Just curious, are you eligible to do another petition if CR-1 is denied? I know when K-1 visas are denied the couple will marry and try again, but what happens when you are already married?

Keep in mind that the interview isn't in London. While the petitioner being at the interview in London "doesn't gain you more points", at some consulates such as Guangzhou, it absolutely does gain you points and for some consulates can be a requirement.



This is true, I am not sure about Peru but in my case, when my husband gets his interview, I MUST be present or he will be denied. Every country is different.

Yea they need these documents but they need to be ORIGiNAL. Read one of the guides. The documents NVC requests are not the exact same you sent to uscis. If I remember correctly the only document that is the same is the MC, but it has to be original. The guides will help you.

Sometimes things happen, documents get lost, they are requested again. So it's a smart and good idea to have those documents ready. JUST IN CASE.

Once you said that, Today I went to check mine on USCIS website after I've been received on 2011-10-11 my I-I130 NOA1 and it says "On October 31, 2011, we mailed you a notice that we have approved this I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN. Please follow any instructions on the notice. If you move before you receive the notice, call customer service at 1-800-375-5283.

For approved applications/petitions, post-decision activity may include USCIS sending notification of the approved application/petition to the National Visa Center or the Department of State. For denied applications/petitions, post-decision activity may include the processing of an appeal and/or motions to reopen or reconsider and revocations.

What's that means?

I suppose that I'm going to receive my I-I130 NOA2 soon by mail?



WOW!! All 3 of us have the same NOA1 date (10/11/11) and so far both of you have been approved. Gosh I am such a pessimist, I am almost certain I will not be approved soon regardless of this. Hey all VJs,

As a newbie I've been following the stats for CSC and VSC in detail. I received my NOA1 for my I-130 on 10/11/11 and have been trying to find how fast is VSC approving I130 petitions. I noticed that many of the September fillers in the same category were getting approved in less than 30 days. So I wondered if VSC will keep it up. And just yesterday they confirmed my thought.

I also noticed that CSC has tons of I-130 going back to early summer that have not gotten approved. Maybe you wanna give them a call and see if they could forward your I130 to VSC b/c as it seems, they have very few I130 and they are approving most people within a month. No sure if they would do it but it's a try for ya that are reaching ya 5months.

It's unfortunate for the K1 applicants. It's it fair? Of-course it is not. Maybe they should work on a method of sharing the work load throughout the board for both the 3 site and all k1/I-130 applicants.

In conclusion as I've said, it seems like good news for only those applicants in Vermont doing their I-130.

Nevermind your saw your TL. Congrats! Wow. Believe it or not you are one of the few lucky ones. My NOA1 is the same date as yours, yet not approval.

The I-130 form has two columns. One for info of the petitioner, and another column for info about the beneficiary. You only need to send ONE copy of this form. You will however need one G-325A form for each of you.

And yes the PETITIONER, will sign it. The I-130 form that is.

So your reason for wanting to pospone the process is not exactly for his arrival, but more about you wanting to be present at the interview? Am I right?If I am right and it is that important for you to be present then when the time comes for it to be scheduled if the interview given does not work for you explain that you want both of you to be present and an estimated time when you will be available to travel there. But i have to be very honest we are on their time and they are definately not on ours. They could give you an appointment just as you ask for or they can give you an appointment a year later? Ultimately the decission is yours. You do seem to be very lucky! As i am still in shock to hear you getting NOA2 as quickly as you did! I definately dont recommend trying to postpone anything in the visa process. Go ahead with all fees and filing that are possible as soon as you can. This process will always keep you on your toes! You never know what to expect! just get through it then when at the final stages if you feel the need to delay the interview then so be it. You have been lucky so far! I will admit verry lucky! extremely lucky! however i would not rely on the entire process to go so smoothly. I hope i am not rambling so much... you asked for advice and everyone seems to be stuck on you getting your NOA2 so fast so here it goes...

1. NVC Case number is your identification number issued to you by the NVC that is used as your Identification number. You will have to put this on nerly everyhting you send out from the time you recieve it on. The Invoice Identification number is a recept number that will be found on the reciept you will recieve after paying your visa fees to the NVC.

2. It is best to not send anything till it is asked for. However, sending it in early is an option but just keep in my mind send them anything they have not specifically asked for can always cause delays. Your case number is not needed on this form and will be given afterwards so you can send this in as soon as you like just keep in mind delay it might cause. Things could also go very smoothly as well i dont mean at all to sound so negative in any advice i give, just being as honest as possible.

3.You do not have to pay the fees until they are requested. I waited long in my case for packet 3, i ended up notify them by mail and soon i did that everythign went by very nicely and i submitted my DS-3032 through an email to them and also paid my fees online when it was requested.

