I have just sent in a I 129f and did not need a 130. The process is simple but it must be perfectly done or they will send it back.
Back in July, I sent one in. They took 5 weeks and sent it back saying one of my divorce judgements was not properly signed and it was not a legal divorce. I had to bring it back to the court house and they said of course your divorce is legal. I asked them to sign the blank line anyways and they did. I sent it back to USCIS and then the girl and i broke up.
So 3 weeks ago i sublmitted another application for another girl and they in 10 days they mailed it back and said that the check i sent was not signed and it was for the wrong amount. I did not realize in that short time the fee increased from $170 to $455.
So I sent them a new check and highlighted my signature with a nice note (because the first check had been signed).
So that is as much as I know. Some of the things they require are
Proof that you met
Biography form for both
Letter of intent to marry in 90 days upon entering the USA
of course the check for $455
and some other things.
You must read the application very very carefully. Write out exactly what you need in a list and check, double check and triple check that you have everything.
There is one thing that i learned yesterday that i had not known previously. It takes 5 to 6 months but you can get it processed in 15 days for a fee of $1,000.
It is called premium processing. There is a toll free number that you can call for the forms.
Read the web site carefully and everything is there. it is www.uscis.gov .

We're just exploring our options at this stage and some advice would be very welcome. I'm here in the US on an H1b valid until early 2009. However I've been job searching as I would like to move from academic research to industry research. I've found this to be next to impossible as I would need a new H1b visa, and wouldn't be able to start a new job until October, not a very attractive proposal for an employer!

So we're looking into K-1/K-3 visas. Can I transfer to a K1/K3 while I'm here on my H1b? Could I start the application process whilst I'm still here or would I have to go home for a while? And what happens about working once I get a K1/K3? Do they expect you to live on fresh air until they approve everything? I already have a SSN, can I keep it and use it on a new visa?

I included my money transfer over Western Union for my fiance and it did not show up as a red flag. So i guess that does depend a lot on the interviewer....I don't think it will hurt, IMHO.

Its a case by case thing, for my case, we did not even have an engagement ceremony. Being that a K-1 is for fiancee and all....we just told them how it was going to be and they understood. We ended up doing the engagement and wedding in vietnam after she recieved her visa, but we told them how and why...and they were ok with it.

Having gone through this process about 2 year ago, i can certainly understand what you are going through. I do agree with the way you are thinking and how you are approaching this process. Every one here is right, that you will need to provide sufficient undisputable evidence of your relationship AND that your fiance doesn't mess up the interview by answering fasely/incorrectly to the CO during the interview. The way i look at it is this: this whole thing is a "story" and it is up to your fiance to paint it out clearly to the interviewer and leave no doubt as to the legitamacy of the story. If you are able to provide all of the requested information/evidence precisely to their requirement, you should have a clear path. BUT, remember, if you get turned away at first, DO NOT be discourage...just be patience and give them what they need and becuase your love is real, in the end it WILL work out. My experience left me feeling like the consulate was beating me around the bush, but at the end, i got really upset (and focused) that i was able to put together all of their requested information and i was able to address all of their concerns and in the end, we passed. Ahhhh!!! So - we set it back until September 20th which gives us 10 months. I'll give someone a cookie if they tell me this is fine and there shouldn't be a problem (unless something crazy weird happens).

Hey all

I received my NOA1 on Nov 16th and am now merrily in the process of waiting. My fiance and I are planning our wedding for August 16th 2008. Depending on how the dates and approval work out, we may get legally married as soon as he comes into the country on the fiance visa and then the August wedding will be to seal the deal with friends and family (and so I can have just a little bit of the princess wedding smile.gif ... )

So - I am wondering....

1. Are we completely foolish for planning a wedding in August and reserving the location/vendors/etc? Is the 8-9 month window enough? We have been together for 2 years and have spent enough time in person together (12+ months) that we have tons of evidence of our relationship and he has been here numerous times. (Hopefully!!) there shouldn't be reason for RFEs.

2. Has anyone done the legal wedding immediately upon entering and then had the traditional wedding later on? Do you have any advice/experience with this?

Hi Lizc,
The I-134 needs to be notorized. There is a woman in the BA embassy, the one that handles the Q&As at the immigrants division, who is very helpfull, but I've caught her making a few mistakes, maybe this is the case. Don't freak out, when's your interview? if you don't have time you can have it notorized at the embassy, if you have time then when you go back to the US have it notorized and send it to BA through UPS or DHL, they do a lot of business in BA so it takes 24-48 hours to deliver. Don't use Fedex as they are not really good in Argentina.

Just to keep you in the loop... I finally got an email back from the consulate and it seems (sadly) that you all were correct.

"Thank you for contacting the Immigrant Visa Unit. There must have been a confusion withe another affidavit of support (I-864) which does not need to be notarized. However, the I-134 needs to be notarized. So please contact a Notary Public in the US or an Immigration Officer in order to have the form notarized."

