So I haven't filed my taxes in 2 or 3 years! (major procrastinator :bonk: ) will this be a problem for me to file for the affidavit of support? or worse, cause our application to be denied?


YES!! It causes major issues, go and file them ASAP, the consulate needs to know if you can support your spouse, they do this by looking at your taxes to see how much you declared to the IRS in earnings. No taxes... no affidavit of support.. no visa..

See if you can go to one of those same day places and back file your taxes... :bonk:

Our lawyer actually made ours worse. First he spelt Canada wrong on the forms, and then put my husband down as my son. Then finally after ALL that and taking our $2600.. he vanished into thin air, and left us scrambling to pick up the pieces.

Yes, if you have an NOA2.. you can bet your bottom dollar theyve done a background check on him. That is what the first part of the whole application process is about.. making sure the USC is eligible to "import" a wife. See, look at it this way... he is already in the US... its not like they can kick him out because he had a DUI... HOWEVER.. you are the one COMING to the US.. they can keep you out if YOUR record isnt clean. :D

Its good that you have CRBA... I was a dodo and didnt get it for Amy.. it was over the olympics too and the Vancouver consulate that I had to do it at was closed to the public...so it added an extra 3 months onto my visa.

So stop fretting, it sounds like you have all your I's dotted and T's crossed :)

Not at all. That is what the USCIS does, first they check your hubbies background to make sure he is eligible to bring you over, once it has gone to the NVC, then your petition starts. Like I said earlier, the only reason they would ask at your interview, its to make sure you really know your husband, consider it evidence of a bonafide relationship :)

HAHAHAHAHHAHAHHA.... We hired an immigration attorney.. turns out he couldnt even spell canada right, and he listed my husband as my son on our application.. it was rediculous.. one RFE after the next. Eventually the attorney vanished with our money.. devistating as that was, it was the best thing that happened to us, because then we found Visa Journey and started getting it right!!

I wouldnt say that hiring an immigration attorney is helpful at all!! Thats just my story.. however, Ive come across others like mine too.

Lol... yes, one can speed through the NVC.. but the montreal consulate is a major speed bump/brick wall. Quite possibly the most trying part of the whole wait, as it feels like your file is being used as a doorstop/desk pillow in someones office. Last year our case cleared the NVC on the 18th of October and we had our interview on the 11th of February... pretty close to 5 months.

Yup,,, all I had to do was go to the SS office after I got my GC. Then a drivers license after all of that. All in all took about 5 weeks to have everything I need to work, drive, pay taxes and get on my hubbies bank account.

The spousal visa is valid for 6 months. Your spouse will HAVE to get to the USA by the date of expiration on that visa. Then he gets his greencard and Social Security card mailed to him. Failure to move by the date on that visa will mean that you will have to start alllllll over again.

You will have to fill out the affidavit of support. However, you will need your father to Co-Sign it. :) Its kinda like getting a car loan. If you dont have enough credit, you still fill out the primary loan forms, but you get someone else to cosign on the loan.

I think the folks over at the NVC are used to the frustrations that USC's and their immigrant spouses express over the issue. I dont think there will be any retrobution over this. As previously posted though, only time will tell.

Are you missing documents in your file? What was the initial question that he asked them?

The same thing happened to my hubby and I. You might have filled the forms out incorrectly as well. We got a case complete and our interview booked, we just had to supply the correctly filled out form at our interview. Also, bring oodles of proof that your co-sponsor is eligible to sponsor you.. taxes, and all assets and savings that person has.

Its as simple as this.. on her B1 application form, and I believe the visa itself, it says that it does NOT guarentee entry into the united states. What she will have to do when she comes to visit is show strong ties to her home country.. job, bank account, apt lease, car loan... all these things, as well as be knowledgable about where she is in the immigration process

Example " Hi ma'am, what is the purpose of your visit in the US?"
Wife "I am here to celebrate my NOA2 with my husband, we have filed for a CR-1 visa, here is the NOA2"

If she shows that she has ties to her home country and isnt just going to abandon them to stay in the USA, and show that she is immigrating, and understands she has to leave the US to go for her interview at her home country, then all should be well, and they should let her in.

Contacting a Senator probably wont do much, but if it will make you feel better then go ahead.

She is more than welcome to apply for a B2 visa.. being approved or denied on that will not affect her immigrant visa application. However.. because of the immigrant visa app, it will definately be much harder to get an approved B2. She will have to show VERY strong ties to her home country, and even then they might still say no.

Keep in mind too, that even if her B2 visa is approved, she could still be denied entry at the border. It is CBP (border protection's) final say as to whether she gets in or not.

I know I sound like a doomsdayer.. but im just preparing you for all the possibilities that come with a B2 app whilst there is an immigrant visa application going on. :)

We sent a marriage cert and birth cert... the rest I brought to my interview and they didnt even really look at that. He saw that I had pictures of me and my spouse and said "oh, are those pictures of you 2?" I said "Yes, would you like to see them" and he said "no, I dont"...And yet some people have been asked to provide them. Its really best to have it all and not need any of it, than not have it and have them request it.

Yes, he wont be allowed into the interview room with you, however take his passport into the interview with you and let the IO know he is right there if any questions need to be asked. Usually he would be allowed into the consulate, but not all of them. Often it is a good thing if the spouse is there. It helps re-inforce that this is a valid strong relationship.

Well, the silver lining here is that you found out before all of this really got sticky. You hold ALL the cards here, you really do have him by the short and curlies on this one. My husband and I have eachothers email passwords, facebook passwords.. so on and so forth. We have nothing to hide from eachother.

I would ask for his email password, and for this womans phone number. If he says he doesnt want to give it to you, then its time to yank the immigration application. If he is hiding things from you and acting squirrelly now before he even gets here, its only going ot get infinately worse once he is here, GC in hand.

Im sorry you have to deal with this. Just be happy this came apart at the seams now, and not later. (F)

ARG.. I tried to edit my response... here is a more indepth reply

The OP is engaged, this makes them ineligible for DCF, it is only available to USC who are married to a foreign spouse, for the most part application is the same as for a regular I-130, and it does appear to be a little bit faster than regular applications. I believe since it is a "spousal visa" and therefore it would have to go through Montreal.

A quick email to the USC services branch at the Calgary consulate will be able to point you in the right direction. As it stands now though, you will have to be married before you can go that route.

Also there are a few ground rules. The USC will have to have lived in the foreign country for 6 months prior to the application

Before abandoning the K-1, another route to try is for the USC to contact a local congressman or senator. They can put a request in with the consulate that usually gets answered pretty quickly. I know it helped in my case, I would give it a shot if I was you, before the time and money of a new visa application.

Your husband needs to call the IRS, get his transcripts for the last 3 years, and mail them to you. If you can, take them to the embassy, if the embassy does not allow drop-offs, then overnight mail it to them.

They need to follow rules too, and many of us here have not had just one piece of paper or something we considered rediculous, and have been told to mail them in. Its definately not a denial, its just a "we need a little more info". It sucks to have to wait longer, but its not the end of the world, and its certainly not a potential denial.

Im gonna go out on a limb here, you should be ok, if you can get a letter from the clerks office saying that they cannot get a copy of your divorce decree, and they should state why.

Other than that, contact your divorce attorney and your ex to see if either has a copy.
