I tried to make them change my birthday in the report, it sates I was born January /1 /1900, so I am 108 years old!!!!! as of September last year, they are not making any changes, they suggested I go to Fiscalia, and to open and investigation,(at least 2 years) so they can find out what was wrong!!!!, now I did talked to consulate in Bogota, and they suggested a solution, which is feasible, so call them on Wednesday, you have plenty of time.

You could use the actual trip ticket to prove it, you can get it , if the trip was in the last 3 years, from the airline. going to DAS is useless.

Our's does not have her exit from Aruba for a 5 day vacation but clearly she did exit and has itinerary and passport stamps to back it up. Is this not sufficient?

Joe, the Certificado Judicial (Police Certificate) is needed for all visa applicants and will show your fiancé's record in Colombia. The Migratory Movement letter (Carta Migratoria) will show all her entries and exists from and to Colombia, even if the person has not traveled outside of Colombia he/she needs to get it so the embassy can verify the information. Both can be obtained from the DAS. The Certificado Judicial can be obtained in any DAS office in Colombia and I believe it's valid for 6 months, but double check that. The Carta Migratoria can now only be obtained in Bogotá, so if she wants she can get both before the visa interview.

Her certificado judicial will show her record, so it should be empty without any notations since she hasn't been in any trouble, she still needs to get her Carta Migratoria from the DAS as well even if she hasn't left the country. As far as fo the immigration records, the US Embassy should have records of this and she needs to be honest about it.

Yes, the 2 notarized I-134s should be enough for the sponsoring part of the process. The only services I've used is Express Mail and it usually takes about a week to get to Colombia but wait for other members to see what they've used.

Now to get a passport in Colombia takes 2 hours, in a consulate, depends, and you are right, Colombians need visa for almost everywhere(except Vietnam), so to have one is better specially if you are not going to live near a big city.

Yes, she'll need a Colombian passport to travel internationally until and if she files for Naturalization here once possible. As for renewing... she may have an easier time here at a Colombian Consulate since their workloads are lighter than going through the normal channels back in Colombia. The GC pretty much will allow her to qualify for most visas US Citizens can get but she'll still have to apply for visas most of the time. Without the typical denials normal Colombians would get.

Y papá... si quiere ir a nuestra Isla del Encanto no te preocupes mano. Como somos colonia gringa no hace falta pasaporte gringo ni GC. She can travel to PR at any time once arriving in the US although USCIS gate agents at SJU may ask where she's from and where she's going to upon boarding the return flight from PR. No worries- have her Colombian Passport with visa available if they ask for ID, and leave the I-94 she gets when entering the US the first time in there too just in case. She'll need it anyway to check in on the way to PR since you need Gov-issued ID to get past check-in and TSA.

if you are accusing the notary system of corrupted you have to have evidence, it is still one of the reliable systems in Colombia, what is truth, is that you can go to a notary Public and swear that such and such child is yours, and then based on that you go to registraduria, and say that such statement is true, from there you have a certificate, which is legal, but the CO, interpreted that there is something to be looked at, since the papers are not coordinated. Now, the DNA test is extremely reliable, so if it comes back negative, the CO was right, if not, the CO was just doing his job.

Hello Erika,

If the result for his daughter comes back negative then her visa will be denied and there is nothing you can do. A visa can only be granted to him and his biological children.

As for your comment to replace the CO, you can't take it out on him and instead put yourself in his shoes. If you're the CO and a couple comes to request a K1 visa for him and a daughter they recently registered as his, what would you think? Of course there would be doubt about it since in Colombia anybody can pay a few pesos to a Notary and have the birth certificate done with whatever info you want in it. I still don't understand why he requested a DNA for your daughter as well since she's already a US citizen, but as far as his daughter goes, I totally understand where he's coming from.

In the newer colombian passports, in the page where the picture is, on the upper right hand corner says: passport number, the problem is that in the space underneath, there is no number of passport(smart move in the contract), but a line bellow, there is number CCXXXXXXX, which is the cedula de ciudadania, so some smart people,(like the secretary of dr Roa, use that as a passport number, it is an obvious mistake, an as long as you are aware of it,(you change passports but never a cedula), it can be explain and corrected.

