I noticed the iraq cases as well. I wonder if USCIS sorts the file by location as well so they can prioritize cases that could have humanitarian concern...or maybe the two iraq cases file for expedite?

IR-1 / CR-1 Spouse Visa Process & ProceduresI-130 approved!
so now do I wait for couple weeks for NVC to send me some instruction on the online fee payment? The online payment site sounds like they will send the instruction with my case number and IIN written on it...or, should I just call them to try to get those two numbers?

The online payment link

IR-1 / CR-1 Spouse Visa Process & ProceduresI-130 approved!
I am December filer and I received my NOA2 in mail today. The online status totally sucked as it did not update and I never received any e-mail noticing me. I filed for CR-1 only, no K-3.

I-130 sent: 12/30/2007
VSC received: 12/31/2007
NOA1 generated:2/6/2008
Sole "Touch": 5/5/2008 (it's actually an update for approval)
NOA2 generated: 5/2/2008
NOA2 received in mail: 5/8/2008 (no prior e-mail notice)

IR-1 / CR-1 Spouse Visa Process & Procedureswaiting for IV Bill
My AOS and IV fee bill invoices were generated simultaneously and I can see them on the online payment website, just 10 days after my I-130 is approved. I paid both immediately. It took 2 days to clear the payment, after which you can print out the bar-code cover sheet and use them to send out the AOS and DS230 package. I expect to finish my NVC stage soon. By then it will only take me one month since the approval of I-130.

IR-1 / CR-1 Spouse Visa Process & Procedurespolice certificate at interview
[quote name='cmoncada' date='May 27 2008, 11:29 AM' post='1873786']
What the heck is a police certificate? My husband lived in the US his whole life Illegal. Does he need one fromthe US too?

um...I assume you are the USC and your husband is the beneficiary? Police certificate is required either at the interview or when you send in the DS230 package (depends on NVC instruction). It's to demonstrate that the beneficiary has a "clean" record and it is ussed at the country/city where he lives after age of 16. Since your husband is already in US, I have no idea if a police certificate is required..someone might know this better than me..

Hi,
I submitted my wife's police certificate along with her DS230. The question is, will that police certificate be forward to the US embassy in Tokyo (where she will be interviewed), or does she need another copy of police certificate at the interview? She spent 8 hours on round-trip bus last time just to get her police certificate, and we will be kicking ourselves if we need another copy...

I've never heard of NVC requesting a police certificate. If you sent it to them, call them and ask if they'll forward it. In the future, don't send things unless they are asked for. If you can't get a firm answer from NVC, then its up to you whether you want to risk a delay in the visa or get another one.

Follow the existing process instead of inventing your own.

Talked to the lawyer on the phone, she said NVC did request the police certificate. But NVC will forward all the stuff to the Embassy so we won't need another copy.

we used the online payment system to generate the barcode cover sheet so we didn't receive the DS230 instruction sheet before we submitted it. However, we are also working with a lawyer and she said we needs to send in the police certificate along with the DS230.

IR-1 / CR-1 Spouse Visa Process & ProceduresUS Embassy at Tokyo interview scheduling
hey guys,
My wife's case will be completed at NVC in next couple weeks and it will be forwarded to the US embassy at Tokyo. Does anyone knows what's the usual time frame for a CR-1 interview to be scheduled after the case is completed at NVC? One or two months or longer? I know it depends on how busy the embassy is, but please speak from experience if you have any. Thanks!

Vermont have only approved a couple of I-129F's since Christmas ..... most are left by the wayside

WHAT ABOUT I-130? IS THERE A WAY TO SPEED UP THE PROCESS BY CALLING OR SOMETHING.

nope, you absolutely cannot do anything. If you have passed 180 days since your receipt date (aka NOA1 date), you can write to your congressman or senator and maybe they can open the inquiry. Notice that even though USCIS claim they HONOR the date that your package arrives their mail room, it is totally bulls and not even senators office can do any good.
Long story short, you just have to sit tight and hope VSC can have mercy on you...

