Im a good person, always counted on to make and do the right things, Im tired of being counted on. Im a good person, too big hearted, hard worker, worked for all I have in this world, nobody gave me anything, just heartche.
All in all, bottom line, if you love a person, you dont shut them out, you communicate one way or another, in good and bad. You dont hurt a person on purpose just to show a superior statue. Im human, Im not perfect, but I never hurt a person to "teach them a lesson" especially on matters of the heart. Im through, Im tired, beat up mentally, I just want to know there is kindness, and respect, and honestly between men and woman who truly love each other.

Hang in there girl... Don't make any decisions or do anything yet... Give you both some time to clear your heads and be able to see above the trees... Then you can see what the reality is... You know who you are, be secure in that... Pressure situations can bring out the best and worst in people... You seen that after the hurricanes, just as I did... Some people and communities band together and help each other out, others loot and steal and horde.... So give it a few days then see where you both stand...

In the meantime, hang out with people who appreciate you for who you are and who do good things for your self esteem... When your self esteem is down it is not a good time to have to defend yourself... I cant say go have fun as I know how this would weigh on your every thought, but at least be around happy people and people who can bring you up... Chin up girl, you have survived a lot and will survive this, no matter what ...

I know that at the moment ya'll are angrier than a pair of wet hens, but take a weekend for ya both to cool off... He's a big boy, let'em find his own feet, you cant do everything for him... No sense talkin to him while he's still spitten nails.... I know I can be a hot-head and said some stuff over the last 6 years to my hubby, not that I'm condoning it... But like most hotheads, give him some time to cool his heels before addressing anything...

One thing to keep in mind... Lawyers LOVE k-3s as it is soooo much more paperwork and $$$ for them!!! In most cases, if you do not have any "issues" (past crimes, deportations, denials, or other possible wrenches) you can do this whole process MUCH faster by using these boards and wiki and guides and doing it your self... after all who cares more about your case then YOU???

mounir: Not sure if it is possible to change? was your case approved at NVC?? If not, then you would probably be taking a step back... But if it has, you can certainly ask the consulate... But the K3 WILL get your SO over here... but it is just a matter that there is a whole other boatload of stuff to do and hoops to jump through... But each person has to decide which visa is the correct one for them and their personal situation...

Thank you for the "kind" offer but I'm not really interested in your bridge in Brooklyn. I was merely trying to clarify something regarding the interview and the adjustment of status. If I were set on something then I wouldn't be asking questions. My question is regarding the AOS. It is my understanding that with the CR1 you have to go through the adjustment anyway 3 months before my second anniversary and that there is an interview. Is this correct? That's all I was asking in the previous posting. I am fed up with getting a little bit of info here and a little there (not from you, but from others along the journey thus far, including legal counsel and USCIS) and so I am trying to collect all the information and data so I can make my own decision. It seems like I'm getting a lot more opinion than data in some cases so I am just asking a specific question. What my decision will be, is my own, as you very kindly pointed out.

What you are referring to is removal of conditions NOT AOS... AOS is for those who enter on non-immigrant visas like the K3 and K1... You do not have to pay the $1010 nor do more biometrics... you will get the conditional GC when they enter, be able to work, travel, get a drivers licence, SS# versus the 90+ days for all the other BS that goes with the K3... For some the few weeks are worth it (pregnancy, medical or cases where the living conditions of the SO are seriously bad) but for most, it is much more advantageous to do the CR1...

One of the reasons that the K3 has virtually become obsolete is that in many cases it does NOT get approved faster... The delay they speak of is that current processing works like this... When you file the I-130 it gets held up to wait for the I-129 approval and both approvals come at the same time... So you are not really saving any time since you might have made up the 1-3 week processing time by only submitting ONE application, the I-130... For that along with the AOS, GC and other factors, that is the reason the K3 is not necessarily an effective visa to save time...

Hello all,

I am planning on doing a DCF with the US Consulate in Casa next month and I will have a co-sponsor in the form of my one of my friends. My question is this:

1. Will she need to supply me with her 2008 or 2009 tax form and W-2? Just 2008 tax return is required if you interview before April, however I would include pay stubs from 2009 from the Joint Sponsor2. Will a letter from her employer be necessary? Would be helpful
3. Does she need to show enough income for just my husband or for me too? Weird because I cant seem to figure this out. NEeds to show income to cover HER household PLUS your husband... she does not have to prove to support you4. I have been in Morocco since August 2008 and I have no income for 2009 to report on my taxes. Do I still have to file or can I simply write a letter to the Consulate stating where in the US tax code I derived this information from. Need to write a letter stating that you were not required to file taxes as you had no income

And off topic...
6. I speak a moderate amount of Arabic and my husband speaks a moderate amount of English. What language will our interview be conducted in?