Hi VJ,
I am a US citizen residing in Colombia (have lived/worked there for 3 1/ years) and my fiance and I plan to marry in a civil ceremony this spring.
I am at home in the US for Christmas and want to go back with documents I may need for the notary.
I know according to the Embassy's info (http://bogota.usemba...v/marriage.html) that I need an apostilled birth certificate and I also need the equivalent of a Colombian registro civil saying I am unmarried/have never been married.

Some notaries may allow you to present signed, notarized letters from friends or family, swearing that you are unmarried.

Has anyone done this? Can anyone give me any ideas on even what exactly the letter should say? I am planning on just having a letter from my father/parents---or 2 letters, one from my dad and one from my mom.

Any advice would be greatly appreciated!

Thanks...I have thought about asking a friend, though there is really only one I think I can ask, as now most of my friends are married with babies or young children and I don't know that they would be eager to take on other "dependents".
I am confused about what you mean about my fiance being "by himself" (I'm the woman in the scenario, btw... biggrin.gif ). The way I have understood it, the sponsor would be responsible for 3 "dependents": themselves, me, and my fiance. That would figure out to an income of $22,000 to meet the 3 person 125% guideline. This is correct, right?

Yes, you're grasping at straws. Either option COULD work but far from a sure thing. As a practical matter, unless you're retired or flush with cash, living abroad during the visa process means you'll need a co-sponsor. Of course, you have few months before the I-134's need to be submitted.

I'll look into having money in my US account or having my US job more when that time comes, but I will be living and working here in Colombia for the entire visa process, no two ways about it. Wow, obviously this is news to me and a new kink in the works. The most likely candidate for the sponsor would of course be good old Mom and Dad...but I am really hoping to avoid going that route. They have not been overly enthused, to say the least, about me living in Colombia at all and it will take a long time for me to work up the courage to even tell them about the engagement...then to have to ask about sponsoring? Ugh.

Would borrowing money to have in my US accounts do anything to help me avoid the sponsor?? I'm pretty sure no, but I just thought I would ask.

What about when I have a job with a high school in the States (which I should have by Spring)? Would a letter from that employer do anything to help me avoid the sponsor??

Hi All,
I have lived in Colombia (in 2 different cities) for the past 2 years, but lived in each apartment for about 10 months before going home to visit my parents for about a month in the summer. I will be living here for the next year also as we do the visa process. I have not "resided" at my parents' home in the past 5 years. But it is the address I use to have mail sent and such. However, I want any correspondence from the USCIS sent to my address in Bogotá, not my parents´address.

How do I reconcile all this on the forms? Does my parents' address need show up somewhere, as proof of "domicile" in the US? If so, where and how?

Also, on the I-129F form, Question 14: Address in the US where your fiancé intends to live? What do I put? We are living in Colombia until the end of this process and then moving to New York City together and finding an apartment together. Said apartment does not yet exist. Do I attach something explaining this? I'm certainly not putting my parents' address...

Any help is appreciated...

No, good Lord, I am the one who is confused. Thanks for the reassurances about going the K-1 route. I just got really freaked out that I had possibly done all the wrong work!
I guess as for a permanent US address, I consider that to be my parents', as that is where I have mail sent and what I use for my US bank accounts, etc. But.....my parents have never warmed up to the idea of me living in Colombia at all, so it will definitely take some gentle talking and a lot of waiting for them to warm up to me being engaged to a Colombian! sad.gif I am not saying they would sabotage this by not forwarding on correspondence from the USCIS, but I know I can rely on my sister and it won't be a whole big emotional thing.
We looked into all 3 options (K1, K3, DCF) and he and I are really most comfortable with K1 and it seems to work best with our timeline. We want to get married in the US. Also, I am pretty certain I have a close, reliable friend lined up as his co-sponsor.
So, if that is all settled, and I can really send this packet, my last question is:

How do I go about using my sister's address? Would that be the address I would need to write on all my correspondence (cover letter, letter of intent, etc) to make clear that that is where I want all correspondence sent (and then she'll forward everything to me)? Right now I have my Bogota address, so maybe that is not the best idea. Someone here told me they put their work address, so I guess it doesn't have to be a residence? Maybe I'll put her address as the answer to #14, fiance's intended residence. We might end up staying with her when we come back anyway.
Do I need to attach a letter explaining that?

