i totally agree with this. i had waaay to much evidence than needed, organized very nice, and 2 photo albums. they ended up asking me 4 very simple questions, and that was it! so it definatelly helps to have more evidence than less. :innocent:

Yes Veronica just had her interview.. they were impressed with the way we laid it out....
We used those White binders with permanent Clear Sheet holders...12 of them..and a place to put a table of contents on the cover I got them at Walmart..something like $2.99 ea.
I had three Binders..

Financials. I-134,Employment letter,Back letter,1040,Wage Stubs,Explanation Letter,Bank Statements

I-129F Original..of everything

Proof Of Relationship..Receipts,Pictures,Emails,Chats,Cell Records,Flight Info, Boarding passes,Copy of Passport Stamps, Anything and everything that included..Visits and on going relaltionship.. Also a Letter from her Mom and Friend that I did Visited.. Copies of the Ikobo Visa Debit Card I got her so I can send money cheaper..

Also I put a Table of Contents on each one..

I think there was 4 questions for her to..Something like

Where did you meet

What attracted you to him

Did he send you gifts..

Has he visited you..

Actual the Interview was the easyist part of this complete process.. At least for the Romanian Consulate...

I'm sure we over did it...But why waste your time in supplying "Just Enough" and who knows which consulate interviewer you will have...the easy one...or the a$$hole... So I'm a firm beleiver in bury them..then there isn't a question because they are all answered..

Plus we looked at the list of questions you find here at VJ... and we went over most of them...I send her a copy of the list I found of possible questions...and I put the answers next to them.. So she could study them..

Hey why walk into the interview unprepared when you have all the information here at VJ...use it..learn it...you have some months to be ready for each process...study..ask questions..My Moto is..."Better Safe then Sorry"

Just so the Newbies know...what the Consulate wants...for the interview

From the Romanian finace'
Passport
Birth Cert.. Translated if in Russian
Police Cert.
Court and Prison if the Police report shows it
Military cert. if you were in it
Marriage Cert.. It means..to show if you were married and if you were if your divorced
up to 8 passport photo's for the consulate and medical exam.
I-134 from Petitioner
Medical exam
Evidence of Relationship...
Any of the cert. that aren't in English or Romanian need translated to one of these..

Notarized Copies of Tax return (1040) for latest year which at this point could be 2005 or 2006... I used H&R Block..and my Bank notarized them..

Thats it... from the Packet 3...

Also if your not in Romania but your interview is there...start checking into the Visa requirements...that came into effect Jan 1st 2007....

Hey, not a bad idea! Kiev that is! If the problem persists I may have to see if they can change it....of course you know what that means; government red tape (no punt intended) and more delays if it can be done at all. :wacko:

Choosing a different consulate other than the one that covers the beneficiary's country of residence creates potential other jurisdictional problems so it is not a simple answer. Currently, a consulate that is not jurisdictional, is not obligated to accept such a case to interview. The closest consulate that a Moldovan citizen can get to without a visa is probably Kiev. The DOS may be forced to change the location or set up an IV unit in Chisinau if the problem is not solved.


I'm told the main reason for such a long wait is all the students that go to school in Romania need to be back there by the 15th... We are hoping things get better by then....



Update:
The President of Romania and Moldova had a look for themselves how bad the Visa problem is in Chisinau..they promised to open other offices to speed things up..
From what Veronica has told me it is already starting to ease up some....
But you diffently need a invitation letter from the US Consulate in Romania to get a Visa for your interview..(no matter what their Annex 2 by-laws say) The consulate knows the problem and what the letter needs to say... Make sure you ask for it when you send the packet 3 back... Also there is a week or so wait for the Visa unless you bribe them.. But it's better to start working on it as soon as you can..You never know what you will run into...in Moldova...As Veronica says... "Only In Moldova" LOL it's our personal joke :dance:

Ok, here is the situation. My lady got her K1 app. aproval (NOA2) and the paperwork is already at the US Embassy in Bucharest. She is a Moldovan citizen and Romania has jurisdiction in issuing the K1 visas. Here lies the problem. On Jan 1 Romania became part of the European Union and now all Moldovan citizens require a visa to enter Romania, which is where the US embassy (Bucharest) conducts the interviews.

The Romanian embassy in Moldova has a web site in which you should be able to register for an appointment......forget it! It does not work! My lady tried to go to the Romanian embassy and guess what.....there were about 2000 people waiting to get in, many of them sleeping on the street, in the middle of the winter, so as not to loose their place in line. It is my understanding that they are being very strict in issuing their visas and she cannot even enter the consulate to talk to them. Forget about calling. How does one get a visa I ask? The US Embassy so far has not been much help; all they said is that she will need a visa to enter Romania.

Yesterday finally I decided to write the Romanian Ambassador in Moldova explaining the situation. I included a copy of the NVC notice which states that the interview is to be conducted in Bucharest. So far no response.

Any ideas?

Those of you with ladies in Moldova be aware, and if you find a solution please let me know.

