US Citizenship General DiscussionAirline Tickets - purchasing before US citizenship
Keep in mind, that waiting to get passports after naturalization without proof of travel might be an issue given the timeframe... Example, they naturalize in October then file for passports, the passports take 6-12 weeks unless an expedite is requested which can still be up to 3 weeks (which normally it is less, but your never know) this is cutting it close IMO.

If you book your tickets now, once they naturalize, they have the option to make an appointment with the passport office as a walk in, show proof of international travel reservations and get same day... To can enter whatever passport info they have now, then, change the passport info either online or at the airport at check n, just tell them they recently naturalized...

I personally would book the tickets...

US Citizenship General DiscussionDual citizenship
OP... As Katheryn said... You will be told and take the oath to renounce all ther citizenships, it the USA cannot force you to renounce anything with any foreign government... But while in the USA you are ONLY considered as a citizen of the USA regardless of how many passports you hold... As long as your country allow you to hold dual citizenship then you are fine...

CanadaEver see a fatality from an accident?
Once, about 7 years ago, I was going from Tampa to Orlando on I-4, a guy was swerving in and out of traffic and BAM, they got hit and thrown into the median and the car flipped... about 4 cars stopped and ran up to the car, the passenger (a girl about 20) was impaled in the chest and dead (lots of blood on the lower body, but the face was just cut up some from hitting something and her face was frozen kind of in shock! (a very haunting image), they guy driver, about 25?? was all bloody and his arm was about ripped off, one of the ladies who stopped was a nurse and I gave my shirt and another guy gave a jacket and she tried to stop the bleeding... I put his feet up on a piece of the bumper while the nurse and others tried to stop the bleeding and were around his head... It seemed like FOREVER until we heard the sirens (probably about 5 minutes) and the fire rescue arrived and they took over and backed everyone up...

Then the police arrived and started taking statements, they covered the lady with a white sheet and sped off with the driver in the fire rescue truck... He was breathing but unconscious when they took him... Not sure what ever happened to him... I like to think that he made it?

However I still get chills whenever I pass that part of the road and even just thinking about it!!! Makes me think twice everytime I approach an accident site...

CanadaApartment Leasing
Not familiar with the tenancy laws in Canada, However, I am a landlord and I know that it is EXTREMELY difficult to throw sombody out (had to do it one time).. Guy did not pay rent for 60 days, after sending legal notices, waiting for enforcement and all the other steps, it took me another 4 months for me to evict the guy... So dont be too ready to just move out, there are usually lots of steps that the landlord will have to take...

You might do some googling on tenant rights and how to evict someone (so you know what they will have to go through)... Hopefully it will not come to this... However, if necessary, you might just buy yourself enough time for the visa to be approved??? Plus, technically, they are not evicting you, but your boss which might complicate things for them???

OMG, I had that exact same moment on a plane too. I was looking around and wondering if I dozed off if a few people would go missing. laughing.gif

(I actually laughed out loud at that. lol)

Speaking of planes.... Any time we are going through rough weather I used to be afraid to look on the wing because of the "Twilight Zone" movie with the gargoyle creature destroying the airplane engines and the freaked out passenger!!!!

Yes, I have seen it... I would think that Storage is one plus for bag milk, it takes up less space and is shipped easier than cartons or jugs... Also the waste factor is a plus... the bags create less waste... They are cheaper to manufacture... We dont have them here, but I would probably buy them if we did...

They do offer temporary health insurance plans for immigrants from 2 months to 2 year coverage... OP, dont worry just yet... My husband just got GC in the mail after about 3 weeks and the Welcome letter came the same day... I have heard of it taking up to 3 months when there is a backlog... But if you do not hear anything or get anything at the 8 week timeframe, then I would make an appt at the local USCIS office and inquire... But I would not fret just yet... from what I have been reading 6 weeks seems to be about the norm...

CanadaAdvice needed fast....AOS question

I am sorry but I am not sure I understand about what visa I used....I was coming just to visit for 3 weeks just used my passport??? I am totally confused about this whole process...was I suppose to use a certain visa to come to the USA???

