No, dont send NON finanical documents with the financial stuff, just send in your 864, tax info and all the joint sponsor stuff...

NO, income MUST continue for it to be considered... However it will help to show capacity to earn.. .But your dad will be the main sponsor...

No, it would be 1 for you... 1 for your wife, 1 for your child and 1 for your other daughter (since you are still responsible for her financial support via child support.... Total would be 4...

Unless you are financially responsible (legally) You do not have to count your brothers as part of your household, They would however be counted on your fathers 864 if they are under age and supported by him... If they are over 18 and file taxes, then they are financilly responsibile for themselves and would not be counted as dependents of your fathers... You did not indicate how old they are... But regardless, the "household" size refers to financial responsibility... Not necessarily the amount of people living under one roof...

I totally understand. ;) Yes we plan on getting his citizenship but he wants dual because he wants to be able to live in Canada again some day. :) His children are there with his ex too so we may agree to move there one day too.

THank you for clarifying the co-sponsor. Are the co-sponsor's only responsible if the immigrant uses public assistance of some type? This would not happen as we are both wanting to own our own businesses in the near future and creating some amazing things but I don't want the co-sponsor to feel limited or responsible. If anything happened to him he would just go home to Canada before he would allow any of my family to take care of him. He is just that way. So they aren't financially responsible for any debt or things like that right? Like if he was to get in a car accident and be hospitalized or have some major cancer or something and wasn't able to pay the hospital bill right then they can't go after the co-sponsor right? I am not anticipating any of this but that would be my first thought if someone asked me to co-sponsor. ;) LOL I would be thinking of every possible scenario to see what I would be liable for.

So if you can help relieve me of that worry I may have a guy friend who is single and a teacher and makes over $50,000 a year willing. He mentioned he needed to know more though.

I just feel that my dad would not want me seeing his tax returns and his assets and all that is private to him. To ask him to bare all of that for me would be too much for me to ask.

You can have your father get his tax transcripts, that way he does not have to show you ANY of his assets or other info... You can order the tax transcripts for free... And definetly go CR1 as they process the same as the K3 in Canada (which is a very long wait anyway because of their personnel issues... 9+ months)

Total process is usually around the 6-9 month mark from filing to bringing them to the US... Take some photos of you guys with your family, keep your boarding passes, prints a few chat logs or phone records per month from talking, Hotel stays, etc... They understand you are a new couple and might not have tons of stuff together yet... Also add her as a beneficerary to your insurance, buy some cheap term life insurance and have her as your beneficaerary...

Since the co-sponsor is the one that you are using to qualify, be sure that you have sent employment proof for him (and bring current paystubs for him to the consulate)... Additionally, be sure that you submitted at least your last tax return or a letter stating why you did not have to file taxes...

Regardless of what NVC says, it is up to the Consulate if they accept the sponsorship/income. NVC just verifies that you submitted everything to them... The consulate is the final word so bring whatever you think might come up in regards to financial support proof.

Since you file your own taxes she does not count you unless she claims you as a dependent.

Since 09 is over, you can probably get your 09 income... for 10 you can project it based on your average monthly salary

Be sure that you include proof of family relationship for you and your mother (birth certificate) since she is filing the 864a

Some banks I think are still pretty sticky about it and do not know the rules allow for an account to be opened without a SSN??? We had the same issue in Florida... We were married for 6 years and tried at 5 banks (Wachovia, B of America, Bank Atlantic, First Federal and one other I cant remember) they all said no... There are others here who have been successful in getting their SOs on the accounts without a SSN??? Someone said HSBC but we do not have one around us...

In fact, the 864 instructions under #29 shows a clear example of this, technically, the USC should be able to show 3x whereas using the intending immigrants savings would be 5x. We used assets and had to show 3x the 125% in the bank under my (the USC) name, this was the specific request of the Naples CO.

No, seriously, that is how it works on the 864... Only they do accept 3x the 125% poverty level if it is the USC's assets...