I should have known better, but one has to dream! Thankfully I had a new form notarized and it is already on its way to Argentina.

I would advise anyone to notarize it and since the OP has left, they can send a new notarized one.

At the same time, though I think the Consular officer will let an un-notarized I-134 pass, since it isn't binding anyway and the binding I-864 no longer requires notarizing.

I surmise that the requirement for notarizing any affidavit of support has been removed by policy but that only the I-864 forms were updated. The I-134 form just hasn't been updated or replaced to remove the notary signature block.

Two things... The I-864 does not need to be notarized and that is the affidavit the IV unit at the consulate is most familiar with. They may have made a wrong assumption when they answered your question thinking I-864 and not I-134.

again, they might simply have defaulted to the answer for the affidavit they are most familiar with... I would have specified I-134.... I would call back

He has until September 6 to enter the U.S. and will be given 90 days on the I-94 from the date of entry. The 90 days is not included in the days the visa is valid.



My fiance and I actually ran into a major problem with the "petition valid to" info. His K-1 visa was valid until November but the petition expiration date was 6/4. Technically we should have been fine as the petition valid until information only means that he had to receive his visa before that date (more or less). However, the folks at JFK were not aware of that detail and saw "petition valid until 6/4" when he entered on 6/8. They didn't allow him to enter on the visa and he ended up having a delayed inspection in Boston 10 days later and had no status until then. It also didn't help that he entered on a Sunday, when the folks at JFK couldn't call the embassy in Buenos Aires.

The moral of the story? Call or email your consulate and say that your visa says the petition has expired and you want to be sure there aren't going to have any problems as you go through immigrations.

As yes - Upon entering on the K-1 visa, you will have 90 days to get married. That includes if you enter on 9/5 itself. (although I wouldn't suggest that).

Hi.

I just started the K-1 visa fiance process recently for my fiance in Vietnam. I have sent in the complete package on 11/13/09. Everything except Affidavit of Support (Form I-134). I did received the NOA1 back on 11/17/09. Still waiting for NOA2 since then. However, I did filled out the application and ready to submit when USCIS request. I have a very stable job that make $70K per year. I have tax return document back 3 years support this. I don't have any asset except for my car, motorcycle. I don't own a mortgage and have less then 10K in my bank.

Am I ok? Will they request me to sent in bank statement? Or will the income tax return is enough.

It's been almost a month since the NOA1. I've check status everyday and said "initial review" stage. Is this normal.

Should I be worried?

Please shed some insight.

I couldn't find a specific time limitation from the Embassies web-site in Accra, Ghana. Within six months should be reasonable. Since you have time before the interview, can you have your fiance(e) contact the Embassy and ask them if it is acceptable.

The other alternative is to simply get a new certificate about 2 weeks before the interview.

Hi Guys.

I was just wondering, thinking of back up plans and/or options if once your petition is denied... I'm sure there's many situation that some case may cause delay or denied.

For my situation.......

My fiance have a 2nd interview in HCM in August to submit require documents: petitioner sworn notarized statement of chronology time line and current past 10 years residential address. I'm positive the reason for this is
Timeline of relationship is very short and get married very quickly such as: get married right on the first trip, one day after arriving. Sponsor must take at least 1 trip to visit the fiance/wife/husband within 18 months. There is no interruption in relationship within 6 months. Sine we're engaged one month after I went back to VN for the first time. Like most of us, we didn't plan for fate to happen but it did... Nonetheless, My only regrets is that I didn't discover VJ soon enough before I file the petition... The the course had been set, we just have to roll w/ the punches now... and take one step at a time.

I'm making last minute arrangement to visit her and support her by being there w/ her on her 2nd interview date.. I know I have better chance winning the lottery than be able to speak or convince the CO that our relationship is true. Regardless, what the our come is, I just want to be able to lived without regrets and be humble that I've done everything that I can to be there for her, to love her, and support her. Even if it have a sightliest chance to prove we have a bonafide relationship. I don't have to have to second guess and doubt myself of questions such as "what if" what if my being there could change or influential the decision approval even though of our short time period. Unfortunately, our engagement party ceremony plans month after the 2nd interview date where I don't have any supplemental pictures for supports...

Assuming after all is said and done, and being cold and scrutinized as they can as CO in HCM where they finalize decision to denied our petition.. What next from there. what do we do?

Do we re-apply (start all over again) from scratch for K-1? (I'm sure now we have address our reason of denied where we have a 1+ year relationship.. Visit fiance 3+ times, Engagement ceremony is complete).

Is there a limit time that we can apply for K-1? Would they review our 2nd petition knowing our 2st was denied?

Or do we file as different type?

At this point in my life, the time yearning to be together is indescribable. Financial is not a problem for me, as I have a good career, but the time we're apart missing each other is brutal..... My one and only goal is able to bring my fiance to the State asap..

