I'm not 100% sure, so you should either wait for a member with more knowledge in this type of situation, or call USCIS or her embassy and the embassy in Romania but I think she could ask to be processed in Romania, in the chinese embassy there, but it's not guaranteed and they could instead send her case to China and let her know she'll have to be processed there.


luis&laura, I think you have a typo in your post, see my bold in the quote.

The beneficiary cannot get a K-1 visa at the Chinese embassy or consulate. Only the US Consulate in Romania can issue the visa. That is what John_and_Marlene was referring to.

To the OP, if your fiancee is a legal resident of Romania, then she should be able to go to the US Consulate in Romania to get her visa. This link is to the consulate site in Bucharest. If you do a bit of digging here you should be able to figure out what the rules are regarding residency for non-Romanian citizens.

What do you mean by "or we get married"?

The K-1 visa is for use by couples who already intend to get married. It is not intended to support a trial period of living together, although my inference may be incorrect.

Your original post says that you "met a girl who lives in Longbeach CA". At no time do you say that the 2 of you have decided to get married and now need to figure out whether to get married in the UK or in CA. My reading of your post indicates to me that the 2 of you are not yet that committed to each other, but you want to find out if it will work out. The K-1 is not the way to go about that. Part of the application process requires you both to submit signed affidavits that you are intending to get married, and the lady in CA needs to fill out a financial disclosure that she can support you, because the assumption is that it will take you time to find a job and start earning. For you to come over here on a K-1 and immediately start working is just not going to happen unless you find an employer who will take you on under the table, so-to-speak. But that option is now diminishing as USCIS starts to crack down on employers who employ undocumented workers. Also, if you got caught doing that kind of work then you will probably get yourself deported and you can forget about living here for rather a long time (10 years I think).

If you are currently employed in a highly skilled job, you may be able to find a US employer who is hiring people from outside the US. Maybe your local job market will have information on what's available. Alternatively, if you currently work for an employer who has Longbeach offices, or close by, maybe you could get a transfer.

An alternative would be for her to stay with you in the UK for a while, assuming that you can support the 2 of you while she is not working. Also, if she works for a company with UK offices, maybe she could get a transfer.

Your proposal is not an easy one to work through, because I suspect that you aren't fully committed to each other yet, hence why the lady may not be prepared to fully support you while you stay over here figuring out whether it will work out between you.

PS Here are some H1B ideas: try using google to see if you can find anything. But, as devilette mentioned above, the H1B visa cap has been reached for this year and next I believe. So it might be 2009 before more slots open up. The competition is huge.

I'll try to address your various questions first:
Holding dual nationality makes no difference. In the eyes of the USA, the important thing is that you hold US citizenship.

Regarding the poverty line (which is a federal guideline by the way, not dependent on which state you will move to). If you are proving it with income, I believe that the expectation is that it is US earned income. If you have no US earned income, then you can prove it with assets. Assets have to be at least 3 times as much as the poverty line. This applies to you, because you are expected to support your new wife without her being a burden on the state. This paragraph applies to the I-134 that you submit in order to get the K-1. Can you use your UK income? No, because you won't have that job after you move to the USA.

Also regarding the poverty line, when you file for AOS you file another financial document (I-864). This document is legally binding on you, or your co-sponsors, that your new wife will not become a burden on the state for 10 years or 40 working quarters, whichever comes later. So, no, your new wife's income doesn't count because she can't work while waiting for the EAD/Green Card.

For both financial submissions (I-134 and I-864), if you cannot meet the guideline then you will need co-sponsors. Especially for the AOS, your co-sponsors should be made aware of the legal and financial burden that the I-864 could place on them.

Regarding where you should file. I think that you should use the service center that covers your relative's current location. When you file for AOS, if you have already moved then you can use the new address. You can always file an AR-11 form to change address, or I believe that you can now also change your address by phone.

The London consulate might help you with some of this, but they are often not too quick in responding.


Here's my 2c:
If you have never lived in the US, then there may be a question of domicile. It may be that you will need to establish domicile over here before you come over. I'm not sure though.

Since you have never lived here, perhaps your best plan is to get married in the UK, file for the CR-1 and then both yourself and your wife can work as soon as you get here. The CR-1 results in your wife getting a green card immediately (within 3 or 4 weeks anyway) on arrival. This way, you can continue to live and work in the UK together while the application is pending, rather than you coming over here and then your fiancee following several months later once the K-1 has been approved. Of course, the K-1 option gives you the chance to get a job and establish domicile.

