I was married for 7 years and my husband worked on a cruise ship so we never filed for IR1, he traveled on VWP or entering on C1D, we just recently filed for his IR1 and he just received his green card. But prior to him getting issued the IR, when we traveled together, I showed them his Italy passport and said he is my husband can he go through the citizen/LPR line... But he was not a GC or IR1 visa holder at the time... We traveled to and from Europe about 2-3 times a year together, me as USC, him as Italian citizen NON GC holder.

Agreed, it all depends on the traffic cop, but as I have experienced, in 7 years of traveling with my foreign spouse I was told at 8 different POE's (Atlanta, Charlotte, Orlando, Newark, JFK, Chicago, Detroit and Houston) that if he is traveling with me, the USC, then he can enter via the citizens line, Miami was the only one that directed us to the visitors line... But apparantly it is subjective to the person directing traffic on any given day at any given airport... Just show your US passport to the person directing people and say I have my wife/Fiance and they are entering on a CR1, K-1, K3 visa and see where they direct you... Nobody here can give you a definite as it depends on the guy/gal at the airport... I can only speak from my experiences over the past years.

Any line they go through your SO will be sent to additional processing room to process the visa, you will not get admonished regardless of the line you choose.

If you are traveling with the US citizen, I know that if they are your spouse (so for K3 and CR/IR visas) you can go through the citizen/LPR line, if they are traveling by themselves, then you will most likely be directed to the visitor line... This is what I encountered over the last 7 years of traveling with my foreign husband through several different airports... The only one that ever gave us an issue was Miami airport...

From the time you file the I-130, you have about 3-4 months wait to get to NVC... That is when the financial evidence is submitted... If you have been working during that time, you get a letter from your employer saying how much you earn and can project that for 2010... You also submit paystubs showing that you are earning that... If you are above the poverty level you can qualify or I would suggest that you get a co-sponsor... But you do not have to show income info for at least another 3-4 months...

By submitting I129F you are on the K3 path and you dropped CR1 and lost your i130 line.
Generally you can later restart CR1 but after going through the K3 line up to NOA2 and if Service center gives NOA2 at the same time for K3 and I130 (2 simultaneous NOA2s) . You do so by dropping K3 at embassy level. (i did it) Except sometimes only the K3 NOA2 comes out (no luck). When restarting CR1 it will be at NVC level that is what is fast for K3s but less fast for CR1.

... What happens is you file the I-130 first, then you receive your NOA1, then you file the I-129 for the K3... Your CR1 application is pulled out of the line and held up until they adjucate the I-129 and you suually receive a NOA2 for BOTH applications... From there BOTH applications are sent to NVC and the CR1 stays there and the K3 is forwarded directly to the embassy BOTH APPLICATION ARE PROCESSING it is not a case of the CR1 is dropeed fromprocessing, you just lost your earlier place in line.... From that point you will receive communications from NVC to submit documents to them AND in some cases communication from the embassy which is processing the K3... If you want to keep with the CR1 (much advised) then you ignore the communication from the embassy regarding the K3...

For UK, I would say that the 6-9 months is probably as good a guess as any (of course non RFE or AP situations).... If you are filing DCF in the UK, then 5 months is possible...

Let me ask this dumb question: If I was to bring videos to the interview, am I allowed to bring camaras inside the consulate?... I thought that even cell phones had to be left at the door?... maybe I can film a couple of social events at home and show them at the interview...

Sorry, you asked if this has happend to anyone else and I cannot say I have seen a case like this... Have you tried looking through the threads and doing a search to see if there are similar cases...

Now at first glance I would say to go to the earlier interview and let them know then that you have the interview for the IR1 in January. Best case scenario is that they can switch you from the K3 to the IR1 and save you the troble of AOS... I have seen other cases where the consulate did this, meaning they went to the K3 interview but since the I130 was approved and at the consulate they issued the IR1/CR visa... Hope that is the case with you...

If they want you to come in and it seems like the AP is done, then I would say go ahead and come in earlier... If there are any issues then you still have the January interview to fall back on...

For the 230, you need to send originals OR copies that are certified by the issuing office (AKA, the copy of your birth certificate you get from the dept of vital statistics)... Photocopies will not be accepted... Make a copy of EVERT PAGE you send to them and put your case # on each page...

OUT ON A F'ing SHIP AGAIN!!!! I am getting really upset as he took this new job to finally live here in the USA and he got sent for this project 3 days before New Years and is STILL NOT HOME!!! I know how you feel, it has been one issue after the other and this 2 week project is going on 4 weeks!!!

Kinda feel like "#######, I busted my butt to get this GC so you can go an be gone again"??? If I had known this he could have stayed on the cruise ship and I could have visited! His boss is pretty PO's that the company messed this one up so bad and kept him so long at sea and promises that this is NOT the norm!!! I sure hope so as I am going crazy!!! The only good thing is that this month is like 4 months of pay for him so I guess that is the positive... But I wish he was home!!!

