Lately, the 2nd week or October myth has been de-bunked... Seems that there have been dozens of interviews scheduled in the last week!!! But they were pretty much all for November.... I know we're waitin for ours (then I will try to get it moved up!!)

That's where we would get hit, he made a lot more than me and we did not want to have to count his income... So I filed married (his name is on the tax returns) but seperatly without a SSN... I did not want to run into tax issues based on his income as he paid taxes in Italy....

As far as the OP, sounds like others here have a better handle on filing jointly as it was not efficient for me.

I did not read the holes thingy, figure they can punch whatever damn holes they waint... However, I did write my NVC# on everypage. I used staples to attach documents that went together, left the actual 864 un-stapled and put a big clippie to put everything together....

It is always difficult to understand when something is effecting you... That is true for ANYTHING!!! And sometimes there is a cop that sits on our residential street, so sometimes I guess their aim is way off!!! Hang in there guys, if everything is on the up and up, then you have to believe that eventually they will realize that and move on. All of this seems like an eternity but keeping in perspective that when we are old and with our SO's, this will be but a tiny moment in our lives together! Best of luck to all in AP!

I would put the following criteria on AP

People who do not have enough evidence to show bonified, ongoing relationships
Those who do not have the financial means to support each other and thus become a burdeon on society
Those who have names matching members of society who have the intent to do harm to citizens of the USA
Those people who have backgrounds or lapses of accountable time or which might have participated in activities perceived to be malicious to citizens of the USA
Those people who have criminal backgrounds or past activities which would warrent further scrutiny
Situations where information given does not match intel
Ties to criminals or a criminal element either through family or friends

Finally; Situations where the relationship has factors which might warrent closer scrutiny, such as several visa requests from multiple partners, visa denials, previous deportation or visa violations, extreme age differences (not that this is wrong as love knows no age boundries, but I believe it should at least be looked at closer if there are 1 or more other "warning signs" with it), very short courtships (again, not that this is wrong, just need further scrutiny), not meeting in person and other "red flags"...

In essence, every person being put on AP, although it is a GIANT hassle and heartache, (and yes, there are admittedly wrongful denials and such) once you have entered this country, it should be realized that all of these checks are done for the benefit of the citizens. Residing here is a privledge and this process does not guarantee to keep out the "bad guys and girls" but I believe it is done in good faith... Just ask some of the people who have been "scammed" and only found out through this rigerous process....

I do agree that racial profiling is in "theory" not correct, but unfortunaly that is the world we live in today. Threats and bad people can come from anywhere, and I agree that using basic intel to isolate areas where these threats are most prevalent is used in every aspect of todays world. A cop does not sit on a dead end street hoping to catch speeders nor troll the retirement homes looking for cocaine dealers... They go to busy streets for speeders and bad neighborhoods for dealers... Same concept. Sucks for those good people caught up in it, but a necessary step... I believe most immigration (not all) have the greater good in mind with what they do and try to use their experience to guide them.

Sorry for getting long winded, just saying what I feel.... I do not mean to offend anyone and sincerely wish everyone the best on their journey....

Very true, they do not look upon a child as proof of a bonafide relationship... However, to try to see the positive, at least you can expect that your husband (sinad) stays very cool in stressful situations.... This is a great attribute for a spouse. Better to have a balance between the two... Just give him everything he needs, label it and send him on his way, he will be OK!!! You're NEVER gonna get a rise outta him if that is not his nature, so just go with it!!!

I have NOOO idea about the scheduling??? There are not a lot of recent CR/IR Italy folks to judge by, but it seems like they schedule interviews about a 1 - 2 months from Case Complete... But some people have had success in getting it switched to an earlier date??? We'll see!!! I'm nervous as a long tailed cat in a room full'a rocking chairs!!!

Well, Welcome, you will find this website a HUGE help and resource, but I will warn you... EVERYONE will tell you to create a profile and make a timeline... They get a bit cranky when folks do not fill in the info... Plus it helps to keep accruate stats and so people can get an idea of who you are, where they are filing from and can assist you better...

Since you have not made a timeline or indicated what visa you are seeking, it is difficult to accuratly answer that question. Are you K3, K-1, IR/CR1, or AOS and is your Significant Other in the USA or abroad??? If you can kindly clarify, it is easier for us to get you the correct answer...Thanks!