You should check with the consulate as to whether you can apply for CR-1. I've only ever heard of it being used by US citizens who have 'unlimited leave to remain'. Your situation is a tad different since you are most likely living in the UK as a UK citizen. I'm not sure if that automatically qualifies you as having unlimited leave to remain since you aren't living there as a US citizen. Have you filed US tax returns while in the UK? That might be something in your favor. Anyway, this is a gray area for me, so you should check it out.

If you take the K-1 option, your wife will not be able to work until she has either her green card or Employment Authorization Document (EAD). This would mean that she wouldn't be in a position to work for roughly 4 to 6 months after your arrival.

You should get the appropriate forms in advance and start gathering the details and documents that you will need. For example, do you have your fianancial affidavit (I-134) ready?

Hi Chris,
All service centers accept courier delivery. Not sure if yours would be classified as such. This link is to the USCIS page about the Texas Service Center that has the various addresses. Did you use the PO Box address or the "Courier Delivery" address?

If my memory serves me correctly, I sent my stuff via regular US mail with "Return Receipt Requested". It went to the PO Box and I got the signature card returned to me.

I think you'll be fine, as jodee indicated. There is usually more than 1 delivery attempt before returning to the sender.

Typically, the '#' key just tells the computer that you have finished entering digits. An alternative is to not enter this digit, in which case the system will time out anyway. So the '#' just forces the system to process your digits more quickly.

Since it can't find anything for you, it probably means that they don't have it yet. Maybe you can follow other prompts on the menu system and talk to a real person?

I'm not clear on why you want to send your documents back before you've received packet 3. There is a checklist in packet 3 from London that you have to return, indicating that you have all necessary documents and are ready for interview. You should wait for packet 3 before sending anything back.

Regarding the envelope, just use your own judgement. Might be as well to use a full-size brown one though. Less chance of it getting lost in the pile, which could happen if you used a #10.

Unless the instructions state that an original is required, you should submit photocopies of all required documents, including your marriage certificate, and the 2 documents that you reference in your post.

You should take originals plus a copy of each to the interview. If the USCIS wants to see an original before the interview they will send you an RFE asking for it.

If you mistakenly send them an original document in your initial submission, don't bet on getting it back. They do state clearly that if you do this, they will keep it.

You answer 'Yes' to the question, indicate which service center you sent the I-129F to, and the date you sent it. It sounds like the result should be 'Denied'. Presumably you still have the paperwork for that application, so perhaps you could include a copy of the denial notice for completeness, as well as a brief cover letter explaining the circumstances.

Didn't you ask this at the Post Office where you mailed the package?

What happens if the UK postal service has a problem with your package before it leaves the UK? Do you expect them to send it to the US return address that you used? I doubt that they'll do this. Hopefully there won't be any problems.

Do you really want to give the USCIS more of your money and delay the processing even more by giving them more work to do?

I don't think so!

I think the reasoning would be that, if you can afford the time to come and 'live' with your significant other, then there is a possibility that you won't return to your home country. Of course, anyone going through this crazy process would not do that, because it would compromise their chances of getting in at all. I know this, but I think that is the logic that is being used.

As suggested, use the VWP for a visit.

If you used the new I-129F that has the additional IMBRA related questions, then you will not be subject to the RFE. If you used an older form, then yes you will get an RFE.

I agree. No point in applying for a K-3 since it implies that your wife is immigrating to the USA, after which time she has to apply for her green card. Better to do the CR1, wher she gets the green card when she arrives in the USA.

The lawyer is referring to what is known as a CR-1. You can get details about it on this VJ page. It doesn't seem any more complex than the K-3, so you may want to save your $1,000.

You will have to go through the USC line at customs, she will go through the regular line. After clearing customs, they will then take her to go through the immigration part of her entry. I confirmed this with customs on my last visit.



When my then fiancee and I arrived in Miami last June, we both went through the non-USC line so that I could be with her through the whole process.

A small point of clarification, the first officer that you will see is a Border Patrol agent. Customs agents come next when you get your bags checked.

I think I finally get it. Your co-sponsor is most likely not referring to the I-134, but is referring to the supporting documents that he/she submitted with the I-134. If that is the case, then I can't see any reason why it would cause any problems. But, you just never know with the USCIS.

Sounds like paranoia. The DHS and SSA work in close cooperation, I'm sure. Even without the number, I would imagine that the DHS could still get the SSN.

Once they've got your forms, things will move along and the interview will come along in no time, although it'll seem like an age!!

Take all supporting documents (originals plus 1 copy) and the photos to the interview. Just get those ducks lined up in a row and things will be fine.
