Actually, for someone just starting out in the system, many of the remarks in my opinion did come off very snippy. Think about when you were first starting this process and seeing all the options and all the conflicting information you heard and read. After all, we are stating our opinions which are not necessarily "black and white". A little compassion for those new to this process please.

Regarding the topic at hand, I agree with the previous posts that I would not risk it. A lawyer is definetly an option, but judging from what I have read in many of the post and my own experience, I believe I feel a bit better being in control of my own situation. Each person and case of course is different, but this site offers a wealth of information and very detailed instructions.

I pray that you will contact them. It is Naples consulate that processes CR1/IR1 visas. The reason I said you should ask them is because I asked if my husband and I could file DCF in Rome in February when we married in Italy. Rome told me that they do not process immigrant visas, it is done in Naples. Also i asked about the time I had been in Italy. They told me that it was not the timeframe....(I know others are saying you must live there for six continuous months, but I am telling you what I was told from the consulate in ROME and Naples)....that I needed to have established legal residency. So since you have your residency permit and an established residence in Italy, I would speak with them about whether you can DCF.

I don't care anymore about what certain people on here want to say about something that is suppose to be the rule. It never hurts to call....even though you are SUPPOSED to wait 30 days, and it never hurts to ask the people who are the one to make the decision, whether you qualify for something.

Sorry, but what someone says on here as to what you qualify for may or may not be the way the consulate sees it. I say ask them and let them tell you NO. That is the best thing to do....not just take someone's word on here that you can't do something based on what they read the rule to be.

Yes rules are rules.....but let the consulate tell you that you can't do it before you throw in the towel.


Thanks for the tips... I know that especially in Italy, rules are rules, but they are not always applied the same... Being from the US, that used to frustrate me so much when I first came over here, now I am hoping that it works in my favor. In the eyes of Italy, I have residency here in Savona Italy and since I enter with my Identity Card, my comings and goings are of no knowledge to them.

I took your advice and sent them and e-mail explaining my situation and I will see about calling them (Naples) next week to ask as well. Thanks for all the tips, I will give it a try. I am bouncing between Italy and taking care of my sick mother here in Florida until my husband can come be here with me full time... After 6 years of marriage I cannot wait to finally be able to live together in the US in a "normal" non sea-faring life!!

Ok, perhaps I am a bit late on this, but I saw in another post about the DCF filing and how much faster it is. Also, I would be thinking about it if I did not ask someone unsure.gif !

Situation: I have filed my I-130 here in the US and am waiting at the CSC. NOA1 of May 5.

However, idea9dv.gif I also have residency in Italy (home country of my husband) in the form of my Permisso Di Siorggornio (Italian Green Card) and an Identy Card. Is is possible to switch to a DCF filing at this point or am I too late? I only ask as it has been 3+ months waiting for NOA2 and not looking to be moving too fast. ClockWatch2.gif

I will be in Italy with my husband for the next 6 weeks and wondered if possible to switch or also file there or would that screw stuff up??? BTW, my husband and I have been married for 7 years but he worked on a ship so we could not apply earlier. I have had my residence there since 2004.

Hi Ya'll. I have been reading so many posts and just need some reassurance (or condradictions if that is the case) regarding my husbands interview. I know I am a bit ahead as I have not gotten NOA2, but eventually, it will be processed and he will get to the interview stage.

I know for a fact that I will not be able to attend any interview this fall. I am a wedding photographer and I am really booked all this fall with barely a week in-between my jobs. I was not nervous, but everyone keeps saying about the importance of being at the interview with their spouse. reading.gifsad.gif

We have been married for 6 years, he worked on a cruise ship and we have spent 6+ months a year together, have an apartment in Italy, accounts together etc.... I know that there is no question of relationship but reading on I am getting a little apprehensive. I am sure it will be OK, just need some input to relax me. cool.gif

Ok, so I just got approved at USCIS kicking.gif But in gathering my husbands birth documents in Italy for NVC, we noticed that his mothers birth name (on the certificate) is actually ROSA but we put ROSELLA (since that is the name she goes by). oops8rh.gif

Since we have our NOA2 approved, will this name glitch get an RFE at NVC??? We have not yet gotten an NVC# unsure.gif
Should we submit the information and a letter stating the error? Or is it better to not say anything so as not to confuse??? unsure.gif

Then I spoke to an operator once I had the number and gave her our e-mail addresses..... Now just waiting to hear that the 3032 has been generated as I have that ready to go... whistling.gif

Better have you NVC case number on the DS-3032 form for them, or otherwise will cause a delay in your case. And we dont need delays anymore USCIS was one hugh delay. UGH!!! Best of luck with NVC!!!


