IR-1 / CR-1 Spouse Visa Process & Procedures8/11 CR-1 interview at tokyo embassy
Me and my wife (Japanese) went to the CR-1 interview at US embassy in Tokyo today. I want to share my experience.
Our scheduled time is 9:30 am, but we arrived at 8:45 am. There are no line at the security check so we went into the embassy directly.
Inside the embassy, we had to take a ticket number (seems like first come, first serve) and wait for our turn.
At around 10:15, we were first called and go to the counter to hand in the medical exam result and other required documents. Afterward we were instructed to wait.
At around 11:15, we were called again to go to the counter for fingerprint. Afterward we were instructed to wait.
At around 12:00, we were called the third time to go to the counter for the "interview", which we were only asked a few easy questions:
Question 1: Describe how you met
Question 2: When did you get married? did you hold a ceremony?
Question 3: Where do you plan to live after moving to US?
Question 4: Did you meet each other's parents?

We did not have to show any supporting evidence. After the questioning, the agent stamps and checks on some documents and told us my wife's visa is approved and should get her passport back within a week.

Conclusion: interview is super easy, but it took more than 3 hours since we had to wait for most of the time. Also, inside the embassy is very cold so a jacket is recommended if your wife is wearing a sleeveless dress.

IR-1 / CR-1 Spouse Visa Process & ProceduresSworn Affidavits of bonafide marriage BEFORE marriage
I just want to give my two cents as a recent (K-1) visa sponsor for my lovely Tico husband.

1) Costa Rica mail has never failed me, and I send both letters and packages almost weekly. Of course, it will never be delivered directly to your house, but you know to get a box at your local post office. It will get there, even if you live out in Puerto Jimenez in the Osa. It is slowwwwwwww, sure, but I've never once lost any thing (mailed to or from CR).

1a) For important things, we have used UPS. There's also DHL. You can go pick them up at the offices so you don't even have to worry about it getting lost internally. I only did that once, and it was for important documents I forgot back in the US while our visa interview was approaching. Easy as pie-- especially if you live in the San Jose area (or perhaps around the Liberia airport, if they have offices up in Guanacaste as well).

2) Costa Rica is such a low fraud country that I doubt that these affidavits are even necessary. If you look at the consulate reviews in CR, the validity of nobody's relationship has never been questioned (at least of those who posted on VJ). It's not like some countries where it really seems you have to shown a rather inordinate amount of "evidence". Though we did not go the CR1 route, for the K1 we had a couple letters from friends, but no notarized affidavits. And those weren't even looked at during our interview! (Perhaps they made a difference at the petition stage, but I sort of doubt it.) I really wouldn't worry about them. But if you reallly want to include them, don't distrust the Costa Rican mail system because there are abundant ways to get them to CR unscathed, and in 24 hours if you're willing to pay!

I have read once in this forum, that this things happened a lot, so no worries, everything will be fine, just keep calling them and talk to an operator, 'cause sometime they don't enter it to the system, I think you suppose to wait until the AVR says that the IV bill has been generated.
good luck

IR-1 / CR-1 Spouse Visa Process & ProceduresAOS, IV, and the FORMS
as I was reading these last couple weeks on this forum, I think when people pays the IV before it gets generated, the NVC system gets confused, so it makes them on delay.
so, as you know corinne we're on the same steps, after I got the email with invoice for AOS fee I only paid AOS fee even IV fee is available, I will wait till they generate IV fee invoice.
about the DS3032, I have sent it just after the NVC assigned a case number so it's already accepted.
I hope by the end of the next week the case will be completed on the NVC
cheers!!

you can get married on a b/2 tourist but you must return to your country, you can't adjust status, get married you go home she files the lost naturalization form N-565 application for replacement of naturalization the fee is 345.00you can down load that and the instractions.before you file the 1-130 for the cr-1 visa you will need to send a copy of that form or a copy of your us passport to show your a us citizen on the 1-130 form the fee is 420.00.if all goes well no rfe's estimate time is about 9 months, its 5 months for approval.then nvc two or three months, when case complete, your file is sent to the dominican repubic consulate for the interview.

Thank you so much JKelly

Based on you response I have two more questions.

