No, the USC is not REQUIRED to be present at the interview. And since your fiance is not in a "high fraud country" you really dont HAVE to be there. As long as he has LOADS of "relationship" evidence with him ( photo's, engagement ring receipts, copies of boarding passes from visits etc..) then he will be ok :)

From and emotional standpoint though, it can be very nerve-wrecking, and sometimes having ones significant other there can help.

After 3 and a half years of fighting with immigration, and a 221(g) that took forever to process, we called our congressmen. Even then, she got a canned response, and waited 2 more weeks before she inquired again.

It should be left as a "last resort".

CBP is Customs and Border Protection and identifies the agency whose task is protecting the borders. Patrolling the borders is the activity of the officers in the white and green SUVs physically checking the borders. Hence the words "border patrol" on their car. It's the same as those cops with "highway patrol" on their car. you wouldn't say that their department is the highway patrol department, but it isn't incorrect to refer to them with that name.

Yes, CBP (border patrol) has the final say on who comes in. If they deem you to be inadmissable, even after allllll the paperwork and consular approval at your interview, they can revoke your visa. Its quite rare and usually for a HUGE reason.

She can apply for a visitors visa, and whether its approved or not will have no bearing on her K visa. HOWEVER... it is EXTREMELY hard to get a visitors visa while applying for a K-1. This being because the officials at the consulate, are automatically going to think she is trying to come over and marry and then adjust status.

To get a B2, she will have to prove strong ties to her home country (owned house, long lease, owned vehicle, job, bank account with money in it etc etc etc). There is also no guarentee that even if she gets the B2, that she will be allowed into the US.. its all up to CBP when she flies/drives in.

It could be a big waste of money, for some dissapointment. However, it will not harm your K visa process if she does apply for a B2.

Im with Vanessa and Tony on this one.. he has 6 months to use the visa after it is issued... apply for K-1 and upon approval, give his work notice, as you say thats only 3 months. That leaves him with 3 months to pack up and get to the US.. plus another 90 days AFTER that to get married. You will be fine. This is the very reason they give 6 months to use the visa... because they understand (one of the few things they make convenient), that people cant just pack up their whole lives in a few days and move.

Sorry I should have specified. It's not ALWAYS required but if you're married they tend to assume the child is the husbands. When you're engaged (like the OP) they tend to ask for DNA. But then i honestly think it depends on each situation/country.

I would make sure I brought plenty of proof of an ongoing valid relationship.. looking at it from an immigration officers standpoint, it could look like you are marrying to get in after previous denials. As long as you have plenty of evidence to overcome that objection, you should be ok!

That should be ok. However, on the next convenient day I would to down to the nearest SSN office and notify them.

He can file for an SSN and a work permit as soon as you guys are married. There is no waiting period. And no, these benefits are dispersed to YOU, you will not have to give them up. However, you will most likely need to find a co-sponsor for your affidavit of support.

There was a case here on VJ a few months back, where the visa was denied after they showed money transfer receipts, as it looked as though the USC was "buying" the immigrant. Now, after saying that, I will say it is VERY rare. I took western union receipts to my interview, and they werent even looked at. I asked the IO if he wanted to see them, he looked at the pile and said "I dont have time to look through those".

It varies from consulate to consulate. She can take the receipts, but in her consulate, I wouldnt offer them if they arent asked for.

This process is very tedious, and takes a lot out of all of us. There were a few times where my husband and I almost filed for divorce because of how heartbreaking it can feel. Now that I am here though, things are wonderful and we are so happy together. Make very sure that you guys do not want to follow through with this before you send your withdrawel in. It is a lot of money to throw away. If you do truly feel like it is over, then end it, but make very sure that is what you want to do.

If the reason for your denial was that you didnt get the BC to them on time, then yes, you can re-apply for K-1 and this time make sure you read ALL the guide lines correctly.

If there was another reason, and its not super serious, then I would suggest flying out to meet your foreign spouse, get married and file for a CR-1. (You were going to have to get married with K-1 anyways). Then re-apply with an I-130 app. Again read all the guidelines, even the small print.

If its a horrendous reason that there is NO coming back from, make plans to move to fiances home country. Its most likely something small though, and easily overcome.

As for arriving on VWP or obtaining a B1/B2, it is highly doubtful, one quick run through their handy dandy big brother computers, would tell them that there was a petition for a K-1 that was denied, and your fiance would be denied at the POE.

I would start petitioning her NOW. For a couple of reasons. You don't have to petition another person, the cost for K-2 is over $1000.00 plus. The most important reason, when the baby is born here, the baby is already a US citizen, no more petition for the baby. You save time and money if you do it now. Who knows, your K-1 application might be quicker because of her situation. If the baby is born in the Philippines, the baby won't be a US Citizen. You have to file a separate K-2 for the baby along with the K-1 Fiancee Visa, if the baby is born in the PI.


Have you read what was posted before this??? His child IS a US Citizen.. him and his fiance just need to present the child to the US consulate in Manila and file a CRBA... there is NO K-2 involved. K-2 visa's are issued to step-children of US Citizens.

Please make sure you know all the facts before giving out false information. :bonk:

I did a CRBA for our daughter (I was the immigrant), I had all the documents needed, which were as follows

1. Childs long form birth certificate (this has both the mothers and the fathers information on it)
2. Proof that you (USC) have lived in the USA for 5 continuous years before the child was born (I took high my hubbies high school
transcripts for K-12)
3. Fees have to be paid in US funds (I took a money order)
4. You apply for the childs SSN and Passport at the same time

And of course the application form needs to be filled out, its very easy to fill it out, one of the easiest in the whole process.
NOW, since she is in whats considered a high fraud country, and you guys wont be married, you will most likely need a paternity test done on the child as well. If you were married, it probably wouldnt be asked for.

ALSO... the CRBA will be needed at your wifes interview if its after the child is born. They would not issue my visa until Amy's USC stuff was dealt with. She (your fiance) will need to take the certificate/passport to her interview.

The whole process took about 3 weeks and I had our daughters passport and certificate of citizenship. They date the childs citizenship from the birthdate, and he/she enters the US with the immigrant spouse as any other US citizen would.

Yes, they are slow in returning emails, but phone calls are rarely ignored. You will have to sign a privacy waiver for them to go ahead and work on your case, usually they will allow this to be printed off the internet and faxed to them, along with your case number your full name and the beneficiaries full name.

Now, the senator him/herself will usually not get involved, but their offices usually have "immigration liasons" that deal with this sort of thing. They will get in contact with someone at the Algiers consulate and hopefully stop your case from leaving the consulate. At which point you will hopefully get a second interview. If it happens to get back to the NVC before they contact the consulate, they will work with the NVC on finding out exactly what made them question the validity and hopefully get it sent back to the consulate, and which point you will want to bring EVERYTHING you have that proves your relationship is legit (letters from family on both sides, more pictures and emails etc).

As for CR-1s being denied after K-1's I dont have any statistics at hand, but usually it helps a little bit.

I dunno if domicile takes longer or not, of if it just all goes into the same black hole...Tired of crying over this nonesense.. about a week before the 4 week mark, Im gonna call the congressmen and get a foot in the door!

Its pretty bad when you send and email and they dont ever respond (still waiting on the response from one I sent in the beginning of february), you cant call, because its just a robot you get to listen too. So congressmen is the way to go!