On the hardcopy (with the barcode I created) I also wrote the NVC # under it just to be sure!!! TKX

While "do what you gotta do" may work for some...it's not the best advice when dealing with NVC.
I'm not sure where the confusion is, but the guide states that you should send in your I-864 after you have paid the fee and received acknowledgement from the payment site. Same with your IV packet, only after it's been confirmed as paid. That said, if you've posted the payments (but not received confirmation) and you know that (a. the funds are available and b. all of your routing or credit card information is correct) then the risk of sending your form (IV or AOS) would be very small.

It's important to understand that NVC, along with being bureaucratic, is also usually overwhelmed with petitions and applications. They (NVC) as a rule of thumb, aren't able to cope with forms arriving before they're expected. They will NOT review an AOS packet or IV packet until the fees have been paid. Sending forms late is usually not a problem, but sending forms before fees have been paid, could result in your process being slowed down because they lose the package, lose a document while it's sitting around waiting for your fee to be paid, or they send it back to you. There's a very specific sequence of events that must occur in order. Yes, you can send in your IV before your AOS, but you can't send in your IV before the fee has been paid.


our payment is shown as PAID online...I just wasn't sure if I should wait anything in mail from NVC before I send the IV-864 package...because I've read alot that actually sending too early might cause a delay...

As long as it shows paid, they are ready to receive the AOS package. Just print the forms, fill them out and print the receipt and cover sheet from the website and off you go...

I figure it is always good to have a plan B... I figure Most folks who are not as informed about the system as people here on VJ will only send one or the other... But I sent both to make sure it was processed as fast as possible. I sent the electronic one on September 9 and the hard copy the same date via priority mail. The hard copy was accepted first. When they scan the barcode of the electronic copy they will recognize that it was already registerd and disregard... I figure a total of 10 seconds, but I believe well worth it for my piece of mind that I have done everything in my power to get my case done as quickly as possible. If only 10% of filers are doing this, I do not believe it is that big of a clog in the system....

Anymore, the K3 is obsolete since they take about as much time to do the CR1/IR route... Plus, you get the green card when you enter with the CR/IR and that is MUCH easier... Pretty much everyone is getting the K3 and the IR/CR at the same time so why do the hassle and waste the $$$....

Seperation can be a difficult thing, especially early in a marriage/relationship. I have been married to my husband, who is from Italy for 6 years and we have been together for 9 years. In all that time, we have been constantly moving and in motion. I will share some of what I have learned over these past years as it relates to seperation and the challanges and the joy.

My husband was an officer on a cruise ship and I lived in Florida. I was a passenger and he was an officer and it was love at first sight. For the entire relationship we were faced with extensive time apart. His schedule was 4 -5 months onboard the ship and then 2 months off. Many times his port was all over the world. I tried to go onboard with him every 6 weeks or so and we spent every moment of his vacations together, mostly in Italy so he could visit his family. In the meantime, I have had medical probelms and have had to have 2 total hip replacements and my husband has loved and supported me through them 100%. But this caused us a lot of time apart with him on the ship and me laid up and in a wheelchair and learning to walk again. But he was always my rock, even when he could not be by my side at every moment.

So believe me, I understand feeling apart and alone. He decided last year to start looking for a job in USA and in April he finally found one here in South Florida!! He decided that he had enough and wanted to live a "normal" life with me on land and in april we started this GC process so he could come over here and live with me.

Since starting this process, it has been difficult not to be consumed by it. We went for years through months of seperation at a time, yet, because we feel that we are so close to realizing our new life finally living together as one, this seperation seems the hardest.

But my husband and I are more in love today than we were 9 years ago. Our seperations and challanges have only proven to reinforce how much we enjoy spending time together and how strong our love is for each other.I believe in part because we know how precious being together is and not to take it for granted. During our tim apart, we have also matured as individuals and both come to the table now with different yet enriching experiences that we share with each other. Yes, throughout the years there have been cultural and language "misunderstandings", but now we laugh about most of them. We are exact opposites yet that seems to balance us, what I am good at, he sucks at and vice versa... We are a very great team.

