There are 3 primary variables in how you will be handled - the mood/personality of the officer, the competence of the officer in handling K-1s, and your mood/personality.

You sound pretty relaxed at the moment, so that's good!! It also seems like you haven't had issues entering in the past, so I don't imagine that you'll have trouble this time.

It is likely that you'll be sent to a secondary processing area, so don't get upset or concerned if that happens. It takes a while to get your paperwork in order, so they do that in order to keep the lines moving along. My wife didn't come through Atlanta, so it might be different there, but that's how things were handled in Miami.

After the NVC gets your fiance's petition, they will give it a case number and forward it to the Manila consulate. You will then be sent the so-called Packet 3 by the consulate and then you will need to submit Part 1 of the DS-230 as part of your submission back to the consulate, so it is required. Read the K-1 guide here on VJ, it tells you everything about the process and what forms you need. There are others in addition to the DS-230 that you will need to submit in Manila.

Regarding the letter of intent, I read a few days ago that the need for a letter of intent from the foreign fiance(e) had been eliminated.

To support yourself and your soon-to-be husband, you will require an income exceeding $16,500 per year. Failing that, you can have a co-sponsor, and your father is a good choice. You should both fill out separate I-134s.

If you still live at home and receive financial help from your father then you are dependent on him. When he fills out the I-134, section 8 expects him to indicate who is dependent on him (you, your siblings, and your mother for example). It is assumed that your fiance is dependent on his support, otherwise your father wouldn't need to fill out the I-134 in the first place. If you live by yourself, with no financial input from your father, then you are not one of his dependents.

With respect to signatures, Part I of the instructions for the I-134 are very clear. Since you are in the UK, it must be witnessed by a consular office. Since your father is in the USA, he can get it notarized.

She does not have a K1 visa yet, that is what we are applying for. The issue is that she is a citizen of Vietnam, living in Japan on a student visa. Thus, she is applying for a K1 in a country she is not a permanent resident of.

I'm sorry, but the first sentence of your original post says "My fiancee is a Vietnamese citizen, who has been in Japan for a long time on a K1 visa". It seems like you meant to say that she was in Japan on a student visa.


I am a little confused by your answer, you say she will be expected to bring originals, then you say she does not need to provide it because it is not itemized. So... which is it?

She is expected to bring originals of the documents mentioned in the checklist, not originals of everything that you submitted with the I-129F. I disagree entirely with scy in this regard. This topic has been discussed many times in the past. The beneficiary is not expected to show up at the K-1 interview with the sponsor's passport.


Regarding DCF, there are different rules for each consulate regarding what they expect to allow you to file DCF. For example, filing DCF in London requires that the US Citizen has legal residence in the UK. You should check the Tokyo consulate web site to see what their requirements are. It may not apply to you since you are not a legal resident of Japan.

I've never heard of such a thing. There is no way for you to prove that you haven't been married before.

The USCIS and the Tokyo consulate are 2 different entities. The USCIS explicitly asks you to send copies. However, when your fiancee goes for her K-1 interview at the Tokyo consulate, she will be expected to bring originals as well as a copy of each original, for the documents that are identified in the Packet 3 checklist. The consulate will inspect the originals, return them to her, and keep the copies. In the case of your passport, she does not need to provide that at the consulate because it is not itemized on the checklist.


- I have read on here that it can take up to two months for an interview date. I just had my fiancee fill out a form online requesting an interview date for about a month from now. Any idea the chances that her request will be granted?

The saying goes "You don't get what you don't ask for.". You will lose nothing from asking, but don't make any plans based on expecting your request to be granted.


- I seem to have thrown away my airline tickets for both the time we were in Japan, and a second time we met in France. Should this be a concern? We have lots of pictures, I sent a copy of the engagement ring receipt, and she's starting to take pics of the video chats we do as well.

I presume that you are making this point regarding providing proof of your ongoing relationship at the K-1 interview. Emails, letters, etc should be sufficient. Airline tickets are helpful to show that you continued meeting since filing the I-129F, but if you don't have them, I presume that you've got entry/exit stamps in your passports.

The State Dept keeps a list of so-called Reciprocity Tables. These tables, sorted by country, show what is needed. Go to this web page for the Mexico table. Actually, the "Police Certificates" section says that they are not available in Mexico.

I also found http://www.immihelp.com/immigration/police-certificates.html that indicates that police certificates are not available in Mexico. I don't know if this is accurate or not.

If he has lived in multiple countries, go to this web page and choose the country/countries.

Once you get the hard copy of the NOA2 in the mail, there is a case number and phone number on there for the NVC which you can call and find out the status of your case. If you get the right person, and you're very polite, they will usually give you some info as to whether the case has arrived, is still processing, or has left the NVC for the embassy.

Normally, at this stage, you just make sure you gather the necessary documents for the interview (police reports, financial documents, etc), while you're waiting on the packet to arrive at the embassy. Good luck!

The NOA2 doesn't have a case number on it, it simply repeats the USCIS receipt number. The 'Case Number' is assigned by the NVC after they receive the approved petition from the service center.



Regarding the letter from NVC, as far as I am aware they always send a letter to the sponsor indicating that the petition has been forwarded to the consulate, and they include the Case Number on this letter.


If you elect to call the NVC, even when you know your case number, you must speak to a live person to get status information. The NVC does not put K-1 cases onto their voice response system.

London seems to be taking up to 8 weeks to give out an interview date, but there are no guarantees. They might suddenly assign more staff to processing the backlog, but then again they might take longer. Once assigned, it seems that the interview itself is maybe 4 weeks from assignment date.

In your case, it seems like your fiance has to be prepared to fly back to the UK at short notice. The only consequence that I can see from this tactic is that the plane ticket may be expensive.

You made a reference to DCF not being for you. I agree on that point, since your US Citizen fiancee would have to be a legal resident of the UK for 2 years to be eligible to file for DCF. That incurs a 2-year minimum wait from her arrival in the UK before the 2 of you could live in the USA.

You could marry in the USA while you are here, file for a K-3, and then you could leave before your VWP expires.

Or you can file for the K-1 now, stay the VWP term, return to the UK to get your documents together, get your police report, take the medical, and have the interview. After a successful interview, you could then come back here and get married.

My fiancee got through her K-1 process from initial application to visa approval in just over 3 months. We were lucky I would say. According to the VJ timeline statistics for London, the average K-1 duration is 5.5 months from initial filing to visa approval. But it is closer to 6.5 months for California applicants, which your fiancee is since she lives in LA.

I would look at it this way. Whether you file for a K-1 or a K-3 seems to make little difference, according to the VJ statistics. My suggestion would be K-1 simply because your fiancee can get the paperwork submitted tomorrow (to file K-3 you first need to get married, and that takes a bit of arranging, which equals time)!! Then you can stay here for another 2 months or so before returning to the UK. Once you get back there, you'll only have about 3 or 4 months apart before you can get back here. You will need time in the UK anyway to get your paperwork together. Perhaps your fiancee can visit the UK during that time.

Just my 2c.

It looks like your CBP record may be marked now, so additional visits in the near future may well result in you being refused entry and returned to the UK.

If you decide to stay here and get married and then try to adjust status, you might find yourself in a jam, because you'll have a hard job convincing an AOS interviewer that your decision to marry was spontaneous (you've spent a lot of time here and given up your job, hence you have no real ties to the UK).

I think your best option would be to put all the papers together for a K-1 fiance visa, send them off to the service center and then return to the UK and wait out the process. From your original post, I'm assuming that you are still in LA.

As you can see from my signature, the processing time from start to finish through London is about 4 to 6 months. This is not a long time to wait, and it ensures that you do things the right way and avoid any bans. Whatever else you do, don't overstay your current visa!!

Perhaps your fiancee could visit you in the UK while you wait out the process.

Technically, you can visit the States, not live here. "Live" implies that the States would be where you are resident.

As a Canadian, I believe that you get a bit more latitude from the perspective of how long you can visit for. Maybe that would be an option for you. You cannot work here, however, until you have authorization to do so from the USCIS, and you cannot file for that authorization until after you are married. It then takes about 3 months to get the authorization after applying.

So, if you did manage to stay in the States through the process, you would be out of work for 9 to 12 months (6 to 9 months to get the visa, get married, and file for your green card, then another 3 months to get employment authorization).

I agree with aussiewench, you need to wait for the letter from the service center before deciding what your next step is. As has been mentioned, the normal action of the service center is to issue an RFE in a situation where the submission is incomplete. Perhaps the congressman's aide has misunderstood what he/she was told and then told you that you have been denied, when in fact you are getting an RFE.

Call the USCIS again and ask them what your status shows as now, and mention what the congressman's office told you.

Can you see what your status is on-line?

You mentioned that USCIS told you that your prior evidence would be sufficient. Did they give you this information in writing?

You mentioned that you cancelled a previous submission. When did you submit that petition? What was the date of meeting that you used in that first petition.

Since you have to submit photos of both parties with the application, it is fairly easy to see that the people in the 'meeting' photos are indeed the sponsor and the beneficiary. Also, these photos will be matched later with official government photos such as from passports. For this reason, I always saw photos as primary evidence.

Once your fiancee gets the interview appointment date, then you will be in a better position to decide if you need to delay the interview. She will have to arrive in the USA on or before the expiry date of the visa, which date shall be 6 months after issuance by the consulate in Sydney.

So, add 6 months to the date of the interview and if that isn't late enough for you, call the Sydney consulate and ask them for another interview date that fits better for you. I have heard of this sort of thing done before, so I feel confident that you won't have any problems. I wouldn't delay anything else at this stage. Get the documents returned to the Sydney consulate as soon as you can. It will be easier to delay the interview than to try and explain why you took a long time to return the packet 3 documents.

Whatever else you do, I don't think you should follow misskiya's advice. If your fiancee comes the USA as she suggests, then she will not be able to return to Australia and then return to the USA without an Advanced Parole (AP) document. AP can only be applied for after you get married and file for Adjustment of Status (AOS). Assuming that your AOS submission is submitted shortly after the 'informal wedding' and there are no problems with it, AP takes about 2 months to acquire. This would mean that your fiancee would have to stay in the USA for about 3 months or so after the so-called 'informal wedding'. This doesn't seem like a good course of action for you, given what I can read into your situation.

Hmmm, yes, you do sound confused!!

This page on the US Consulate (Ireland) web site says

To file the I-130 petition at the Embassy, both the petitioner and the beneficiary must be residing in the Republic of Ireland. Proof of residence is required for all petitioners.


Since you are in the USA, you are obviously not a legal resident of Ireland. Therefore, DCF is not an option for you.

That leaves K-1 (if you want to marry in the USA) or K-3 (if you want to marry in Ireland). And, yes, your assumption is correct, once you get your fiance a K-1/K-3, DCF becomes moot.

If you want to get married in the USA, here is what you need to do (I am assuming that you will be successful):

1. File the I-129F here in the USA.
2. Once approved, your fiance will be interviewed at the consulate and get his K-1 visa stamped in his passport.
3. He will have 6 months from the visa issuance date to enter the USA.
4. You will both have 90-days from his arrival to get married.
5. Once married, he will file for AOS.
6. A few months later, he will get his conditional green card.


For a K-3, you would need to get married in Ireland (you, as a US citizen might need special permission from the Irish authorities to do this - something for you to check on), then you file for the petition and wait for your fiance's consulate interview. During that waiting time, you could, of course, come back to the USA while your husband waits in Ireland for his visa.

K-1 seems to be your best course of action, given that you said that you want to marry in the USA.
