They are visas for foreign workers in specialty jobs (like chemist, specific engineers, scientist etc..) companys rush tomget these requests in since many employers who use these specialty workers have to get in their applications before the quotas are filled or they do not have workers. This is a normal slowdown this time of year but does not explain WHY applications were not processed prior to April (when h1bs can be submitted). I think the H1B excuse is a convenient scapegoat and the real reason for the backup has yet to be released...IMO. Sorry for all those waiting!

No rhyme no reason... It is very random and one persons experience is not indicative of what your will be (even from the same service center). You have the right to ask your congressperson for help, but unless it is outside their normal process times, they can't really do anything, however, for many, once a congressional inquiry is filed, sometimes it lights a fire to pick up,and look at those files... But call and ask for a tier 2 and see what is going on... But I believe that you should be getting close and hear something any day... Have faith!

I would let your husband know that you NEED to get some photos of the two of you with his family and that they are VITAL to your case. As far as the gifts, you do not send the ACTUAL gifts, but photos of the cards and you or him with them and the receipt for them... that sort of thing. But since receipts do not seem to be your thing (which I understand, I throw everything out too), I would get letters from family members stating that you have a bonafied marriage and that they know the two of you to be a married couple. You can have them translated... The wedding photos and all the other photos you will NEED to bring and if you can get a printout of your SMS messages or at least a printout of your phone records showing all the communication between the two of you, that is good two. But do not send in actual gifts, videos etc... just paper things like photos, documents, bills etc... You can also purchase a term life insurance policy online for like $2 a month and name him as the beneficerary.

Thank you for clearing up your residency questions and that makes your proof gathering way easier. Being over there with him (lucky you), you should be able to bring all kinds of photos of you together and with his family as well as show some things you do together (dinner receipts, places you go together etc..) other than just the cell phone photos and 2 wallet photos that you used a proof in your first interview. Stick with the pitctures, plane tickets, e-mails etc.. and other tangible proof. As far as the cards, it should not be your PRIMARY evidence but all part of a quilt showing your life together so I dont think official translations will be necessary but you might want to put a note inside the cards translating what he is saying. But I would stick with paper things, not boxes, presents or videos... just photos or paper to make it easier on everyone.

For your second issue with the embassy, bring a copy of a bank account opened with the address of your parents, the water bill you said is in your name and sign a lease with your parents all showing your intent to live in the USA upon receiving the green card.

I have read several of your posts regarding your interview experience and as I recall you had issues with your domicile stating that you currently reside with your husband. I also read that you only had cell phone photos of your wedding and were not adequately prepared for your interview to which several VJ'rs responded about things to bring. During your post "desparate" you were also advised on how to establish domicile with a lease from your parents and opening a bank account on-line.

My point is that if you have been living with your husband and fear having to leave him alone and return before him, how is it that you have a plane ticket (as you stated earlier) showing your return from visiting last year? I am confused, do you live over there with him or in the US? If you live in the US then you have no domicile issues???

I don't mean to doubt anyones posting intentions, however I also believe that it is not fair to all those VJrs trying to offer advice to be led around in circles responding to condradicting questions.

To summize your OP;
1. If you can prove that the gift came from him, send the receipt or card that came with it, otherwise it does not prove relationship
2. If you live over with him and do not wish to return without him as in your previous posts, you should have SOME photos, if not TAKE some together and with family
3. If you live in the US as you said in this thread, then start making copies of e-mails, phone records, phone cards, anything you got AND open a bank account and sign a lease with your mother, dont bother with gifts that you cannot prove came from him, they are nice but not useful.
4. Regardless of where you actually live, this time when you go to the interview, bring proof other than cell phone photos and 2 photos in your wallet.

It IS the same question, i posted on this thread again for OBVIOUS REASONS, as i stated in the beginning of this thread because my original question was only answered by one person, the rest of the thread was us talking about WHY they asked for an I-864A to begin with and got off topic of my original question. They were very helpful but i only got ONE answer for my original question.I am here to get help and get some more answers from experienced people who have gone through what i am going though and who have filed this form out. I stand by my assertion that he was charged with misrepresentation not an overstay and i am not being judgmental and gave constructive advice (she needs competent legal council as well as options for her to go to Italy). This charge and deportation carries with it a "lifetime ban" ... There are waivers that they can file (but they cannot file any waivers now... they must first file for the visa, be denied THEN can try to file,the waiver) but given the circumstances this will be an uphill battle... They need to be prepared... Regardless, the need for a lawyer well versed in these cases I believe is warranted.

Wow.. That is a Situation... Now for him... I fear he is facing the lifetime ban for misrepresentation, for,which there is not waiver... But you can certainly try to file (be prepared to shell out some $$$$ for a GOOD lawyer) any old run of the mill immigration lawyer will not help.. Perhaps others have recommendations... But you have a huge uphill battle.

Now for Italy... Are you there now? Or planning on going back? I would get married wherever you can (legal entry into another EU country) then have him apply for permisso for you to stay in Italy. A church wedding will not be performed between a non-catholic and non resident as they require classes and so forth... Check with the requirements of the commune as I married in Italy as a tourist (of course getting all the permits).

In any case... I will not belabor the fact that both of you find yourself in a romeo and Juliet situation because of your ignorance of the laws and blindly trusting others without doing your research... But own up to the errors, shell out for a GOOD lawyer and be prepared for a very very long and tough road... This will not be easy...

Now he will "likely" need a waiver.... They WILL need a waiver. Not putting personal judgement on his overstay.. But the govt outlines the rules and does not pick and choose if someone will be judged different based on human reality considerations... That is a value judgement... What members here are try g to say, what matters is how the govt looks at the reality, and that is, at age 18 a person is responsible for their actions and any overstay is counted, regardless of ignorance of the law or any other human realities.

The OP needs to know this and needs to know the reality of dealing with the situation. Nobody said they could not get a waiver, just that they would need one... Period. So the sooner the OP gathers info on how to prepare for,that reality, the better off they will be. Sugar coating and qualifying why the overstay happened does not eliminate the fact that there was an overstay, they will be denied and a 10 year ban will be incurred and they will have the chance to file a waiver (which if presented correctly is many times approved) which will take more time... Better to go into this eyes wide open...