IR-1 / CR-1 Spouse Visa Process & Procedurescase completed! hooray!!
In only 5 weeks after NOA2, our case was completed at NVC! We could've done in 3 weeks, since my wife spent an extra 2 weeks to obtain and mail her police certificate from Japan. Anyhow, the online payment is really a life saver and NVC is very good at reviewing the case documents (only spend 4 business days doing so). Check out my timeline.

The NVC operator told me that a July interview is unlikely due to the capacity at the Tokyo embassy, so right now I am looking at an August interview perhaps..

Good luck to you all smile.gif

my case was completed on 6/11. called NVC within a week and the operator told me that I missed the July scheduling because they only schedule interviews at the 2nd of each month for the following month. That is a bunch of #######. It turns out they schedule my interview at the 3rd week of June and forward the package to US embassy in Tokyo on 6/23. My interview date is set at 8/11.

I think as long as folks don't lie about their reasons to visit the US, they should be alright. Lying could be seen as (attempted) visa fraud however, and that could get you in serious trouble.

I'm flying to the US to see my husband in a few weeks under the VWP also, and am taking proof that i'll be returning here, and a copy of our K-3 appl., just in case.

well there's no 10 year ban...not sure where that came from. if she gets denied POE then that is all that happens...nothing affects here CR1 application. Its not illegal to visit while visa is pending...it just seems to be harder to get in thats all. I wouldn't offer up the info that she has a visa pending just try to come and see what happens. I know many people undergoing CR1 who visit the US with no problem.

I agree the 10-year ban seems ridiculous..dunno where my wife got the idea from..
Now the question is, if the denied entry is simply just a denied entry, why would lawyers almost ####### their pants when asked about visiting US during I-130 process? My take on that is it must have some ill effect if you tried but got turned back. Perhaps you will get extra screening or get scrutinized more at interview?

I think your wife might be talking about the a ban regarding the VWP.
I have heard if you are denied entry with the VWP you are not allowed to use it again for 5 years or something like that.
But as far as affecting the outcome of the Visa, no. I dont think it has an affect.

my wife is too scared to attempt anyway..sighs..
did your wife volunteer to attempt or did you talk her into it?
my wife worries that if she gets denied entry, she cannot enter US again in the immediate future..very hard to persuade her when I am not 100% confident myself..

My wife wanted to try. I actually was the one who was most scared. I told her we should wait.
Im glad someone has some balls. hehe
But actually, there is a website that helped my wife's confidence. She said it was full of Japanese women posting their stories about traveling to the US while their visa( both I-130 and 1-29f visas) was pending. Not one of them was denied entry. After my wife read that site she was more confident that everything would be fine. I'll ask my wife tonight for the link and send it to you. Maybe that will help your wife. Its all in Japanese too.

sweet! yeah that will definitely help! I will let her see the website and have her decide it. She does not have much balls though (figuratively and literally..)

guys,
I am thinking to have my wife visit US for a month under VWP. I am very busy at work and cannot travel to Japan that often. I know many people got through POE without a hitch, but we were just discussing what's the worst that could happen..

Hypothetically, if my wife is denied entry at POE during a pending I-130, what effect would it have on the CR-1 application? My wife said that she thinks if this action results a denial on CR-1, there will be a 10-year ban. I do not think the penalty is that severe and I think she will still be okay to get her CR-1, but maybe with some delay. Any comment?

thanks!

I just want to tell you that the interview was really easy. the officer asked her question about me like:

where do I work?
how long I've been working for this company?
how often do I go to Morocco ?
what's my hubbies?
where do spend most of my time?
etc..

and about us :
how did we meet?
when did we get married ?
how often we talk with each other?
do we have any children?
does any one of us get married previously?
etc...

