If you marry in the Philippines, you will need to get an Avadavit from the US consulate in Cebu or Manila embassy for elibility of marriage. You then need to submit it to the town government in which you plan on marrying in and wait 10 days and attend some marriage counseling classes. Then you can get married there.
If you have been divorced before, which it does not sound like the case, then you must have certified copies of your divorce decree to submitt to the consulate and town in which you are getting married in. I have heard since then, that some towns want more than what I had to obtain from the US consulate. I heard that it depends on where you are getting married in the Philippines.

The advantage of being married already makes it easier to get here after the NOA2 has been issued and the NVC has processed the paperwork for the interview. The CO does not have as much power on CR1 visa's after the NVC has approved the visa. The only way the CO can deny the visa is prove that whatever was previously provided to the NVC was not truthful. The CO has to be able to prove it based on info provided at the interview. The CO then has to send the reason and proof back to the NVC. The NVC will make the final decision.
I have read so many cases where the CO is in a bad mood and denies the K1 visa based on the CO's feelings on the interview with little or no valid reason.

My wife's sister and her sisters daughter are from the Philippines as well as my wife.  My wife's sister came to the USA about 10 years ago without her daughter and then brought her daughter here about 5 years ago when her daughter was 16 y.o.  Her daughters father was never in the picture from birth.  I don't believe she had to obtain permission from her daughters father because her daughter was raised without the father ever being in the picture.  In fact, her daughters last name is the same as her mothers family name.  You need to find out what you need to do to obtain permission from the Philippine government.  Besides, it will cost you much less than needing to do a DNA test that will prove that your Fiancee is not the father.  The last thing you want to do is lie about anything.  It will backfire on you.  The US gov just cares about honesty.  You lie, and get caught, the US gov may give you a lifetime ban to the USA.

I sent in transcripts because they are official documents directly from the IRS.  Transcripts are better because they actually prove that you filed with the IRS.  

Transcripts is what I provided for each step of the process for my wife.  We are at the Citizenship phase and again, I had to submit transcripts for my tax returns.  

You do not need to worry because it is better than sending copies of your original tax return that can be easily faked.  Transcripts are better.

You can request the last 3 years of your IRS tax returns from the IRS.  It is easy to do and you can have them within 2 weeks.  You should keep a copy of the tax returns or you will need to request them again when applying for a 10 year green card.  Go to IRS website to request tax returns.

My wife and I were married in the Philippines therefore we went the CR1 route.  It takes about 10 months from the time you file the I-130 to get her here in the USA.  The timelines for the CR1 process should be very close to that time frame.  It takes about 5 months to approve the I-130 at the USCIS.  Once approved, the paperwork is forwarded to the NVC where it takes about another 5 months to get her interview.  Then two more weeks to get her Visa package sent to her home.  The good news about this process is it is actually cheaper overall than the K1 process.  It just takes longer and she can work after she gets her green card (2 weeks after arriving in US).  

 

If you decide to marry her in the Philippines, you will need to get an affidavit of eligibility to marry her from the the US Embassy in Manila or at the US Consulate in Cebu (lower level of the Waterfront Hotel is where its located).  If you have never been married, I just think you need to swear to that when obtaining affidavit but if you have been married, you will need to bring original or certificated copy of divorce decree with you.  Do not give them the original copy.  Have a copy and retain the original.

After you have the affidavit of eligibility, you will need to take that to the city office and apply for a marriage license.  Then you have to wait 10 days before you are eligible to marry and most towns require you to attend marriage seminar for one day.  Not a big deal.  Its more intended to prepare locals on the responsibility of marriage, etc.

Once married, your wife will need to obtain copies of the marriage certificate from the NSO in the Philippines.  She will then also want to get her new passport with her married name.  She will also need to get certified copy of birth certificate for her.  I recommend getting multiple copies of each (3 each).  She and you will need these for the I-130 and for her interview at US embassy in Manila.

It took about 1-1/2 months after we were married to obtain a marriage certificate from the NSO.  

She will also need to get a police certificate from the NBI in the Philippines for the I-130 to ensure that she does not have a criminal pass.

 

I recommend the CR1 because I have read too many times on this website where the Philippines will not approve co-sponsor for a K1 but they have no choice because that is not determined by them for the CR1 process.  That is done here in the USA at the NVC.

You need to find out if Vietnam Embassy will approve K1 with co-sponsor. The Philippines will not approve a K1 filer that needs a co-sponsor. I have read too many K-1 filers in Philippines getting rejected because of the need for a co-sponsor.
If you file a CR-1, prepare to wait approximately 10 months from NOA1 to interview. The good news it once the USCIS approves the petition and everything is truthfully disclosed, you should have no problems during interview for the CR1 visa.
You should seriously consider the CR1 route.
For me, the income was never an issue during the CR1 process. I have a few years on you.

I would like to inform everyone that contacting your Congressman or State Senator helps when your petition at the USCIS exceeds the time guidelines.
During my wifes interview at Manila Embassy, the interviewer brought up that her husband must want you in the USA very badly because he contacted his State Senator during the process.
Yes, I contacted my state Senator, which is Scott Brown (newly elected to position after Ted Kenedy passed away) and he helped get my petition at the USCIS approved quicker. The petition was approved the day after I contacted my Senator. The guideline for processing the petition at the USCIS is 5 months. Once the USCIS exceeds that 5 month time frame, your Senator or Congressman is then willing to get involved.

