Yes, especially if you are filing under the 3 year rule, one of the listed documents is tax proof (it also,shows you file married). Most of us sent in tax transcripts and I would venture to bet that those that did not, we're asked to provide tax proof. If you are behind in taxes, they require you show proof that you either have arranged for payment or are in good standing with the IRS.mthis is the federal government... They find tax info VERY important.

Yes, you need proof of filing taxes... One of the questions on the 400 pertains directly to if you have filed taxes (or ever evaded taxes) ...

One last question, I made few trips to Canada by driving, dates of which I don't remember. Now, how do I enter that information into N-400 without coming across as a liar ?

Estimate the dates as best you can... If you have nothing in the passport, go back and look at credit card statements to get the dates etc... But Don't sweat it too much unless you were gone for long periods of time... Just put the days to the best of your knowledge... It is a common issue.

Yes, you can just take a copy to the interview if they need it. The usually don't RFE citizenship packages, the just have you bring missing stuff to the interview...

Miami experience was similar, except he was traveling within 2 days, so we made an appointment in the morning 8 am... And we returned at 2 pm and picked it up. They were actually rather efficient, parking was $8 an hour for the first 3 hours... Everything was on time and each visit was less than a half hour....( luckily, we found a lot nearby that was $10 for the whole day..)

. Hubby brought a letter from his employer and flight reservations for proof of travel. Sme people were picking up from the days before (those with less pressing travel plans))... We were stuck in Miami all day, but I suppose there are worse places to be stuck for a day B-) he got his first stamp in the passport today!

If the baby's father is a US citizen, the. After the birth in Jamaica you would apply for a CRBA and the baby could be issued a us passport and gain citizenship,through the father. Pregnancy is NOT a reason for expedite... And they cannot expedite AP, you must wait it put till you are cleared...

I wouldn't put any reliance in a prenuptial agreement. They are not always recognized by Courts and there is little consistency throughout the US on how this is handled. Even IF you were to divorce in a Court where they typically upheld prenupts, it would be relatively trivial for a good attorney to persuade the Court that your foreign-born wife had little understand as to what she was signing at the time. I wouldn't even waste the time/money involved.

Rather, if you're concerned about assets you ALREADY have then take steps to keep them totally separate from assets you will co-mingle after marriage that will be considered marital assets in the event that a divorce comes your way. Pay a decent attorney to set up a trust for those assets you currently own and want to preserve for children from a previous marriage. If you have cash/investments, place them in a separate account. Be careful to never 'hide' this information from your new wife, but to be careful to never comingle or give access to her as this will then make these accounts marital property to which she may make a valid claim.

I was in a similar situation and created a blind trust for those assets which would eventually go my existing children ... and realized some favorable tax benefits as well which was unexpected. Also, college fund is set up to benefit current children and any future issue, but controlled and disbursed by the trustee (the bank) according to my wishes, with any remaining funds being given to my alma mater.

When you file DCF, they require you show proof of INTENT to create domicile... They obviously understand the you are living over there and cannot have domicile in 2 places... To prove intent you will need to show financial ties (such as bank accounts in the USA, job contracts or other things) plus intent to move there upon issuance of the CR1 visa, this would be a lease on a home or apartment, enrollment in school, quotes from moving companys etc... This is generally how DCF process the domicile issue... Not sure if HCMC has a different set of standards. But you will definetly need to show rental of a place to live in the USA...

I am confused are you the USC or the intending immigrant?

But how it works the I-130 is for the CR1 visa (for spouses and grants a green card upon entry with the visa that is put in the foreign spouses passport AFTER all is approved and interview in the home country of the intending immigrant)... A k3 is also for spouses but it is not an immigrant visa and takes the same amount of time and is a BIG hassle in the end... Since you are married you cannot apply for a K1 which is a fiance visa

You filed the I-130, now you wait for USCIS to approve the petition (usually around 3-4 months)... Then it goes to NVC... You pay the fees and file the paperwork for the intending immigrant AND an affadavit of support (filled out by the US spouse saying that he/she can support the incoming immigrant)... Once approved at NVC your foreign spouse will get an interview at the US consulate at their home country...

The spouse will most likely not be able to enter the US while waiting for the visa... Total process is around 6-9 months...

Blurg...I guess asking them to process them in the order received is too much to ask...

Another issue to consider with a K3 is that the I-130 is accepted, then the K3 application is filed, so BOTH applications are being reviewed and the I-130 is usually held up to allow for the completion of the K3 application... These essentially TWO applications together take longer to process and marry together then it would be just filing the spousal visa and not the non-immigrant version along with it (the K3).

I know that you are aware of the K3 issues as you have indicated in other threads, but you chose to pursue the K3 in hopes of being reunited faster and time was more important than $. However, I believe from what I have read and seen, that the K3 application actually slows down the entire application process.

I do however understand the frustration with the fiance visa versus the spouse visa... Logically, it would seem that reuniting a married couple should take priority since the priority of USCIS is the reunification of families and a married couple is a legal family whereas a fiance is not considered "family" until the marriage occurs. However, the lack of rights of K1 applications upon entry and the restrictions on them from time of entry until they have legally adjusted their status means that they the majority of paperwork and checks are completed by a different unit at a different time, thus the processing is less on the front side.

The CR1/IR1 is for married couples, the i129F are for those that are not married but plan to get married upon entry into the US, so I'm a little confused why you sent two different applications... If your married your i129F will probably be rejected.  




Queene... one note... You might Familiarize yourself with the process prior to giving out filing form info less confuse someone unessarily... How the process works is exactly as the OP has done... Once a CR1 (130) is filed, couples can file the 129 at no extra charge to peruse the K3..

. However, to the OP, as you have probably discovered in your research, the K3 is functionally obsolete and will be administratively closed as it will most likely be processed the same time as the CR1 application... There has been some discussions how the K3 concurrent applications can slow down the CR1 due the fact they have to be pulled and matched up, however this is mostly speculation... I think it is more likely that this is a case of just taking longer than some. This system is unfortunately many times, a luck of the draw. I hope that you will get so e movement soon, if you get outside the uscis normal processing times, file a status update... But I hope that you will get word before then! Good luck

I think the use of the term obsolete is overstating the situation... Technically, it is not obsolete, but it is functionally irrelevant... Meaning that, for most couples and when the system is functioning normally, there is not practical advantage to the K3...

Now that being said, there is currently a longer than usual (using the historic processing times from the past 7 years) wait time for processing the CR1/i130 thus, at this point there MIGHT be an advantage with a K3 where it is processed before the CR1 and thus has the possibility to reach the NBC/Embassy before the i130 and not be administratively closed...

For many, getting their loved ones over quicker outweighs the inferiority of the K3 and could possibly be a better route. Given that it is free for couples who have filed the I130, I say why not give it a shot? Not gonna hurt... But hopefully the CR1 processing will soon speed up and the k3 option will once again be pushed to the forgotten visa closet again...

Sorry, no expeites for pregnancy... They consider it a "choice" and part of family planning decisions not an emergency condition... If they were to grant expedites merely for getting pregnant there for sure would be a rampant misuse of that loophole... But as others have said, there are significant advantages to giving birth in your home country, financial burden certainly being one of them... Good luck

No matter how many threads you ask this in... It is same answer. Your lawyer did not send it your paperwork until April. You have a long wait as you are only at beginning. Ask lawyer why they not send it in December? Process is about 1 year from April 13. Fire your lawyer, get an honest one!
