Hmmm, what a mess. And yes, the US president can not forgive a crime commited in SA.. Only SA officials can forgive that. Sounds to me though that he is still under a suspended sentence. Perhaps you will at least have to wait for that to be finished with before filing. After that Im not sure what the deal will be. I do know for sure though that they will absolutely not let him immigrate if he is still "in trouble". And I dont think anyone is telling you to "get out" of the US, we are just merely preparing you for the probability that you might have to move there if you want to be with your lovie. Its a hard pill to swallow, and I imagine you are somewhat frantic about resolving the issue.

People on VJ give their honest opinions, sometimes its not delivered in a politically correct way, but dont take it too personally. Coulda, woulda, shoulda's wont help you guys now, only cold hard facts will. He commited a very serious offense, one that he probably never intends to commit again. But cocaine is a serious problem in the USA and Immigration Officials do not look at it as though "oops, we were all young once". They look at it as "this man uses an illegal drug and we dont want him bringing those habits to the USA".

Nobody is arguing your intent or worthiness or anything. It's just that you've framed much of your case in terms of "how it should be" when that doesn't really play. I think if people are encouraging you to look at things in a realistic way, it's because they think your seeing the issue without blinders will be your best bet for success. It doesn't matter that marijuana is harmless. It's still a thing. It's still a roadblock. We are all hoping for your success. But wishful thinking, and any attempt to wiggle around the strict process, is going to end in frustration. I, for one, have been there. Ok ok, please try not to become defensive. All we are doing is giving you the honest facts. Nobody has a "cut and dried" case. I have been dealing with my immigration for 3.5 years because of various mishaps along the way. Im sure we would all LOVE to tell you that its going to be ok, but you came here for an honest answer, and we are giving that to you. Yes, you deserve to be happy, yes, you deserve to be with the one you love. As far as the US government is concerned what you want, and would make you happy, isnt necessarily what you are going to get.

We are just forewarning you of the hardships you face. It may well be possible that you get him in, there COULD be ways around it, but its going to be expensive, and very frustrating. Im sure every one of us on this forum wish you the very best, and I SURE hope it all works out. We are just telling you what you face, and what the law is.

If she has to move then that is ok. That is something you will tell the NVC when your case gets there. Keep in mind though, that her previous visa's will be asked about at her interview (not necessarily in an accusitory manner, but she had better be prepared to answer questions).

While not in a similar situation, I am a South African citizen living in Canada. It wasnt too much of a problem, they just asked me why I never naturalized in Canada, and I explained when the time came to naturalize, I met my US hubby and decided it wasnt worth the time and effort since I wanted to move to the US. When you are there, take lots of pictures with her, keep any mushy cards you guys have sent to eachother, boarding passes for aircraft, make notarized copies of the visa stamps in your passport, all of this is evidence of a bonafide marriage. Keep your receipt for her engagement ring as well, its big evidence not so much the price of the ring, but the fact that you bought one is key. The lease thing is good, because it shows you were in the UK, but since her name is not on it, they will ask for additional info such as all the other things I have mentioned. As for you finances, you will have to prove that you can afford to support the both of you, as with a K-1 visa, she will not be able to work when she gets there, she can only do that after you guys adjust her status.

Dont panic too much, it should all work out. But she does need to keep any documentation on the current student visa, and paperwork with regards to her appeal, sometimes they ask for these things at interviews. I know of a haitian man who applied for refugee status in canada, and met an american girl, married her and went for a CR interview, and they asked him for all of his refugee documentation, even though it had nothing to do with his CR visa, I think its more of a character thing, to make sure the applicant isnt "visa hopping" to avoid their own country.

Just so you know though, if for whatever reason they dont give her a tourist visa.. the K-1 (once approved) gives you 90days to get married. In that 90 days she can come and stay with you and you guys can use that to figure out where your future is headed. This is just advice for if they dont want to give her a B1/B2.

If she tells them she is considering moving to the US, its almost a guarenteed that she will not get a visa. A few questions though, does she have a car? property? good paying job? If she has all of these things, they might consider it. And just as a side note, my first B visa was 180 days, but I showed VERY strong ties to canada (lease agreement, manager at my job, family, return ticket, vehicle..etc)

HOWEVER, that being said, if she tells them she is just going to visit, and you guys get married and try AOS... you will find urself in big doo doo.

And by the way, she will have to apply for B visa at the US consulate closest to her.. and getting the visa doesnt mean automatic entry into the US, they can still stop her at the POE if they feel like shes acting nervous or trying to hide something.

Hello everyone,
I have been unable to find a clear answer to my question, even after searching the forums. I hate duplicate question posting as much as the next person, so i really did try searching. Anyhow, i hope someone can give me some first person experience feed back on this issue.

Ok, I am at that stage im sure everyone has been at where my lovely lady friend and I are feeling pretty sure marriage is in our future. Ive been there to visit her in England and now her visiting me is our next step. But despite how sure everything feels, we want to be positive before making such a big life change. Vacation/Holiday time is tight, so we can't make monthly visits to each other. So one option we're trying to investigate is the idea of her coming here on the 6 month Tourist Visa and living here with me to get a true feel of life together. Of course during this visit we would become "officially" engaged and would like to file and start the process (if everything feels right). Once the time for her interview is given, we'd both fly back to England for her Interview and hopefully be able to stay long enough to receive her K-1 visa and return together.

