I've heard though that if your declaration of meeting on your I-129F does not rule out an IMB, then you will undergo the checks.


Well, as I mentioned in another thread, we met for the first time at a sports event in Toronto, Canada. We described this meeting and several of our meetings afterwards, and supported each of those meetings with photos, train stubs, passport stamps, etc... We didn't specifically state "we did not use an IMB" but I think it was pretty clear that we didn't and our case has been recalled beause of IMBRA.

I'm wondering now what we should do with packet 3; he hadn't had a chance to send the forms to the Embassy before he got the letter stating that the case had been sent back to Vermont. Should we wait until the background check is complete, or will it speed things up if we send it to the embassy before that happens? How will I even know when the check is done? Will they notify me?


I'm in the same situation, I received the recall letter before I had a chance to mail back the packet 3 forms to Montreal. I called the Montreal Consulate about it and they said I should wait until I hear from them as they won't accept my packet 3 forms until the petition is reapproved. I think you should call the Embassy and see what they suggest.

I have this text on my NOA1 too, but it's preceded by "If this receipt is for an I-485, or I-698 application...", so I don't think this affects K1s at all. I received my NOA1 well before the recalls happened (although we were recalled and are affected by IMBRA).

The medical exam is $75, but what does that include? The physical, blood test and x-ray? Or is that depedent on the case? Since this is a K-1 what would it be. Also, The "Vaccinations must be completed at the Quarantine Service", what is included in this part and how much does this cost? I also assume that each would take approximately one day to get result of each?

Our parents have already met and every thing is okay. The sad thing is that there really isn't any way to prove that that took place beyond just an explanation. I mean, parents meeting and agreeing is huge, at least for Vietnamese people i guess. The plan is to do the engagement and wedding this summer regardless of the visa status, obviously i would like for it to be granted so that she could just come back with me instead of us getting married (without doing the paperwork in Vietnam, of course) and then having her wait for her visa then. We DO plan to get marry and we have met 3 times in the past year and a half. I am just nervous of the interview and wanted to know how to guide my fiance in her interview process. All of this concern was raised again because of Lurker's post regarding his fiance's experience with the interview. It is nice to know that i just have to show proof versus having to actually have the formal engagement. Your comments really helped, now i can sleep easy again. :)

To have engagement ceremony in VN is not a big problem, the most important thing is if you can come back to VN on that day?? If not, you must have a good reason to explain and it must good enough to persuade the CO that's the truth.
A small party with the relatives of both families may be enough, you don't need to invite too much people to come. Every lady coming to the interview always get the question for the photos of wedding or engagement ceremony, it seems become the fomular of the interview. We didn't have the engagement ceremony but I could pass the interview as we had the good reason to explain, and it should be the truth.

It's of course to encourage the fiance' spirit is necessary, and we always wish for your lucky and happiness but you should prepare enough evidences for just in case ....

Can you please tell me what your good reason was? Because that is basically where i am stuck. Every thing is legitamate, but we haven't had a formal engagement ceremony yet. Hi,

I filed a K1 Visa for my Fiance who lives in Vietnam. However, we have not officially had our engagement ceremony yet. The plan was to have it this summer along with the wedding and if she gets her visa, she will come back with me. Since this IS a K1 visa, how would/should we go about explaining this to the consulate interviewer? If everything goes well, she should probably have her interview within the next 2 months. Since the first time i saw her i have visited her twice already. And many of my family and friends are coming back this summer.


Please, any advice or comments would be greatly appreciated.

Regarding the police record, i am sure its different for each country, but my fiance's paperwork took about one month before it was granted by the authorities. The paperwork was good for like a year, i think... Anyways, we were a bit lucky we did it early or else we would have had problems. But check out the timelines for other folks that are in the same country as you are, you will get a pretty good idea of the timeline, hence, be better prepared.

The date on the letter was the 14th of February but my fiance did not get her packet until the 26th and the interview date is on the 9th of March, talking about short notice! I had to rush all of the paperwork back for her, what a mess!!! Now she is on her way to Saigon for her medical examination. Still more to come....

The strangest thing is that the interviewer wanted an explanation of two things: a) why didn't i work during that period B) why i had a co-sponsor even though my income exceed poverty level.