Unfortunatly, there are MANY jobs within the govt and critical contractors that fall under the isue called "foreign Influence" with their security clearances... My brother works for Lockheed and had to report everything to do with my husband, an Italian national... Because Italy is not necessarily considered a suspect nation, there were no problems, however, MENA countries could pose problems with friends and family.... So sorry for your loss, it is difficult....

Here is info on the provision....

The “Foreign Influence” criterion under the “Adjudicative Guidelines for Determining Eligibility for Access to Classified Information” affects many security clearance applicants, particularly those who are naturalized U.S. citizens or whose parents immigrated to the U.S. Others who marry (or reside with) a foreign national, who have foreign financial/business interests, or who maintain close and continuing contact with foreigners are also affected. There are two other related criteria—Foreign Preference and Outside Activities—that sometimes affect these same applicants.*

SECURITY CONCERN

Foreign Influence has been a significant concern when considering people for security clearances. This has been due in part to changes in motivation of those who have chosen to spy against the U.S. A government study issued in March 2008 reported that since 1990 offenders who are naturalized citizens rose to 35%, those with relatives or close friends overseas increased to 58%, and those with foreign business or professional connections increased to 50%.

The Adjudicative Guidelines specify that “foreign contacts and interests may be a security concern if the individual has divided loyalties or foreign financial interests; may be manipulated or induced to help a foreign person, group, organization, or government in a way that is not in U.S. interests; or is vulnerable to pressure or coercion by any foreign interest.” The Adjudicative Guidelines further specify that “Adjudication . . . should consider the identity of the foreign country in which the foreign contact or financial interest is located, including but not limited to, such considerations as whether the foreign country is known to target United States citizens to obtain protected information and/or is associated with a risk of terrorism.” However the location of a person’s contacts or interest is not by itself a disqualifying condition.

EVALUATING FOREIGN INFLUENCE

The location, relationship, occupation, activities, and interests of the foreign person, as well as the recency, frequency and nature of the contact are all relevant. The security significance of these foreign contacts can be measure by the extent to which an applicant:

• Maintains contact with foreign friends, family members, or professional associates.
• Provides or receives material support to/from contacts outside the U.S.
• Returns to native country.
• Maintains property or financial interests (including inheritance rights) outside the U.S.
• Fails to report association with foreigners when required.

Foreign connections that “create a potential conflict of interest between the individual’s obligation to protect sensitive information and the individual’s desire to help a foreign person, group, government, or country by providing that information” are security concerns. Absent a potential for a conflict of interest, foreign connections must present a “heightened” risk of foreign influence to be a security concern. A heightened risk can be created either by the nature of the foreign contact and/or by the applicant’s perceived ability to resist foreign influence. In assessing an applicant’s ability to resist foreign influence adjudicators may consider the degree to which an applicant has assimilated American culture and displayed undivided loyalty to the United States by:

• Applying for U.S. citizenship as soon as they are eligible.
• Expressing their intention to live permanently in the U.S. even after retirement.
• Observing American holidays.
• Participating in local non-ethnic social, community, political, or charitable groups.
• Socializing with people outside their ethnic group.

Additionally, circumstances or behavior that could attract the attention of foreign intelligence are also potentially disqualifying factors.

I don't know much about MENA outside of the drama and challenges I read here, but after married 10 years to an Italian man (which included a 2005 mazda with shotty A/C 2007 escape with falling headliner and a 2010 hybrid that we overpaid for) i understand that regardless, there are marital challenges that are not even imagined until after the "just visiting" phase is past. i wish the OP the wisdom to take that extra step and really get to know their husband BEFORE the "real world" kicks you in the butt and real ups and downs take hold so they are better able to deal with it.

I really don't wanna brag, and I know there are a lot of haters out there...but who cares...here's my story....

We drive a 2011 Nissan Rogue S, with a light gray interior which we keep imaculately clean by using 2 rounds of "$1 for 5 minutes" of vaccuming at a local car wash that costs $12 a wash, but we spare no expense because we love each other so much.

We live in my parents Basement and enjoy 3 full rooms, a double shower bathroom and a living room, all decorated to my parent's taste, which shows just how much we love each other.

Sometimes my husband drives my parents spare car, a 1999 Mercury Villager Sport Edition. It doesn't have a working clock but it does have a leather interior which of course shows how much we love each other.

