Hi. My first post here and I'm little confused.
We filed for I130 and got a letter back dated April 15.'09.
US Citizenship website still only reads that our case was received and pending in April. And time table for I130 is 5 months.
My question is how unusual this is, should we be worried and is there anything we can do like call them.

Thanks a lot.

Time frame of USCIS used to be 6 months. Wait till mid Oct and then contact them if no response yet good.gif

Once you hit the 5 month mark you can ask for an investigation into your case. 5 months is enough to request a formal look into your case. Call the number and there is an option if you are outside their normal processing times... Give them a call and get them looking into your case.

Don't worry it can take up to 30 days blush.gif

wow. 30 days just for a notice of receipt? and majority of the people here report they receive notices in a week? man, that';s not fair.

Unfortunatly, nothin in the guidlines said anything about fair!!! Otherwise this process would be MUCH easier.... But give it some more time... they seem to be a bit backed up with this wave of USCIS approvals so I have noticed the past few weeks it taking about 10 - 14 days... sorry... just keep calling

IR-1 / CR-1 Spouse Visa Process & ProceduresNeed advice ASAP...divorce after husband arriving here
Yes, I am married to an Italian, we celebrated our 6th anniversary this year.... He worked on a ship and just got his first land job here so we are just now needing the GC. And you are starting to think things how you need to. And you are right, unfortunatly our mothers will not be around forever and it is us that have to make our own choices and have to think of our own happiness. It is YOUR life, not your mothers.... He might not have been HER choice, but it is HER choice to live with you so either she accepts that or finds other accommodations. At some point you have to defend your husband as he is your teamate in life now...

This economy is sooo tough now, for everyone... So now is the time to work together.... Buckle up and work through this and once things get better, you both will be stronger from it AND have some common expierences to draw from and keep you guys together...You never really know a person until you have faced difficult times together.... Everyone gets along when times are good!

But dont let your mother ruin things for you as she will unfortunatly not be around to face the consequences, you will... I can honestly say that I feel much stronger that I have my husband to lean on and help me through things... and vice versa... Having someone who is always on your side is a great feeling, don't throw that chance away too quickly because of some bumps in the road.

Same thing happened for me with Italian. I went there and my husband had to leave early for work on the ship and left me there with just his parents (no english) and I had to communicate somehow. Up till that point I only had my 3 Italian classes I took and some books. I too learned more in that month by myself by being immersed in the language... So give him some time in this enviornment to get an ear for English....

I really do encourage you to try to work on things and give him some more time... It seems your personal situation (job and such) has recently changed dramatically as well as the addition of your husband coming over into the mix.. We are all sometimes thrown difficult situations to have to deal with and any major changes in life can cause stress... It seems to me that you are dealing with several life changes like job, income, new husband and living circumstances and new responsibilities which all might seem overwhelming especially with outside pressures of others pointing out what they believe to be mistakes you are making.

As for your husband, he is dealing with a leaving his home, not knowing the language, trying to find a job in an almost impossible economy. He will learn the language just by being out and around and HAVING to use English... just give him time. Perhaps it was difficult for him to learn in Russia since he was not forced to learn and could rely on being able to speak Russian if someone did not understand....

Marriage takes effort on both ends and is not always an easy road... otherwise they would not have the phrase "for better or for worse" in the vows. I do know that it is much easier to have someone helping you through difficult times and finding a way for your differences to compliment and help each other. In my humble opinion you both have so many life changes that you are dealing with that adding a divorce and the issues that come with that at the moment would just cause even more stress than sticking it out.

I have been married for over 6 years to my Italian husband and we have gone through good and bad times. You are right and life is not a fairy tale or happily ever after but it is having someone who helps balance you and makes you whole. It takes commitment and patience and understanding. Don't close yourself off as you might suprisingly find that it feels good to talk about what is going on and you will learn how to help each other through this stressful time.

I really do wish you the best because I know once you find that balance, you both can be very happy together. You must have had something to keep you going through this Visa Journey, which is stressful enough... so try to find what that was and what it was in your husband that made you want to committ your life to him and keep that in your mind and heart....

Thank you Dear, you can't believe how all this helping me!
I am in a panic about his English and job...+ I have my Mother to live with me.

That's why I was wondering do I have to do divorce paper here.
Any way, thank you so much for your letter. It helped.

Well, he is your husband, not your mothers so this is a decision you have to make with your heart and what is best for you. Try to see the man you married and remember why you are together. I know sometimes we all get frustrated with our SO so keep calm, dont do anything too brash and Best wishes...

Add your new spouse to your US Bank Accounts, yes it can be done without them having a SSN!

Also, be sure to add them as beneficiary to your 401(k) as this in now required by law.

Finally add them as beneficiary to your Life Insurance. You can even get the spouse a small ( > $50,000) Life Insurance Policy with you listed as primary beneficiary.