The answer to a was included but i guess they overlooked the fact that i didnt make enough to file a tax return. The answer to b is because i was a student so i didnt have enough income level for the prior 3 years and my lawyer recommended that i do that. But here is the wierd thing, on the blue slip it ONLY mentions needing my and my cosponsor's tax return for 2006.....

any thoughts would help....thanks

Hi all -

I have been with my Argentine fiance for over 2 years, and we have in total traveled 5 times back and forth between us. However, I have never thought to save boarding passes.

1. Do you think this is a huge deal?
2. Is there a way to get copies of this post-flight from the airline?
3. What else would be an appropriate alternative. We have pictures, emails, birthday cards... tons of passport stamps. What else can I do?

She entered US in last March 07 and the immigration officer at POE stamped for 3 month validity for the stay. Her visa expiration is Jan 08 (from the US Consulate in Vietnam), so she can still re-visit the US later.

She has a child still in Vietnam. If she stays here and they get married, he (my friend, the petitioner) will file a I-130 and AOS for her. And also he can file another I-130 for her child? How long it takes for the child to come here? Or she should just go back to Vietnam, and he files I-130 her and the child comes along? Please help, she stay in US will expire in 3 weeks!

Of course, the girl (Vietnamese) entered US with the B1 visa without immigration intention or to get married. But now, she met my friend and wants to stay with him. This is the first time she entered US, and my USC friend, who is from Vietnam also, never go (back) to Vietnam in 17 years. Therefore, they never met before.

No and yes. No, she doesn't need a visa so it would not be the CR1 route. CR1 is a visa. Yes, they can file I-130 and and I-485 but do so at the same time. I suggest you have your friend access this site and study the guides then he can come back with any questions and get first-hand answers.



My friend's English is not that good, so I'm trying to gather preliminary info for him. Should we go that route (I-130 and i-485) like you mentioned above? Do we stand a good chance? If not, she will be denied and banned which would cause many years of separation. If yes, then they should go for it because they do not want to be apart. Or his girlfriend should go back and then he can file K1/K3/CR-1?

There is no point of calling VSC, they will just tell you what you've already known. You just have to accept the fact that VSC is a black hole and hopefully one day it will spit out your approval mail.

I got my I-130 NOA1 at 2/6 and last updated on 2/24 (due to address change). Still no NOA2 yet so you are definitely not alone.

Yes, They asked her how long she is staying and who she is visiting.
She was 100% honest about everything.
They said "why do you live in Japan and your husband here"
She said "because we are waiting on the Visa"

She said the lady just handed her passport back to her and said "enjoy your visit"

I hope my experience can help other people visit their loved ones.
I havent really been able to sleep because Im so happy(among other things hehe)!!

On a subsequent note, I have noticed that some forums allege that even if your spouse is granted entry during the I-130 process, such trip would generate additional FBI name check (if it has already been done), which could delay the processing time at the consulate. I've never heard of that happening. The main thing I was worried about was how it would look if she got denied entry.
I think though as long as she can show on her passport that she left before her 90 days was up and didnt overstay I dont think there is anything to worry about.
Cause technically there isnt any law against people coming to visit while waiting for a visa. Its all up to the Immigration officer at the POE.
If he thinks she is a risk to immigrate illegally then he wont let her in.

But then again Ive heard this over and over again but Ive never read about an actual IO not letting someone in.
Im sure it happens but I just havent seen it happen.
Im not sure why lawyers and other people scare us like they do.

I think the laywers are afraid the denial of entry would delay the Visa process (like a black mark). I am sure there are people got denied entry, but the percentage maybe as low as 0.001%. I guess lawyers are not taking any chances, no matter how safe it might seem..

We use both. Her english isnt really good and my Japanese is just good enough to get by. So there are still alot of times where I have to repeat things or say something in a different way. Sometimes I sound like Yoda talking.
I need to keep learning more Japanese though! I can communicate great with my wife but with her friend or family I struuuuuuggggglllleeee.


That's awesome. I am probably at exactly the same situation as you are. Sometimes I feel a lack of sentence structure and often just use words or phrases. I am a member of the Yoda club too...I wonder if VSC would be susceptible to Jedi mind trick..

Do they give you a year-cap on the "flight information"? Like within the last 5 or 10 years? What are people supposed to do if they visited 10 years ago and already got a new passport and cannot look up the old entry stamps? just seem a little bizzare.