If, using all of those sources, the minimum income requirement is met, the affidavit would be "sufficient." To be counted, the cash value of assets must equal five times the difference between the sponsor's income and 125 percent of the poverty line for the household size. For example, if you have a family of six, but your income is only $30,000 you are $3,500 short of the required income level. You would need to show assets of at least $17,500 ($3,500 x 5).

Usually takes about 14 - 17 days for your 230 package to be reviewed and case complete (no rfe's of course)... Once you get a case complete, NVC schedules interviews the second week of the month for the following month. Waiting time is consulate specific, but most are scheduled within a month or two from case complete... Check the regional forum to get specifics for your consultate.. But my gut reaction is that you will not make it for a Feburary interview, but I could be wrong... Good luck

I doubt the consulate has any 'agreement' with Canada. However, many of our banks are intertwined, a whole different kettle of fish than Italy I would presume. I for one would be incredibly surprised if there was any question that Canadian funds in a Canadian bank were refused.

We had a BIG issue with this at the Italy consulate... But it might not be an issue from Canada... Basically, they did not count my husbands assets in Italy or his employment (which was to continue with the same company when he entered the USA because he had not been there for a year), so we decided to qualify based on our assets in Italy which were WAY sufficient, however, they did not accpet those assets and asked to see the 3x 125% in an account in the USA under the US citizens (my) name. Luckily we had this but spread out in a few accounts, but we consolidated it and showed them the bank statement totalling the 56k and we got the visa...

Again, I would think that Canada would have more agreements and be able to count assets in Canada towards qualifying... But I will see if there are other Canadians who can verify this...

I say debated since it seems that each consulate does not follow this, for example, we showed 3x and I have seen other VJ memeber who were required to demonstrate 5x... so I think that the application of this might be consulate specific. Also, the Italy embassy would not even consider my husbands assets in Italy even though they exceeded by over 15x the 125%, we had to put the 3x in an account in my name in the United States???

Your parents would file and 864 as co-sponsors, their dependents would be your spouse + patents + dependents that they claim on their tax return... For a household size of 5 it would be $32,238, for 6 $36,913 and for 7 $41,588 Gross income to qualify for above 125% income level...

You need to send in the 2008 returns for you and co-sponsor

If you fall short by a small margin to sponsor her, can you qualify in assets? You can make up the difference in assets by having 5 x the shortfall in liquid assets... For example, you need $18,213 and say your gross income is $15,213 so you fall short by $3,000 then you can show your income plus $15,000 in assets to qualify. Technically as the US citizen you should only have to show 3X the shortfall, however this has been debated since the example on the 864 shows 5x

If you are filing a CR1 from the USA, then once the visa is granted they do not have to file to adjust status, but they will have to file to remove conditions prior to the 2 year mark. If she is entering as a student and you are adjusting her status from a student to resident, then you will have to show evidence of living as husband and wife. Understandably, there are circumstances where some couple have to live apart for work and school, however I would say that this could be a red flag that there is intent for immigration fraud.

However, if you establish a residence together, accounts together, proof of spending significant time together it is possible to overcome these issues. But living in different states will create some issues with the process.

I found that by following the guides here and asking whateve questions I had, I was able to complete everything MUCH faster than with a lawyer and saved thousands... Also, keep in mind that a lawyer will probably direct you to do a K3 saying they process faster... But hte TURTH is that, although they are free to file initally, they will cost your a significant amount and the lawyer makes much more $$$ by doing this, that is why they recommend it. But it slows down the CR1 and takes the same amount of time...

Just follow the guides and dont overstress about each little thing, and ask here if you have a question or not sure how to answer...

If i need more evidence i have the paperwork where i got enrolled in DEERS but it has jons old address on it, im not going to use it the time rounf because i thnk it might cause problems with a different address on it, is that ok or shouldnt it be a problem?

Did you use a folder with a see through front cover? did you put the papers in flimsys or did you just put the paper in it?

No, the photos do not have to be in color
I used a ziploc sandwich bag for photos
I did not use a folder, just a binder clip