So far the only good thing for us..is you don't need a invitation.. So that means...from this point on Veronica will be working on the problem.. and will keep trying... We aren't in a big hurry for 3-4 weeks because I need to get my W2's and file my taxes...so I can send her the W4's... SO we have alittle slack time
I've been told they are going to gear up pretty soon...something about more places to apply at or something in that order..maybe they meant more workers..I'm not sure.. but I know they are aware of the problem.....

Yes bribes are very normal process ..

It's just business as normal... but maybe a call to one of the medical centers the Consulate gives you to express your concern.. and ask if you can pay extra not to have these done..

Also...I was scared of needles als..other then I get blood taken every 6 months.. but I needed like 6-7 shots before going to Moldova... Let me tell you...Shots in the arm are so easy!!!! 10 times easier the having blood taken...I hardly felt anything..
Now in your butt... don't flinch or tighten up...or your going to be limping because it's like getting a bruise... in both areas..Just relax...and look the other way... :)

they asked all things related to jobs of both, asking for pay stubs, employment agreement, w2, 1040, mortgage, retirement plan, bank letter.... and finished the interview with blue handed. she asked that W2 showed the income over the poverty line, why we need submit 1722 and they say they want to see net income of petitioner. Thats suck!

I know it is very hard waiting for the next step in this long and stressful process. But there is nothing we can do to expedite. Calling USCIS will only generate more frustration because they will give standard replies. Since a load of K1 cases were approved in the first week of Sept. at CSC. They will all be shipped to NVC in batches. It is possible that our files have already arrived at NVC, but not appearing in their computer system because of the backlog.

I am in the same boat as yours. I am also very anxious. Actually I can hardly get sound sleep. I amtrying to divert my mind to other things....in vain so far.

I know.... I'm having a lot of trouble sleeping! I need to relax.... hehe
Everything you said there makes sense and I agree with you, but it's hard to relax when I know that Christmas is coming and one week could make a HUGE difference.

Mine says sent to NVC

I was approved by email on 27 November 2006. A week later I got the hard copy N0A2 in the mail. My N0A2 says, "The above petition has been approved and forwarded to the listed consulate. Please contact the consulate with any questions about the visa issuance or if you would like them to forward the petition to a different consulate." My fiancee's name is listed at the top right of the N0A2 under Beneficary. Just above her name is listed an "A" number. At the top left of my N0A2 is our original WAC number. Has anyone else gotten an N0A2 like this or do all of your N0A2's say they were sent to the NVC? I thought that the NVC assigned the "A" number? But I got my N0A2 directly from CSC and it already has an "A" number assigned to it. Does this mean that my petition has gone directly to the consulate and bypassed the NVC? Thanks for any responses... because based on what I've read here on VJ, it seems most petitions leave CSC and go to the NVC, right?

Wow you started checking pretty quick.. I've heard you should start after two weeks.. So I was going to start next week..but I saw your post and thought What the hey... So I did a inquiry just now..

Well, as you can see we were approved on 11/29. I sent NVC an e-mail last week and they had no record of our case. So, I sent another e-mail on Monday (a week later) and they e-mailed me today saying my case has been sent to Rio!!!

My case number is RDJ2006XXXXXX

This is super exciting!! The e-mail said that it could take 10-15 business days to get there but I know that I can call/e-mail them. We probably won't be able to send our packet 3 to Rio before Christmas - which is only 6 business days away - but Merry Christmas to us!

If anyone else was approved around the same time as us maybe sending them an e-mail would help you. Calling sure didn't for us...

I did as your advise but i can not track the DHL. I saw someone got DHL number. How did they get it?

Works for me, I set date range to Dec 17 to Dec 19, and get a long list of shipments, Vietnam was at the top of the list. There were 166 packages sent in that range on the 19th.

Note there is no way to know that yours was in that package, also if package weight is 1 lb or less that probably will not be your petition.

Yep this works great..but be ready to wade through alot of Shipments if you use to large of a date search.. I did 12/9-19 and had 300+ hits..
the good thing for me is.. there was only 2 Romanian Shipments... 12/15 too soon most likey for me.. and 12/19 Yea this could be it... because I'm not sure when NVC got my Petition..

You can't tell if it's your package or not.... but if you are watching timelines.. and have a pretty good idea when it should be leaving.. and not to many others are leaving the sameday..you will have a good idea..which is yours...but it's all guess work..mainly something to keep your spirits up..
I was able to see mine leave..mainly because I called NVC and emailed them..they told me they sent it to our consulate on 12/20 but actually the only package to her consulate within +/- 7days of the 20 was the 19th.. So I just figured when they gave it to DHL and when DHL regisitered it was a day different... also my Fiancee called her consulate on the 22nd and they said they received a email telling them it was on the way to them from NVC later that day they did get it..like at 4:54pm..
It's all guess work.. but with a little luck you can get a pretty good idea and it's fun figuring this out...

This is only for employment based petitions, not K-3 petitions, so there is no expediting of our kind of petitions except for extreme family emergencies or other emergent situations.