My post was not to say anyone was doing anything wrong on this site with posts or I knew exactly how the process works at the service center. I was simply working off of common sense. Day in and day out the phone calls directly impact the the people that aren't answering the phones, because they have to report to the people that are what is going on so they can provide information...the more questions the more answers needed. So, I just had a fun thought of starting a week long ban on calling to see if there was a relate.

I feel for everyone on this site. It's an extremely painful process. I wish the best to everyone and to take my posts as a way of looking at things with common sense, not the cases outside the boundaries (those are exceptions). Because, for the most part, a lot of people get approved within the long set timeframe.

I see your point, but the people who answer the phones are not the people working on petitions. They are two separate groups of people, and probably even work in different buildings or floors. The work flow is not affected by phone calls to the service center.




I wish you the best of luck during this long process. I only hope for lots of people to receive approvals when I go about my day.

My post was not to say anyone was doing anything wrong on this site with posts or I knew exactly how the process works at the service center. I was simply working off of common sense. If you look at a company (I own a fitness center)...You have a front desk that handles all the calls and people that service everyone else and don't take calls. Note to all!

Simply view the current NOA2 received by fellow Visa Journey people on this site to get an understanding on how service centers are processing. I received NOA1 on October 2nd. Now, I'm seeing a bunch of people around me reporting NOA2's all of a sudden. If you were a government organization, would you be giving every caller an exact timeline of when they will get approved? Do we fully believe any organization could handle that accurately? That would probably create more trouble in trying to please callers by trying to give them an exact date on when they would be approved. It is impossible with their load of applications.

My best advice to everyone on this site and waiting like I am. Click on immigration timelines on this site. Search your visa and sort to your NOA1 date (great function on this site), view what others are posting for their process. That is the best way to understand how any service center is doing at handling all the applications. Calling isn't the answer, congressman won't get an accurate answer all the time and it is true that an application lands on someone's desk and you may get a hard worker, average or someone that is slow at their job (like any corporation out there - 10% do the work and 90% tend to move paper).

I believe the best evidence is what people post on their timelines on this site. (1) no reason to lie about your postings (2) people get excited to post good news, which then i believe is accurate (3) its a great way to view where you are in the process.

YOu're absolutely right. The NVC Will send the case to the consulate where your fiance is. Then they will send out packet3 to you. It will require you to send to your foreign fiance all your information etc (134, tax returns, bank info, job info, evidence etc) for the INTERVIEW part. she will need to get a police check for packet 3, long form birth certificate, divorce decrees etc etc. your lawyer is uneducated with this type of visa perhaps its time to terminate his "services"

Hi - THANK YOU SO MUCH. My lawyer is a mess...thank god I had this site. He also put down Pretoria on the I-129F as the fiance will apply abroad...after i put down joburg. Do you think the NVC will still automatically send it to Joburg?

HELLO ALL-


I met with our lawyer today to discuss next steps after receiving the NOA2 in the mail. I think he is more confused than me! Please help.

I stated to him I wanted to go over the I-134 to get notarized and sent to Sarah in South Africa. He said - No, we have to wait for NVC to request that from us. He stated that the NVC sends us a paper requesting for the I-134 and that is sent to the consulate from the NVC. He also stated that the NVC may request a police certificate before sending anything to the consulate.


AM I WRONG? My belief was that: NVC gets approval from VCS or other service center, assigns a case number (which I have), runs a background check and ships the packet to the consulate. Sarah than provides the consulate with the I-134 notarized an all other related documents requested.

Hello all VISA JOURNEY FRIENDS!!! We need your help!

So here Sarah (Fiancee) and I are nearing the last phase. Sarah and I have been working on her documents needed for the interview – going very well. We will be faxing in OF-169 tomorrow and DS-230 Part 1 in order to receive packet 4. I managed to have the consulate email the packets and not do snail mail.

Tonight, she realized that no one ever asked her to hand in her I-94 departure slip when leaving the states in May/2007 – she still has it! So, I’m guessing the US may not have any notification that she actually left the country in May-2007.

Is this a serious issue?

Would the USCIS approve a K1 visa to the NVC and forwarded to the US Consulate in South Africa if they hadn’t recorded she had left?

What should we do?

If approved, will this become an issue when she enters the USA?

Well, you could always come here and try to win your fiance back. Perhaps the time spent apart made her forget the feelings she had for you. By coming here you could remind her. If things dont go your way you can always return within the 180 days.

Hi folks, you've all been so kind. I really appreciate everyone's quick response.

So my understanding at this moment is...
I won't need a K1 visa; the H1B visa is dual intent and we can get married this summer. Phew!
After we get married, we'll simply file to change the status.

As long as the H1B visa exists, we should be okay. We're also debating for her to quit her job and come to Massachusetts during the process. I assume if we do so, the H1B visa terminates and we would have to apply for the K1 visa.
