IR-1 / CR-1 Spouse Visa Process & ProceduresWhat are the main reasons for a visa denial?
My concern is that, because I don't see many K3's on this site, its difficult for me to compare or get a good idea of how this will be treated/recognized once we are at the interview. Our marriage is as bona fide as it gets, i visit him every 6 weeks, we have over 200 pictures from different occasions, an endless amount of communication exchanges, etc.......should i be concerned?
[/quote]

You go visit every 6 weeks?!! I don't think you have anything to worry about. Just stay confident and prepare yourselves with all the evidence you have. Put your game face on!

IR-1 / CR-1 Spouse Visa Process & ProceduresRecommendations on Attorneys for Spouse Immigrant Petition
Like EVERYONE said, unless you have complications with immigration or anything funky. Do it yourself!! Honestly this process is not that difficult if you can read and follow directions. And with a website like this, there is no way you can really mess up. Don't be shy and ask all the questions you need to. Save your money, you will need it for the process anyway. :star:

Affidavita may be helpful but not totally going to make or break your petition. I only sent one from a family member. Your list looks good. I sent way less evidence with my I-130 and was approved without any RFE's. Good Luck. :star:

IR-1 / CR-1 Spouse Visa Process & ProceduresEvidence of Bona Fides for Consular Processing of I-130
Hi mesh,

my petition was just approved last week after a little over 4 weeks after NOA1. For evidence I sent:

1. Marriage Certficate
2. 1 Affidavit from a family member
3. 5 photos
4. Evidence of a joint account

I was approved without any RFE's and fast as you can see. I also have a friend who sent only her MC and was approved without any RFE's. There is a lot of debate about this, whether to frontload your petition or not. Personally I feel, the more you send, the more there is to look over, so the more time it takes to review and approve the petition. Send enough, but don't over-do it!!

Best of luck. :star:

Today I submitted my I-130 along with copies of translated and Urdu nikkah nama.

few more questions.
what is next step, and how long will it take?

Could I also delay this process?
If yes, then what will be suitable stage?

I read your signature and it says you got RFE request. what was that?

After you get NOA2 you can delay paying fees and/or sending the documents that NVC will request to delay process if need be. I am doing that myself because I was not expecting NOA2 to come so soon. You have up to a year to send documents to NVC. But like someone said visas for middle eastern countries take a very long time, after interview there is a mandatory period of AP, which seems to take very long. Other MENA members can tell you more, i'm not familiar with it too much. So think wisely.

Thanks Now I understand why it goes that fast. I will become US citizen in couple month if god want. I have to take the test next mont, hopefully everything go good. Thanks to everyone.

I have another question:
Does my petition status will stop as it is now until the visa is available?

Like do you mean is your petition gonna basically sit around till a visa becomes available, yes. When you become a citizen let them know.

It can take many years for a visa to become available for your wife since you are a permanent resident. The timelines that you see moving quick are that of US CITIZENS filing for CR-1 visas. As harsh as it sounds, you will be waiting a long time. Hope this helps. :star:

IR-1 / CR-1 Spouse Visa Process & ProceduresOriginal documents vs copies

Stephanie, you are so lucky, did u expedite your petition? From NO1 to N02 was really quick, can u please share some tips.

Thanks a lot

I don't really have any tips. I just got lucky, my petition was sent to VSC and they seem to be working really fast recently. I prepared my petition with care and caution to make sure everything was right. That is all. No expedite.

IR-1 / CR-1 Spouse Visa Process & ProceduresOriginal documents vs copies

"NOTE: If the applicant or petitioner has already submitted the original document to the USCIS in connection with another matter, he or she may submit a photocopy along with an explanation of when and why the original was previously sent to the USCIS.

For all other documents, the applicant may submit a photocopy of the document required; however, he or she may be required to present the original:

in person, upon the request of a USCIS or consular official during an interview, or

by mail, in response to a written request from USCIS.
An original document submitted under these circumstances will be returned to the petitioner or applicant when no longer required"

This is what I was referring to from the uscis website. I didn't understand how I could send a copy of original M.C with my wife's and and original with my step-child, unless I get two originals. I didn't think evidence needed to be sent with the DS-230?
Matt

Last time I checked they do not require any additional evidence. You will need excessive evidence for the interview.

I translated my MC myself and had my mother sign it. It is not required to be notarized or translated by any "official fancy translator". As far as the stamps I just listed what the stamp said and made the translation as similar to the original as possible.

