In about three days you can call them or like Monday...and they should have it.. Your lucky your SO is from Romania ..as that new transit visa law that came into effect Jan 2007 sucks... It's slowed us up 2 weeks or more..but it's ok..Veronica finally got the invitation letter today ..So she'll be getting the transit Visa next week....Which was one big worry...:)

Romania Consulate is very fast in the interviews...Once you send back packet 3 and they receive it..your interview will be about two weeks away... So you have a good chance at catching up with us on Veronica's flight here... She's leave around March 7th ..as I'll book the ticket two weeks in advance to save 300-$500.. plus they issue the visa that day..or the next morning..

you probably know this.. but because they schedule the interview so quickly..You need to get started on the Police..and Marriage Cert. as they could take longer then a day...also I'm not sure..but with alittle extra money you can get it the sameday...
And you need to send your original I-129F and everything else...I-134...Employment letter...Bank letter.. 1040, wage stubs anymore proof of relationship you have gathered.....
I used DHL to send my stuff and it cost $144 for 3.5lbs I just wanted to be sure it got there..but then Moldova's mail system sucks too..maybe Romania's is better...
I've made and Callina has made a detail list from the Packet 3... just do a search also Callina did a Embassy Review..

after logging in and out USCIS's website for more than 2000 times over the past 3 months, after hoping, screaming and yelling for 3 month, there comes the GOD DAMN NOA2 at 10:00PM EST on 1/24/2007. After jumping around all over the apartment, hugged my indian roomate(almost choked him :lol: ), and ran around the building for 15 munites, I am finally able to sit my ### down and share this news with all of you. WAITING IS NEVER EASY, I just hope all of you who are waiting for NOA2 will soon join me for the sort of excitement I am expereiencing now.

also want to thank everybody for being positive while I was waiting, your message didn't help me to get NOA2 ,but it does help great amount to survice this increditable waiting period.

Hello to all,

As I write you, Nadya is now in Kiev for her interview tomorrow. I pray that the i's are dotted and t's crossed. Not much rest going to happen until I hear from her. Of course, if I'm nervous it doesn't come close to how she feels. This has been a long journey. I can only waited and hope all goes well.

Her cell service is iffy...and then it's $3.00 per min on roaming.. So we can't talk like normal.. But the good thing is we are close to the end of being apart... I will tell you this.. if we are denied.. I'll be moving to Moldova.. .

Yep just follow what others have said... but age difference isn't that big of a problem if you go into it fully aware of the little bumps you'll encounter.. Lucky my fiance is mature for her 30 years and I'm still a kid at 49.. So we meet in the middle... I thought one could show proof of the legitimacy of the relationship at the interview stage, regardless of how long they've been in one. Maybe I'm mistaken. I've never heard of the 2-year thing.

Also, the OP wants to file for a K1 and not K3 (although he might consider going for a K3). Either way, the beneficiary has to be old enough for her to be ble to marry according to the laws in her country.

Maybe the two year comment has something to do with parental permission, which I believe is needed in Thailand. True, the OP mentioned the K-1. Someone suggested that he marry her and live there for two years and do DCF.

And yes, ultimately the beneficiary has to be old enough to be married...either in her country or by the laws of the petitioner's state. Either way, she still has to be 18.

You most certainly can still get temporary EAD at JFK (apparently its best to ask) , but there are very few other POEs that do it. I'm not sure why they stopped doing it.



This is what I'm asking and don't understand about. Why only at JFK (and a few others)? It use to be given out at ALL POES. I know for certain they gave it out at SFO. What changed and when?

I was just curious, if we have filed for the K-1 Petition last week, but my fiancee's passport is expiring soon, can she still renew it? It expires in February 2009.

The problem I foresee is that the passport number WILL change as the machine-readable passport will be changed into a biometric passport.

Or can the old passport though invalid, be used as proof that the passport number at the time of filing is indeed the same?

At the bottom of the G-325A (which I'm assuming both petitioner AND beneficiary have to fill out), there's a big black box that says:

APPLICANT: Be sure to put your name and Alien Registration Number in the box outlined by heavy border below.

If the Petitioner is a USC, and the Beneficiary does not have an Alien Registration Number, does this still need to be filled out?

Karl is a man of convenience; and we're not exactly affluent to begin with, which is why we went to the We The People people at the recommendation of a friend. It might have better success in other states, I do not know. But all I can say is that I will never trust them again.

Either way, I'm gathering up the updated documents and sending them to him again for him to re-file, or wait for an RFE (or six? haha.) and then carry on from there, with or without the We The People's help. We have found a lawyer who is not able to help us in the legal processes (he isn't qualified for immigration), but knows enough to see what is required and what is not, consultation fees need apply only.

