The financial document is the 864... not the 840... And you will fill out an 864 claiming you and your husband (even though you do not make enough) and your father will fill out the 864A and count his dependents and add your husband as a dependent...

You were correct in filing the 864A... However, you need to provide a cover letter explaining this (they might have gotten confused) and yes, you have to provide proof that he is related (birth certificate showing him as your father and a copy of your drivers licence or other ID with the same address and proof of your fathers citizenship/Legal permanent residence status etc...)

I have heard that in many countries, this is the case (just keep adding names)... I know that if you want her final last name to be the married name, you have to make sure she changes her passport to add the married name... If her passport does not have the married name, they will not issue it with the married name and you have to pay to have it changed after she arrives... As far as if they put ALL the names on it... I am not sure, perhaps someone in the South American Forum might be able to answer that better...

Well, I guess the reason why I posted 2 different topics is because in one topic I literally explained my whole situation while in this topic, I basically asked about using a house. Yes, I would think that a realators appraisal would also be considered... And I definetly agree that in this current comditions, unless you have no other options (finding another sponsor or your faterh having enough liquid assets) I would not get into the mess of "will they consider the house" determination... It may be rather difficult to convince a CO that your father will sell the roof over his head to support your husband???

Recently quite a few have been denied solely based on the house as an asset, especially since the housing market has tanked... As far as requirements for a current appraisal, I can only go by the clear instructions on page 8 which says that they require a current appraisal.. I would think this is fairly important since the rampant decline in housing prices...

As far as if it is needed?? I would call the embassy to find out exactly why... I would get all the savings and other documents of assets together for your father and see if that makes up the difference... But be sure to tell the embassy that you are the sponsor and why the joint sponsors assets are being considered since you clearly qualify?? You can also write them a letter and e-mail it of fax it to them so they are clear on this...

Page 8 of the I864 instructions has what to submit if using a house... It includes mortgage information and a current appraisal... A few people here have gotten denied use of a house because all assets must be able to be converted to cash within one year, and with the current housing market, some Consulates do not believe that a house can be sold in that amount of time...

As far as the bank accounts and savings, yes, bank statments will suffice... I just wouldent count on the house counting unless, as I said, they have a HUGE equity in the house...

If you are using the house, then you also need a current appraisal... This is especially critical now as home values have decreased... I have also read here that they have been reluctant to count the home since the housing market has tanked... Too difficult to sell a home now and with soaring forcolosure... Unless they have a HUGE equity in the house or have a decent amount in savings, you might have another co-sponsor on standby...

Not sure about GZU specifially, however, I would send in the package now and on your cover sheet, I would explain that you recently accepted this better position.. If it generates the RFE, you can send the stubs to them then... And just be prepared to show your paystubs then, or at the interview... Make sure you turn in past income (provideing it was enough) to establish a history as well as the current employment letter... Good luck

If she lives in a seperate house, then it is the 864 and you can omit the proof of relationship...

Yep...it's happening to a LOT of people lately.

Next time you log in, click on the "payment receipt" icon and it SHOULD show as being paid...so that should be some solace at least.

I called NVC about it this morning and was told that I shouldn't have paid it until I was told to...but that the system should correct itself in a day or two.

Keep your chin up. I've seen accounts of at least ten people in the last day or two with the same issue.

Wait till the next day when the e-mail has been processed... LOTS of pepole have gotten stuck because they jumped the gun on paying before invoiced... Check in the NVC September and October threads to see what I mean...

Problem is that I have not received the return receipt card the USPS usually returns back to you when someone on the receiving end signs for it??? Plus, our DS-3032 was emailed the week before this and to this day, our DS-3032 it has not been accepted yet. Should I worry? I don't know what else to do at this point...



UPDATE: I JUST CALLED THE NVC AND THEY INFORMED ME THAT OUR DS-3032 WAS RECEIVED ON THE 27TH (FYI: THE USPS RETURN RECEIPT STATES IT WAS DELIVERED TO THEM ON THE 22ND). ANYWAY, SO THEY ARE ALLEGING THEY RECEIVED IT ON THE 27TH AND CANNOT TELL ME WHEN THEY WILL GENERATE THE IV BILL. ARE YOU KIDDING ME? HOW MUCH MORE LONGER CAN THAT TAKE? Your problem same as mine. I sent DS3032 to NVC by email and my husband sent it by post mail but until now we still not get reply from NVC about they recieve or accept my DS3032 or no.
Today my husband sent to them i-864 with cover sheet of paid 70$. so we will wait for letter of NVC to ask pay 400$ again or my husband can pay now ?