IR-1 / CR-1 Spouse Visa Process & ProceduresK1 or CR1?
K-1 is a bit faster (not always). The best thing about CR-1 is that it is less expensive in the long run, and your husband will be able to work a few short weeks after arriving in the U.S.A. (big plus) Keep in mind that K-1 visa has recently not been significantly faster than CR-1. There are some guides here further explaning the difference between the two, I can't find the link right now, but I've seen it before. Personally I would go with CR-1, but only you know what is best for you.

Good Luck. :star:

IR-1 / CR-1 Spouse Visa Process & ProceduresNVC docs need to be translated to english??

"Translation Requirements

All documents not written in English, or in the official language of the country in which application for a visa is being made, must be accompanied by certified translations and submitted to the NVC. The translation must include a statement signed by the translator stating that the:

Translation is accurate, and
Translator is competent to translate."

I got this off the NVC website. I was also under the impression that everything(M.C, B.C) not in english must be translated into english. But this appears to say that it's not necessary if the official language of the country is the same as the language on the M.C and B.C. I have the documents translated anyway but I was always under the impression that the documents HAD to be translated. I guess not.
Matt

Thank you so much Matt. I had been looking for the official text but couldn't find it. This is very helpful.

Stephanie...hey girl how are you? That I am aware everything must be translated. Do you have copies of the translations that you sent to USCIS for the I130? If so then you can use those same translations. Keep me posted on your process so I can have an idea when my turn comes....hoping and praying anytime soon!

For uscis I only translated the MC not my husband's BC since it wasnt needed. Alia look at the post below from a fellow DR member. I'm gonna follow her advice because last time I checked there is no need to translate to english.

Girl, you don't need to translate any document into english, I already send out my Package to the NVC without translating the BC & MC, and did not get anything back about it, I just got my interview date... :D
The interview is going to take place at the US Embassy in DR, and the documents are in the official language of that country.
Also I read someone that had an interview (in DR) and she said, she saw how the CO took out the translation from the BC & MC and put it in the garbage.

I hope This Helped you out!!!!

Thank you!!! I knew I wasnt crazy! I will double check with NVC before sending everything in, but I doubt I will be translating everything. Why make more work for myself if not needed?

IR-1 / CR-1 Spouse Visa Process & ProceduresNVC docs need to be translated to english??
I was under the impression that as long as the documents sent to NVC (MC, beneficiary BC) were in the language of the embassy where your interview and beneficiary are located in then they do not need to be translated. Someone told me they do need to be translated though. Anybody that went through this recently, preferably in DR know the answer?

IR-1 / CR-1 Spouse Visa Process & Proceduressilly question...married name or maiden name?
As long as you provide your MC which is the proof that you are married then what name you use doesn't really matter. Like the person above me said, they know all the documents might not be changed to your new last name right away, this takes time to change everything. Don't lose sleep over this!

Personally I have chosen to wait till this entire process is over to change my last name, so I have used my maiden name on everything and will continue to do so until my husband does POE and this is all over. Just makes things less complicated, I think, but you are welcome to do as you please.

You are welcome to change your last name after you send the I-130, it's okay.

IR-1 / CR-1 Spouse Visa Process & ProceduresTranslation of Birth Certificate

The short answer to your question is yes.

Now for the long answer: You can translate the certificate yourself, but it may be best to have a friend who is bilingual look it over and then sign the required attestation statement.

Lastly, check with the Embassy in Stockholm (where the interview will take place) to see if document translations are required. Some IV units do not require document translations if the document is in the language of the country. If Stockholm does not require document translations, then you will not be required to submit translations to the NVC.

This is all true. There is no need for an "official" translator to do this. Do it yourself, have a friend look over it and sign off on it. And yes, research if a translation is even necessary before driving yourself crazy. :star:

IR-1 / CR-1 Spouse Visa Process & Procedurespassport. single vs married
For DR members, I need your help.

I had my husband get his passport BEFORE we were married since I figured he should get it out of the way asap since we would need it in the long run. There is no fine print on the passport where it says he is single vs married, but he claims all of this info can be obtained from the bar code on the passport. My mother in law also keeps INSISTING that he will have to get another passport and pay all the fees again because he had gotten the passport he has now while he was single.

Personally I don´t think it matters, is it really a big deal? Will he really have to pay again to get a whole new one even though there is no fine print on the passport with his status. I would like to figure this out before I leave DR in a couple of days. I know people are gonna say just get a new one to be sure, but its expensive to get a new passport and I hate doing unnecessary things, so only answers from people who know what they are talking about. Thanks!!