Just remember, as I try to keep in mind too while going through this mess, that things will not always be this way. We try not to constantly talk about the process and let it dominate our conversations, because #1, we do not have any control over it and #2, It will come to an end someday (hopefully soon) and you want to be sure you have other things to talk about and share when this process is no longer the main topic of discussion.

I guess, from someone who has experienced many years together in a semi long-distance and very hectic marriage, keep up the connections and keep each other as part of your lives, seperate as they seem, and once you are both settled in the USA and living together, this experience will be a huge bond as something you have faced and overcome together. Most people do not have to fight so much for a marriage and thus never share the same bond as facing these challanges will be.

I just pray that they soon approve our petition and we can move on and start a new decade together under a single roof. My hope to all those on the VJ and best of luck!

I took my parents on a cruise that I won from a travel agent drawing. It was October 2001 and he was an officer (Engineer) with Carnival. We met in the disco and spent the whole week talking... Funny, I can remember thinking from the moment we talked "Well, I'm going end up head over heels with this one, I am sure". Then kicked myself for thinking such silly things. Found out later he thought the same thing. We had our first date in San Juan Puerto Rico. After months of taking, in December when he signed off the ship, it was too late for him to sign off B2, so he sent me a plane ticket to visit him in Italy.... I was not sure to go, but decided what the heck???

We dated for 2.5 years with me going on several cruises him staying a few weeks of his vacation here in Florida, then we would go to Italy. We finally got married in Italy in June 2003. We flew my mom and dad, brother and 3 friends for a big Italian celebration. The past 6 years he worked on board and I cruised with him and went to Italy on his vacations (he worked 4 months onboard then 2 months off)... After traveling all over and constantly in motion, Now we want to start a family and live here in Florida, so he found a job and we finally applied for the Green Card.

Funny, after being married for over 6 years and all the seperation and strange life, it is kinda scary to finally think of living together.... But he is the love of my life (and I used to be quite cynical about such things). I am still so in love and he still treats me like I am the most special gift in the world. He is my other half...

The one piece of advice I have seen too many people unfortunatly caught on is that if in your past you have EVER tried ANY drugs, regardless if it was experimental or otherwise, you should be aware of the consequences of a positive answer!!!

I cannot advocate lying to the medical staff, however an edited omission of incriminating past discresions might be something you can consider... Especially as the US Govt does not fool around and you will be banned for YEARS!!!

they could've goofed up.....i had a similar scenario happen to me, when i sent my stuff in. i put my hubby's passport pics in a small envelope and stuffed it in with the paperwork i needed to send. i got a letter from NVC and one of the items stated that i needed to send in the pics....i was pissed off. thankfully i had like 10 pics with me so i just resent them in, but it does happen....hopefully you'll have copies of everything already so you can just go ahead and resend it all....what can you do...it's the high and mighty NVC.



thanks for the support......yes i did send originals and an exact duplicate package with color photocopies to them (and a copy for ourselves). I still can't imagine what they don't have, since I sent originals with english translations and exact photocopies ..............

Ahmed also took a ton of passport pics (I sent 2 with the IV package).......so we're covered.

I'll call first thing monday and see what's up with them..........

Just some more info on the NVC automated message........

on Oct 15, it said "the NVC has received the checklist letter response and is reviewing...." that was my IV package. that I sent Oct 10.

today the 22nd, the message said "the NVC has reviewed documents and found missing/incomplete......., and has sent a LETTER (not a CHECKLIST LETTER), on Oct 22........"


I'm wondering if there is a difference between them saying they sent just a LETTER, and not a CHECKLIST LETTER?

Stop obsessing and call on Monday... It still sounds like a false rfe to me and I would hate you bustin ur britches to send something they dont need... Cant do anything till Monday and nobody here can accuratly know if it is a false rfe or real one, only NVC on Monday can tell you that... Dont' worry until they give you reason to... I dont think USCIS lost your stuff... But stressing about something you can do noghing about at this moment will bring you nothing but lack of sleep and indegistion... So enjoy the rest of the weekend and call on Monday good.gif