I'm having a hard time with this, but you guys have been very supportive and informative thus far, and for that I am extremely grateful. smile.gif

In my opinion, this wouldn't have happened if the person knew what she was doing when she said she did. We specifically and personally asked if she handled immigration cases, and she said yes, and even told us that one of the cases was her brother's. So naturally, we went with it. A big mistake on our part, we now realize. We've made nothing but mistakes over the past two years, to tell you the truth. First time, we never got around to sending the form until a year later. A year later, it was sent by normal mail (something that woman would've done as well if I hadn't made a long-distance call to her bloody office from Singapore), and that one got lost in-transit. Now, THIS.

I wish there was an easier way to do this. And people wonder why there are so many illegal aliens there. It's because the legal process is so damn frustrating and painful. Trying to find an immigration lawyer is easy. Trying to find an immigration lawyer in Boise, Idaho isn't that easy. Trying to find an immigration lawyer in Boise Idaho that doesn't specialize with Mexicans is even harder. Getting one to respond to emails... heh. I've tried.

It's difficult for Karl and I to do anything together while we're apart. It's not that we don't want to. My work schedule and his work schedule are erratic, and the only times that we can call each other while we're both awake would be when he's at work, or when I'm at work where we're both not allowed to use the phone for prolonged period of time. We can only make short phonecalls, one before he goes to bed when I'm at work, one before I go to bed when he's at work, lasting a total daily average of about 2 minutes.

I was just curious though... anyone know any immigration lawyers in Boise that may be able to help?

Karl and I have a very low budget, so I'm not sure if anyone will even take up our case. sad.gif

I understand, but that is not really the point.

To be sent an RFE, have some of the information sent to me and then sent back when in proper order, and then sent AGAIN to the USCIS seems like a lot of unnecessary work that could have been done BEFORE filing. The problem could have been eradicated before it even started.

It's already taken enough time as it is.

Furthermore, we're filing with the CSC which means that it'll probably take EVEN longer, with no guarantee that the bloody documents won't get lost in transit.

If it doesn't get lost, it gets delayed.

One more day of my life I don't get to be with my guy.

I just spoke to my fiancé (the one who's petitioning for me) and he told me he has sent the documents to the CSC. I know the CSC is taking a long time but we don't have a choice as he lives in Idaho.

The thing is, he sent the petition through We The People because the last time we tried to file it ourselves the documents were lost and never reached the service center, and we did not know this over the course of more than half a year.

However, he tells me that all he had to send as told by the person over at We The People was the I-129F form, that's it, and that's what he did. No G-325A or whatever, nothing. No letter of intent, no evidence to support our case, just the I-129F. I was surprised, because he didn't send me anything to sign, like my biographical information or a letter of intent to marry him before he sent the documents to be filed.

At this point, I'm confused.

How is a case going to be built from NOTHING?

In other words, it's okay to do it, just do NOT get caught. The consequences may be severe, and you may not be given the chance to file for a K-1 ever again (the denial to file is what I heard, correct me if I'm wrong)

It might be better to hold off on a wedding for now.

What symbiosis said is true. If you get married (wherever) and file for K3 visa, you will still have to submit an I-129F on top of the I-130, so might be just easier to do the I-129F (K1) and not get married until you enter the United States. Either way, you would have to be in your country of residence for your consulate interview.

I'm not sure if you can withdraw your affidavit of support at this juncture, because that will almost result in an instant denial. Instead of just emailing them or writing them a letter you should call the consulate just to be sure that they have indeed received said letter and are looking into the matter.

I do not want to judge your choice in the matter, but being too quick with finding another girl so soon might raise some eyebrows on both sides. I recommend you get to know this girl really, REALLY well before petitioning for her, marriage broker or not.

To the OP: If you are getting married Wednesday, then your K-1 application will be void. No amount of appealing will help you with it if you are married. YOU HAVE TO BE SINGLE AND ENGAGED. *AND* you have to prove that your relationship with your fiance is real, and that you DID NOT get engaged just to be able to move to the USA.

Proof could include:
Photographs of both of you together
Written statements of both your friends and/or family
Chat logs, emails, phone bills, anything to prove constant communication

Tell you what you can try... instead of pressing through all four sheets, fill in each sheet by hand, individually, with a separator in between so the carbon doesn't get pressed through for legibility's sake. I also noticed that you are right, there's only a single sheet on the form available on the USCIS website.

The last time I filled out a G-325A was two years ago, and back then it had four copies. I'm not entirely sure if you need four still, if they're only giving out single-sheet forms, but I'd advise you to check your I-129F and see if they actually mention you need more than one copy.
