The police certificate that I have is 2 months old, dated Aug/25th. By the time I submit DS-230, it will be over 2 months old from the date issued? Is that a problem? It doesn't have expiration date (which is the case with police certificated issued by Nepal Police).

They are usually good for at the very least 6 months from the date issued so you should be good to go...

No, not if they are US citizens... You will have to count them on your 864 fiancial documents as dependents for calculating income purposes

Your packet is likely there already.. You should get an interview date of mid to late Nov. Email the consulate with your file # and request the interview date...

Ok... Things getting confusing.... To answer the OP... (and clarify from ScottThuy)... in IR/CR cases (Vietnam) NVC does the scheduling for the interview (NOT THE CONSULATE, the consulate schedules K3 and K1)....
Scheduling is done normally the 2nd week of the month (aka, next week) for the following month (November)...(sometimes that schedule other weeks, but a bulk of scheduling is done the 2nd week of the month) They say 8 weeks to CYA...

So hopefully you will get something in the next week or so... There are quite a few of us waiting for interviews... So hopefully soon

That is not how I understood it... From my understanding, when filing for CR1 you must legally file for her name to be changed and the Green Card will be issued under the name in her passport. If you want the GC to be issued under her married name, she must change her passport... Plus, for airlines and the POE, if the name in the passport and the GC/visa name do not match, so she might not be able to fly and the POE officers will have an issue with all her documents done with one name and her passport with a different name...

Perhaps others who have gone though this can ring in??

That makes sense and that is what I thought had happened. It had never taken this long with my previous shipments using Delivery confirmation (no signature). This definitely is a good topic for others to know as well..
But now that I have been burnt, next time on I will use OVERNIGHT.

Someone can correct me if I am wrong... But I think it goes like this...

If the parents file their own taxes, then you do not have to put them on the 864 for your husband.... The cousin since I assume does not live with your husband, files an 864 and is in support of his family plus your husband. He will file his own 864 counting himself and you... If the parents are dependants (meaning he takes exemptions for them on his taxes) then he has to count them as part of the family size...

So your husbands is Him and you (even though he does not qualify he still has to file)
the cousins is his family plus you (and if he is married, his wife has to file the 864A to acknowledge that he is sponsoring someone, even if she does not qualify).

With those everyone submits as least last years tax information, employment letters, pay stubs, proof of citizenship/residency and in the wife of the cousin, marriage certificate.

u no need to worry at all they will send ur case to the embassy as thy get interview date for you,it takes maximum 1 month after completion of case,

Watch out about projecting time to assign interviews as each embassy is different... The OP is from Canada and right now Canadian interviews are taking FOREVER to be scheduled (like 4+ months from case complete to interview assignment)... There is no "maximum" timeframe for scheduling interviews....

Once you pay the AOS fee, you (the petitioner) can send in the 864 and documentation

Once the IV bill is paid, the benificerary can send in the 230 package with all the documentation and yes, she can just download the form and sign Part I

As far as an interview date... First you have to get the case completed (about 2-3 weeks) THEN the embassy will schedule interviews... Each consulate is different so you should check out the PI forum and similar timelines to see how long from case complete it is till interviews on average... Nobody can give you an exact timeframe...

Just writing a general notice regarding paying the IV Fee bill (when the 3032 is accepted)

Many of you are checking hourly for when the fee becomes available to pay (meaning the 3032 has been accepted) ALERT; DO NOT PAY THIS BILL THE MOMENT IT BECOMES AVAILABLE!!!!!

You have to wait till NVC acknowledges you have been billed... Billing is done by a 3rd party... SOOOO if you pay it before NVC notifies you that it is available... YOU MAY ONLY SERVE TO DELAY YOUR CASE WHILE THE PAYMENT ISSUE IS SORTED OUT!!!

You run the risk of falling into a little black hole where you paid but NVC did not generate the bill yet (paying something before NVC is ready for it could cause unecessary delays)!!! You will end up costing youself anywhere from 3-10 days while you send proof of funds transferred from your bank... It is not guaranteed you will have a delay, but why risk it!!!!!