4.You can pay the fees whenever you like but not before they are requested to be paid. Dont hesitate to email the NVC with any questions you might have reguarding this or anything else that may come to you. You can choose to wait to send in the packets or not as i have already discussed this above. Please be careful not to delay it to long as you will have to start this entire process all over including repaying all the fees.

I hope this helps and dosent bore you or confuse you in anyway. blessings to you and yours through your journey.


It is not not only that I want to be present at the interview. It is REQUIRED that I am present at the interview (or my husband will be denied a visa). That is how the embassy in Domnican Republic does it, unlike in other countries. I will pay the fees when requested, and postpone sending AOS and IV packets, and get my case completed sometime around march/april. EVERYONE has a one year window to submit all the necessary forms to NVC without even having to contact them about it. I have seen various members do this. I do not see why everyone is making a big deal out of it, and saying i'm presenting a risk for myself. If the CO at the interview happens to ask why it took so long, I will explain. That's it. I am not doing anything various members have not done. It's just not so common. "Rescheduling" an interview for the very busy embassy in DR is not as easy as everyone is making it sound. That is why I have chosen to not take that route.

Oh...well, from both cases that I have seen on VJ - I know it is not qualified data to represent- they were get expedited because their military work. I remember one of them an army guy that married a Filipina girl named Steph. Another guy that engaged to Korean girl named Amy (?) I guess. I can't recalled the detail but I still remember both of them got approved less that 30 days. But of course the OP understood my question though. Not all military members get expedite unless in extremely situation.

What are the criteria to have an application or petition expedited for military personnel?



A. USCIS reviews all expedite requests on a case-by-case basis. Some examples of situations that may qualify for expedited processing include:



  • Pending military deployment
  • Extreme emergent situation
  • Humanitarian situation

The info from USCIS that basically my question for the OP. I took it from USCIS website. Some people told me there are some benefits being in military. This is the first time I've heard that being in military only make things harder. But, thank you for the info. I'm appreciated it.



However, just a reminder. I am NOT in the military and NEVER asked to expedite the case. VSC seems to be working extremely fast these last couple of months. Just look at Igor's list.

OP: You can start calling NVC in about a week, they might have your case number then. I'd call the AVR until it updates with your case number, then get in contact with an operator to give them your email addresses (yes, both yours and your hubby's). Giving them your emails opts you into electronic communication from NVC.

The NVC case number is the equivalent of your USCIS case number. The BIN (beneficiary id number) is only used with countries eligible for electronic processing. You will need the IIN (invoice id number) in order to log into the payment portal.

Email the NVC with the DS3032 after their first email to you, which will include a copy of the Choice of Agent form. You don't have to send that exact form, but use the template here on VJ.

You can delay on paying the fees. It's not going to harm the case any. Or, you can choose to pay the fees right away, and then delay on sending in the paperwork. (I personally did the latter.) Either way, it'll be fine.

I'm confused. You want to wait so you can immigrate in late April/early May. The person you replied to told you not to bother delaying as you have 6 months to use the visa which would mean (seeing you won't get an interview until in December and thus approved in December) you have until June to use the visa... which fits with your timeframe... So I don't understand.

You could take your time (not too long) doing what you're supposed to, then you could also request an interview after a certain date.


It is extremely hard for me to fly out for an interview to accompany my husband before April, and I would love to accompany him for POE. I would rather take my time with NVC than have to cancel and reschedule an interview. Then I may really get a very late date. If I am able to complete my case at NVC by March/April, I am estimating I will get an interview by May.

You don't have to delay anything. You should continue in the process as it develops. You have 6 months to use the visa after you receive it. I would not delay anything. Or you might not end up getting him here until after you planned to.

I am the USC petitioner.

I need some help. I was not planning to get my NOA2 so fast. I got it today. It's only been 4 weeks! :rofl: My husband and I were not planning for him to come till late april/early may so we decided it's best to delay the case a bit. For many reasons, it's best for us to wait. However, I want to make sure I do things right. I read some wiki guides, but i'm still a little confused about what to do next.

1. When do I call NVC to get a case number?? Do I still need to get a invoice identification number? What is the difference between that and a case number? Additionally, I would provide my email as well as my husbands....correct? :blink:

2. When do I email the DS-3032?? Right after I get the information above from NVC? :help:

3. Since I want to delay the case a bit, do I have to pay the fees (AOS and IV) asap? Or can this be delayed too?

4. If the fees cannot wait and I pay them soon, is this where I halt, and wait on sendings AOS and IV packets since I would like to delay the case for a couple of months? :help:
