What you "believe" and what is "legal" in "other countries" makes no difference.  It does not apply.  And if I were a gambling man I would bet that the Federal Government does not make marijuana use legal in our lifetimes.  But that's just me.

Marijuana use and possession is illegal in the United States Of America.  I am not preaching.  I am merely stating a fact.  I am done here because there are some that want the laws of other lands to apply here.








I perfectly understand that it is illegal here... You stated that people should "think" before they participate in an illegal activity as this will effect them in the future should they apply for residence in the USA. I am merely pointing out that many people come from places where pot is legal so for them, they are not taking part in anything illegal.

Now I will take you up on that bet about legalization here in the USA (or at least it will be removed from the class A felony drugs) ... Colorado and Oregon are already the test states for how it will work. Eventually, the court system will have to hear a challenge from a Colorado resident who is charged with possession or a pot sales company fined and the whole state vs federal will,have to be addressed, where it will be removed from the feline drug list... Then this change will affect the immigration admissibility of former smokers... Just what I found from my interpretation of the recent state actions.

So is drinking under the age of 21 ... I dont think youmshoukd mix the decision tomuse marajuana with a question if morality, they are not equalivient... And as far as legality... There are MANY countries where marajuana is perfectly legal (and soon will be for all states in the USA)

I believe there Should be a statuette of limitations for what is included in the ban... Saying "have you EVER" tried marajuana to a 40-50 year old... Well that covers a LOT of time and what you did 20-30 years ago should not label you for life, especiallymifmwhat you were doing was not even illegal where you did it!

Right.. But you pointed out that someone in their own country should... Throughout their life... Not do something that is considered illegal in another country in the off chance you want to immigrate to that country in the future? I think that is their point... So the punishment of a ban for ever, in your entire lifetime EVER tried something (which might happen to be legal when you tried it in your country) would be a ban? Now abuse of any such things I think is a fair question... But having a ban for trying something, even if it had been 10-20 years ago, even if it was legal where you participated I think is a bit outrageous. I understand you have to follow the USA laws, however, reading into the future to anticipate that you will meet someone from a country where something that is legal,in your country but illegal in that country so you better not do it... Well that is an ability that nobody has...

Now with regards to the OP, we obviously do not have that issue since there was recent contact and a positive test..

The most confusing thing to me is that he proved that he is not using drugs by the drug test coming back negative. It doesn't make sense that he has the same consequence as someone's test coming back positive. If his test came back positive for marijuana I can understand the decision to go through routine drug tests to make sure he is clean but he is clean now. I don't understand why we are needing to wait. He has no medical or criminal history related to drug use or anything else. He doesn't even have a speeding ticket on his record! Really...his police record was basically a blank sheet. Now because of this he is put in the same category as criminal offenses? 

Fair.. No... But when has anything in this system been fair... It is the rules as they are written and as other posters have pointed out... Just a year or so ago the penalty was a 3 year ban!!

Luckily, my husband has actually never tried marajuana so it was not a issue for us, however if it was me... Personally, I can't say I would have been as forthcoming if I could help it... It is a personal decision for everyone, but the argument that not disclosing the past "sin" of trying or smoking a joint will lead down the slippery slope to a life of lies and despair and mediocracy is the same argument that cannabis opponents have been using for years to keep any use of cannabis a class 1 felony drug saying smoking pot is the gateway to hardcore drugs and crime or worse... There ARE legit medical and humanitarian uses for cannabis and the classification of this drug in the same lines of heroin or cocaine is insane and luckily the tides are turning...

However, the doctor has a job to do and like it or not, he did what he is instructed to do... For others out there reading this... Please have a discussion with your husband/wife/fiancée so there are no "surprises" ...

Don't waste the money on a lawyer... Admitted drug use is one year...so sorry... Us it for a visit while you wait out the ban... So sorry... But i secondmthe other idea that maybe you get married and file for CR1 which will save you some money in the end and get the GC when he does enter (so he can start working immediately ) just an idea?

You must meet face to face... This is even more vital for Nigeria... 1 short visit and not meeting family/friends is a giant red flag. Lagos is one of the most difficult consulates... I would look up recent experiences for there... Do you have other red flags (age difference, outside childbearing age, religious etc...) as these would compound the short courtship,and quick visit issues... Read up and be prepared...

Have your fiancée contact his representative as they have a smaller constituency and thus your fiancée should get better service (my rep was really responsive) but have him contact both senators and reps (he MUST be the one to do this as it is HIS petition at this point) ... Have home contact the tier 2 person and I seen that you have requested a service request... Aside from that, there is the ombudsman route which if you use the VJ search tool, you can get details on that process. Good luck!

Do you know why that is? I'm just curious. Are CR1's harder to deny? 


Spouse is already an immediate relative, the USC is given the legal courtesy of bringing their immediate relatives to the USA so a denial,of this requires justification and thus appeal and it is an immigrant visa. A fiancé is not yet an immediate relative and is technically a non-immigrant visa...

Unfortunately, denied k1s are usually left to languish and expire... Options will probably be to refile or figure out a way to marry (maybe a 3rd country) as i understand CR1 denials are able to be appealed for re affirm... Not fiancé visas... Sorry this is happening to you...

they took her passport and told her they will call her in 2-3 days, "(so im guessing she approved)" she said they were very nice, and everything went smooth :D

I received an RFE today after waiting 6 months from the initial filing date. All they asked for was an original letter/statement, one from me and one from my fiance, staying explicitly that we will definitely marry within the 90 days period once my fiance arrives into the US. How strange because our original letter of intent indicated we definitely planned to marry? What is everyone's take on this? By the way this is the first RFE, should I expect more? Yikes, and stressed :wacko:

Being able to hold a basic conversation in English is a requirement, not just memorizing answers on the application... He traveled internationally 2-3 time a week during the process for work with NO problems (he just had to update his trips at the interview and oath on a separate piece of paper). You said you would be gone for 4 months... Most folks process has been complete in 3-4 months... Ours was 70 days from application to oath... Phoenix is rather quick as well (look at recent progress reports from the past few months) so plan accordingly. Biometrics appt. is usually within 6 weeks of filing...

If you took the oath... You are a us citizen and must enter the USA when you return on a us passport... You can enter a foreign country with any passport you wish. I believe that you will have issues with the ticket if it does not match but I will wait for someone with more info to chime in ( like those that have traveled with maiden name passports etc...)
For options... If you have the oath, depending on where you live, if you can prove imminent travel, you can get a same day passport from the passport agency ( we did this), you can postpone you oath till after your trip, but contact the airline for the name thing...
Ha, just read BEFORE the oath... Disregard above, yes, up till you take the oath you travel on your foreign passport, you are not a citizen until you take the oath... No problems using that passport...