Once a week we get a take and bake pizza from Papa Murphys, half Chicken Garlic and half "Papa's favorite" minus the pepperoni. Then we cook it in a Double Wolf Convect oven that belongs to my parents, and then we eat our pizza using sturdy DIXIE paper plates because we love each other so much.

Sometime we go to the mall and I buy new shirts at Maurices that cost an average of $29.99 which of course proves we are so blissfully in love.

Yesterday we bought a HeatDish space heater by PRESTO, for $24.99, to help keep our basement bedroom warm. We paid cash which of course proves we are so blissfully in love.

The point is, I am not not bragging and don't want to make anyone jealous, but sometimes you just have to convince others in order to really convince yourself how blissfully wonderous your life is. To the OP - be strong, stay the course, a thousand points of light, and maybe someday your marriage will be as blissfully perfect as mine. Good luck Girlfriend.

Once you do get the interview assigned and your case is forwarded to the consulate, Naples is pretty receptive to moving your date up if they have availablility... But they have to have the case in their hands and that happens after you are scheduled at NVC... So once you get your date, keep checking with NVC to see when they sent it to the consulate, then e-mail the consulate to ask if you can get an earlier date... I know of 3 Naples CR1/IR applications that got earlier dates that way (including mine)

Also, if you file married filing seperatly and your spouse had no income you can amend the returns for head of household and get some big $$$ back!!! Especially if they are outside the USA the entire time.... You get this money because the IRS assumes that you are mainting 2 households...

If you are married, you are married filing seperatly not single... Not that it really matters, however if you are in the visa process and from a high fraud country, it might come up at interviews why you filed single when you are married...

I second the above post... I was married for 7 years before my husband applied for GC and we had NO ITTN# for him (Complicated story, but it was financially better that he did not have one and remain Non resident Alien)...

We filed married filing seperatly, in the space for the spouses SS#, you can write the NRA, None, Non-Resident etc... You will have issues electronically filing, but you can print the return out and mail it.

So you do not have to get an ITTN#.

I didn't mention that we applied via the NVC - perhaps that is the problem?

Naples consulate is really weird and quirkey regarding domicile and sponsorship, they gave us trouble for financials not accepting bank accounts, co-sponsors etc...... Not the norm!
To the op... As others have mentioned, you just need to show intent to re-establish domicile... Use examples as others have stated to do this. Bank accounts, lease etc... I would also make it a point not to say you are "living" in HK, rather you are "visiting" sometimes symantics matter...

I concur with other posts... When hubby became LPR it was in November, we put his income (below the 92k threshold) on the tax return, and filed the form 2555 which basically minuses his foreign income.... So although you file the income, you will subtract it and thus not pay taxes unless the amount is over the 92k threshold.

My personal experience is that I believe that having control over my own case gave me a sense of understanding and control over the situation. I also know that I cared about my own case more than any lawyer ever would so i had motivation to get everything done as fast as possible. Luckily, I found this site early in my process so I was aware of the process (sort of) and I did a lot of research. I think mine moved faster than with a lawyer as I could respond immediately to paperwork requests etc... And did not have to wait for a lawyer to get around to it.

Tomorrow hubby takes his oath and becomes a us citizen and I owe so much to VJ for getting us through this!

I know that income of the intending immigrant does not count unless they can prove it will continue in the US, and foreign assets are a problem unless they can be quickly liquidated when needed to provide money for living expenses.

True dat! And even if the income of the intending immigrant will continue (which was our situation as he was working for the company and was being transferred to USA) they did not count it... Which is not to say all offices will be the same way... But better to be over prepared than under.

They normally will not count the foreign spouses assets or income... And the assets needed is 5x the 125% poverty level regardless of his or hers. As far as I know, you do not have to show having these assets for a specific period of time.

Then I would suggest that you consult with a lawyer who can assist you with filling out the proper forms. I stand by saying that reading the guides and re-read them again. But the DIY process is not for everyone and perhaps you would be better served with a qualified immigration lawyer as there are not too many of us "geezers" who went through this process as minors.

Now pulling advice from whence it was stored away from the sun.... specifically to your age issue, I remember a few cases where it was a cultural norm for the country where the spouse is from to legally marry (I believe India was one of them) and you marry in the country where it is legal, the marriage will be recognized (along with proof of family consent which is embassy specific). However, might I suggest you visit the India sub-forum as they might have embassy specific info regarding this... But be specific in your question, might I suggest, 17 years old and want to marry and petition for cr1 ... I had other info, but can't seem to find it where it was tucked away in my nether-regions. Good luck...

Well duh! it was not registered Because SHE never reported herself as married... It's not like a worldwide wire notification goes out for every marriage. It is up to the married person to file and register their marriage! Anyway.. Good luck