You can include copies of the bank statements in both names, the forms used to add beneficiary to 401(k) and Life Insurance as weel as getting something from the 401(k) Plan Manager and Life Insurance Company stating the spouse is primary beneficiary.

All of these demonstrate co-mingling of financial affairs.

How did you get your spouse added to your bank account? I tried 4 different banks and all denied my request. I have added my wife as the beneficiary to my IRA and added her to credit cards etc. However the rest has been a dead-end thus far...

Thanks,

Tom&Jialian

I agree, I have been married for over 6 years and could not get him added the bank accounts because of 9-11 laws without a SSN... But I put him on a small 10k policy I pay 2.50 a month for....

First Off... Tygrys... I understand and agree that today, there is a blatent disregard for the proper usage of the English language, however, the issues you pointed out seem very petty. I am sure that for most, the words plz and coz are quite recognizable in text speak. If your only contributions to this poster and forum is as an English professor, then perhaps you have missed the purpose of the forum, to help and assist others in this visa journey.

To OP, I am confused as to what exactly you are asking; As far as #20 of the I-130, it is not the signature they are requesting, it is to write the name and address in the language/alaphabet of the benificerary.

As far as the I-129/I130, what did you file already??? Many have filed both in concurrance, however, the IR/CR has been processing in about the same time and it will give your relative a GC upon entry versus the K-3 which you will have to file for Adjustment of status...

christeen i just want to say you handled that very well i do not like when people take petty things and point them out instead of just focusing on the issue at hand

Thanks, It just seems like a waste of time when others comment just to point out flaws without addressing the problem at hand. It is like asking for directions in a foreign city and having the person correct your pronunciation of their language and not give you the directions....

Just wondering are copies of photo's okie? (ie Photo's printed out on plain paper) I don't want to send the originals and it would be easier to print them out rather than running to walmart and getting the pictures printed on photo paper. Also how many letters from friends or family would be sufficient?

That is what I sent, I think sending printed photos on paper is better as they are the same size as the application and they have less of a chance to get lost...

IR-1 / CR-1 Spouse Visa Process & ProceduresQuestion about DS-3032 form
QUOTE (Dina-Rich @ Sep 27 2009, 11:10 PM) <{POST_SNAPBACK}>
Hello all my VJ friends! Ok, Paid the $70 fee online Sat. And I already have his signed DS-3032 AOS which he emailed to me, but does the NVC need the original signature for this form? I realize I can't send it until NVC receives my Payment and marks it Paid, then I can Overnight it - is this correct? Then he starts working on the Immigrant application form next ..right? If it has to be original signature I should have him send both forms to me at the same time - ??? Thanks for the feedback and direction.
Dina smile.gif unsure.gif

There are 2 streets for the NVC process... One is for the petitioner and one is for the benificerary

The petitioner 1. pays the AOS fee bill, then 2. mails the AOS package to NVC
The Benificerary; 1. mails or E-MAILS the 3032 (can be e-mailed, just see the guides or the instructions on the 3032 NVC sent) 2. Once the 3032 is received and processed, the IV fee bill needs to be paid, 2. once the IV shows paid on the website, you can mail the 230 paciage with part I signed with original signature and Part II left unsigned to sign at embassy.

Once all the documents are received at NVC and processed, both streets merge and you get a case complete!

So you can sent the AOS package once the bill is paid... and wait for the 3032 to be accepted (but e-mail that ASAP)...

Best luck!

So what if he's from Pakistan? What's their basis in putting someone's case on AP/AR by the way? The AP process makes me wonder. Are there particular nationalities or beneficiary's travel history that needs to be AP'd? unsure.gif

Don't know if they should be put on AP, but Unfortunatly for the many VJ'rs who are just trying to unite their families and loved ones, in the current conditions and mindset of the US govt, they do tend to put most middle east and nationals from muslim nations on AP as well as many in North Africa. Hight fraud countries in Asia and East Europe are also subject to the possibility of AP. It seems to be happening more and more given the curent political and world climate.

My wife & I got married in Hong Kong. Unlike in Western culture, women in Asia don't really change their names / take their husbands' last names. So we weren't given the option to change her maiden name to my last name.

Now that we're married (and currently processing the CR1), how would we go about a name change if she wants to take my last name?

To avoid any delays, I would personally wait till you are finished processing, then file for a name change... Otherwise you will hung up waiting for a new passport and identification for her... Just my suggestion. Having different names will not affect anything in the short term.

IR-1 / CR-1 Spouse Visa Process & ProceduresSome questions regarding CR1
The K3 was introduced when the peititions were taking years to be approved. Nowdays, the process has gotten so streamlined that the K3 and CR/IR takes about the same amount of time... The K3 however requires that you adjust status after your spouse has gotten in the US whereas the CR/IR gives the spouse the Green Card and right to work upon entry...

They now take nearly the same amount of time but the K3 costs significantly more, thus the K3 has become nearly obsolete... However, you are free to file both (paying the filing fees) and see what comes out sooner???
