QUOTE (yourangel8 @ Oct 22 2009, 11:25 PM) <{POST_SNAPBACK}>
Interview November 10th Mexico. I have a question i cannot figure out how to track the packet can anyone help me out. my case was completed on october 6th.

To track packages you go to the DHL website and track by reference and enter (exactly like this with all the spaces) EXP 12 OCT 2009A You can use whatever day you want... I suggest that you contact NVC to see what day they sent your package to NVC so you know what date to put in...

Oh, and we are Nov 10 also in Naples Italy!!!

My case took 1 month, you or your husband should email to NVC and ask about case. Good luck.

Can you please provide email address.

Thanks

Call them... Don't e-mail them... it has been taking 3 weeks for them to reply to e-mail... if you call you can speak directly with an operator and give them your e-mail addresses and see what is going on!!!

Senator cannot really do anything yet as you just applied... I would save the senator thing in case there is an issue or problem... If you just applied their inquiry will not really do too much... Hold that card for an emergency... My opinion

When you send the ds230 to NVC (CR/IR) also send a photocopied set of the complete package, that way they will give you the authentic ones back and keep the photocopy set... For K3, bring the original/certified copy AND a full set of photocopied of the package for the same reasons...

When you get your appointement letter, it will indicate which documents they have and which/if there are any that you need to bring (CR/IR)

Good day VJ members,

I know that my question has been asked many times before but here it goes anyway. I so understand the difference between the Original and Certified but I was told before, that I can send photo copies to the NVC w/our DS-230 and for my husband to take all the originals for his interview. Is this not the case? We only have one set of originals for: Birth Certificate (his), Military Record and the Police Record...

Should I submit all the originals to the NVC along with our DS-230 or send photo copies and have my husband take the originals to his interview??? I did send all these documents to a company out here in California who especializes in certified translations for Immigration purposes and ordered two sets of each document. What if I send one of these certified translated copies? Will this work too?

Please advice I feel now that what I thought of behind ahead of the process may set us back now because we should of had 2 originals of all the requested documents... crying.gif

HELP!

Thanking you in advance,

Liz and Mohamed

Read the document instructions from NVC and then follow them. Hint. Send originals or certified copies.

Thank you for your response...

So we should have ordered 2 sets of originals on all our documents? Wished I would of known this way before...I don't understand if we are sending the NVC all the originals & the NVC will just be forwarding our paper work (case) to the Consulate/Embassy for their portion...why does the Consulate/Embassy need ALL originals documents all over again????

HELP!

Liz and Mohamed

Where did you get the impression you needed two sets of originals. The originals you send to NVC will be forwarded to the Consulate. A second set is not required. Perhaps you're mixing visa categories as you research requirements.

I think that they do not want to send the ONLY originals they have, so they want to get another set of document...

A certified translation is not a certified copy... Unfortunatly, to be a certified copy means that it is certified by the country issuing the document... A certified translation just certifies that the translation of the document presented is correct, not that the document itself is valid..

You can check to see how to get another certified copy from the country issued, otherwise, you will probably have to send the originals... Send a complete set of photocopies of the package so you can get your originals back...

Last week I sent off my DS-230 package to the the address that was in IV Paid printout along with the printout on top of the DS-230 stack.

I barely received an email (PDF attachment) from NVC which has a bar code and an address, same as what was in IV paid print out but the attn is different ATTN: - DR instead of CMR.

What the heck is going on? No wonder why my case hasn;t completed. People with similar timeline as mine has approval already.

Thanks,

It's the same place and everything goes through the same mailroom (per NVC, or that is what they told me because I did the same thing) it will not delay your case...

IR-1 / CR-1 Spouse Visa Process & ProceduresRequired funds in bank account?
It is the sponsor in the USA that has to have the income to support the immigrant OR the assets (or a combined) not the intending immigrant... He/she does not have to prove assets or income just the sponsor/co-sponsor

I was talking to my husband today and he mentioned he had been told by a friend that when he goes to the Casablanca embassy for his interview he will be required to have a certain amount of funds in his bank account before being given his visa. Now, he is NOT asking me for it (to dispel any red flags out there or any naysayers) and if it is true, he will take care of this himself. But I thought the fact that I have to show financial responsibility with the I-864 would take care of this type of requirement. Anyone else go through Morocco on a CR1 and have any insight?

Sounds like something got mixed up in translation or somebody is confusing tourist and student visa requirements with immigrant visa requirements. A visa is not a visa is not a visa.

I'm a little confused by your response. I thought that I only needed 125% of the poverty level, not 3 times that. Or are you saying that if I don't make 125% of the poverty level then I need assets worth around 56K?

If you are using your income, then you just have to show that you earn 125% of poverty level... If you do not earn enough, you can qualify by using your assets, but the required assets in that case is 3 years x 125% poverty, or around 56K...

IR-1 / CR-1 Spouse Visa Process & ProceduresRequired funds in bank account?
If you as the sponsor make enough (per the 864) then you do not need to rely on assets... Plus the assets should be in the sponsors account, not the intending immigrants (aka, in the USA). If you are using assets you need 3x 125% poverty level... Basically around 56K for the 2 of you. But if your income is sufficient, you dont need to show that...

