There is no outstanding medical or other issue that is preventing Her from coming back. so i think you are out of luck expedite wise. And like Nola said, not ALL European countries are so wonderful about immigration... I can tell some stories about the Italy and Swiss systems... But good luck

At this time, I would try to make arrangements for your spouse and child to come over to you. I would like to say a quick thing about the dialysis to maybe ease your mind about them getting to meet if there is no tourist visa or expedite... My mother lives with us and has been on dialysis for 8 years... She is still going fine (bones getting brittle from it but otherwise ok)... She has 0% functioning kidneys but dialysis will take care of the toxins so it does not matter what the function is, it is normal it decreases as hemodialysis is doing the job for them. On the upside, she will not ever have to make a pee pee break or have to go in the middle of the night... (Trying to be positive) but seriously, people can go years and years on dialysis, don't write her off yet!

It might be difficult... But you can try... She needs to apply on her own merits, but a letter or contract showing your need to return (her being your wife and being dependent on you) home ownership, lease etc... Would be her major ties. But the fact you have an application in the system will be a huge mark against you as it shows an n tent to immigrate. I don't think the odds are in your favor. That being said, your case will probably expire if you do not plan to immigrate for years... It is not a perpetual application.

You mentioned that the chat logs etc are not mandatory, but it can only help right?  Yes, our marriage is legal and real.  We married here in the states, she entered with her C1D visa (Crew visa) and she's been back to work as usual (she's a flight attendant).  We had our reception in Vietnam just last month.  So that's why I'm very thankful for the support from you guys and all of VJ.  I want to kick off my CR1 request as soon as I can.  Although I am very fortunate to see my wife, but one day with her every now and then just isn't enough.  Thank goodness for Skype and all the technology out there to help us communicate and see each other.

My husband worked n his C1/D right up until the IR1(CR1) visa was put in his passport... Then he worked using the I551 stamp (given upon entry to the USA) until his GC arrived so no worries... It is not cancelled until another visa is issued.

To the OP... Time spent together in person and face to face is most weighted... So be sure include copies of passport showing entry into Italy, receipts showing stuff you did together etc... But Naples is not super strict at looking at bonified proof (it is not considered a high fraud country ) they are however, known to be sticklers for showing that the immigrant will not become a financial burden (in other words the USC makes enough money)... We self translated everything and had no issues.

An affidavit where you claim to be legally free to marry, signed by the person in many cases suffice for countries that do,not have such certificates. It would be a question for the Slovenian entity which oversees marriage since that is where you will be marrying.

As others have said, right now your first course of action is to get working on an annulment. She will NOT be able to get a visa until that is done as she is legally married to the other gent according to Phil law... So sorry... This is going to be a difficult journey. Once she is again "free to marry" the two of you can get married then file for spouse visa... You cannot hide this in the process... Sorry

Getting married and hosting a wedding are two different things... Anyone can get married (the legal act of joining two people in holy matrimony) for $200 but hosting a wedding for 200 guests (food, drink, location, flowers, photographer, DJ, dress, plane tickets ) can easily go into the 20k range here in the USA (I am a wedding photographer and planner) ... 9-10k for all that is pretty good as a cheapo wedding here is much more, especially considering there were 200 guests.

Although I still don't recommend getting married in home country on a k1, before or after interview,official,or not... I have seen waaaayyy to many cases where that backfires. If you need the big in country wedding, do it and file CR1 or K1, marry here, then go back later for big celebration. Don't risk immigration issues as what happened to the OP

It in not a decision.... IF, at the time you enter the USA you have been married for over 2 years... THEN it is processed as IR1. IF at the time you enter at POE in the USA you are married less than 2 years, it is processed as a CR1 .... I say you need to alert the officer at POE because they will not usually do the calculations... It should be pointed put to them that you have been married over 2 years... No "decision" just a fact that they sometimes overlook if you don't point it out to ,them.

When you enter the country at the POE... When you hand in the package, be sure to notify them that you have been married for over 2 years and that you are eligible for the IR1... If you don't point it put to them, they will likely miss it. There is no AOS with cr/ir1 visas. If at entry to the USA you have been married for over 2 years, you should be processed for the IR1 and you will receive the 10 year GC ... But you have to speak up when you enter.

Question? Does your spouse have savings? I ask this because Because sometimes they take issue with self sponsorship and any "proof" from foreign countries as they cannot be authenticated....

For example... In our situation, (I realize it was a different consulate and each one has its own standard practices they follow).. We had pay stubs, letters from employer that his job was continuing in the USA (it was a Danish company), bank statements from Italy showing we had over 20X the poverty amounts in the Italian bank accounts and NONE of it mattered... The ONLY thing they wanted to see was 3x the 125% poverty (or approx $60,000) in a US bank account... So rush, rush, We had a few thousand more transferred and consolidated our accounts had the bank print a statement showing we had 60k and showed them this the next day at the consulate... And it was all good (I am self employed so did not make enough salary wise) ...

You might look into recent reviews for Panama and see if they have any "financial quirks" that you need to be aware of to avoid any surprises... I know the UK consulate regularly OKs self-sponsorship but some are more picky... Better to be prepared with a plan B just in case...

All options are ok.. It is just really a question of "do you want to get married"? If you do, then great, go for it, if you prefer to wait for a relationship reason, then that is the best... But don't let immigration decisions interfere with decisions for you relationship... Easier way would of course be to marry, then file based on marriage...