So if your petition has exceeded 5 months, contact your Senator or Congressman for help. Both have websites and on the websites it will have a tab or folder (or whatever you want to call it) for Visa help.

You can do what I did. I contacted my Senator because he is a Republican and I am a registered Republican and I told him that I voted for him and that I would appreciate if he now helped me. He was just elected to office this past fall. His name is Scott Brown. He did help us because it was brought up by the inteviewer at the embassy during my wifes interview. The interviewer stated that I must want my wife in the USA very quickly because I had contacted my Senator.

I agree that you should contact both like the others have stated.

Remember either will not do anything for you if at the time you contact them via their websites is less than the minimum 5 month wait period at the USCIS.

I would focus more on what type of plane I was flying on rather than what airlines.  You should try to focus on a booking a flight on a Boeing 777 rather than an old 747 or something else that has not been updated.  You will not enjoy flying Delta in the USA if you have to catch a flight between New York and Miss.  It is like being cattle hearded.  They pack them with very little leg room.

 

If you get American Airlines or any airline on a Boeing 777 direct from Europe to Dallas Fort Worth, you will be better off regardless.  The connecting flight from Dallas Fort Worth over to Miss will be a very short flight so it won't matter what kind of plane you will be on for the connecting flight.

I am mad as hell with the NVC. My first DS230 packet arrived at the NVC on 12/15/2010 based on USPS tracking signature. On 12/23/2010, I received an email that they are waiting on the DS230 packet to complete the processing. I called them several times and they assurd me that if it arrived based on tracking performed by the USPS, that it was there and that they receive a lot of mail. I did not feel comfortable with that statement so I had my wife send my the required DS230 docmentation and certificates from her country via Fedex. I mailed the new DS230 packet Saturday and it arrived at the NVC yesterday because they entered in ito the system Tuesday (today).
I am glad that I had my wife get two original documents of everything in the event something like this occurred. It was just a matter of her sending it to me which took a week via FEDEX and then me submitting it again to the NVC.
I highly recommend when getting certified birth certificates, marriage certificate, Police certificate, etc. that you have your spouse obtain at least two of each. That did save us a lot of time having two of everything already.
The NVC cost us at least 3 weeks longer of being a part. It could have been much longer if I had trusted their word that they have it some where in their system.
Word to the wise, have multiple certified documents already available and if it does not get put into the system and show up under your NVC number within 3 days from when it arrived at the NVC, then assume that they lost it.

If you have to pay it again, I suggest you pay it online at the NVC via a checking account. That is the fastest and safest way to do it. I paid online and it quickly cleared my checking account and within a few days it appeared as paid.

You should never rely on the USPS when sending money orders or anything important.

Forget about processing a K3 visa. It will die at the NVC. You need to pursue the I-130 application only for a IR1/CR1 Visa. The CR1 visa is for couples married less than 2 years.
It takes 5 months at the USCIS for your NOA2 approval and it takes another 5 months between the USCIS NOA2 and the interview date. You may be able to shave off a month. If you are military, you can get it expedited which is a lot faster.

Clarification:  Typically when filing for a CR1 petition, the NVC schedules the appointment at the Manila Embassy.  This differs from the K1 process where the embassy schedules the appointment for K1 a visa.

It looks like you are set with your interview appointment at the US Embassy in Manila.  You should take a copy of the letter from the NVC to Saint Lukes and get your medical done as soon as possible.

That is what my wife did.  She had no issues but many woman in the Philippines need additional TB testing due to questionable chest X-rays which can easily add a  month to the process.

Plan on 10 months to 12 months from NOA1 to interview. That way you won't be disappointed if it takes a year.

Are you sure it is a K3 visa? Your timeline shows that you applied for a CR1 visa. If that is the case, then your interview should be for a CR1 visa, not a K3 visa. K3 visas die at the NVC if the CR1 visa is already being processed.
Besides the path from a CR1 visa to a permanent 10 year green card is less expensive and less hassle.

You should also be prepared for a long wait. The USCIS process takes a minimum of 5 months. This week it will be 5 months waiting for my NOA2 and I have heard nothing from the USCIS. Then you will have to wait another approximately 3 months from the time you receive your NOA2 to getting your wife here to the USA. The CR1 process takes longer than the K1 process and based on Visa Journey.com, the K3 process is no longer an available method of getting your spouse here sooner. So plan on 8 months from the time you submit your paper work until you get your bride here to the USA.

I just hope I will see the NOA2 soon from the USCIS.

You will also need to complete DS230 and send it to him.
You will need a police clearance from the NBI that is good for 1 year also.
I recommend getting two certified copies of each.
You will need to obtain certified birth certificates
He will also need certified birth certificates and divorce decrees
Just follow the process and look to visa journey for help.
You do not need an attorney.
Because you want to bring son to US, you will need approval of father if he is on birth certificate or was involved with raising the child.

It is a 10 month on average process.
Sometimes the process takes longer because of the medical in Manila. They seem to fail conservatively when checking for TB. They often require aditional testing that delays you in getting the visa. You can read a lot on visa journey about that also.