Now, i guess im just trying to make sure this is Ok to do and wouldn't throw up any red flags. Has anyone done this method before? We would not be getting married while she's here on the tourist visa. She would be getting a round trip ticket for the stay. What is the best way to describe this when going through customs/immigration? Or should she just say "im here as a tourist"? Of course she'd be living with me. But we just feel those months could be vital in making sure we're not rushing into anything. But we want to do it right.

Thoughts, opinions, advice? Big thanks in advance.

Seems legit to me, as long as she doesnt overstay whatever time they give her on her I-94, ofcourse, this is assuming they let her in at the border (sometimes they get snarky). The big thing is that she shows sufficient ties to her country (lease,house, job, bank account etc). Once she is in the states, you may get engaged and send off the K-1 app, but if the expiration on her visa happens before the interview, she will have to go back to her country. While she is in the US with you, take lots of pictures with her and your family, give eachother lots of shmushy "i love you" cards.. all this adds up to evidence of a bonafide relationship :)

If anyone else has input, Im sure it would be appreciated. From what I can see, you should be ok though. The biggest deal is getting into the States. If a border patrol agent feels like she cant establish sufficient ties to her home country, then no B1/B2.

Is there any way you can call the consulate and enquire about it yourself? It wouldnt hurt to call your congressman, if they have kept copies of the documents, at least someone in Peru can look at it and tell you on what basis they denied the visa. There might be some misunderstanding on something, perhaps an additional thing that can be provided (receipts from paying for your wedding, invitations). Sometimes its something silly that they need. Call and find out. I dont think your congressperson can help you, but you never know if you dont make the call. I would call/email the consulate as well if I was you.

Oh thats heartbreaking, Im so sorry. Congressmen cant unfortunately force a good decision in your families favour, in fact, Im not sure they could even look at B1/B2 applications. Did they say why it wasnt good enough? Usually they will give a reason as to why they arent issuing the visa.

If all else fails though, go through with your wedding here (you only have 90 days). And after that, when she has adjusted her status, and received her GC, then go to Peru and have a celebration there! (Not many people have a good reason to have 2 weddings!!) Not that you could get married legally twice, but you could have a ceremony, she can wear the same dress even (not too many brides get to wear their dresses twice either).

I am sorry for your unfortunate luck there, you could try your congressmen, he might be able to find out why it was denied, and perhaps it could be fixed in time.

that's exactly what I'm scared of, that another agency will be picky and make a big issue about a clear error like LPEZ instead of LOPEZ (I mean, have you ever heard of Jennifer LPEZ? or George LPEZ? of course not, I don't even know how you could pronounce it...). the only thing I'm sure about is that I've got to leave by the middle of May, but anyway I think they'll be able to fix this thing by then.

This sounds like a case of procedure not being followed and they started removal proceedings on her, not realising she had left the country. A good immigration attorney can untangle those wires. In the mean time, accumulate TONS of evidence of your relationship as well, as this is her second K-1, there might have been some problems there too.

This shouldnt be too complicated to overcome, especially if you have a well qualified attorney. Just a few more months should clear it up.

I would suggest writing the USCIS (local office that you sent the original I-129 into) as well as the NVC and inform them that you intend to withdraw your approved I-129.

The rule is to rather have it and not be asked for it, than not have it and be asked for it..

It seems they are taking about the same time these days. Usually K-1 is a bit faster, but then you have to wait to work in the US. CR-1 is a little bit slower (2/3 months) but you get to land and work right away.

I think thats probably a good idea if you dont have too much proof... start taking lots of pictures!! And keep a few emails. It also helps to send eachother a real card/letter everynow and then. That way it is something to take to the interview, and a nice thing to have as a keepsake later on.

Keep everything! Thats the rule.. CR-1 is nice, because you can work as soon as you get to the US, and it is a smidge cheaper than K-1.

As long as you have a few pictures together, and he kept his boarding passes/copy of plane ticket, you should be ok. Also, if he can get a copy of the stamps in his passport, that will be good too!

Did he buy you an engagement ring? Take the receipt for that. Emails that you guys have sent backwards and forewards, phone records to show how much you talk.. all of these are ok. For the K-1 you only have to prove that you met physically at least once in the last 2 years. Your childs birth certificate is also going to be required, as well as a consular report of birth abroad for the child.

Good luck, a K-1 is what you need if you are not married :)

Yes, a police clearance from every country the benificiary has been in for longer than 6 months since that person was 16. Usually you go to the local police station and request one. It really depends on where you are from.

Hey, no worries I'm not at all insulted. I appreciate everyone's help on this matter. Now, I just have to figure out how to get certified copies of all this stuff!


Call the courthouse in the state/county that you had all these problems in, they will send you everything you need. Also if you were on parole/probation, call that office as well. Im not sure how long it will take, it varies from state to state, my hubby's was in clark county, nevada, and he got copies of all of his stuff in 3 business days :)

If you have a joint sponsor (I did) they ask you some questions about the sponsor. They ask for your paperwork, and passport. And if all is well, they welcome you to the USA!

No, the USC is not REQUIRED to be present at the interview. And since your fiance is not in a "high fraud country" you really dont HAVE to be there. As long as he has LOADS of "relationship" evidence with him ( photo's, engagement ring receipts, copies of boarding passes from visits etc..) then he will be ok :)

From and emotional standpoint though, it can be very nerve-wrecking, and sometimes having ones significant other there can help.
