This is not required but you can send it as extra evidence. You may want to use affidavits from family members intstead. Like those who attended the wedding.

I filed married/separate. Did not need to get ITIN for my husband or have him sign anything. Just put NRA (non-resident alien) in place of a SSN and mailed to the IRS. No problems.

Yes he will have to file seperate for the wife and stepson. He will also have to pay the $420 twice. I am currently doing this as well but for two step daughters. Everything is separate but you can mail them in together in the same package and include a letter requesting that they be processed together. I am currently waiting for my NOA2 but from what I have been told everything is separate as far as fees except for when you do the AOS (affidavit of support) payment. If done online I have been told you can get away with paying the $88 fee once. Good luck to your friend.

IR-1 / CR-1 Spouse Visa Process & ProceduresAOS Help Please

Still best to file two I-864 forms and for Mother to state only her own personal income and document it with tax return copies and W2 forms. In addition, current income can be documented with a pay stub.

In the I864A, my father only included his income, not my mother's and supported it with IRS transcripts, W'2s and paystubs. I read the instructions hundreds of times and extensively, and it seemed this was the only option since we live under the same address. I suppose it can be done both ways.

IR-1 / CR-1 Spouse Visa Process & Proceduresi am chance with this proof of relation ?

I think it is enough to provide the marriage certificate. But certainly bring photos if you can. My wife and I are not the type to take photos of us so we only have about six! But I'm not worried. We are legally married. Unless there's another reason for a yellow or red flag, it is not the same as having to prove a relationship like a fiance visa. I have also read on this site that other couples only provided their marriage certificate and they got their visa. But bring "more evidence" if it will make you feel better. You never know, right?

This can lead to disaster and a Denial. Just because you have a real marriage doesn't mean that the Consulate will believe it. The burden of proof is on you. Please be careful with posting this type of advice because this misinformation can ruin someones chances of getting their Visa to be with their wife/husband. That would be devastating.

IR-1 / CR-1 Spouse Visa Process & Proceduresi am chance with this proof of relation ?
Hello. How are you doing? You should have your wife come on to this website to gather information and ask questions also. She will have to gather much of relationship evidence on her end and of course that you gather relationship evidence too. There's a lot of information here on Visajourney. You can also lookin the "GUIDES" Section at the top of this page under CR-1 Visa. I see you put yourself down as K-3 Visa, but that does not exist anymore. It would be CR-1 Visa. This is why you should have you wife come on here since she made the original petition. Also it will be good for you both to know what steps you need to do next in your immigration process. Good Luck.

They give him six months to leave DR and come to U.S.A. If he lets this time pass and does not use the visa, I'm pretty sure it is revoked. The green card will expire in two years, and then you have to remove conditions (more paperwork) and he will then get a 10 year green card. He is elegible to become a citizen in 3 years. I hope that helps!

Congrats again!

Let's say he has to travel back to DR for whatever reason, wouldn't he need his passport??

My husband and I have been married for less than a year. He has been approved for his visa and will be flying in 9 days!!  His visa states it expires March 15th, 2012. Does that means he receives a new visa with a different expiration date once he enters the US?? :help:

Also I have heard that his green card will expire in 2 years...is this true?? If so, does he have to re-apply for his green card and when does applying for citizenship come in affect?

I believe that it is approved/denied/red flagged before interview is given. I saw the green card when we deposited our papers. Also during the interview after we were asked our names, the CO asked my husband to sign a form than the CO approved it before asking any other questions. I also brought a recent affidavit, copies of all the evidence, petitions, 200+ photos and all he looked at was my passport and wedding pictures which I had a separate folder.

IR-1 / CR-1 Spouse Visa Process & ProceduresAffidavit of support without a steady income...

greetings!
I am trying to bring my Costa Rican boyfriend to the usa so i have decided to marry him in Costa Rica and then apply for a CR-1 Visa. I am aware that I have to show an Affidavit of Support. My issue is that I have spent the past 2 years teaching english abroad and volunteering (without legal papers and definitley under the USA poverty line.) When i come visit home I usually substitute teach and waitress while in town to make money. However I do have a big chunnk of change in the bank so I'm thinking this may help me? I'm not sure how to prove that although i do not make a steady income of 18,000- since I have been living outside the usa- we will not have monetary issues. Help! thanks

just find a someone to boyfriend sponsor. Anybody can be your sponsor as long they're employed and is making enought money.

IR-1 / CR-1 Spouse Visa Process & ProceduresI 130 specifics

Hello all! I'm new to VJ and am very happy I stumbled on to the site it is giving me hope.

Basically, I filed for the 1 130 for my husband and received the NOA1 on 9/19/12... Hopefully I will have my NOA2 soon...fingers crossed.