Husband answered, back in '84. Consul gave my husband a look of disbelief and then my husband said we had met when we were kids. Consul just laughed.
When did we start dating?
In 1991
When did we get married?
2007.
Who had petioned me to come to the US?
He said my mom.
Have you ever had any problems with the police?
Husband answered no... I work for the police.
Consul laughed again.

And that was it. The consul smiled at my husband and said "congratulations: your visa is approved. You can go pay the courier service and have a nice day"

It was a very smooth interview. He was done in no time. Thank God!!!! star_smile.gif

the interview is not as complecated as it seems especially if you already submitted evidence before also it is required you have it with you , any ways it is not that hard just be honest and tell the truth and show your evident i posted some stuff they asked on the interview on my previous post check that out and if you have anyq let me know .

Dear hbk,

Unfortunatly you have run into the issue of members not wanting to spoon feed info to you regarding the K1 visa without you doing the necessary research before asking questions... I believe you will find that the members here in the CR1 forum will be just as demanding of you to take an active role in doing some research on your own. We are all married here so for many of us, we have even less patience for redundant questions then the engaged folks (this is just my opinion).

That being said, bringing a foreign spouse or fiance to the USA requires a great deal of work and research and time. If you are unable to do your part to read the well written guides here or have a problem interpreting them, then my best suggestion would be to consult an attorney who is paid to respond to your questions and will do the paperwork for you...

We are not being rude, just saying that you should print out all the guides and spend some time reading and write down each step... IF after you have studied you have specific questions or need info, we will be here to help out... But take control of your situation and :guides: Being armed with all the information will help you feel more in control of the situation and aware of where you stand. It is a long and difficult process but can be done if you invest the time and effort.

Yes, I sent out the AOS package this past Monday, via USPS Express mail. When I tracked it via the web, I can see that they received it the next day at approx. 10 am. I just wonder why my 3032 is taking longer than others who have had their processed in a matter of days??? 2-3 weeks for the processing and how much more time for the IV bill to be generated???

No-ones lately has taken days!!! The average from the time received is 2-3 weeks... That is from the date they show receiving it to the date you get the IV fee bill... Processed means accepted... So if they said it was received on the 27th, you should have the IV fee bill ready for payment between 10-17 November... They have gotten SLOW lately with the big rush from USCIS

If you come on the VWP, then it is up to the immigration officer if you are admitted or not... That is based on you showing ties to Poland (university, leases, job) something that will convince them that you will return to Poland to finish the procedure and not stay in the US... If they feel you do not have enough compelling ties to your home country to return.. You can be denied entry to the USA and will have to wait in Poland..... There are many here who have successfully stayed here in the USa and retruned to the home country, so try to read some threads about this to get an idea of what to expect...

I know what you mean. We drove all the way there and all they did for us was switch ours from Oct 26th to Nov 23. Even my husband begged them "please nmy wife is 5 months pregnant, travelling 6 hours back and forth is difficult, she will be 6 months then, can't we have an early date?" and the guy said "Nov 23rd is the earliest date we have available for those affected by the closure, everyone else is getting Dec 15th or 16th." SSB, I think we should email the embassy too and try to see if perhaps, Insha'Allah, they would be able to move our dates up as well? Did they say anything to you about a new scheduling letter? Because they told Zaheer that he doesn't need one, just write down the new date on the old letter. What do you think?

If you put the USC as the agent, both of you will get e-mails (make sure they have your e-mails)... If you only put the beneficerary, then only she will get them... Since you will be over there with her, no biggie... I never got ANYTHING in the regular mail system from NVC??

what did you say to get an earlier date?

Nothing special, we just asked if they might possibly have an earlier vacancy as he would like to get the US to start his new job.... But we had heard that the Naples consulate was pretty slow and not a lit of requests (thankfully!!!) So surprisingly, they said yes! Hopefully the interview goes easy too.. But after 6+years married, we have plenty of evidence together...

Just curious, but how did you request an earlier date? We originally had an Oct 26th date, but Islamabad closed their embassy for this week. So when we called to reschedule, they told us the EARLIEST date they have available for those who were affected by the closure was Nov 23. But when I went on the Islamabad thread, someone's husband got a call from Embassy and they rescheduled their Oct 28th date to Nov 19th. So, how do I get an earlier date for my husband? I am pregnant and really need to get back to USA soon for prenatal care but my hubby wants me at his interview. Any advice?

Each embassy is different... Naples is not a super busy embassy so they had openings... I know that there are a few affected by the Pakistan embassy issues... I am so sorry for all those who have gotten delayed... I really hope that they get things moving for everyone paitently waiting!!

To track packages you go to the DHL website and track by reference and enter (exactly like this with all the spaces) EXP 12 OCT 2009A You can use whatever day you want... I suggest that you contact NVC to see what day they sent your package to NVC so you know what date to put in...

Oh, and we are Nov 10 also in Naples Italy!!!