I'm sorry to ramble...This whole process makes me feel like I am losing my mind. And we haven't even started it yet!! dry.gif

Yes, you will need to have someone forward the mail to you. The K-1 is for US citizens who are resident in the US to file for a fiance to come and marry them. That is why they request a US address - you are living in the US and requesting permission for a foreign national to come and join you in the US. If you are not in the US, then there is no reason to petition to have someone join you in the US.

If you are resident outside of the US, then you don't have the option to have a fiance 'join you' as you are not in the US, but you do have the option to get married to that individual outside of the US and file DCF for your spouse. This requires you to have legal residency of some sort in the foreign country. If you have legal status while you are in Columbia, you might want to check out this option.

Most individuals do not have the option to spend time living with or near their fiance/es in the foreign country as they have to work to satisfy the affidavit of support requirements for when their foreign partners join them in the US. Separation, unfortunately, is a part of most long distance relationships, and no USCIS really doesn't care if they are making it difficult for you or not.


Ok....now I am totally, totally confused. I have been planning for months to file K-1 and just about have the whole package ready.

As far as I understand it, I can do the K1 petition legally. I live and work in Colombia but I do NOT have residency here. I have been here for 2 academic years (I teach high school) but I go home every Christmas and summer. As I further understand the requirements, I know that unless you reside in a country for more than 6 months without setting foot in the US, you cannot be considered a legal resident of that country and are still considered a resident of the US.
Furthermore, I am almost positive DCF is not an option in Colombia.
I will be back teaching school in New York Fall of 2009 and will leave Colombia for the US late Spring-Summer 2009. So, I am indeed petitioning to have my fiance "join" me in the US.

Because I was already here, and we were beginning this process, I decided to stay on (aside from going back to the US for about 6 weeks this summer, when I will send the I-129F) and so will also be having a sponsor, as I already understand that because I am not working in the US, I cannot satisfy the affidavit of support.

So, please, someone tell me if I am crazy and after having done all this work and research am doing totally the wrong thing, and should really be finding out if I can do DCF or a K-3...?

If I am not crazy and not going about this all wrong, the concern over having things sent to me from the USCIS will remain my main concern.
Which now is......
How do I do that? Can I have things sent to my sisters address and she can forward them on to me? (My parents' address is not an option as they still haven't even adjusted to me being in Colombia, let alone starting this whole process with a Colombian...sigh.)

What exactly would I need to attach in my I-129F packet to make this mailing situation clear?? Does anyone know if this will be looked at weird in anyway, or it's obvious that this is my option because I am not legally a resident of Colombia?

Ok, probably a silly worry, but I will be here in Bogotá during this whole process and will put the I129F in the mail in a couple weeks. So I want any and all contact from the USCIS to be sent to my apartment in Bogotá. But I guess I'm a little doubtful about the guarantees of that happening.

Do I have to request all contact by email? Should I do that? Or is that a given?
Where would I write my email address, just in my contact info that will appear on every letter/attachment in the package?

We just got our NOA2 and so now are gearing up for the whole new set of worries. No, we are happy, but still:
One question I have is that my fiance has some debt. It is not a lot, below $3000 US I believe, some credit cards/motorcycle lease, that sort of thing, which he has planned to have paid off by the end of June, when we would hopefully be going to the States.
I know that we have to have a co-sponsor, since I live and work here in Colombia, so have no US income to report.
However, I am guessing we will have our interview before the end of May. Are his finances ever looked at? How so? Will we need the Affidavit of Support at the interview?