First post here, but I've read a lot of the other posts, as well as FAQ's and the I-130 guide. Here's my situation: my girlfriend and I met while I was working in Trinidad. I was transferred back to the US in September and we've decided the long distance thing isn't going to work, so we want to get married (and fairly quickly). We don't want to have her enter on a B2 visa and then get married and pretend it was spur of the moment with an AOS. So it would seem like filing the I-130 'from the outside' is the best (and legal) plan. She has long had a 10-year B2 and consistently gets 6-month entries.

Here's what I'm thinking:
- Fiance comes to US on B2 (she gets 6 month visa), we get married OR we get married in Trinidad and she comes to the US on a B2 tourist visa
- We immediately file the I-130
- Once B2 visa expires, she returns to Trinidad to avoid overstay
- Depending on where we are in the process, she either waits in Trinidad for I-130 interview or attempts re-entry on B2 visa, telling the complete truth to CBP. She has significant financial resources and a mortgage in Trinidad, so I'm hoping that helps to prove the "home ties".
- If in the US, she heads back to Trinidad for the interview (could the interview be done in the US if she's here on a tourist visa?)
- As I understand it, once the petition is granted, she would get the CR1 visa within about 2 weeks, after which she returns to the US legally.

Questions:
- Is there a pro/con to getting married inside/outside the US?
- Can she basically spend most of the waiting time in the US on her tourist visa? I've read a number of posts that say that the B2 visa can still be used as long as there is no intent to AOS while visiting.
- Other than the interview, is there any other requirement for her to actually be in her home country during the petition? I believe the only time her passport might be surrendered is after the visa is approved (the 2-week thing). Are there other required visits (e.g. the medical or more paperwork) that would require her to be in Trinidad?
- During the interview, she would truthfully explain her visit(s) on the B2 visa. Would an interviewer question her having spent so much time in the US?
- She would have to quit her job to spend this much time in the US. Would not having a job be enough to turn her away at the border (in spite of the banking/mortgage info)?

I know about the K-1 and K-3, but we're hoping to be able to avoid significant time apart after we get married. Any thoughts, suggestions, experiences are greatly appreciated.

You have to take into account that one of the first questions at immigration is who are you visiting... If she says her finance and that you are going to get married... You risk her turned at the border... If you lie, then you run the risk of ban as that is Fraud... To get married in the USA you need to do a K-1, which will be the shortest wait time... K3 is obsolete as it is processing in the same time as the CR1...

If you get married ouside the USA, then file the I-130.. She will have to show very significant ties to her country and intent to return in order to be admitted... Quitting her job will not look favorably as having ties to her home country...

She will have to get all the required original paperwork from her home country (Police Certificates, birth certificates etc..) as well as birth certificates from any country she lived in more than 6 months since age 16..

As far as which is best?? That is your personal choice, however, there is NO easy way with the immigration system!!! It is a difficult process and most of us would rather just have our SO's with us while it processes, but to do things legally and correctly and not risk fraud, bans and lots of trouble down the road, you will probably have to deal with some time apart.. Uless you can go stay with her in her home country... I am not saying that it is not possible for her to come here and stay...But you have to be prepared!

Yes, I sent out the AOS package this past Monday, via USPS Express mail. When I tracked it via the web, I can see that they received it the next day at approx. 10 am. I just wonder why my 3032 is taking longer than others who have had their processed in a matter of days??? 2-3 weeks for the processing and how much more time for the IV bill to be generated???

No-ones lately has taken days!!! The average from the time received is 2-3 weeks... That is from the date they show receiving it to the date you get the IV fee bill... Processed means accepted... So if they said it was received on the 27th, you should have the IV fee bill ready for payment between 10-17 November... They have gotten SLOW lately with the big rush from USCIS

In the mean time, it give me time to continue making copies for my husband and getting all other docs ready...Any suggestions on what those maybe? It is the 230 package that follows after the IV bill payment right?

Yup... the 230 package with the original/certified copies of the documents (see the Wiki, they have a more complete list) You are moving along GREAT... You got NOA1 in September and already at NVC!!!!

A few people have had this probelm (happens when you pay right away)... Call and talk to a supervisor as they have to manually put in for a payment and system update.... Best of luck