Not sure if Casa and how they work is different, but this is the rules per NVC

I do know that some people have had luck in switching their K-3 to CR1 at the time of the interview... You are very near the end of the NVC process based on your timeline, you might benefit from a scheduling point of view, however, this will also affect your document requirements and need more originals... If you do not get lucky with the timing, then you will get the K-3 and have to adjust status in the US... But I know that there are many others who have had success in filing K-3s and switching to CR1 at the interview time... Check the regionals to see if there is anyone else from Egypt that has done this....

(PS...Pushbrk, the VJ system does not allw you to enter multiple timelines for K3 and CR1, if they received a notice of the K-3, then obviously they have also filed one)

Thank you Christeen! I wanted to explain this to Pushbrk but you beat me to it. I do appreciate your input Christeen and have decided not to take any chances and stick with our CR1 path. In looking at my timeline, I think we are making fast progress even on the CR1 process. I've looked at the Cairo Embassy timelines and some of the K3 filings have taken longer than the CR1. Go figure.

Does the length of our marriage play any role in the process? We have only been married 4 months...Thanks again for every one who contributed their input to my question.

Liz and Mohamed

Probably the safest route... As far as time married, just be sure to collect and gather all the evidence of your ongoing relationship that you can... read the guides and others ideas of things to get... Good luck!

Oh dear, I wasn't getting touchy. Sorry if it came off that way. I just was trying to understand the process and why it is required for him to prove domicile when he's been living there his entire life. I thought proving domicile was only important in cases of DCF. That's all. I did take up your advice -- the in-laws will write a letter of invitation, stating that I will be living with them on my arrival in the U.S.

I do appreciate your help and tips, Christeen!

Sorry, it just seemed a little sharp, or I might be edgy expecting the hubby... But as far as the domicile, it is not that they will doubt that he lives in the USA, my thoughts were that they might ask where you plan to live when arriving and since he does not have a place yet in his/your names, you have an answer that you will be living with in-laws... It might not even come up at all, but since you are in the process of trying to get everything possible together, thought you might add that to the list "just in case" scenario...

Uh okay, thanks for the tip, Christeen. I'll look up on it.

So his MI driver's license + vehicle/ US passport / bank account and the fact that he's been living in the U.S for his entire life means nothing? He still has to prove domicile? I thought proving domicile was important only in the case of DCF.

No need to get touchy... I just pointed out that a way for you to prove "where" you will live and showing where you will live once you arrive the USA... You said you did not have a lease but since you are going to live with in-laws you can do a lease with them... You wanted advice on a comprehensive list and I was just adding that as it was not on your original posting... Also, I dont know that he has drivers licences and a "lifetime" of domicile evidence. Like I said, just pointing out something that I did not see in your OP.... Use it or not

I'm glad your visa journey is over. Now let the life journey commence.

Hey Christeen, I live in India, not in the U.S. Why would I need to prove domicile? My husband is the USC. I WAS in the U.S. for the four years for my undergrads and that's where we met -- in college. The plan currently is that I will be living with my husband and in-laws in Michigan for a couple of weeks when I first get there. After that, we'll rent a one/two bedroom apartment for ourselves. What would you suggest in this case? Rent an apartment before the interview and have him mail the lease over? Or have his parents write a "letter of invitation" of sorts?

The US citizen would have to prove domicile.... If you are going to live with the in-laws and wanted to suppliment your proof, I would have your husband download a "lease" agreement between both of you, and your in-laws, saying that you will 'rent" a room from them... You can download the forms easily on the internet, just a simple lease agreement will show where you both will live after you are issued the visa. Kind of an "official" plan if you will...

Evidence wise then you should be fine... However, one of the requirements is proving domicile... meaning that you are living in the USA and have a home to come to... Where will you be living in the USA?? If with a relative I would download a lease and have you both sign a lease with your parents, or if you are going to rent a place, put both of you on the lease...

It is quite comprehensive but I think that 300 photos is way overkill... I would select some of the more meaningful ones and put them together... Something else I did not see on the list is anything regarding joint lease or housing (if you are the sole owner of the residence, then dont worry about that)... As far as what to print, they are pretty much only concerened with communication AFTER the marriage... And I have heard that recently India has gotten particular over following religious norms in part of establishing valid relationships (aka, registered Muslim or Hindu ceremony)

But you sound like you have it pretty covered...

However, at interview time, consulate asked for the co-sponsor's tax return. So, be sure to have co-sponsor fill out I-864 along with supporting evidence of income such as employment letter, pay stubs, tax returns, etc.

Thanks!!!! I got my friend to do the I-864 and her taxes too!!!

Dont forget to get a copy of proof of residency (passport copy, birth certificate, green card) and current proof of income (pay stubs or letter of empolyment) from your sponsor and you will be good to go

First, you need to fill in a timeline so we know what is your timeframe and how you filed. Also, I am not sure if your translation software is doing the best job of translating for you as some of your posts is a bit difficult to comprehend???

But to answer what I think is your questions we need to know, Did you file DCF in Germany or from the USA?... When did you send the I-130? Who did you request the paperwork from? Did you fill out the paperwork yet??? Are you both living in Germany or is one of you in the USA???

However, if you are filing a joint-sponsorship (that is a relative living under the same roof as you who fills out the 864A, then you also have to submit proof of relations).. But since it is a cousin and they live at another address, no worries.. But do submit proof of Legal Residency or Citizenship for them and the other documentation....