Wait for it to get approved... You can go to the USCIS website, enter the case # and follow online... You might/might not get an e-mail when it is approved, but you will get NOA-2 in the mail... Hang in there, you have anywhere from 1-5 months depending on how everything is moving....

You will have to write a letter stating that you were not required to file taxes because you did not earn enough.... You will also have to supply a copy of your paystubs and an employment letter...

Based on your situaiton... Are you planning on using a co-sponsor?? If not, I might suggest you consider it since you recently started working and you need to prove that you will earn 125% poperty level.

Not sure what to put in the #25, perhaps another VJer who has had to file like this can guide you on how to list that one....

I think you might have made a boo boo.... you filled out your 864 and signed and filled it out... The joint sponsor filled one out marking the "I am only joint sponsor" box... on her 864 she fills out your SO's name for who is immigrating, her information on page 2, her income info and she has to sign it and put her info that she agrees to be responsible... I would call NVC and tell them you discovered this error otherwise You will probably get an RFE, so I would have another copy done correctly ready to send... the NVC can direct you to either just send the correct one with a letter explaining OR you wait for the RFE... The main thing is have another ready to go correct...

However, I can tell that you are already VERY agitated with the process thus far, I fear that you will have a long and anxious road ahead of you based on your stress level... This is a very difficult process and patience is a premium. There is nothing you can do at the moment to make things go faster and the more upset you let it get you, the more difficult the journey...

There are currently thousands of recent approvals from USCIS after a long lull.... NVC is processing but I am certain it will be MUCH slower than you are expecting. Just keep in mind that this journey is difficult and I wish you the best...


Yea..Its already been a long journey. I hope that is not the case. I have seen people get thru NVC within a month. But per what you are saying it sounds like it will take close to month just to get the case into the system sad.gif . Thanks for the info. Does it help, or do you think its faster, if I elect to go K3 route as it was appoved the same as 130?

I got through in a month, but that was before the big rush of USCIS approvals... Now it is DEFINETLY slower... If you have everything ready and send on the day they ask, I suppose that you might squeak by in 45 days... with no RFE's, AP and some good luck with 3032 processing time (sned e-mail and hard copy). But the key is to have EVERYTHING signed and read to go with all the PCC's, Marriage and other original documents... No having to mail back and forth from India... Have they ready to go now and memorize the shortcuts!!!

As far as the K3 That I cannot answer as I only cared about the CR/IR1, but from everything I have read, it is about the same amount of time for both and since they are approved now at the same time, I dont expect that you would save much time or be reunited any sooner... Plus the cost and hassle of AOS seems crazy to save just a week or two of wait time?? Other K3 people might have more insight... But I know that the IR/CR is the way to go....

Just dont git ur drawers in a wad now over how long its takin or ur really gonna be grey haired by the end!!! (not to mention on some Blood pressure meds).... Just realx and go with it and have everything ready to go

Having a case # DOES NOT MEAN THEY ARE READY TO ACCEPT YOUR 3032!!! You have to wait for them to send you an e-mail ( I hope y'all have called and given your e-mail addresses) that they have generated the 3032 and AOS fee bill!!! If you send them stuff BEFORE they are ready to receive it, IT WILL BE IGNORED!!! and that would be a big waste of time as you would not know it was ignored until after a while that it was not processed!!!

According to Igor's list there are still 13 May filers (I-130) waiting to be approved (which the May filers seem the ones to really be screwed since they have had to sit by and watch all the June and July and August filers fly by) and there are 12 June, 14 July and 11 August... So I would not be worried... of course it really sucks that there are so many seemingly left behind. I do hope for everyone that they start getting all of these older applications approved!!! Whoa whoa whoa!!! You need to wait till the 3032 is generated and the AOS bill is paid and shows paid before you start sending stuff in to NVC!!! If you send anything before, it will NOT be accepted!!! I would however suggest that you have the benificerary fill out the 230, send all the required original documents to you and have everything ready to go... For anyone confused the formula is this
Petitioner = Get NVC # + receive AOS fee bill + pay 70$ online + wait to show paid + print cover sheet + send 854 AOS with all documents and case # written on each page
Benificerary = Get NVC# + receive 3032 + send 3032+ 3032 accepted + IV fee bill available to be paid + pay and wait to show paid + print IV cover sheet + mail 230 package with all original/certified documents
======= wait for case complete + wait for interview to be scheduled

Yeah I paid the 400 and the 70 online it shows paid I went to the next step and printed out my cover sheet and emailed the coversheet to my wife. She is getting the paperwork done there once she has it complete she is going to mail me her paperwork and I will mail them to the NVC either with my I-864 or by themselves if I send the I-864 now. I was just wondering speed wise would our case be completed at the NVC sooner and we will get our interview date sooner if I send my info in first if not I will send them both at the same time.