[/size]WAIT TILL THE NEXT MORNING, YOU WILL HAVE THE OFFICIAL BILL FROM THE NVC... ONCE YOU GET THE E-MAIL FROM THEM.... THEN YOU CAN PAY!!!

No attorney. I am the Agent. My concern was with the case leaving the NVC and being sent to Cairo if I want to pursue the CR1 visa. Should I allow this to happen? Or call the NVC to stop the K3 and keep our case (paperwork) at the NVC until our paperwork for the CR1 clears and our case closes with them first. If the case leaves the NVC for Cairo for the K3 visa...will this create more problems if we are still not finished with our CR1 process with the NVC???

No... All K visas are sent to the Embassy for processing so they only spend a week at NVC, whereas the CR! is processed at NVC...... Just ignore anything for the K3 visa, if you write to cancel it, you run the risk of them cancelling everything by mistake... Just ignore the K3 stuff and the embassy's request for it... Your fine, happens all the time



I think, I am misunderstanding something here. I originally started with a K3 but as soon as the I-130 was approved, I pursued the CR1 instead because my I-129 had not been approved on same day as our I-130. Now, that I am on the CR1 path, currently getting ready tomorrow morning to send out my I-864EZ & documentation for our CR1, I get hit with this letter from the NVC telling me our case will be send to Cairo in 1week. I don't need my case going to the embassy, when I haven't even finished my case with the NVC for the CR1 case! HELP! What should I do?

Just ignore everything realting to the K-3 and follow the directions and requirements for the CR1... When you are complete at NVC, you will be assigned an interview for the CR1 and you will process for the CR1... Ignore the K3, your fine, people do this ALL the time

No attorney. I am the Agent. My concern was with the case leaving the NVC and being sent to Cairo if I want to pursue the CR1 visa. Should I allow this to happen? Or call the NVC to stop the K3 and keep our case (paperwork) at the NVC until our paperwork for the CR1 clears and our case closes with them first. If the case leaves the NVC for Cairo for the K3 visa...will this create more problems if we are still not finished with our CR1 process with the NVC???

No... All K visas are sent to the Embassy for processing so they only spend a week at NVC, whereas the CR! is processed at NVC...... Just ignore anything for the K3 visa, if you write to cancel it, you run the risk of them cancelling everything by mistake... Just ignore the K3 stuff and the embassy's request for it... Your fine, happens all the time

The K-1 will get him here quicker but he will not be able to work for like 90 days... The CR1 will take longer and cost less, but you will be apart... He must wait outside the US for the CR1 visa, he cannot wait here in the US with you (which would defeat the purpose anyway since he would not be able to work while waiting with you...)

Sorry... The intending immigrant fills out the 3032 and indicates that they DO wish to appoint an agent (the person in the USA) as their agent... and puts the petitioners info in the address/phone info.... Then BOTH the intending immigrant AND theh USC will get the e-mails...

No, it the opposite... If he wants you to also get e-mails/mail he has to check the box that he DOES appoint agent on his behalf and put your information in the lines below... Be sure that they also have your e-mail Info... call NVC and give it to them if you have not already

Thanks christeen. Also, i will have to mail DS 3032 to my wife since it requires her signature. After signing it can she mail it directly to NVC.

You will also need a co-sponsor as you will have to prove 6 months of income, employment letter and paystubs... Unless you want to wait 6 months to move forward...

You can also e-mail the 3032 using the template here on VJ (see Ling or James NVC shortcuts)... But e-mail it from her address...

It has a lot to do with timing. Maybe you filed during an off-week and it got approved quickly. Or maybe your file fell to the floor and got kicked under the desk and is recovered after four months when somebody comes in to sweep. Mostly has to do with luck. I agree... A LOT is due to timing... If you file in April/May like I did, USCIS pulls most agents off of processing family petitions to process work visas... They get backlogged and it take a few months to dig themselves out... If you file in August and September, it seems they process much faster, but they get hung up at NVC because they get backlogged (IR1/CR files)... Then the January and February files process really quickly... But it also depends on if you get hit with name check or background checks...