I am wondering about the part when the US embassy in Costa Rica tries to contact my beneficiary to give him the packet. It makes sense that they wouldn't try to mail it because that wouldn't be very reliable. I read somewhere on here that they will call my husband and tell him to come pick it up. Is this correct? If so how do I update his contact info and phone number, he has a different number now than the one on the biographic data paper? Will they send me a copy of the packet? And lastly is it in English? If it is how will he know what to do with it...

I'm also wondering if I can go to an infopass appointment for the above reason, I really just want to talk to a person face to face and have them tell me things are progressing, you know?

Any insight would be greatly appreciated. Thank you all!

Last thing: how do I add my timeline to the end of my posts like most people do?

I got my NOA2 back at the end of December, and it took about a 10 days (which included New Years) to get the consulate in San Jose. What you can do is call the NVC once you get your NOA2, and they will ask for your spouse's email address and can also confirm the phone number (I also assume change it). What happened with me in regards to the consulate contacting us is-- first they tried calling Daniel, who did not answer because he does not have cell phone reception where he works. They almost immediately sent me an email afterwards letting me know they had tried to get a hold of him, that his packet was waiting for us. After that, it was up to us to get a hold of the consulate. (Keep in mind, they have very restricted hours when you can call... something like between 9-11 am four days a week.) And you are right, you guys have to pick up the packet from the consulate, though it is almost identical to what they send you once they receive your packet (at least which they sent to me in my case with a couple important exceptions.

Also, in case it is relevant, if your spouse is not in San Jose, someone else can pick up their packet for them. You just need to call the consulate and give the name and cédula of the person who will pick up the packet.

Good luck!

I think most people stay at El Hotel de Los Jardines (i think that is what it is called). From what I have heard it is right around the corner and the cheapest place around. Look at the reviews for the embassy in DR, I believe alot of VJers mention it in there.

Good Luck!

Yes I've read plenty of interview experiences and it looks like most people stay there, and they always say something very nice about it. Especially that it is super close to the embassy.

How did you show proof of your joint financial funds for your I-130?

We have a joint savings account at banreservas (DR). On the first page of the passbook it has the account #, my name, his name and the date the account was opened. Should I photocopy this and send it even though it's in spanish (The only thing that is in spanish is the words like account #, office, name of account holder and date account was opened) ? Or should I request a letter from a staff member at the bank saying that we have an account together, and then have that letter translated to English?

Any other ideas? :help:

Thanks everyone for info. I got all my paperwork ready for marriage in DR yesterday. They charged me $155 for the BC (the translation, apostille, legalized etc) AND the single status affidavit, which they wrote themselves. They were able to prepare the single status letter the same day I went (monday). And the BC was ready by thursday. Everyone at the consulate (Boston) was very nice and pleasant. But they killed my pocket!

BC (apostille, translated, legalized) $100
single status letter (wrote in spanish, legalized) $55

Hope this thread is helpful to others starting out.

I'm unclear as to how the Junta is making money off of requirements fulfilled in the US. The Junta had the same exact requirements as the embassy, but they never offered to help me with those requirements for any additional cost. They told us what I needed to bring with me for them to marry us, and I was on my own to get it all together with no guidance from them. The BC, apostille, translations, etc were all paid for PRIOR to my arrival in DR. The only money the Junta got from my husband was the 7000 pesos it cost for the wedding.

Well I guess he means for those that choose to get things done in DR. Like me, I am going to do my single status letter over there, and the judge that is marrying us is the one that is gonna do it for us, so I have to pay him for that besides the 7,000 pesos.

IR-1 / CR-1 Spouse Visa Process & Proceduresmarriage in dom rep
Okay so I just called the Dominican embassy here in Boston. The man I spoke to told me that it would be $155 to get my 1. BC translated and legalized 2. my single status letter: written, translated, legalized, notarized. :o I think that's a rip off!!

So then I get in contact with the judge in the town in DR where I plan to get married and he tells me that he can take care of the single status letter, and all I have to do is take my translated, apostilled and legalized BC. In addition to a copy of my passport etc. He had told my fiance's mom he would do it all for 10,000 pesos (the marriage itself you gotta pay 7,000 pesos.) but when i asked him how much was it he didn't really answer (probably since i'm american he's already plotting to charge me more   ) So basicalllyyy he told me the same things most of you have been saying about the paperwork requirements. Who would think that in a country like in DR you need all this paperwork just to get married!!