To answer your question, you can send the 864 package now then her package once it gets here... Since they are two different processes that merge, not sure if it cuts any time off, but at least you know if your part has any issues or if they need any other info....

Whoa whoa whoa!!! You need to wait till the 3032 is generated and the AOS bill is paid and shows paid before you start sending stuff in to NVC!!! If you send anything before, it will NOT be accepted!!! I would however suggest that you have the benificerary fill out the 230, send all the required original documents to you and have everything ready to go... But do not send anything to NVC before they are ready to accept it!!! guides6ly.gif

I cant answer that? I would imagine that if you qualify based on income, that would be OK... However, be sure you have a letter of employment (or if qualifying on assets that you have proof). I have not heard of being denied specifically because of age??

The AOS form is essentialy a contract that the joint sponsor takes responsibility for the financial support of the intending immigrant... Therefore, I would think that they would need the original signed contract.... Can you send DHL or worldwide global to get it there faster (I know more expensive... but might be worth it to guarantee delivery)...

You can file as married filing seperatly (cannot do e-file if the spouse does not have SSN, but you can paper file) or like others have suggested, file to ammend the taxes once they get a SSN and you might get a few $$$$ in returns!!!!

I cannot comment on the rate of pass/fail on the CR1 vs the K3... If you have solid documentation then it should not matter as far as things YOU can control... As far as denial or AP because of name checks or other additional processing, that is something that would delay visas which ever one you choose....

With regards to which visa is better? Without a doubt, go for the CR1/IR... This give you the green card (551 stamp) upon entry and GC status... With the K3, you will have to file for Adjustment of status which is expensive and yet another process....

Just have all your information together (proof of relationship, financial documents etc...) and go for the CR1, it is the permanent resident visa and the best visa to get... The K3 visa was invented when wait times were much longer than today.... It is practically obsolete... Especially now that the CR/IR is taking the same amount of time!!!

The only signatures on the 230 is the intending immigrants (part I)... and Yes, you can send it to the Petitioner to mail once the IV fee bill is paid... Send that and all required original (or certified copies) documents with the 230 package... Does not matter where it is sent from (here or there just as long as they get it)... Also, make a photo copy of the entire package and send it with the 230 originals (this is if you need your original documents back)... Dont forget to write your NVC# on each and every page!!! and make a copy for both of you....

They should issue you an IR1 since, at the time of the interview, you will have been married over 2 years.... Be sure to mention it (just in case) but they should do it automatically.... Auguri!!!

As far as scheduling, To totally Depends on the consulate... However NVC is scheduling for November this week... You might check other timelines from Nigeria and see what past experience is for scheduling...

I recently moved (I changed my address at the USPS. and they told me that my mail will get forwarded to my new address)

so i did not change the address with USCIS just so that things don't get too complicated.

then on october 8, i received this from the USCIS:

On October 8, 2009, the post office returned your document I130, IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN as undeliverable. We will hold it for 180 days from October 8, 2009 to allow you time to contact us. If you do not contact us at 1-800-375-5283 within 180 days, this document will be destroyed and you will need to file a new application or application for replacement with fee

I called the USCIS and explained what happened (that the post office didnt forward the mail like they said they will)
and got an address changed, and also a request to resend the notice of approval.

they told me that it will take 45 days to get the notice.

so my QUESTION IS :
since my case was approved, but did not get the hard copy of the notice of action...will my case still get forwarded to the NVC ?
or will it get forwarded after i receive the actual notice in the mail in about 45 days?

Yes, your case should be forwarded to NVC... However, the post office will not forward official govt documents because it is printed on the front of the envelopes Do no forward or no forwarding service

there are many documents that may be mailed to you KEEP USCIS AND NVC IMFORMED OF ANY ADDRESS CHANGES!!!

You can call NVC to see if they have your case because odds are they ALSO mailed you information which was not forwarded because the govt has to be accountable for those letters arriving to you and if you move, they are informed immediatly and the mail is not forwarded.... I would call NVC and give them you USCIS number and see where things stand
