I sent them the engagement ring and wedding reception contract (and cancelled check) in our I-129F. I like to think that it helped our speedy approval, but that might just be a fluke. I plan on sending those abroad for the interview as well though.

PS - I didn't send them the actual engagment ring, lol. Just the receipt.

No worries. The whole K-1 process puts a lot of strain on a person, and a lot of people don't want the stress of wedding planning on top of that, which is completely understandable. But I'm pretty low-key about the whole thing (i.e. not a Bridezilla) and we want a church wedding, which we really didn't want to compromise just because he's not a U.S. citizen.

Just remember the thing about getting those FLEXIBLE CONTRACTS IN WRITING and you should be fine.

You can have your amazing wedding (which does require advance planning and money), don't let everyone tell you that you have to do it quickie-style if you don't want to, SMASHROX, though it's certainly an attractive option for many.

I would make sure, however, that when you're contracting for services and goods, you get written contracts which are flexible about postponing the date. A lot of deposits are non-refundable, but even if it's non-refundable, it should be fine to contract for goods and services if you can change the date if need be.

I sent in October and set my wedding date for August 16, as I wanted to have a traditional wedding and wanted to plan ahead. I'm a bit of a gambler though.

But it looks like we'll be okay - just got our NOA2. I would give yourself till the end of the year though (maybe closer to November than September) if you really want to set a date.

I'm an attorney, and I can honestly say, you don't need me or anyone else to do this petition for you. I don't want to be made extinct dry.gif and there are lots of immigration matters where attorneys can come in handy (usually business related), but this isn't one of them.

Read all the guides on this website and triple check your application to make sure you have everything on there. Be honest about everything. Many of the delays are usually because a person omitted a prior address or place of employment or didn't have all the divorce decree stuff together.

I am really sorry for those of you that have had bad experiences with your attorneys. Unfortunately, I have seen a high level of incompetence and a low level of customer service in the immigration field. This is not official legal advice, but here's the thing from an attorney (albeit a new one) who filed her K-1 herself and helps others to do the same. If you have a relatively straightforward case, it makes sense to file the K-1 application yourself and use the money you saved on attorney's fees to visit your fiance. BUT, there are instances where I recommend you seek COMPETENT legal counsel prior to filing:

1. You don't speak/read English well. There are tons of little details, etc. in the filing process and it requires a keen eye and a good understanding For detail. In this case, I think it is well worth the money to hire a competent attorney.

2. There are "red flags": previously married to a US citizen, prior visa overstays, high number of K-1 applicants from the region, high incidences of fraud in the region, criminal histories, lack of evidence that you are a bonafide couple, etc.

Finally, before shelling out the money for an attorney, I suggest you spend $50 for a consultation, give a succinct explanation of your case and some of the relevant facts and "red flags," and ask a number of questions:

1. How often will I receive updates from you regarding my case? Are you readily accessible by phone or email?

2. What can you do for me that I cannot do by following the instructions and filing the I-129F myself?

3. Will you charge a flat fee for your service, and if so, what level of attention will that entitle me to? Will you handle RFEs and other requests from USCIS?

I’m writing for some friends of mine, in hopes that someone reading this has been in similar circumstances and can offer suggestions as to best handle the following situation. Here’s the story:

Marco came here to the States from Brazil , on a tourist visa. I do believe he overstayed the visa (probably more than a year…). While here, Marco met and fell in love with Lisa – a U.S. citizen. They’ve been together for about a year and a half now. About a month ago, Marco had to go back to Brazil , as his dad was very ill (and passed away a several days after Marco got home). Lisa and Marco had been thinking about getting married, but hadn’t made any solid plans. Now they’re wondering: Should they go ahead and file for Marco to come back on a fiancé visa? Is this possible? Or should they get married in Brazil and then file for a spousal visa?

Is Marco automatically doomed, seeing that he overstayed his last visa??? He wasn't deported - he left on his own...if it matters.

I'm a relative newbie too, but the answer to your question is yes, if you decide to pursue the I-130 route. You could always choose to withdraw your I-130 once you get a K3 for your spouse. (Or do people just simply ignore it?? I don't know.) But as you may know, with K3, you have to apply for an AOS, whereas with I-130 you get a greencard directly.



