Although SSD benefits technically should be counted, since they are a seperate line item on the 1040 (SS benefits) and they are not always considered under taxable income if you earn in total under a certain amount, it depends on the adjucater of the AOS as to whether it will trigger a flag. Should it count, yes, but the embassy and NVC sometimes do not look favorably and ask for a co-sponsor anyways...

So to be safe, I would use the co-sponsor... 55k is definetly enough to qualify based on the 3 dependents (the anut, husband and your husband)...

It is OK that you were a student and did not have any income... check the guides here and you just submit a letter you write (do a topic search) saying that you were a student and did not have any income and were not required to file taxes... You brother is the co-sponsor... YOU are the primary sponsor regardless of if you have $0 income!!!!

Check out the Canada regional forum as they have some long waittimes for interviews at Montreal... the 3-5 months is for part 1 which is USCIS, after that you have 4-8 weeks for NVC processing THEN the wait for the interview which is currently about 4-5 months... it is about a 9 - 12 month process... But the Canada regional forum can give you a better ides of the wait times and any other options...

I agree with darnell... take a break, so something different and go back to it or you will make errors and get comfused... clear your head...

Then; The 864 is the package from the USC... it includes an original 864 form signed by you... and copies of your financial documents (copies are OK)

The 230 is the info fro the foreign spouse... these need to be original forms and documents from the issuing authority...

Write the case # on EACH piece of paper you turn into them... Then... I recommend you send the package PLUS one photocopy of the package to NVC... ANd I made 2 other sets of complete paperwork so I had one and my husband had one... Same goes for the 230...1 full set of original documents and one full set photocopy (so you can get your original documents back)... plus 2 sets for you and spouse...

If you file for a spouse visa, they have to FIRST be your spouse... only then can you start the paperwork... and from there it is about 6 - 9 months... If you file for a fiance visa now(k1), you might be able to have them come here, as someone suggested, have a quiet civil "official" ceremony here, then go have a big formal wedding in your spouse's country as generally, it is about 4-6 months... but you would be cutting it very close...

Read up on the guide here as there is LOTS of info... you can type in keywords at the top and see some situations similar to yours...

I might add that if you get married over there, he would not be able to come over and live with you immedialty... the process is between 5 - 9 months generally before he could join you here...

First and foremost, if you want accurate assistance :time: so we can see where you are in the process and what visa you are filing for.. and what country (as it makes a difference in what you need to send)

If you are at the USCIS initial petition part, then take a look at the guides... But normally this is where you put in the USC birth certificate, proof of marriage etc... etc..

The 3032 is a form that is sent to NVC after the petition is approved by USCIS... This is done by the foreign spouse... THEN the AOS package and then the 230 package (which is info about the foreign spouse)...

Please take a moment to fill in the timeline so we are not spinnin our wheels trying to help not knowing where you are in the process... Without the info we are shooting in the dark for helping ya...

Make sure you give them (nvc) you e-mail addresses), make youself the designated person for the 3032 (you both will get e-mails ) and you can take the stuff with you and mail it in... as long as you have internet access you can keep up with the payments and so forth... be sure to bring your account info for the payment portal... and print the Ling shortcuts so you have them at hand...

Nobody can tell you when the interview will be... However if you get all your paperwork in to NVC in a timely matter with no RFE's, I would venture to guess that you could possibly interview in May or June if you have any delays in getting required documents... This is my best WAG (wild a$$ guess).

Yes, you are correct. My sponsor does not meet the 125% guidelines, so I combined the income with the assets. If going off the 125% x 5 only, the sponsor will not meet have the sufficient amount to meet that level. My understanding was that I could use the income and if there is a difference, I could multiply the difference by 5 and provide the amount with assets.

Yes, I do work, however, I am a full time pre-med student and my income is not that great since I only work part-time so I definitely need a sponsor. However.. I could support my wife without a sponsor.

So my understanding is that I could either provide income that surpasses the poverty guidelines OR provide assets that equal the 125% x 5?

I understand what you were doing and in "theory" this should be acceptable, but it is entirely up to the consulate and they tend to take the entire situation into consideration and they must have some doubts regarding the joint sponsor and using the "calculate the difference" method. Although it is an acceptable method of calculation on paper, what the consulate will permit and approve is unfortunatly, in their hands...

So it seems that you are left to find another joint sponsor who meets the criteria either with income (preferrably) or with the total assets necessary. With this, I think since they know that you are probably scrambling to find someone else, they want the new joint sponsor to write a letter stating the reasons they are helping you (like he is my best friend and has helped my family over the years... or he is family and I believe in his ability to support his wife and I would like to offer my full support... etc....) As far as the monthly amount, I would have them put that currently you provide sufficient income to support them, but would be willing to cover any housing/food costs up to like $900 a month) ... These are just numbers I am pulling out, of course the new joint sponsor needs to earn enough to be able to support whatever amount you say they are willing to give you without leaving themselves in the hole, if you know what I mean.

Perhaps others have better ideas, but this would be my .02 cents.

So the joint sponsor does not make above the 125% without the use of assets to cover the difference it that correct?? Well, that might be the issue. In many cases when using a joint sponsor, many consulates want to see that the joint sponsor either makes the sufficient amout OR they have the full assets to cover the 5x the 125%. Using the combination method "in theory" is within the guidelines, however if it is a case of the joint sponsor perhaps not earning enough without the use of some assets, it raises red flags.

If the situation is as stated above and you do not earn enough, and the joint sponsors income/assets are sketchy or close to the limits... Then yes, you might have a problem and I would certainly look for another joint sponsor.

As far as the monthly amount they are wanting... that one still baffles me since the sponsor is on the hook for re-paying the govt for any means tested assistance. Do you show any income to support your spouse?? If not, then perhaps they are questioning how you will maintain them in the USA and want to know that the joint sponsor or someone will be taking the responsibility of paying for their needs? This is just a possibility.

Yes, that is what they are asking me for when I find a new sponsor.

However, they requested the samething during the interview from my wife and I provided them with this document from my sponsor. After reviewing the document... they now tell me the sponsor doesnt qualify...

Was the co-sponsors income sufficient (above the 125%) or were you using assets of the co-sponsor??? (5x the 125%)?
