us in USA. This report just blindsided us and I'm trying very hard to not mope around. Please send good thoughts our way and I'll let you know what happens on Monday.

Clearly, they are living in Upside-Down, Opposite, Backward World, which is a different world than the boys live in, so quite obviously they couldn't have interviewed the right children.

(What the hell???? So sorry to hear about this, and hoping for much better news Monday.)

I called NVC early this morning and was told that my petition was sent yesterday to U.S. Embassy of Cairo by DHL. I tried to get the tracking number, but the customer service rep. told me that he doesn't have it, and he doesn't know when It should be delivered to the embassy. Where you guys got these DHL Tracking numbers from?

Search VJ for "DHL tracking"--there is a thread where some genius VJ member explains how to find packages leaving NVC for various destinations. I never quite figured out how to do it, but the people in the thread are very helpful in searching for you if you can't get it to work. If you know when your petition was sent, it's possible to search the outbound NVC shipments for one going to your embassy. There's no way to tell 100% that it's your petition, but it's pretty likely. If you can find a probable package, you can track it via DHL and have a better idea when it reaches the embassy. Good luck!

Hey all...i'm hoping someone can give me a bit of advice here but it's a bit of a unique situation so appreciate if no-one knows!!! There is a chance that Jason will have an opportunity to change jobs in October...my interview is November 1st! Obviously our affidavit is based on his current employment. There's no worries about finance. He's currently about 6x the threshold and would be getting an increase but he would obviously not have pay stubs from his current job if he changes and might even be cutting it close to do a new affidavit/employer letter! Should we avoid this happening? He could stay put and give a start date end November/beginning of December but if it's too good to turn down then he can't really wait!

Any advice or thoughts would be welcome Thanks!

Why would the start date have to be late November/early December? As long as it's after Nov. 1, I don't see a problem. That would probably be the simplest way to do it, if you don't want the added hassle of redoing all the paystubs/employer letters you've already done. Also, if he's been at his job for a while, it would probably look better to be able to show employment of longer duration at the interview.

Guys,
When you call NVC to ask If they received your approved petition, what do you exactly ask about?

They won't really give you much of a chance to say anything. Once you get connected to a live person, you'll start being asked questions, starting with your receipt #--if the person asks anything more than that, that means the NVC has your petition (they will ask for your and the beneficiary's names and DOBs if they have your petition). After they confirm all of that, they will tell you the case # and possibly let you know when it is being sent to the embassy. If not, you can call back a day or two later and ask for that information.

K-1 Fiance(e) Visa Case Filing and Progress ReportsAny February 2012 filers?

AAAAAAH!!! Most definitely!!!

And about booking the ticket before our interview result... I don't know. I think we freaked out enough about the whole process while not really necessary. There is really no reason why we wouldn't get approved. Kim and I love each other, we filled everything out perfectly fine so we stopped worrying. Mostly because there is just no question about the validity of our papers. I think in the last year we've spent far to much time wondering if everything went right and after we got the forms and so back, everything was just fine. The stress must be because of such extremely big things happening to all of us. We're leaving our friends, getting married, dedicating our lives in a completely different way. We must be ####### about things but really, I truly believe that if we fill out everything truthfully and in our best knowledge, nothing really can't go wrong.
Of course I've heard the horror stories here on visajourney and I feel for them a lot. Not trying to nullify their story whatsoever!

But...even if there's no reason you wouldn't get approved, you love each other, you filled everything out perfectly fine and truthfully and in your best knowledge, there is just no question about the validity of your papers, etc. etc., having a difficult consulate means you still have to worry and worry and worry and plenty really can go wrong. That was what I was getting at. I'm terrified. If we were going through a European embassy, I probably *would* buy a ticket to save money, but if anyone wants to be horrified and scared (for me, not for yourselves), check out the Nairobi embassy thread.

Still, at least it's not, say, Lagos or Guayaquil. And at least I have the visit to focus on! 27 days!

It's so exciting that some of the February beneficiaries are really close to being on their way over! I can't believe how long we've all been at this: it's been a long, strange ride, but I'm glad to have been in this boat with all of you. May we all make it safely ashore (and soon!).

Glad to see everyone is getting interview dates and even US flight dates!

Really amazed to see people buying tickets before their interviews. I'm not nearly that brave. And it's nothing to do with the legitimacy of our relationship, and *everything* to do with the difficulty of the consulate. I am so wishing right now that we were able to be that confident of the outcome of the interview: everything after Nov. 5 is a huge question mark.

Mariya, I'm so sorry to hear your update. Please take care of yourself.

I bought my plane ticket last night to go over there for his interview!

It feels wonderful that I actually know when I'm going to see Aaron: Oct. 25!!! We're going to spend some time with his family (both his cousin's folks in central Uganda and his own people in eastern Uganda:  new photos for the interview...) before heading to Kenya for his medical exam, after which I'll fly out from Nairobi.

Plus I tacked on a few days on the way back to stop in and visit the family I au paired for in 2003. I'm connecting through Amsterdam, and it actually costs the same thing for the ticket with or without the extra stop, so why not? I haven't been to visit them since I started going to Uganda every chance I get--2009, I think? The little 4.5-year-old I took care of is 14(!) now.

Great to see so much progress! We decided to stop trying for an earlier interview date and start planning around the Nov. 5 one we have scheduled already. I scheduled his medical exam for Oct. 31, and I am going to fly in the previous week so that we can spend some time with his family before we travel to Nairobi for the interview.

So, lots of preparation to do! And my 2nd ("summer") job decided that they have enough funding to keep me on as long as I want to stay and would really like the extra help, so my schedule is still insane. It helps to think that this could be our last full month apart, though!

Ughhh now I'm worried about being together for Christmas.

Yeah, I'm back to being-afraid-to-make-any-projections-at-all land. Thanksgiving, Christmas, Groundhog Day...sometime. He'll get here sometime. Really dragging right now.