I believe that some were confused on the unique entry process for Canadians (as all other countries enter with a visa or specific visa waiver programs)... However, I believe you can file the AOS and be prepared to prove that you did not enter with the intention of marrying and staying (this will include ties to Canada like a job, school, house etc..)

There are many here who can address your questions specifically as they have gone through this.... Before I give you wrong info I will leave it to others more knowledgable on the ins and outs... dont get too confused yet...

National Visa Center (Dept of State)DS-230 questions

Anybody knw do we have to sent our original marriage certificate, birth certificate, police certificate(PCC)along with DS 230 or they need only attested copies(Certified copies)??
If any documents is missing means, they will notifies us by mail or email?
thank you!!

Original or certified copies are sent to NVC, not photocopies... Certified copies mean that they are copies issued BY the office (for example, if you go to the local town hall and get a copy of the BirthCertificate directly from them, that is a certified copy... NOT a copy that you have notarized...) So for all practical purposes, it will usually be what we refer to as "original" documents...

Also, if you include a regular photocopy set of ALL documents submitted, you should be able to get these certified/originals back at the interview...

National Visa Center (Dept of State)I130 approved. How the processing of our case can be expedited to get soonest interview day?
Pregnancy in itself is not a valid reason in which they grant an expedite. The question they will ask is "what is the hardship to the petitioner"? Although being separated IS a hardship, it is not one that they consider a valid reason. They will say, as another poster pointed out, nothing is stopping you from going back alone to take care of your business. You have to prove why your spouses presence is necessary to aid you or when her not being there will be a hardship.

Plus, to be honest, nothing in the US govt moves that fast... 2 weeks, I hat to say it, but. Really don't see it happening. I would make for an alternate plan with her giving birth in Bulgaria. But you are of course free to give it a try... But it usually takes up to a month to even get a response, needing a response, then sent to embassy, niter view, visa granted and fly to USA in 2 weeks? IMHO I really don't see it happening... Sorry

National Visa Center (Dept of State)High Risk Countries! Submission of more Relationship Evidence at NVC stage!!!

A most excellent point.

I made sure to only send information that proved an ongoing relationship and only those that occurred after the petition was approved.

Yep.

About the worst idea for this specific embassy. There's documented evidence of CO refusing to accept anything during the interview.

I also might add, that this consulate specifically, if you ve ANY additional documents to present at the time of interview... You MUST turn them in at the first window or they will not even be co,elected or glanced at... Lagos are some tough cookies, send it what you have (quality vs quantity) otherwise I fear the decision will be made before you even have a chance to show any of it! Good luck... Check in with the regional forum for more details on this.

Everyone is overlooking that this is going through Nigeria! What you sent in for PHL, Canada etc... Probably will not cut it in Lagos! I have been around enough to see a slew of denials coming from there... Decisions seem to be made before the interview... I say SEND IT IN ... Because omitting it and being denied takes a whole lot more time...

K-3 Spouse Visa Process & ProceduresSo Off Topic Sorry
I know that sometimes even good news sometimes seems to put the mentos in the coke. Especially when you wish you had your loved ones there to share these moments with you... The perfect recipe for a sloppy pity party in your honor... jest.gif

But seriously, big changes in life trigger big responses (good and bad)... Just keep in mind the positive things coming your way and take everything one day at a time. I know that my dad, despite he is not here with me anymore, still keeps track of what I am doing innocent.gif

Congratulations and look ahead! Godd things comin your way!!

K-3 Spouse Visa Process & ProceduresI-130 sent to USCIS last oct., check cashed March this year, still no NOA1 - is it normal?
QUOTE (Darnell @ Sep 26 2009, 02:58 PM) <{POST_SNAPBACK}>
Ah, sorry, I wasn't so clear.

IIRC, USCIS operators will tell ya 'don't bother us unless it's been 6 months'.