Para que un colombiano pueda visitar Canadá necesita visa de ese país así tenga la visa de turista de USA. Sería diferente si fuera residente permanente porque sólo sería mostrar la green card.

Felicitaciones por el proximo nacimiento de su bebita.

Le cuento que mis papas y mi hermana tuvieron la entrevista para la visa de turismo hoy y les aprobaron las visas. Por lo que me cuentan todo fue muy rapido, fueron preguntas muy basicas como el nombre de todos los miembros que estaban aplicando para la visa, en que trabajan, que edad tenian ellos, cual es el motivo del viaje a los Estados Unidos, quien vive en los Estados Unidos, cual es el parentezco con la persona en los Estados Unidos, hace cuanto vive el familiar en los Estados Unidos, cuando fue la ultima vez que viajamos nosotros a Colombia y listo. Les aprobaron la visa y deben reclamarla en 10 dias en las oficinas de DHL.

Los papeles fueron la carta laboral de mi mama, los papeles de mi papa fueron documentos de la pension, documentos de la casa, papeles del carro pero NUNCA les pidieron ningun papel.

Espero que esta informacion le sea de ayuda.

Tengo mi carta de extension la cual me aceptaron en el Trabajo y con la cual he viajado a Colombia sin ningun problema, pero me pregunto cuanto tiempo tarda este proceso?

Por otra parte muy emocionada porque a mediados de este mes nacera mi Bebita. Y porque Mis padres tienen entrevista para visa de Turismo el 6 de Julio en Bogota. Y a pesar de que en la red hay muchisima informacion sobre preguntas y recommendaciones yo les pregunto a Los expertos y a las personas que tienen experiencia con visas de turistas de sus padres. Que informacion o documentos consideran relevantes al momento de la entrevistaaa?

Por lo visto Sarita88 solo esta tratando de crear controversia y cuando una persona como Mononoke, que ha colaborado con todas las dudas de inmigracion, consejos generales y demas le responde Usted es la que se ve aludida porque no veo nada vulgar o de baja clase en el post.

El que uno conozca al esposa/esposo por internet no significa que el matrimonio vaya a terminar en divorcio. A la final, la pareja debe tener una buena comunicacion, tolerancia y respeto mutuo. Uno nunca termina de conocer a otra persona porque una cosa es cuando uno de esta novio (ya sea comunicandose por internet o compartiendo en el mismo entorno) y otra muy diferente la convivencia en el dia a dia.

A la final si una persona decide venir a los Estados Unidos "con afanmigratorio a cualquier precio y decide casarse con un gordo horrible de 70 anios, para hacerse ciudadanos como sea" como Usted lo menciona NO es su problema.

Hay muchas parejas en el foro que hasta el momento tienen un matrimonio feliz, han crecido como personas y estan formando hogares estables. Si desafortunadamente se da la situacion donde deben divorciarse pues esa es la realidad y hay que seguir adelante.

Tengo excelentes noticias que compartir. Le acaban de dar aprobar la visa de turistas a mi papá y mamá.

Les preguntaron algunas cosas como:

- Qué hacen?
- Cuánto ganan?
- A quién visitarían?
- Qué hace su hija allá? y qué hace el esposo?
- Cómo se conocieron ellos?

Mi papá me dice que los entrevistó una señora quien fue muy amable. Luego les dijo que la visa estaba aprobada y que les llegaría en 10 días. No pidieron ver ninguno de los documentos que llevaron, ni siquiera las escrituras de la casa, cartas de empleador de mi mamá, nada! sólo el formulario de aplicación .

Do you know when your case was sent to the Ukraine Embassy? Usually if you call, the NVC will give a date and then you can start tracking the package.

The NVC sent on 9/25 diplomatic papers to the Ukraine Embassy in Kiev and they were received on 9/29 (AWB 9459506814)

Is your case in this package? If you need help tracking your case just let me know.

My visa was approved and as Cameron and Carina had their interview today too...I have read at the Spanish thread of "Colombianos en visa K1" that they were also approved.... kicking.gif kicking.gif