Hum... I don't think you can withdraw the I-130, Joe. In fact, you have to file it even before you can send in the I-129 for a K3. I think it's a matter of "stalling" the I-130 if indeed my husband is granted a K3. But the question still remains: Will he have to go back to Australia for the interview if he comes here on a K3? I thought the interview would take place here, if he's here. But I've seen two different posts (including this one here we're tailing on), where people talk about going back to the spouse's country for the interview, if they are in the U.S. on a K3.



He would not have to go to Sydney for the interview, it is just an option. The other option is to AOS so that he would have the interview in the US. More paperwork, more time waiting. We'd rather not go that route so that we can get it all done with ASAP. ;)

The best thing to do is look at other people's timelines and see what is happening at your Embassy. Right now it is looking like we will probably get our I130 interview sometime around October. (We will be coming back to the UK rather than AOS since it is quicker)

I opened my e-mail this morning thinking I was going to see "RFE" but I really got a letter of APPROVAL for my I-130! Yipeeeeee! I was gathering the forms for Packet 3 because I figured I might as well get Darcy started on the forms he needs to fill out. Well I was reading through DS-230 Part I. Question #20 says "List below all places you have lived for at least six months since reaching the age of 16." Well he is going to freak. He has moved over 25 times in his lifetime. I realize it is after he was 16 but I can guarantee they won't all fit on this form and will have to attach a sheet.

This will just make his day....NOT! :P

Great to hear that yours went through without a hitch. I think I'll follow suit and send mine in, as is. (And not sign my continuation pages, as this will call attention to the fact that my husband didn't sign his!) After all, the official forms that the pages are attached to have our signatures. I should think that would suffice!

Hello all,

I was just about to assemble and mail out my I-130, when I noticed that, according to the I-130's general filing instructions, continuation pages (needed to complete items, such as employement history, etc., if one runs out of room) are to be signed and dated. I do indeed have a continuation page attached to my petition, but somehow I had missed this "signature needed" detail. Okay, glad I caught this before shipping everything out. But then I realized, both my husband and I have continuation pages attached to our G-325a forms, and mine is easy enough to sign, but hubby's continuation page does not have a signature, and, well, he's 12,000 miles away. He pre-signed all four copies of the G-325a, when we were together in Australia last month, but he didn't fill in the form at that time, as I had volunteered to do the job once I got back to the States.

We didn't give the forms a second look, as we were too busy looking at each other :P So we missed the point that all four pages were to be submitted. Oh, THAT'S WHY 4 pages printed out...I had him sign all four pages, thinking the other three were "spare" copies, silly me! Good thing I had him sign all of those "spare" copies. So it worked out, after all, though I had to fill in all four copies by hand...UGH. But the question is, does he need to sign the continuation page that's attached to the G-325a? There are no instructions for the G-325a, no mention that a continuation page should be signed and dated, but should we play by the same rules as the I-130, to be safe? Or is it really such a big deal?

Oh, all these details :wacko:

Gotta share: Got back from lunch today, back to my dreary corporate cube, and decided to login to USCIS for the umpteenth time this month...BEHOLD! Touched last night, I knew, but again today...so I click on my case number and nearly fell outa my chair when I read: "This case has been approved. On August 21, 2006, an approval notice was mailed." Hubby just happen to call me, right as I was clicking my way to the website. What timing!!! So great to share with him, at that very moment.

So, we did it! Paul went for the interview yesterday (Friday the 13th..heehee), and walked out with his "Welcome to America" paperwork! Yippee-Yahoo! Just some loose ends to tie up in Oz, and he'll be on his way home. We're shooting for his arrival on the weekend of May 12th, as our anniversary is on Sunday, May 13th.

Well, this is Luis...I'm sort of a noob in the asking stuff...Laura is the one that handles much more of the forums and stuff. But she is netless at the momment and I have a few quesitons regarding the I-134 :blush:

1) My dad is co-sponsoring but he has 5 dependents including me my mom and 2 sis. So there's not enough space for all in the form. So my question. He should file 2 forms? and if so he has to fill all out and sign again?

2) I have to print this form and fill it out by pen? cus I can't seem to write on it like the I-29 one.

Hello Luis and welcome to VJ! I think you're referring to Question #8 on the I-134, yes? I see that there's room to list 3 dependents. What I would do: List the first two, and then in the box for the 3rd, write (or type) "Continued - Please see attached." And then attach a piece of paper to this particular page of the I-134 with the rest of the gang listed. Maybe type some sort of heading on the page like "Item #8, Continued".