AS IS, your petition is fine, it's not invalidated, but USCIS hasn't done anything past 'cashing the check'. HE SHOULD have gotten the first notice, NOA-1 , as a 797-C receipt notice.

I don't want to raise your worry levels, at all, but right now, I'd be concerned with the casefile being LOST somewhere. A Service Request does a coupla things - but the most important thing it does is to FIND the casefile, see WHO has it (they won't tell you WHO has it, but a search will be started).

Did he make the original submission into USCIS or was it done via an attorney? If through an attorney, then he/she is falling down on the job.

Actually, you can do a service request at 5 months not 6... So I would be on the tele on Monday getting them to track it down... as paris said, you can look on the back of the check for the USCIS number (WAC or EAC).

As far as the lawyer, as many here will tell you, if you follow the guides here and the past experience of others, your immigration process can take much less time and definetly cost much less by doing it youself. But it is important to familiarize youself with the guides here. A lawyer does not guarantee faster or more accurate filing! After all, nobody cares more about your case than you!!!

If you want to file the K-3 you have to wait for the NOA-1 before you can send in the petition (follow the guides)

If you ask me, you REALLY want to stick with the I-130 and go for the CR-1. Again, follow the guides

Good luck, now comes the tough part...waiting

I file my I-130 back on September 11, I just got my NOA1. If you could explain the difference for CR-1 and K3 please. I thought after appoval of my I-130 the paper would go to the NVC and be forward from there to the Connsulate in HCMC Vietnam. There an packet will be mail to my wife. I will need to send her papers for proof of support.

A CR1, once complete gets you a Green Card upon entry into the US... The K3 allows your spouse to come over, but you have to file for Adjustment of status... Right now, the K3's are almost obsolete since the CR/IR visas are processing in about the same time... Plus the K3 costs more to do... You can read about the difference in the guides on which visa to file, but for my 2 cents, go for the CR, then you dont have to go through the hassle of Adjustment of status and it takes a bout the same amount of time...

Also, in the CR, all the documents are sent to NVC then to the embassy for an interview... For the K3, your package is sent to the embassy and they collect the documents...

this is what hubby did few months ago and has been told by them, just I didn't let him give them the original as we needed it for the visa process. but i know it has to be an original one. good luck good.gif

Not sure what city hall told your husband, I took mine from Italy down to them along with a certified translation and the clerk literally asked "what do you need me to do?" I said I need to register my marriage... The lady said, and I quote, "Don't know who told you ya had to do that, we don't do nothin with that here". I clarified if I needed to register and her and her supervisor said absolutly not... just keep a copy in case I ever got asked....

K-3 Spouse Visa Process & ProceduresK3 vs. CR1??? Which one to file?
I cannot comment on the rate of pass/fail on the CR1 vs the K3... If you have solid documentation then it should not matter as far as things YOU can control... As far as denial or AP because of name checks or other additional processing, that is something that would delay visas which ever one you choose....

With regards to which visa is better? Without a doubt, go for the CR1/IR... This give you the green card (551 stamp) upon entry and GC status... With the K3, you will have to file for Adjustment of status which is expensive and yet another process....

Just have all your information together (proof of relationship, financial documents etc...) and go for the CR1, it is the permanent resident visa and the best visa to get... The K3 visa was invented when wait times were much longer than today.... It is practically obsolete... Especially now that the CR/IR is taking the same amount of time!!!

K-3 Spouse Visa Process & ProceduresNeed someone to clarify please!!!
Agreed, the K-3 will maybe save you a few weeks... But you have to weigh if that few weeks is worth the hassle and $$$ invloved in Adjusting Status and work issues... Remember, once the CR1 is issued, your spouse enters with the right to work and GC (551 stamp)... K-3 takes time, effort and another process???