I mainly use the service in my sig as they have the best prices and bill me once a month.. And number one reason is they send me a print out each month with my bill on all my calls to Veronica...
The reason you stated is one reason I don't use calling cards alot..as you hardly every get one that gives you a print out of your calls...
Also Yahoo Messenger voice..is ok... good rates usually.. and you can print out the call records..

I go by Chris D?????? but my Legal name is Christopher Allen D?????? I went back and changed everything to match my Birth Cert. and PassPort.. I figure if it matches those two..I'm not giving them any chance to kick it back..







It takes too long to get all that fixed and I'd have to jump through so many hoops on other issues at work if my name is changed now that is why I didn't.

Junkie, you would do well to listen to those of whom you've asked advice from. NO, the USCIS isn't going to cater to your idea that it's just too much trouble, there are too many hoops to jump through. I'm sorry you don't like your legal name...nevertheless the USCIS doesn't care what you like or don't like.

If you get denied, or your petition is delayed while you sort out this mess, then you can't say you weren't warned.



Even if I changed it with my employer that isn't going to solve the problem of my 2004 and 2005 W-2's having John on it either. And my girls interview is in three weeks, there is no way I can get all this done that fast. Thanks for the help I appreciate your input.


I don't technically use my full legal name either. Just the names I like. I haven't had a major problem yet. My SSN is in that name and so are all my tax records, HR records. Only problem I had was applying for my passport. I had to give them five years worth of public records showing the name I currently use and now my US passport is in that name. I put my name under the other name place on the G325. We got approved so hopefully you won't any issues. If it will make you feel better write a letter and give to your fiance and if, only if they bring it up she can give them the letter.

True, that won't solve the problem with the tax returns. Not sure what you'll do. But I'm fairly certain the embassy is going to check this out and see the discrepancy. If you don't like your legal name, why don't you do the legal legwork to change it?

Maybe writing a letter stating that "this is my legal name but I don't like it so I go by this name" might help?



It's not that I don't like my legal name. Trust me if that were the case I would have changed it. It's just that my legal name is asian name and it's not easy to pronounce so I just started using another name at places like work and school but all my legal documents have my real name on there.

I thought about writing a letter saying this is my real name etc etc but I don't see how that would even help.. Either way they have to take my word for it letter or not.

My girl knows fully why there is a descrpency and when she goes to the interview I told her to mention to look at the I-129F and the G-325a from me in my original petiton.. that will show that i disclosed that I go by the different name.

If they put us on AR because they have to check the descrpency on their end then so be it, I'm not worried about a little delay, i've already been waiting long time so a few weeks or so isn't going to kill us. I'm just asking people on this board if they have ever experienced something like this or heard of someone going through this problem and wondering if they still got approved.

All the replies so far are what people think will happen, yes that's what I thought too which is why I'm asking but I'd appreciate some input from someone who actually been through this. THank you all.

I have no plight at the moment in regards to the timeline. The timeline is right now NOT my main concern. I know that one day I will be under the same blanket of super-long waits at the CSC, though.

HOWEVER;

I am also concerned for other K-1 CSC filers like myself, and K-3 VSC filers. What I did was NOT complain about the difference in time it takes right now for an application to go through, but rather shed some light on the current situation and alert people who actually KNOWS these trends (because it's their job).

I believe something should be done to relieve the load of work on the CSC areas (which I noticed are the high-volume immigration states; AZ, CA, WA, OR etc.) but until then, I guess we cannot do anything but wait.

First of all, you don't really have to make all your text so big for us to read it. It sometimes is a pain to read text that big on a computer screen because it seems like more words to digest than there really are.

Anyway.

You really cannot explain it plainer than that. Read the instructions carefully, follow the instructions closely and you're good to go. What you have is called an RFE, or a Request for Further Evidence. When filing for your mother, did you miss something out for her? A document, something? If you did, it should be in the "MISSING DOCUMENT LIST FOR: GAYLE, EULALEE EUGENIE" list. If you didn't, I'd call to check.

Uhm, dude.. if you married her, she's not your fiancee anymore, so filing for the fiance visa is considered fraud. I say go for the K3. Might take longer, yes. But I believe it's a little bit faster after that when she finally enters the United States. So it works out either way, yes? That's what I believe. Don't quote me, I'm not sure on that! tongue.gif

As for a visitor's visa, I believe she *CAN* file for one, she just has to show intent of returning back to India, such as a current job, a return ticket, etc, something like a person travelling on the Visa Waiver Program. I mean, the process takes a loooooong time. You don't expect a couple to not see each other (or at least to not long for each other!) during that time. She should probably speak to the consulate (or wherever she files for travel documents) regarding this issue.

I know a lot of people not gonna agree with me but i suggest that you file 129f for k3, it's gonna speed up the process for your I130. your I130 gonna be approved along with your I-129F , trust me there is two cases i know got lucky in doing this.It's not gonna cost you anything. when uscis will approve your case,they will send both I-130 and I-129f which they gonna close .and that's good as long as they gonna process the I-130 , GOOD LUCK