There are actually tons of people over on our forum who did not have to have half of this stuff. It really depends on who is marrying you. For example, I'm getting married down there in two weeks and I just need my passport, and birth cert. the lawyer who is doing the marriage doesn't even require an apostille. I am bringing translations and an apostille anyway just in case but for SURE you don't have to have the SSL done at the embassy. they are telling you that because they make tons of money on those. Any good attorney in the DR can do that for you for less than half the price. Of course if you call the official agencies down there like the Junta Central they are going to tell you otherwise because they want to make MONEY.

Tim, I bet your totally right that a lot of people don't require a lot of these things, but the more I ask around, the more i get the same answer, so I guess I'm just gonna spend the money and get all the dumb paperwork to be sure I get married. Your getting married in Santiago if I recall correctly, and that's a little too far for me, plus better safe than sorry.

It cost $125. You have plenty of time before your wedding, so I'm positive you can take care of it all yourself for much less. I paid it out of convenience. The nearest Embassy is more than 2 hours away from where I live. Also, I decided to get married at the very last minute...about a month before my trip, so I didn't have much time to play games. Plus it was around the holidays when a lot of places were closed for long periods of time, so I figured it was better to let someone else handle it as far as timing was concerned. You have a lot of good info here, so you should have no problems.

Definitely contact the Embassy and you might also want to have your fiance speak with the JCE. I'm not sure why, but I was never told by the Embassy that I needed to obtain anything from the Marriage License Bureau. And my husband was never told by the JCE that my single status letter had to come from any particular place. I wrote my own letter and had absolutely no problems. I used the letter I saw on the WEDO site as an example to create my own. Also, neither the Embassy or the JCE said my husband needed a single status letter. All he needed was his cedula. I would imagine they can check to see if he's single/married, but can't do the same for a USC.

I'll call the embassy and ask about the single status letter, because if that's the case my mother can notarize it for me, and then I would just have to get it legalized at the embassy. I will post the info for future members seeking responses.

I would strongly recommend that you take some time next week and go to the Dominican Embassy. That is the best thing to do. They will tell you exactly what you need and how it needs to be. When I went, they gave me a contact for a translatin service whose translations are accepted by the DR. They were a HUGE help in getting all this paperworkin order. You can't go wrong by doing this.

When I did it,I just stopped in and talked to the admin person in the front. She brought someone out to talk to me and we got all squared away.

It will make your life SO much easier if you do this.

Thanks amesa, and everyone else.

Legalization is for civil documents. It is usually a stamp on the document authenticating that it is a real, valid document used in the country of orgin.

Having a document notorized means that there is an offical person that verifies you are the person presenting the document. This is usually for personal documents that need your signature. It confirms to the entity receiving the document that you are who you say you are.

Apostilles are separate documents. They are not stamps, but a separate document that goes attached to the birth certificate, divorce certificate. YOu have to place a separate order. You need to contact the State Department of Health of the state you were born in, or divorced in, in order to get that apostille. It only comes from Department of State. I would highly recommend that you order a new original copyof your birth certificate, with an apostille. You will most likely need to send two separate payments...I did. Once you receive those documents, you need to have each one translated for the wedding.

Like I said in a previous answer, per the Dominican Embassy, you have to go to the Marriage License Bureau in your county/city and request a single status report. They will know what you are talking about. They will also notorize it for you. This will also need to be translated. It shows evidence that from the date of the report, you are still single and free to marry and will need to be given to the judge prior to your wedding ceremony with all of your other documentation. The costay vary state-to-state, but here in Miami it cost me about $7.00. This is not something you write yourself...per the Embassy.

Thanks. There is a Dominican embassy in Boston luckily. I'm glad I inquired about this early, I didn't think there was so much paperwork involved.

I asked the same question on DTTUSA and was told my BC wouldn't be necessary if I find the right person. BUT when I did a search, I found that others had to have their BC and the rest of the documents that I had. Like amesa, I decided I didn't want to take chances, so I also contacted the Dominican Embassy. I got the same information from the Embassy. I also sent my husband to the JCE to ask what I'd need in order to marry there and he was given the same information the Embassy told me. I needed a notarized single status letter, but he did NOT. All documents need to be legalized at the Embassy. I used WEDO to handle all of my paperwork. I sent them my BC with the apostille and my single status letter. They do all translations and take the documents to the Embassy to be legalized and return every thing within days.

Okay thanks guys. One of the things I'm confused about is the difference between legalized and notarized. BocaChicaBabe, what is WEDO?

Also I have my BC, but it is my original one from when I was born 21 years ago, so it's kinda wrinkly and worn out. If I go to city hall and request another one, will this one have the apostille? I'm assuming the apostille is that big star looking thing on my BC.

Also who writes the single status letter? Do I? Is there a format, or does the embassy do that.

thanks again EVERYONE. Your responses are greatly appreciated.