K-3 Spouse Visa Process & Proceduresreason for denial
I am so sorry to hear about the denial. Be calm and rational, It is hard to say what is in the minds or the intentions of others in power, but Take charge of the situation;

1st, have your finace write down exactly what happend and questions/responses while it is still fresh in his mind
2nd, Gather as much supporting information as you can
3rd, Most senators or congressman have a section for dealing with Federal Agency intervention and have a form you can fill out and have to sign (privacy act)
4th, Keep on top of where your application is being sent and when it arrives back at USCIS so you can take appropriate actions and know where your file is

Finally, there is a useful thread which discusses common questions and things every couple should be able to answer without hesitation, I would look it up and review it with your Fiance. Everyone gets nervous, but this is not the end of the road...

If your motivations are genuine, you will have other opportunities to prove that and live together happily, it just might take longer, that's all, not the end of the road, just a bump... Keep your head up.

K-3 Spouse Visa Process & ProceduresK-3? K-1?
K-1 is faster but you have to adjust status after marriage which must occur within 90 days...

If you get married outside the US... Definetly go the CR1 route... K3s are basically obsolete as they take just about the same time as the CR1, cost double and you cannot work or travel for months after entering the USA... With the CR1 you get a GC upon entry...

I hope that your grandad earns more than just the minimum 125% as it will certainly look better...

As far as the income... If you do not have proof of employment or earned any income, then you have to put zero... I would however include a letter stating that you did not earn anything and were not required to file taxes but have the intention of working and are currently seeing employment. Although they cannot count future employment it does show character...

If your co-sponsor is OK then hopefully that will suffice them...

Yes and no- she can come over on her tourist visa, but she must be careful not to overstay, and she will still need to do her medical and interview in Singapore.
Can I ask why you are going for the K3 rather than the CR-1? CR-1 is generally considered a superior visa as it leads to immediate greencard upon entry.

Based on the VJ guide, it sounds like the I-130 may be approved before the K3 is processed, in which case I could proceed along the I-130/CR-1 route. Is this correct? Is there a compelling argument for me to just wait for the CR-1?

CR-1:

1. It is cheaper
2. Does not have to adjust status
3. Can work and travel upon arrival

It seems like the only minus is "Separation from family for sometimes longer then the K-3 or K-1 visa option. Applicant will most likely not be able to enter the US during this time." Does this mean that my spouse would be unable to stay in the USA while the paperwork is pending?

Lately the time difference between the K-3 and CR1 is a matter of about 2 - 4 weeks... As far as entering on a tourist visa, the same requirements for visitation during the K3 is applicable with the CR1. The following pro-con list is from Dakine

Won't have to adjust status like a K3 tho.
K3 has to adjust status [$1010] and remove conditions [$545}
Just a few reasons why to go with the CR-1. If you are eligible for a IR-1 then you would be nuts going with a K3!
The K3 has to adjust status which cost $1010 + $131 visas application fee.
Have to go thru the cost and hassles of getting a I-693 also.
K3 normally has to do biometrics and have a AOS interview. Time off from work cost the petitioner. PLUS the hassles of submitting the paperwork and going for the interview. Tain’t fun.. Especially if denied or questioned. Ever done a Stokes interview?
That’s the second interview if they are in doubt of your relationship.
Also a possibility of being deported. Yeah doesn’t happen much but it happens.
K3 has to wait about 90 days after they file to get EAD or GC so they can get SSN and be able to work.
CR-1 can work as soon as they get the GC and SS card in the mail. Normally with 6 weeks.
Can’t do a LOT of things without SSN. Like work or get a drivers license in some states.
Some K visas don’t get GC for a LONG time.
If petitioner goes belly up before you get GC you stand a chance of being deported.
If the petitioner loses his/her job after the interview you don’t have to worry about getting a co sponsor to adjust status!
CR-1 cost about $470
Get their GC and SS card in the mail within 6 weeks of arrival.
No biometrics , dealing with civil surgeons, AOS interviews, going to SSA for SS card.
I’m sure I’ve missed a few things.
Bottomline is anyone that goes with the K3 the way things are now are masochist!
Yeah I did but at that time K3s were a LOT faster. That’s not the case anymore.

Have fun!

If you qualify based on your current income, which it sounds like you do, then it should have no effect. They are concerned that you currently earn enough to support the intending immigrant...