1. Those 9 months implies the time that the N-565 will take? or what you said is that in replacement of the Certificate, we can use the passport?
2. What goes after the interview? what are the steps after that? time?

IR-1 / CR-1 Spouse Visa Process & ProceduresGoing back to my country to apply for CR-1
Hello!

I'm new on this forum, so I welcome any suggestions about rules and anything else.

Some background:

- I came to the United states to be spend some time with my girlfriend and get married on a B1/B2 visa.

- I've arrived the US July 23rd and we got married in August 4th.

- I'm from the Dominican Republic, she is from Venezuela bot naturalized in US (by the way, she lost her certificate of naturalization)

- We know each other from Internet since 2009. We met for the first time this February in the States, she went over the DR last July for 1 week an a half and I came here July 23rd.

I'm suppose to go back to my country this September 2nd, my wife is kind of pushing me to stay and apply here for adjustment of status, But I don't want to do so that way. What I want is to go to my country and wait there for the CR-1 and then come back to the states by the right way.

Saying that, my questions are:

1. How long can take the CR-1 to be in my hands?
2. What do you suggest?
3. Its OK to marry in a B1/B2 visa? some people are saying that we did an error.

I will appreciate any suggestions that can point me in the right way.

Thank you in advance.

Edit #1: The fact that she lost her naturalization certificate is new to us, we discover that just yesterday. But even if she found that I will prefer to go to my country.

IR-1 / CR-1 Spouse Visa Process & ProceduresI-864 - Tax related question...
Ok, this is what I did:

I called the IRS and this is what I did per their instructions:

I filed my 2007 Taxes Married filing Jointly. I attched form W-7(W-7 is the application for a TTIN for my wife) to the tax return and mailed completed to the IRS.

I then took that copy of the 2007 return, attached 6 months worth of paystabs and a W-2 to it, and mailed with my I-864.

Hopefully this will be ok.

IR-1 / CR-1 Spouse Visa Process & ProceduresI-864 - Tax related question...
Here is the problem, I filed for an extension with the IRS this year and therefore I do not have the 2007 tax transcript yet. Is this going to bite me?

The reason why I did not file my taxes yet is becaouse I am required to file married this year, but abviously my wife doesnt have a SSN yet. I will be filing for TTIN for her shortly but I may noy have this completed by the time I will submit the I-864. Or should I just file single?

In this case can I just submit 04, 05, 06 tax years?

Thanks!

IR-1 / CR-1 Spouse Visa Process & ProceduresAnyone Been Approved for Advance Parole?
Hi!
I am wondering if anyone can help clarify the Advance Parole process. As I understand it, after the beneficiary gets approved and enters the US,we can get married and then submit the paperwork for AOS. Then we can apply for the Advance Parole(I-131). Now since we have just submitted the $1010 for the AOS, we don't need to also submit the $305 for the AP, right?

About how long does the AP approval take?

And how strict are they on approving the AP based only on emergency cases? In our case, we plan on getting married here in the US but then traveling back to Germany to have a full wedding ceremony there. It is very important to us to celebrate our marriage with the friends and family in Germany as well. But is that a good enough reason for the US to grant us the AP?
Does anyone have examples of how they were approved?

Thanks!

Ok so the beneficiary would need a police report from his home country (Germany) but also a police report from Boston since he lived here for 2 years. Is that correct?

NVC clearly says that, beneficiary need a police certificate from her/his country of residence + any other countries that s/he has stayed more than 12 months.

For some reason US doesn't have somthing like PCC but I recommand you to call NVC and ask the operator. They should definitly be a help for you.

Good Luck

Hello Again!
I just wanted to update this topic. To recap, my question was if the beneficiary for a K1 had lived in the US after the age of 16, if they would need to obtain police reports from the US city as well as the Countries they have lived at abroad. I contacted the US State Department Visa Application office. They confirmed that police reports from the US are not necessary. They only require police reports from foreign countries.

They give him six months to leave DR and come to U.S.A. If he lets this time pass and does not use the visa, I'm pretty sure it is revoked. The green card will expire in two years, and then you have to remove conditions (more paperwork) and he will then get a 10 year green card. He is elegible to become a citizen in 3 years. I hope that helps!

Congrats again!
