The plan is for my husband to come to America with a CR-1 visa if all goes well. When he purchases his ticket, is it okay to buy only ONE WAY since he obviously plans to stay?? He doesn't need to buy ROUND-TRIP right? :star:

Husband just skyped me freaking out that we might have a problem as he is filling out the form. For #21 "If filing for your husband/wife, give last address at which you lived together'. We have never lived together so is writing in "NONE" acceptable?

Also, I have to renew passport as mine is expiring in a few months. I will be doing that fairly soon, so should I hold off until my renewed one comes in or just file the I-130 with my current passport number and adjust later?

If you have never lived with your husband, then the correct answes is "have not yet lived together". I put this on my I-130 and it was approved, no RFE's. 3 days or even 3 weeks doesn't count as living together.

All the above is correct. However, if you DO receive a checklist very soon after submitting documents, it probably crossed in the mail. No need to submit the documents twice unless you receive the checklist more than about 3 weeks after submitting the documents.



Funny thing is I never reiceved the checklist or anything from NVC requesting the DS-230 :unsure:

You can send your DS-230 package when you have it ready to go and the payment portal shows the IV bill as PAID. People in this thread who have been telling you AOS has to be sent first are grossly incorrect. At the NVC, AOS and IV are separate tracks, meaning AOS and IV are processed independently. Typically the AOS bill is invoiced first before the IV bill is invoiced, however, that does not mean the AOS has to be submitted first.

To answer another question you had, don't staple anything.

Also, if the NVC needs something from you regarding your IV package, they will issue you a checklist specifically stating what it is they need. If you do not receive a checklist for any items in the IV package, then your package has been accepted and ready to go to the next step.

Thanks but this does not specify that AOS has to be sent before DS-230. AOS just happens to be listed on the left. :unsure:

This is not true.

Once your AOS and IV fee bills show PAID online, you are free to submit either packet and it doesn't matter which is first.

We sent the DS-230 packet before the AOS and it was processed and completed 2 business days later, which I called NVC to find out.

The AOS packet was then delivered and processed in 2 days and we received a case complete.

As long as the bill is paid and you have the barcode cover sheet, you can submit either package.


Ok now I am confused, I plan to send DS-230 this week and AOS in like a month when I finish filing taxes. Still OK? :blink:

I am preparing DS-230 for my husband. I am the petitioner. Got a couple questions.

1. Should I include a cover letter? I included one with my I-130 for uscis but I don't know if this is helpful for NVC.

2. Should I staple anything?

3. Is the current address where I will be sending DS-230 to:

This document is just a transcription of your tax return, so you can't have it yet for 2012, you'll only file your 2012 taxes in the begining of 2013 :)

If you have already filed your tax return for 2011, then you can order 2011, but I guess it depends when you sent it since I think there's a delay after filing before you can obtain a return. You should probably call and ask if it's available. If not, order 2008, 2009 and 2010.

Call the IRS and request your 2010 Tax Return Transcript, ask for it to be sent via fax, this can then be forwarded to NVC instead of waiting the traditional 14 days for the mail to arrive.



So you are saying have them fax it directly to NVC? Shouldn't this be included with the rest of the AOS packet?

I translated my MC myself and then had my mother sign it at the bottom with the note saying she was able to understand and translate from spanish to english. Done. She is not an official translator and neither am I. :thumbs:

Yup have exactly one year to send AOS and DS-230 packet to NVC before they throw your case out. So do not feel rushed at all. After you send NVC the AOS and DS-230 packets they will review them both, and as long as you are not missing anything your case should be completed within a week or two, sometimes just under a week. Then depending on how busy your embassy is, interview will be scheduled 1-3 months from when the case is complete. :thumbs:

You really need to submit the pay stub(s) to substantiate your income and support your claim of employment.



Remember pay-stubs are only optional, not required. But if you have them, it won't hurt to send them in.

I also submitted my dad's w2's from the last 3 years to highlight his individual income since the IRS transcript reflects the total between him and my mother combined.

Hello, I am getting marriage next week in the Philippines to my loving Fiance! Now...

I read about the bonafide evidence of marriage thing for the I-130.

1. Documentation showing joint ownership or property; or

We don't own any property

2. A lease showing joint tenancy of a common residence; or

We have a place, but don't currently have a lease in writing. We do have pay receipt though with both our names.

3. Documentation showing co-mingling of financialresources; or

I guess we can open a joint bank account in the philippines after getting married?

4. Birth certificate(s) of child(ren) born to you, the petitioner, and your spouse together; or

We have none

5. Affidavits sworn to or affirmed by third parties havingpersonal knowledge of the bona fides of the maritalrelationship (Each affidavit must contain the full nameand address, date and place of birth of the person makingthe affidavit, his or her relationship to the petitioner ofbeneficiary, if any, and complete information and detailsexplaining how the person acquired his or herknowledge of your marriage); or

Do family members count? What does that mean Sworn or affirmed by third parties?

6. Any other relevant documentation to establish that thereis an ongoing marital union.
We're going to take pictures and a video of our civil ceremony. Do I put the video on a Flash Drive or something too?

Any advice from someone with experience here would be great!

- You can send them the receipts with both names of the property.

- Sworn affidavits can be made by family members. I had my Godmother write me one since she was a witness at the wedding. It can be anyone aware of your relationship.

- Do not bother with the flash drive, they WILL NOT view it.

- If you can open a joint account, do so. It is good evidence, not only for I-130 but for the interview in the long run.

- Lastly, send a couple of photos. Do not go crazy with it, as it is not necessary.


I sent the following evidence with my I-130 and it was appproved without any RFE's: MC, 1 sworn affidavit, 5 photos, joint bank account evidence, copies of passport stamps indicating visits.