The documents that she took with her was :
Her Passport
2 photos of her
The appointment letter

usually you take with you medical exam result, but because she is pregnant it was submitted to the by
the physician
also any original documents that were requested by the NVC but were not submitted
to the NVC, when you get the appointment letter from the NVC with it there a table lists the documents requested by the NVC and whether or not the NVC received them.

that's all Good Luck

If you are willing to live there during process, you would be better off living there for 6 months then doing a DCF application, thus avoiding much of the ####### here in USCIS.

IR-1 / CR-1 Spouse Visa Process & ProceduresFiling info
Hi...as I wrote in a previous post, I am a US citizen and I went to Ghana for 3 months to stay with someone that is a NIGERIAN citizen but has been living in GHANA for several years. We stayed in Ghana the entire 3 months. I now want to go back to stay with him again. But we are considering going to another country (cape verde). It is Visa Free for him to go there. I want to marry him this time and apply for a visa for him to come to the US based on marriage. Here are my questions: If he is a Nigerian citizen...can we only get married in Nigeria for it to be legal? Once we are married, can I file the visa papers from anywhere or do we have to be in NIgeria? We know it is going to be a long time for the process and I'm willing to live with him over there until its done. I have enough money to support myself there so I'm not concerned with that. I just don't know the process as far as filing once we're married. Can we be living in Cape Verde and still do most things? or would we have to remain in Nigeria until it's done. If anyone knows the process......plsssss advise me. I would appreciate it so much. Thanks !!

Hello,

I wanted to file directly to the consulate in ghana after establishing residency there with my soon to be husband, but I just found out that Ghana does not offer DCF. :( So my next idea is going to Ghana, marrying him, and then returning home to the US to file the papers. But instead of waiting in the US for the lengthy process to be complete....does anyone know if I can return to Ghana and wait there with him til everthing is done? I can have someone in the US retrieve all my mail and update me on anything I get from them. Do u think this is possible? Thanks for the help

IR-1 / CR-1 Spouse Visa Process & ProceduresMissing case at VSC
I filed the I-130 package on October 26th, 2007. It was received by VSC on October 29th. It has been almost 6 months, it is now 4-14-08 and no NOA1 received as of yet. No communicastions received period!

I called them several times but I am always told that my case is not in the system and that the EAC number that I have is valid but it doesn't bring anything up. How can this be? They cashed the check assigened a case number but are unable to find it? Frustrating.

I opened a case with USCIS on 2-27-2008 about a missing NOA1. Received an email on 4-10-2008 that stated: "Based upon the information you provided, the Vermont Service Center is not able to locate a record of your filing at this office." Fortunately I do have a copy of cashed check with a case number. I will be sending a copy of that to VSC on 4-14-08. I also decided to switch my process from K3 to IR-1/CR-1.

Could they really lose my case eventhough the check was cashed? Anyone had a simmilar experience?

We just got approved today too!
I kept checking my e-mail, hoping to get the NOA2 notice, but nothing! Then today Michael checked the USICS online status check and there it was! We submitted the 129 package on September 2nd, so we have been waiting about 5 months. We are just so excited and shocked! I am estimating now, that he'll be able to return to the US in 2 months! I think we'll start planning the wedding for May 30, 2009!
I hope that everyone else waiting for their approvals, receive them soon!

IR-1 / CR-1 Spouse Visa Process & ProceduresAre they listening?
I think it's a good idea. I've just posted. The more angry and disgruntled spouses they hear from, perhaps the sooner they will get the message to change their priorities.

IR-1 / CR-1 Spouse Visa Process & Proceduresaffidavit of support paid one doesn't let me pay another

Just a clarification. EACH intending immigrant will have their own affidavit of support, so even though there's one fee, there are two I-864's provided.

Yes good point there. One fee. But two separate forms.

When it says PAID, you can send the AOS packet to NVC. Make sure to print out the coversheet and include that in the packet. The coversheet can be found on the same page you made the payment.
